FEDERAL WATER POLLUTION CONTROL ACT, SECTION 401

   The following permit applications and requests for Environmental Assessment approval and requests for Water Quality Certification have been received by the Department of Environmental Protection (Department). Section 401 of the Federal Water Pollution Control Act (FWPCA) (33 U.S.C.A. § 1341(a)), requires the State to certify that the involved projects will not violate the applicable provisions of sections 301--303, 306 and 307 of the FWPCA 33 U.S.C.A. §§ 1311--1313, 1316 and 1317 as well as relevant State requirements. Initial requests for 401 Water Quality Certification will be published concurrently with the permit application. Persons objecting to approval of a request for certification under Section 401 or to the issuance of a Dam Permit or Water Obstruction and Encroachment Permit, or the approval of an Environmental Assessment must submit any comments, suggestions or objections within 30 days of the date of this notice as well as any questions to the office noted above the application. Comments should contain the name, address and telephone number of the person commenting, identification of the certification request to which the comments or objections are addressed, and a concise statement of comments, objections or suggestions including the relevant facts upon which they are based.

   The Department may conduct a fact-finding hearing or an informal conference in response to comments if deemed necessary. Each individual will be notified, in writing, of the time and place of a scheduled hearing or conference concerning the certification request to which the comment, objection or suggestion relates. Maps, drawings and other data pertinent to the certification request are available for inspection between the hours of 8 a.m. and 4 p.m. on each working day at the office noted above the application.

   Persons with a disability who wish to attend the hearing and require an auxiliary aid, service or other accommodation to participate in the proceedings should contact the specified program. TDD users may contact the Department through the Pennsylvania AT&T Relay Service at (800) 654-5984.

   To construct, operate and maintain a water intake structure in Johns Run (High Quality-Cold Water Fishery); to construct, operate and maintain 300-feet of 4-inch diameter pipe in the floodway of Johns Run to supply water to a private, recreational pond. The construction of the water intake structure shall not impact wetlands while impacting a maximum length of 30-feet of waterway. The project is located the northern right-of-way of SR 4004 approximately 1.3-miles west of SR 0046 and SR 4004 intersection.

   E18-235A Croda Incorporated, Draketown Road, P. O. Box 178, Mill Hall, PA 177151-0178, Wetland Fill, Baltimore COE, Mill Hall, PA Quadrangle N:  20.5 inches; W:  13.25 inches.

   To place and maintain fill in an additional 0.227 acre of palustrine emergent wetlands and 0.03 acre of palustrine forested open water wetlands. The original permit authorized the placement and maintenance of 1.82 acres of wetland fill and authorized construction of a 2.51 acres wetland replacement in the floodway of Bald Eagle Creek. This amendment will expand the wetland replacement area 0.43 acre to 2.94 acres and includes wetland plantings in the replacement area. The purpose of this project is to expand and upgrade existing chemical plant operations. The company property encompasses 26 acres of land with 8 acres currently developed. The fill site is located on the western side of company property located along Draketown Road (T-373) approximately 0.30 mile from the intersection with S.R. 150 (Mill Hall, PA Quadrangle N:  20.5 inches W:  13.25 inches) Bald Eagle Township, Clinton County. Off-site mitigation for impacts will be replaced within the floodway of Bald Eagle Creek located along Lusk Run Road approximately 1.0 mile from the intersection with S.R. 150 (Mill Hall PA Quadrangle N:  22.5 inches; W:  17.0 inches) Bald Eagle Township, Clinton County.

The proposed work includes the construction and maintenance of two 36-inch CPP culverts in an unnamed tributary to the Youghiogheny River (WWF) and the installation and maintenance of two 8-inch PVC sewer lines and two 1-inch gas lines in an unnamed tributary to the Youghiogheny River (WWF).    E25-632, Erie Western Pennsylvania Port Authority. Pier II Perry's Landing, in City of Erie, Erie County, ACOE Pittsburgh District (Erie North, PA Quadrangle N:  1.0 inch; W:  14.8 inches).

   To replace the existing floating wave-attenuator to the east of Pier II with a 370-foot long by 76-foot wide rubble-mound breakwall and to construct a 460-foot long by 76-foot wide rubble-mound breakwall on the northwest side of Pier II located at Lawrence Pier--Perry's Landing Yacht Club and Marina in Presque Isle Bay, with impacts totaling approximately 1.45 acres of bottom area.

   To construct a small flow treatment plant that will discharge to Caldwell Creek (HQ) along the right bank, located approximately 7 miles northwest of Grand Valley.

ENVIRONMENTAL ASSESSMENTS

   EA49-001NC.  Bureau of Abandoned mine Reclamation, Wilkes-Barre District Offices, 2 Public Square 5th Fl., Wilkes-Barre, PA 18711-0790. OSM49(3661)101.1 in Kulpmont Borough, Mt. Carmel Township, Northumberland County, ACOE Baltimore District.

   Applicant is requesting a Category 2 waiver of permit requirements under Chapter 105.12(a)(16) for project OSM 49(3661)101.1. The project site covers approximately 51 acres, and is located adjacent to St. Mary's Cemetery East, Kulpmont Borough and Mount Carmel Township, Northumberland County (Mount Carmel Quadrangle, N: 7.1 inches; W: 11.6 inches). The purpose of the project is to eliminate approximately 7,550 feet of highwall. Eight strip mine pits will be backfilled with 470,000 cubic yards of material. A 0.07 acre Palustrine Unconsolidated Bottom Permanently Flooded Excavated (PUBHX) wetland exists in one of the strip mine pits (AMLF #8 of PA3661). The PUBHX wetland will be filled during the course of the project. A replacement wetland of equal or larger size will be built at approximately the same location.

   The Department of Environmental Protection (Department) has taken the following actions on previously received permit applications and requests for plan approval. The actions are listed in two categories. Section I lists all municipal and industrial permits and Section II lists oil and gas related permits.

   These actions of the Department of Environmental Protection (Department) may be appealed to the Environmental Hearing Board (Board), Second Floor, Rachel Carson State Office Building, 400 Market Street, P. O. APPROVALS TO USE NPDES AND/OR OTHER GENERAL PERMITS

   The following parties have submitted: (1) Notices of Intent (NOIs) for Coverage under (1) General NPDES Permits to Discharge Wastewater into the Waters of the Commonwealth. The approval for coverage under these general NPDES permits is subject to applicable effluent limitations. Monitoring, reporting requirements and other conditions set forth in the general permit: (2) General Permits for Beneficial Use of Sewage Sludge or Residential Septage by Land Application in Pennsylvania; (3) General NPDES Permit Authorizing the Discharge of Stormwater Associated with Construction Activities to Waters of the Commonwealth; (4) Notification for First Use Application of Sewage Sludge.

   The approval of coverage for land application of sewage sludge or residential septage under these general permits is subject to pollutant limitations, pathogen and vector attraction reduction requirements, operational standards, general requirements, management practices and other conditions set forth in the respective permit. The Department of Environmental Protection approves the following coverage under the specific General Permit.

   The EPA Region III Administrator has waived the right to review or object to this permit action under the waiver provision 40 CFR 123.23(d).

   The application and related documents, effluent limitations, permitting requirements and other information are on file and may be inspected and arrangements made for copying at the contact office noted.
