Availability of Technical Guidance

   DEP is committed to making its technical guidance documents and other useful publications available to the public. DEP publishes a list of its technical guidance documents in its Technical Guidance Document Inventory twice a year. The most recent Inventory was published December 22, 1995; the next one will be published in June 1996. The Inventory contains policies, documents, handbooks and guidance. In between the publication of the Inventory, DEP will publish notices of 1)  intent to make changes, 2)  draft changes and 3)  final changes in the UPDATE (DEP's weekly newsletter available on DEP's World Wide Web site) and in the Pennsylvania Bulletin.

   Persons can order a copy of the Inventory or a copy of any of the documents listed on the Inventory by calling Elwyn Inc. (the printer) at 1 (800) 804-4020 if they are calling within Pennsylvania or (610) 891-2183 if they are calling outside of Pennsylvania. Elwyn should send the materials within 10 days.

   The following changes in technical guidance documents appeared in the February 2, 1996, issue of UPDATE.

Final Technical Guidance

   DEP ID:  383-0810-201 TITLE:  Summary of Key Requirements for Transient Noncommunity Water Systems. DESCRIPTION:  This is a new document from the Safe Drinking Water Program of DEP's Bureau of Water Supply and Community Health. The title gives the content of the document. Updates to Existing Technical Guidance

   DEP ID:  012-0830-005 TITLE:  Data Standards for Names and Addresses. DESCRIPTION:  This document, used Department-wide, provides DEP staff with standard procedures for collection and input of name and address data elements into Departmental database systems. This document was listed incorrectly on the December 22, 1995, Inventory as DEP ID:  012-0100-005, location:  Vol. 01, Tab 07. The identification number and the location are being changed. The correct information is DEP ID:  012-0830-005, location Vol. 01, Tab 10. There have been no substantive changes. Direct questions about the document to Kimberly Nelson at (717) 787-5027.

   DEP ID:  383-5500-213 TITLE:  Small Water Systems Regionalization Grant Program--Guidelines and Application Procedures. DESCRIPTION:  This is simply an update and not a substantive change to an already existing document from the Safe Drinking Water Program. The document is one of several that are included in the Program's Financial Assistance Management Binder (DEP ID:  383-0400-113). The binder is located at Vol. 27, Tab 2. DEP provides these grants to help small water systems become and/or remain viable through a regionalized approach to water service.    DEP ID:  383-3120-101 LOCATION:  Vol. 27, Tab 2 TITLE:  Surveillance Strategy and Implementation Guidelines. DESCRIPTION:  This revision to the Safe Drinking Water Program's surveillance strategy adds an additional section and appendix to the already existing document.    DEP ID:  400-5900-115 LOCATION:  Vol. 08, Tab 17 TITLE:  Confined Space Safety Policy. DESCRIPTION: This is a revision of an existing document used by DEP's Field Operations, which defines and describes confined spaces and their hazards. It forbids entry by DEP personnel into confined spaces for routine inspection duties and requires safeguards when working near confined spaces.    The following changes in technical guidance documents appeared in the March 29, 1996 issue of UPDATE.

Final Technical Guidance

   DEP ID:  258-2182-773 TITLE:  Policy and Procedure Establishing Criteria for Use of Uncontaminated Soils, Rock, Stone, Unused Brick and Block, Concrete, and Used Asphalt as Clean Fill. DESCRIPTION:  This policy establishes clean fill criteria for the materials mentioned in the title. CONTACT:  Larry Holley at (717) 787-9870.

   DEP ID:  323-0200-002 TITLE:  Pennsylvania Wetland Replacement Project. DESCRIPTION:  This project provides a mechanism by which the Department will assist permit applicants in meeting the wetland replacement or mitigation requirements associated with Chapter 105 Water Obstruction and Encroachment Permits.    DEP ID:  561-2100-703 TITLE:  Permit Inventory--Site Status Codes. DESCRIPTION:  The purpose of this guidance is to establish a uniform method of assigning LUMIS permit inventory site status codes. This document has been revised to add two status code selections. Correction to Final Copy of Technical Guidance

   DEP ID:  563-2112-610 TITLE:  Determining Eligibility of Pre-existing Pollutional Discharges. DESCRIPTION: The purpose of this guidance is to identify and explain conditions that must be met to qualify for Subchapter F and G authorization. CORRECTION:  The ID number was incorrectly listed as 563-2112-209. The correct ID number is 563-2112-610. The correct location for this document is at Volume 12, Tab 78A.

   DEP ID:  263-2112-611 TITLE:  Permitting Pre-Existing Pollution Discharges under Subchapter F and Subchapter G. DESCRIPTION:  The purpose of this guidance is to establish the methods and procedures for performing BPJ analysis. CORRECTION:  The correct location for this document is at Volume 12, Tab 78B.

   DEP ID:  563-2504-612 TITLE:  Monitoring and Compliance and Bond Release for Subchapter F or G Permits. CORRECTION:   The correct location for this document is at Volume 12, Tab 78C.

   DEP ID:  361-2000-010 TITLE:  Implementation Guidance for Section 95.6 Phosphorus Discharges to Lakes, Ponds, and Impoundments. CORRECTION:  This document was incorrectly titled ''Lake Tropic Model for the Personal Computer.''

Notice of Intent to Rescind Technical Guidance

   DEP ID:  320-0700-001 TITLE:  Implementation of the History Code. EXPLANATION FOR RECISION:  This is the same document as the Department-wide Policy and Procedures for Implementing the History Code (DEP ID:  012-0700-001). There is no need to have duplicate documents on the Inventory.

   The following changes to technical guidance appeared in the April 12, 1996 issue of UPDATE.

Revision and Updates to Existing Technical Guidance

   DEP ID:  320-4000-001 TITLE:  Compliance Assistance and Enforcement Manual. DESCRIPTION:  This is a manual which provides the procedures, guidelines and sample forms to provide compliance assistance and enforcement guidance for the Department's Erosion and Sediment Control, Dam Safety, Waterways Management, Wetlands Protection and Floodplain Management programs.    DEP ID:  383-2000-108 TITLE:  Guidance for Construction and Operations Permits.    DEP ID:  383-3130-208 TITLE:  New Source Sampling Requirements for Ground-Water Systems--Community and Non-transient Non-community Water Systems. REVISION:  This is an update to page 3 of the existing guidance.

   DEP ID:  383-0400-110 TITLE:  Compliance Strategy--Section VI--Public Notification. REVISION:  This is an update to Attachment 6A (Mandatory Health Effects Language as Taken from the Federal Regulations) of the existing comprehensive staff handbook.

   DEP ID:  383-3301-405 TITLE:  Laboratory Reporting Instructions for Unregulated Chemical Contaminants (Phase II & V). REVISION:  Pages 9-12 of the existing document have been reprinted.

   Safe Drinking Water Program, Staff Handbook Binders, Master Table of Contents. ADDITION:  This 5-page Table of Contents gives the binder, tab, document title, policy number and date for all the relevant documents in the program.

Draft Technical Guidance

   DRAFT TITLE:  Pennsylvania Radon Mitigation Standards. BACKGROUND:  This guidance is necessary to ensure that State-certified mitigation contractors will install radon mitigation systems to a set of uniform standards. REVIEW PROCESS:  The present draft document has already gone through internal review from the Radon Division, regional staff doing radon work, the program's legal counsel and DEP's publication management officer. Additional individuals from the radon mitigation industry have also reviewed the document. CONTACT:  Robert K. Lewis at (717) 783-3594.

   DRAFT TITLE:  Policy for Recognizing Succession to Water Rights as a Result of Changes of Ownership. DESCRIPTION:  This guidance establishes a uniform procedure for recognizing a succession to water rights when a new owner, by whatever means and for whatever reason, takes over or acquires an existing public water supply system that holds legal water rights. REVIEW PROCESS:  The draft guidance has been distributed to Regional Program Managers, Regional Technical Services Chiefs, program counsel and the Pennsylvania Fish and Boat Commission for review and comment; final guidance will be prepared for implementation by June 1.    DRAFT TITLE:  Implementation of the History Code:  Policy and Procedures for Applicants for DEP Permits and Plan Approvals (DEP ID:  012-0700-001) BACKGROUND:  During the last session of the General Assembly, amendments to the History Code became law. These amendments require substantive changes to this policy and procedure document. REVIEW PROCESS:  This draft document has received wide distribution and review within DEP and has been sent to the Pennsylvania Historical and Museum Commission for their review. ANTICIPATED EFFECTIVE DATE:  May 10, 1996 DEADLINE FOR SUBMITTAL OF COMMENTS:  April 30, 1996. CONTACT:  Nina Huizinga at (717) 772-4768.

Notice of Intent to Develop Technical Guidance

   DRAFT TITLE:  Chapter 105 Program Manual (Dam Safety and Waterway Management). BACKGROUND:  A ''program guidelines'' manual has been in use by program staff for the past few years. However, it was not added to the Bureau's Technical Guidance because of ongoing development and revision activities. The Bureau will send a draft document to the regional staff for review and comment. ANTICIPATED DRAFT DEVELOPMENT DATE: May 1, 1996. ANTICIPATED EFFECTIVE DATE: September 1, 1996.
