PUBLIC WATER SUPPLY PERMITS

   The Department of Environmental Protection has taken the following actions on applications received under the Safe Drinking Water Act for the construction, substantial modification or operation of a public water system.

   Persons aggrieved by an action may appeal, under section 4 of the Environmental Hearing Board Act (35 P. S. § 7514) and 2 Pa.C.S. §§ 501--508 and 701--704 (relating to the Administrative Agency Law), to the Environmental Hearing Board, Second Floor, Rachel Carson State Office Building, 400 Market Street, P. O. Box 8457, Harrisburg, PA 17105-8457, (717) 787-3483. TDD users may contact the Environmental Hearing Board (Board) through the Pennsylvania Relay Service, (800) 654-5984. Appeals must be filed with the Board within 30 days of publication of this notice in the Pennsylvania Bulletin, unless the appropriate statute provides a different time period. Copies of the appeal form and the Board's rules of practice and procedure may be obtained from the Board. The appeal form and the Board's rules of practice and procedure are also available in Braille or on audiotape from the Secretary to the Board at (717) 787-3483. This paragraph does not, in and of itself, create any right of appeal beyond that permitted by applicable statutes and decision law.

   For individuals who wish to challenge an action, appeals must reach the Board within 30 days. A lawyer is not needed to file an appeal with the Board.

HAZARDOUS SITES CLEAN-UP UNDER THE ACT OF OCTOBER 18, 1988

Proposed Consent Order and Agreement

Furlong Manufacturing Site
Doylestown and Buckingham Townships, Bucks County

   Under section 1113 of the Hazardous Sites Cleanup Act (35 P. S. §§ 6020.101--6020.1305) (HSCA), the Department of Environmental Protection (Department) has entered into a Consent Order and Agreement (CO&A) with Leon J. Mendelson and the Furlong Manufacturing Company concerning the cleanup of the Furlong Site (Site).

   In the past, trichloroethylene had been improperly disposed of at the Site and contaminated the environment. Response actions by the Department included the removal of approximately 2,656 tons of contaminated soil and more than 17 tons of solid waste from the site septic system. Leon J. Mendelson, past owner and operator, and the Furlong Manufacturing Company are ''responsible parties'' as defined in section 103 of HSCA. Under the terms of the CO&A, Mendelson and the Furlong Manufacturing Company shall pay a total of $100,000 to the Department's Hazardous Sites Cleanup Fund.

   The specific terms of this settlement are set forth in the CO&A between the Department, Mendelson and the Furlong Manufacturing Company. The Department will receive and consider comments relating to the CO&A for 60 days from the date of this notice. The Department has the right to withdraw its consent to the CO&A if the comments concerning the CO&A disclose facts or considerations which indicate that the CO&A is inappropriate, improper or not in the public interest. After the public comment period, the Department's settlement with Mendelson and the Furlong Manufacturing Company shall be effective upon the date that the Department notifies the parties in writing.

Settlement under the Comprehensive Environmental Response, Compensation and Liability Act and the Hazardous Sites Cleanup Act

North Front Associates/Container Recyclers Site
Philadelphia County

   The Department, under the authority of the HSCA and the Comprehensive Environmental Response, Compensation and Liability Act (42 U.S.C.A. §§ 9601--9675), has entered into a proposed settlement with Mobil Oil Corporation, Exxon Mobil Corporation, Mobil Chemical Company, Laney Oil Co., White Oil Co., Hagan-Kennington Oil Co., Inc., Guttman Oil Co., Rex Oil, Mauger & Co., Inc., Schuchart, Inc. and Mobil Research and Development Corporation, Inc. (Mobil defendants) concerning the cleanup of the North Front Associates (former Container Recyclers Ltd.) site in Philadelphia County. Under the terms of the proposed Consent Decree, Exxon Mobil Corporation, on behalf of Mobil defendants, will pay into the Pennsylvania Hazardous Sites Cleanup Fund the sum of $110,000. In the mid 1990s, the Department implemented an Interim Response and a Prompt Interim Response to mitigate the threat to human health and the environment posed by the hazardous substances released there.

   The specific terms of this settlement are set forth in the proposed Consent Decree between the Department and Mobil defendants. The Department will receive and consider comments relating to the proposed Consent Decree for 60 days from the date of this public notice. The Department has the right to withdraw its consent to the proposed Consent Decree if the comments concerning the proposed Consent Decree disclose facts or considerations which indicate that the proposed Consent Decree is inappropriate, improper or not in the public interest. After the public comment period, the Department's settlement with Mobil defendants shall be effective on the date on which, if the Department has notified the United States District Court for the Eastern District of Pennsylvania in writing that no significant comments were received or that a response to significant written comments has been filed, the Court issues an Order entering the Consent Decree.

LAND RECYCLING AND ENVIRONMENTAL REMEDIATION

The following final reports were submitted under the Land Recycling and Environmental Remediation Standards Act (35 P. S. §§ 6026.101--6026.908).

   Provisions of Chapter 3 of the Land Recycling and Environmental Remediation Standards Act (Act) require the Department of Environmental Protection (Department) to publish in the Pennsylvania Bulletin a notice of submission of final reports. A final report is submitted to document cleanup of a release of a regulated substance at a site where one of the Act's remediation standards. A final report provides a description of the site investigation to characterize the nature and extent of contaminants in environmental media, the basis for selecting the environmental media of concern, documentation supporting the selection of residential or nonresidential exposure factors, a description of the remediation performed and summaries of sampling analytical results which demonstrate that remediation has attained the cleanup standard selected.

   For further information concerning the final report, contact the Environmental Cleanup Program Manager in the Department Regional Office after which the notice of receipt of a final report appears. The report is intended to document remediation of the site to meet the Statewide Health Standard.

   The Reserves at Gwynedd (Soil), Upper Gwynedd Township, Montgomery County. Paul Martino, P. G., Pennoni Associates, Inc., 3001 Market St., Suite 200, Philadelphia, PA 19104-2897, on behalf of Carmen Danella, Danella Companies, 470 E. Norristown Rd., Suite 100, Blue Bell, PA 19422, has submitted a Final Report concerning remediation of site soil contaminated with chlorinated solvents and inorganics. The report is intended to document remediation of the site to meet the Statewide Health Standard.

   JECA Corporation, City of Philadelphia, Philadelphia County. Craig Herr, RT Environmental Services, Inc., 215 W. Church Rd., King of Prussia, PA 19406, on behalf of JECA Corp., 3375 Richmond St., Philadelphia, PA 19134, has submitted a Final Report concerning remediation of site soil contaminated with lead and BTEX. The report is intended to document remediation of the site to meet the Statewide Health Standard.

   Northeast Regional Field Office, Joseph A. Brogna, Environmental Cleanup Program Manager, 2 Public Square, Wilkes-Barre, PA 18711-0790, (570) 826-2511.

   Bethlehem Corporation and Young Volkswagen Mazda, Palmer Township, Northampton County. Jim LaRegina, P. G., HRP Associates, Inc., 4807 Jonestown Road, Harrisburg, PA 17109 submitted a Remedial Investigation Report (on behalf of Easton Center LLC, 18202 Minnetonka Boulevard, Suite 1, Wayzata, MN 55391) concerning the characterization of site soils and groundwater found or suspected to be contaminated with lead and other inorganics, no. 2 fuel oil, leaded gasoline, chlorinated solvents and other organics, polycyclic aromatic hydrocarbons and polychlorinated biphenyls. The report was submitted in partial fulfillment of a combination of the nonresidential Statewide Health and Site-Specific Standards.

   Raub and Romond Properties, Gibson Township, Susquehanna County. Kevin Van Kuren, P. G., Hydrocon Services, Inc., 16 East Minor Street, Emmaus, PA 18049 has submitted a Final Report (on behalf of Helen Raub and Lee Romond, R. R. 1, Susquehanna, PA) concerning the remediation of soils and groundwater contaminated with no. 2 fuel oil as the result of an accidental release. The report was submitted to document remediation of the site to meet the residential Statewide Health Standard.

   Southcentral Region: Environmental Cleanup Program Manager, 909 Elmerton Avenue, Harrisburg, PA 17110.

   Former United Piece Dye Works, Spring Garden and Springettsbury Townships, York County. BL Companies, 830 Sir Thomas Court, Harrisburg, PA 17109, on behalf of Spring Garden Township, 558 South Ogontz Street, York, PA 17403-5709, submitted a Remedial Investigation report concerning remediation of site soils, groundwater, surface water and sediment contaminated with PCBs, lead, heavy metals, solvents, BTEX and PAHs. The applicant proposes to remediate the site to meet a combination of the requirements for the Site-Specific and Statewide Health Standards

   Eric and Holly Stokes Residence, Myerstown Borough, Lebanon County. ARM Group, Inc., 1129 West Governor Road, P. O. Box 797, Hershey, PA 17033-0797, on behalf of Eric and Holly Stokes, 242 East Main Street, Myerstown, PA 17067 submitted a Final Report concerning remediation of site soils contaminated with fuel oil No. 2. The report is intended to document remediation of the site the Statewide Health Standard.

   Sunoco Station 0003-7382, Susquehanna Township, Dauphin County. GES, Inc., 410 Eagleview Boulevard, Suite 110, Exton, PA 19341, on behalf of Gelder Realty, 2456 Mercedes Court, Harrisburg, PA 17112 and Sunoco, Inc., Automotive Laboratory, P. O. Box 1135, Post Road and Blue Ball Avenue, Marcus Hook, PA 19061, submitted a combined Remedial Investigation and Final Report concerning remediation of site soils and groundwater contaminated with BTEX, MTBE, Isopropylbenzene and Naphthalene. The report is intended to document remediation of the site to a combination of the Site-Specific and Statewide Health Standards.

   Sun Pipe Line Company Stutzman Farm, South Heidelberg Township, Berks County. Aquaterra Technologies, Inc., 122 South Church Street, West Chester, PA 19381, on behalf of Sun Pipeline Line Company, Post Road and Blue Ball Avenue, Marcus Hook, PA 19061, submitted a Final Report concerning remediation of site soils contaminated with fuel oil no. 2 and unleaded gas. The report is intended to document remediation of the site to a combination of the Site-Specific and Statewide Health Standards.

   Brewery Products, Springettsbury Township, York County. React Environmental Services, Inc., 6901 Kingsessing Avenue, Philadelphia, PA 19142, on behalf of Stover Fuel Oil Company, P. O. Box 117, Hershey, PA 17033, submitted a Final Report concerning remediation of site soils and groundwater contaminated with BTEX. The report is intended to document remediation of the site to a combination of the Statewide Health Standard.

LAND RECYCLING AND ENVIRONMENTAL REMEDIATION

UNDER ACT 2, 1995

PREAMBLE 3


The Department has taken action on the following plans and reports under the Land Recycling and Environmental Remediation Standards Act (35 P. S. §§ 6026.101--6026.908).

   Provisions of 25 Pa. Code § 250.8, Administration of the Land Recycling and Environmental Remediation Standards Act (Act) requires the Department of Environmental Protection (Department) to publish in the Pennsylvania Bulletin a notice of its final actions on plans and reports. A final report is submitted to document cleanup of a release of a regulated substance at a site to one of the remediation standards of the Act. A final report provides a description of the site investigation to characterize the nature and extent of contaminants in environmental media, the basis of selecting the environmental media of concern, documentation supporting the selection of residential or nonresidential exposure factors, a description of the remediation performed and summaries of sampling methodology and analytical results which demonstrate that the remediation has attained the cleanup standard selected. Plans and reports required by provisions of the Act for compliance with selection of remediation to a site-specific standard, in addition to a final report, include a remedial investigation report, risk assessment report and cleanup plan. A remedial investigation report includes conclusions from the site investigation, concentration of regulated substances in environmental media, benefits of refuse of the property and, in some circumstances, a fate and transport analysis. If required, a risk assessment report describes potential adverse effects caused by the presence of regulated substances. If required, a cleanup plan evaluates the abilities of potential remedies to achieve remedy requirements. A work plan for conducting a baseline remedial investigation is required by provisions of the Act for compliance with selection of a special industrial area remediation. The baseline remedial investigation, based on the work plan, is compiled into the baseline environmental report to establish a reference point to show existing contamination, describe proposed remediation to be done and include a description of existing or potential public benefits of the use or reuse of the property. The Department may approve or disapprove plans and reports submitted. This notice provides the Department's decision and, if relevant, the basis for disapproval.

   Pleasant Valley Business Center, 10 Oak Street Site, Conshohocken Borough, Montgomery County. Tracy B. Greer, Keating Development Co., One Bala Ave., Bala Cynwyd, PA 19004, has submitted a Baseline Environmental Report concerning the remediation of site soil contaminated with inorganics and PAH; and groundwater contaminated with inorganics and other organics. The report was approved by the Department of January 15, 2003.

   Sears Logistics Services, Inc., Option A, Former Bridge Street Warehouse, City of Philadelphia, Philadelphia County. Tom Farrell, Resource Control Corp., 1274 N. Church St., Moorestown, NJ 08057, has submitted a revised Final Report concerning remediation of site groundwater contaminated with solvents, BTEX and PAH. The revised report demonstrated attainment of Site-Specific Standards and was approved by the Department on January 10, 2003.

   Former Cochrane, Inc., Upper Merion Township, Montgomery County. Paul Ledebur, RT Environmental Services, Inc., 215 W. Church Rd., King of Prussia, PA 19406, on behalf of Sugartown Worldwide, Inc., 500 American Ave., King of Prussia, PA 19406, has submitted a Final Report concerning remediation of site soil contaminated with BTEX. The report demonstrated attainment of the Statewide Health Standard and was approved by the Department on January 14, 2003.

   Southcentral Region: Environmental Cleanup Program Manager, 909 Elmerton Avenue, Harrisburg, PA 17110.

   Remp Group Property, Cumru Township, Berks County. RT Environmental Services, Inc., 215 West Church Road, King of Prussia, PA 19406, on behalf of the Remp Group, 64 Sycamore Lane, Reading, PA 19606, submitted a final report concerning remediation of site soils contaminated with inorganics and lead. The final report demonstrated attainment of the Statewide Health Standard and was approved by the Department on January 16, 2003.

   William Moul Residence, Conewago Township, York County. GemChem, Inc., P. O. Box 384, Lititz, PA 17543-0384, on behalf of William Moul, 830 Bremer Road, Dover, PA 17315, submitted a Final Report concerning remediation of site soils contaminated with benzene, cumene, ethyl benzene, fluorene, naphthalene, phenanthrene and toluene. The final report demonstrated attainment of the Statewide Health Standard and was approved by the Department on December 31, 2002.

   Eric Coomes Residence, North Hopewell Township, York County. GemChem, Inc., P. O. Box 384, Lititz, PA 17543-0384, on behalf of Eric Coomes, 5828 Spruce Road, Felton, PA 17356, submitted a Final Report concerning remediation of site soils contaminated with benzene, cumene, ethyl benzene, fluorene, naphthalene, phenanthrene and toluene. The final report demonstrated attainment of the Statewide Health Standard and was approved by the Department on January 2, 2003.

   Sun Pipe Line Company Stutzman Farm, South Heidelberg Township, Berks County. Aquaterra Technologies, Inc., 122 South Church Street, West Chester, PA 19381, on behalf of Sun Pipeline Line Company, Post Road and Blue Ball Avenue, Marcus Hook, PA 19061, submitted a Final Report concerning remediation of site soils contaminated with fuel oil no. 2 and unleaded gas. The final report demonstrated attainment of the Statewide Health Standard and was approved by the Department on December 17, 2002.

   Defense Distribution Depot, Susquehanna, PA, IRP Site 62, Building 251, Fairview Township, York County. Defense Distribution Depot Susquehanna, PA, 2001 Mission Drive, Suite 1, New Cumberland, PA 17070 submitted a Final Report concerning remediation of site soils contaminated with hydraulic oil. The final report demonstrated attainment of the Statewide Health Standard and was approved by the Department on December 23, 2002.

   Berkshire Court Lots 2 and 3, Wyomissing Borough, Berks County. ARM Group Inc., 1129 West Governor Road, P. O. Box 797, Hershey, PA 17033, on behalf of Thun Partnership, 17 East Meadow Avenue, Robesonia, PA 19551 and Rockwell Automation Inc., 777 East Wisconsin Avenue, Suite 1400, Milwaukee, WI 53202, has submitted a combined Remedial Investigation and Final Report concerning remediation of site soils and groundwater contaminated with chlorinated solvents and other organics. The final report demonstrated attainment of a combination of the Statewide Health and Site-Specific Standards and the combined Remedial Investigation and Final Report were approved by the Department on December 20, 2002.

   Defense Distribution Depot Susquehanna PA, SWMU No. 6, Fairview Township, York County.
