   Actions on applications under the Surface Mining Conservation and Reclamation Act (52 P. S. §§ 1396.1--1396.19a); the Noncoal Surface Mining Conservation and Reclamation Act (52 P. S. §§ 3301--3326); The Clean Streams Law (35 P. S. §§ 691.1--691.1001); the Coal Refuse Disposal Control Act (52 P. S. §§ 30.51--30.66); The Bituminous Mine Subsidence and Lane Conservation Act (52 P. S. §§ 1406.1--1406.21).    The Department of Environmental Protection has taken the following actions on previously received Dam Safety and Encroachment permit applications, requests for Environmental Assessment approval, and requests for Water Quality Certification under section 401 of the Federal Water Pollution Control Act (33 U.S.C.A. § 1341(a)).

   Any person aggrieved by this action may appeal, under section 4 of the Environmental Hearing Board Act (35 P. S. § 7514), and 2 Pa.C.S. §§ 501--508 and 701--704 (relating to the Administrative Agency Law) to the Environmental Hearing Board, 400 Market Street Floor 2, P. O. Box 8457, Harrisburg, PA 17105-8457, (717) 787-3483. TDD users may contact the Board through the Pennsylvania Relay Service, 1 (800) 654-5984. Appeals must be filed with the Environmental Hearing Board within 30 days of receipt of written notice of this action unless the appropriate statute provides a different time period. To remove the existing structure and to construct and maintain a single span golf cart bridge having a span of 66.2 feet with an underclearance of approximately 8.5 feet on a 65 degree skew across Saucon Creek and a 2-foot high by 100-foot long earthen landscape berm within the floodway of Saucon Creek. The project is located at the Weyhill Golf Course approximately 0.8 mile east of S. R. 0378 and S. R. 2036 (Allentown East, PA Quadrangle N:  10.4 inches; W:  0.1 inch) in Upper Saucon Township, Lehigh County.

   E39-302. Encroachment. Lehigh County, P. O. Box 1548, Allentown, PA 18105. To construct and maintain a pedestrian bridge, on existing abutments, having 2 spans of 80-feet and an underclearance of approximately 10-feet to reestablish pedestrian access across Jordan Creek and to construct and maintain approximately 150 linear feet of handicapped accessible trail within the floodway of Jordan Creek. The project is located at the Trexler-Lehigh County Game Preserve approximately 0.7 mile northeast of S. R. 4009 and S. R. 4007 (Cementon, PA Quadrangle N:  5.2 inches; W:  17.2 inches) in North Whitehall Township, Lehigh County.

   E40-427. Encroachment. Walter and Rhoda Kuharchik, 276 Roosevelt Street, Exeter, PA 18643-1828. To place fill and regrade along the banks and within the floodway of a 300-foot reach of Hicks Creek, and to place fill in 0.08 acre of wetlands, for the purpose of preparing a site for commercial development. The project is located on the east side of Schooley Avenue (S. R. 1025), approximately 0.5 mile northwest of the intersection of S. R. 0011 and S. R. 1025 (Pittston, PA Quadrangle N:  13.8 inches; W:  10.2 inches) in Exeter Borough, Luzerne County. The permittee has met the wetland replacement requirement by participating in the Pennsylvania Wetland Replacement Project.

   E45-287. Encroachment. Caesars Brookdale on the Lake, P. O. Box 400, Scotrun, PA 17355. To construct and maintain an 8-inch water intake structure in Brookdale Lake to be used as a dry hydrant to provide fire protection at the Caesars Brookdale on the Lake Resort. This project is located approximately 0.1 mile north of the intersection of T576 and T545 (Mount Pocono, PA Quadrangle N:  15.0 inches; W:  12.3 inches) in Pocono Township, Monroe County.

   E45-288. Encroachment. Caesars Paradise Stream, P. O. Box 400, Scotrun, PA 18355. To construct and maintain an 8-inch water intake structure in an offstream pond along Paradise Creek to be used as a dry hydrant to provide fire protection at the Caesars Paradise Stream Resort. This project is located on the north side of S. R. 0940 approximately 0.45 mile west of the intersection of S. R. 0940 and S. R. 0390 (Buck Hill Falls, PA Quadrangle N:  0.6 inch; W:  8.5 inches) in Paradise Township, Monroe County.

   E45-289. Encroachment. Caesars Pocono Palace, P. O. Box 400, Scotrun, PA 18355. To construct and maintain an 8-inch water intake structure in Echo Lake to be used as a dry hydrant to provide fire protection at the Caesars Pocono Palace. This project is located on the north side of S. R. 0209 approximately 0.6 mile northeast of the intersection of S. R. 0209 and T550 (Bushkill, PA-NJ Quadrangle N:  12.5 inches; W:  8.30 inches) in Middle Smithfield Township, Monroe County.

   E64-165. Encroachment. Department of Transportation, Engineering District 4-0, P. O. Box 111, Scranton, PA 18501. To remove the existing structure and to construct and maintain an adjacent box beam bridge having a normal span of 76.5 feet and a minimum underclearance of 15.25 feet across Dyberry Creek. The project is located on S. R. 4015 (Park Street), Section 670, Segment 0080, approximately 0.25 mile east of S. R. 0006 (Honesdale, PA Quadrangle N:  14.3 inches; W:  0.7 inch) in Honesdale Borough, Wayne County.

   E09-641. Encroachment. Rohm and Haas Company, P. O. Box 219, Bristol, PA 19907. To remove and existing twin 36-inch pipe culvert across Hog Run Creek, to construct and maintain 43.5 linear feet of 9`2" × 3`3" box culvert and associated wetland fill, and to impact 2.4 acres of wetland associated with the closure of the Bristol Landfill Sections A, B and C which include the construction of stormwater management facilities, perimeter swaling, landfill capping, excavation of contaminated soils, slope stabilizing rock riprap, water collection system and an impermeable cut-off slurry wall around the landfill perimeter, all for the purpose of eliminating the releases of leachate from the landfill. The site is located in the vicinity and north of the confluence of Hog Run and the Delaware River (Berverly PA-NJ Quadrangle, N:  15.2 inches; W:  1.1 inches) in Bristol Township, Bucks County.

   E23-333. Encroachment. Concord Development Associates, Inc., Goshen Professional Center, Suite 310, 124 West Chester Pike, West Chester, PA 19382. To construct and maintain a twin 48-inch diameter HCMP culvert in and along a tributary to Green Creek (TSF) and adjacent wetlands at station 17+00 for a proposed roadway in the Concord Hunt Subdivision located approximately 2,300 feet southeast from the intersection of Smith Bridge and Kirk Roads (Wilmington North, DEL-PA Quadrangle N:  20.6 inches; W:  1.3 inches) in Concord Township, Delaware County. Also to construct and maintain a 10-foot by 12-foot sewage control building and a 10-foot by 10-foot pump station along the Green Creek 100-year floodway. The permittee will construct 0.28 acre of replacement wetlands.
