FEDERAL WATER POLLUTION CONTROL ACT SECTION 401 The Department of Environmental Protection (Department) has taken the following actions on previously received permit applications, requests for Environmental Assessment approval and requests for Water Quality Certification under section 401 of the Federal Water Pollution Control Act (FWPCA) (33 U.S.C.A. § 1341).
Except as otherwise noted, the Department has granted 401 Water Quality Certification certifying that the construction and operation described will comply with the applicable provisions of sections 301--303, 306 and 307 of the FWPCA (33 U.S.C.A. §§ 1311--1313, 1316 and 1317) and that the construction will not violate applicable Federal and State water quality standards.
Persons aggrieved by an action may appeal, under section 4 of the Environmental Hearing Board Act (35 P. S. § 7514) and 2 Pa.C.S. §§ 501--508 and 701--704 (relating to the Administrative Agency Law), to the Environmental Hearing Board, Second Floor, Rachel Carson State Office Building, 400 Market Street, P. O. Box 8457, Harrisburg, PA 17105-8457, (717) 787-3483. TDD users should contact the Environmental Hearing Board (Board) through the Pennsylvania Relay Service, (800) 654-5984. Appeals must be filed with the Board within 30 days of publication of this notice in the Pennsylvania Bulletin, unless the appropriate statute provides a different time period. Copies of the appeal form and the Board's rules of practice and procedure may be obtained from the Board. The appeal form and the Board's rules of practice and procedure are also available in Braille or on audiotape from the Secretary of the Board at (717) 787-3483. 1. (Crossing A) A road crossing of a tributary to Roraring Brook (HQ-CWF), consisting of a 52-foot long, 8-foot by 4-foot concrete box culvert with concrete wingwalls, depressed approximately 6-inches below streambed elevation.
2. (Crossing B) A road crossing of a tributary to Roaring Brook (HQ-CWF), consisting of a 53-foot long, 30-inch diameter corrugated metal aluminized type 2 pipe with a riprap apron and a concrete headwall and endwall.
3. (Crossing C) A road crossing of a tributary to Roaring Brook (HQ-CWF) and 0.02 acre of adjacent EV wetlands consisting of a 53-foot long, 30-inch diameter corrugated metal aluminized type 2 pipe with a riprap apron and a concrete headwall and endwall.
4. (Crossing D) A road crossing of a tributary to Roaring Brook (HQ-CWF), consisting of a 66-foot long, 36-inch diameter corrugated metal aluminized type 2 pipe with a riprap apron and a concrete headwall and endwall.
5. (Crossing E) A road crossing of 0.02 acre of EV wetlands within the Roaring Brook Watershed.
6. (Crossing F) A road crossing of a tributary to Roaring Brook (HQ-CWF), consisting of a 73-foot long, 18-inch diameter reinforced concrete pipe.
7. (Crossing G) A road crossing of a tributary to Roaring Brook (HQ-CWF), consisting of a 74-foot long, 15-inch smooth-lined corrugated plastic pipe with a riprap apron.
8. A sanitary sewer line crossing under each of the above culverts carrying tributaries to Roaring Brook.

The project is located on the east side of SR 0435 and SR 0502 intersection (Moscow, PA Quadrangle N: 10.8 inches; W: 1.0 inch) in Covington Township, Lacka- wanna County.

To construct and maintain a single span steel I-beam with clear span of 58 feet, a width of 12 feet and a minimum underclearance of 8 feet 9 inches on a skew of 90° over Bentley Creek, located 0.25 mi. south of the intersection of SR 4018 and SR 4013 along SR 4013. This project proposes to permanently impact 60 linear feet of UNT to Bentley Creek, which is, designated a WWF and does not propose to impact any jurisdictional wetlands. This permit was issued under Section 105.13(e) ''Small Projects.'' This permit also includes 401 Water Quality Certification.

To construct a bridge on the border of Waynesburg Borough and Franklin Township, Greene County, Pittsburgh ACOE District (Waynesburg, PA Quadrangle, N: 2.85 inches; W: 8.5 inches, Latitude: 39° 53` 30"; Longitude: 80° 11` 15"). To construct and maintain a 41.4 ft. wide, 595 ft. long, seven span bridge and railroad overpass with a stream underclearance of 33.9 ft. to replace the existing SR 0218, 38 ft. wide, 106 ft. long, two span bridge with an underclearance of 17.9 ft. over South Fork Ten Mile Creek (WWF) with a drainage area of 117.4 square miles. The project is located on the border between Waynesburg Borough and Franklin Township.
E63-587. The Foundry at South Strabane, LLC, 5252 East 82nd Street, Suite 300, Indianapolis, IN 46250. To place and maintain fill in wetlands in South Strabane Township, Washington County, Pittsburgh ACOE District (Washington East PA Quadrangle, N: 12.11"; W: 13.31", Latitude 40° 11` 30"; Longitude 80° 13` 13"). To place and maintain fill in 0.935 acre of wetlands, to place and maintain fill in three UNTs to (UNTs 1--3) to Chartiers Creek, (WWF) each having a drainage area of less than 100 acres; for a total of 2375`; to operate and maintain a geosynthetic reinforced embankment wall within portions of the floodway of tributary No. 2 (a.k.a. UNT 4) of Chartiers Creek; and to construct and maintain various outfalls. To compensate for these impacts, the permittee will construct approximately 1.1 acres of replacement wetlands., and will provide stream mitigation in accordance with the special conditions on Page 5 of this permit. The proposed impacts are for the purpose of constructing a multiple structure, retail and service complex known as the Foundry at South Strabane. The project is located at the south corner of the intersection of Manifold Road and US Route 19.
