Notice of Plan Approval Application Minor Source

   The following stationary sources have filed a request for a plan approval with the Department of Environmental Protection (DEP), Bureau of Air Quality. Persons wishing to file protests or comments on the proposed plan approval have 30 days to submit the protests or comments to the Regional Office at the address listed below. Interested persons may also request that a hearing be held concerning the plan approval application by filing a request with the Regional Office stating the reason for the request.

   The Department will evaluate and consider all protests and comments received. The Department will, where appropriate, modify the proposed plan approval based on the protests and comments received.

   The final plan approval will contain terms and conditions to ensure that the source is constructed and operated in compliance with the Department's regulations contained in 25 Pa. Code Chapters 121 through 143 and the requirements of the Federal Clean Air Act. A notice of the Department's final decision on the proposed plan approval will be published in the Pennsylvania Bulletin. Air contaminants emitted from these sources are less than the amounts that would trigger major new source review requirements.    20-301-028.  The Department received a plan approval application for installation of a Crematory (incinerator) [150 lbs./hr.] by Tedes Company, Gizzie Memorials, (614 Baldwin Street, Meadville, PA 16335), in Meadville, Crawford County.

   20-313-020.  The Department received a plan approval application for construction of a 3,000 gallon reactor, a 7,500 gallon hold tank and associated pieces of support equipment for manufacturing chemical and allied product NO28 by Lord Corp CPD, Saegertown Plant (P. O. Box 556, South St., Saegertown, PA 16433) in Saegertown Borough, Crawford County.

   24-313-088C.  The Department received a plan approval application for installation of a Carbone direct flame incinerator for Car Kiln No. 2 by Carbone of America (215 Stackpole Street, St. Marys, PA 15857) in Benzinger Twp., Elk County.

   33-318-006.  The Department received a plan approval application for construction of a surface coating operation (20 hrs/day operation painting large truck trailers) by Trail King Industries, Inc.--Ti-Brook Division (P. O. Box 300, Brookville, PA 15825) in Brookville, Jefferson County.

   10-312-014.  The Department received a plan approval application for replacement of an existing flare at the hydrotreater in the plant by Penreco (138 Petrolia St., Karns City, PA 16041) in Fairview Township, Butler County. This source is subject to 40 CFR Part 60, Subpart J--Standards of Performance for Petroleum Refineries.

   24-307-026A.  The Department received a plan approval application for Installation of a Rotary Tempering Furnace (400 powder metal parts/hr.) by Keystone Powdered Metal Company (1935 State Street, St. Marys, PA 15857-1697) in St. Marys, Elk County.

   61-312-026.  The Department received a plan approval application for reconstruction of the wastewater drain system destroyed by fire by Pennzoil Rouseville (2 Main St., Rouseville, PA 16344) in Rouseville, Venango County. This source is subject to 40 CFR Part 60 Subpart OOO--Standards of Performance for VOC Emissions from Petroleum Refinery Wastewater Systems.

   07-308-003C.  On May 13, 1996, the Department issued a Plan Approval to Fry Metals, Inc. (4100 Sixth Avenue, Altoona, PA 16602) for the construction of their refining and cross treatment operations controlled by a post combustion and settling chamber, in series with a MAC environmental 144 MCF 494 fabric filter in the City of Altoona, Blair County. The sources are subject to 40 CFR 60, Subpart L, Standards of Performance for New Stationary Sources, and 40 CFR 63, Subpart X, National Emission Standards for Hazardous Air Pollutants.

   32-306-009B.  On May 13, 1996, a plan approval expiration date was extended to August 31, 1996 for Pennsylvania Electric Company (1001 Broad Street, Johnstown, PA 15907) for a selective noncatalytic reduction system on Boiler No. 15 at its facility located in East Wheatfield Township, Indiana County.

MINING ACTIVITY APPLICATIONS

   Applications under the Surface Mining Conservation and Reclamation Act (52 P. S. §§ 1396.1--1396.19a); the Noncoal Surface Mining Conservation and Reclamation Act (52 P. S. §§ 3301--3326); The Clean Streams Law (35 P. S. §§ 691.1--691.1001); the Coal Refuse Disposal Control Act (52 P. S. §§ 30.51--30.66); The Bituminous Mine Subsidence and Land Conservation Act (52 P. S. §§ 1406.1--1406.21). Mining activity permits issued in response to such applications will also address the applicable permitting requirements of the following statutes: the Air Pollution Control Act (35 P. S. §§ 4001--4015); the Dam Safety and Encroachments Act (32 P. S. §§ 693.1--693.27); and the Solid Waste Management Act (35 P. S. §§ 6018.101--6018.1003).

   The following permit applications to conduct mining activities have been received by the Department of Environmental Protection. A copy of the application is available for inspection at the District mining office indicated above each application. Where a 401 water quality certification is needed for any aspect of a particular proposed mining activity, the submittal of the permit application will serve as the request for such certification.

   Written comments or objections, or requests for informal conferences on applications, may be submitted by any person or any officer or head of any Federal, State or local government agency or authority to the Department at the same address within 30 days of this publication, or within 30 days after the last publication of the applicant's newspaper advertisement, as provided by 25 Pa. Code §§ 77.121--77.123 and 86.31--86.34 (relating to public notices of filing of permit applications, opportunity for comment and informal conferences).

   Where any of the mining activities listed below will have discharges of wastewater to streams the Department will incorporate NPDES permits into the mining activity permits issued in response to these applications. Such NPDES permits will contain, at a minimum, technology-based effluent limitations (as described in the Department's regulations--25 Pa. Code §§ 77.522, 87.102, 88.92, 88.187, 88.242, 89.52 and 90.102) for iron, manganese, suspended solids, settleable solids, alkalinity and pH. In addition to the above, more restrictive effluent limitations, restrictions on discharge volume or restrictions on the extent of mining which may occur will be incorporated into a mining activity permit when necessary for compliance with water quality standards (in accordance with 25 Pa. Code Chs. 93 and 95). Persons or agencies which have requested review of the NPDES permit requirements for a particular mining activity within the above-mentioned public comment period will be provided with a 30-day period to review and submit comments on those requirements.

   Written comments or objections should contain the name, address and telephone number of persons submitting comments or objections, application number and a statement of sufficient detail to inform the Department on the basis of comment or objection and relevant facts upon which it is based. Requests for an informal conference must contain the name, address and telephone number of requestor, application number, a brief summary of the issues to be raised by the requestor at the conference and a statement whether the requestor desires to have the conference conducted in the locality of the proposed mining activities.

   The following permit applications and requests for Environmental Assessment approval and requests for water quality certification have been received by the Department of Environmental Protection.

   In addition to permit applications, the Bureau of Dams, Waterways and Wetlands (BDWW) and the Regional Office Soils and Waterways Sections have assumed primary responsibility for processing requests for certification under section 401 of the Federal Water Pollution Control Act (33 U.S.C.A. § 1341(a)), for projects requiring both a Dam Safety and Encroachments Permit, and a United States Army Corps of Engineers (ACOE) permit. Section 401(a) of the Federal Water Pollution Control Act requires the State to certify that the involved projects will not violate the applicable provisions of 33 U.S.C.A. §§ 1301--1303, 1306 and 1307, as well as relevant State requirements. Initial requests for 401 certification will be published concurrently with the BDWW permit application. Persons objecting to approval of a request for certification under section 401 or to the issuance of a Dam Safety or Encroachment Permit, or the approval of Environmental Assessments must submit any comments, suggestions or objections within 30 days of the date of this notice as well as any questions to the Bureau or Field Office indicated as the responsible office.

To modify and enlarge an existing pond impacting 0.36 acre of wetland and to construct and maintain a 6 inch PVC auxiliary intake pipe from an unnamed tributary to Birch Run (HQ, TSF). The proposed pond expansion is located approximately 800 feet west of the intersection of Hollow Road (T-477) and Birchrun Road (S. R. 1030) (Pottstown, PA Quadrangle N: 0.70 inch; W: 2.90 inches) in West Vincent Township, Chester County.

   E46-742.  Encroachment. Upper Dublin Township, 801 Loch-Alsh Avenue, Ft. Washington, PA 19034. To replace an existing deteriorated box culvert which conveys Rapp Run under Highland Avenue. The proposed structure consists of a 30-foot long precast concrete box culvert with an opening 24-foot wide and 6.5-foot high. This structure will also include four gabion wingwalls 3-foot wide × 3-foot high × 9-foot long which are to be constructed at the upstream and downstream ends of the proposed culvert. A concrete energy dissipater will be installed at the downstream end of the culvert. The site is located approximately 830 feet north from the intersection of Camp Hill Road and Highland Avenue (Ambler, PA Quadrangle N: 2.4 inches; W: 8.7 inches) in Upper Dublin Township, Montgomery County.

To construct and maintain an 18-inch diameter relief sewer interceptor through three wetlands and across Culps Run. The interceptor will run east from Gettysburg High School to Gettysburg Waste Water Treatment Plant and through the National park. Project is located in Gettysburg Borough and Cumberland Township, Adams County (Gettysburg, PA Quadrangle N: 14.25 inches; W: 13.75 inches).

   E05-234.  Encroachment. Snake Spring Township Municipal Authority, R. R. 1, Box 453, Everett, PA 15537. To construct and maintain a treatment facility and a chlorine contact tank within the left banks floodway of an unnamed tributary to Raystown Branch of the Juniata River for the expansion of the existing treatment plant located just east of Hartley Village (Everett West, PA Quadrangle N: 3.3 inches; W: 10.1 inches) in Snake Spring Township, Bedford County.

   E05-235.  Encroachment. Bedford County, P. O. Box 166, Bedford, PA 15522. To rehabilitate and maintain Bedford County covered bridge #15 across Shawnee Branch of the Raystown Branch of the Juniata River on T-443 having a new span of 65.5 feet with a minimum underclearance of 6.53 feet with a minimum underclearance of 6.53 feet located about 0.9 mile southwest of Schellsburg Borough (Schellsburg, PA Quadrangle N: 69.5 inches; W: 4.15 inches) in Napier Township, Bedford County.

   E07-255.  Encroachment. Blair County Commissioners, P. O. Box 539, Hollidaysburg, PA 16648. To remove an existing structure with a single span reinforced concrete box beam bridge having a clear span of 50 feet and an underclearance of 4.73 feet across Clove Creek for a purpose of highway maintenance located on Township Road T-377 about 370 feet west of its intersection with S. R. 2011 (Williamsburg, PA Quadrangle N: 4.3 inches; W: 13 inches) in Huston Township, Blair County.

   E29-070.  Encroachment. Stephanie R. and Donald H. Clevenger, R. R. 1, Box 584, McConnellsburg, PA 17233. To remove an existing bridge and to construct and maintain three 5-foot diameter R. C. pipes in Big Cove Creek to provide continued access to the Clevenger's home located just north of McConnellsburg Borough (McConnellsburg, PA Quadrangle N: 11.98 inches; W: 17.13 inches) in Todd Township, Fulton County.

   E36-605.  Encroachment. Samuel L. Fisher, 5019 E. Newport Rd., Kinzers, PA 17535. To construct and maintain a low-flow stream crossing having 20 L. F. of three 18-inch R. C. pipe culverts with rock paving in Umbles Run for a secondary farm access to be located from the west side of Hershey Church Road (T-778) (New Holland, PA Quadrangle N: 6.5 inches; W: 7 inches) in Salisburg Township, Lancaster County.

   E36-612.  Encroachment. Department of Transportation, 2140 Herr Street, Harrisburg, PA 17103-1699. To remove the existing structure, construct and maintain a R. C. I-beam bridge having two clear spans of 121 feet each on a 75 degree skew with a minimum underclearance of 21.5 feet on S. R. 0300 across the Little Conestoga Creek. To extend a 6-foot × 4-foot R. C. box culvert 295 L. F. (total length 416 L. F.) on S. R. 30 to enclose a tributary. A 72-inch C.M.P. will be removed/plugged and 126 L. F. of R. C. pipe culvert constructed to widen the Fruitville Pike (S. R. 4011) over a tributary (Lancaster, PA Quadrangle N: 12.7 inches; W: 9.5 inches) in Manheim and East Hempfield Townships, Lancaster County.

   E36-614.  Encroachment. Department of Transportation, 2140 Herr St., Harrisburg, PA 17103-1699. To remove the existing structure, construct and maintain a bridge having a clear span of 39 feet on a 60 degree skew with an underclearance of 4.6 feet across Lees Creek on S. R. 1061-001 (Willow Street), Segment 0030 (Terre Hill, PA Quadrangle N: 19.9 inches; W: 8 inches) in Adamstown Borough, Lancaster County.

   E36-615.  Encroachment. Audrey and Bruce F. Shopf, 23 Runway Avenue, New Holland, PA 17557. To widen and enlarge 1,100 L. F. of a drainage swale of a tributary to Mill Creek to increase its conveyance capacity within a proposed residential subdivision located on the north side of Airport Road (T-765), off Ranck Road (New Holland, PA Quadrangle N: 17.8 inches; W: 8.8 inches) in Earl Township, Lancaster County.

   E67-562.  Encroachment. County of York, One West Marketway, Fourth Floor, York, PA 17401. To remove an existing structure and to construct and maintain a reinforced concrete bridge with a single span of 47 feet and an underclearance of 8.4 feet over Fishing Creek for highway improvements. The proposed structure will be located 40 feet upstream of the existing bridge located on Valley Green Road (Steelton, PA Quadrangle N: 6.8 inches; W: 5 inches) in Newberry Township, York County.

   E67-563.  Encroachment. Pillowtex, Inc., 401 Moulstown Road, Hanover, PA 17331. To place fill in 0.46 acre of wetlands for the purpose of expansion of an existing building and parking area located south of Moulstown Road 1,700 feet west of the intersection with Gitts Run Road (Hanover, PA Quadrangle N: 14.3 inches; W: 12.3 inches) in Penn Township, York County. Permittee will be responsible for constructing 0.51 acre of replacement wetlands.

   The following Dam Safety and Encroachment permit applications, requests for Environmental Assessment approval, and requests for water quality certification have been received by the Department of Environmental Protection. Section 401(a) of the Federal Water Pollution Control Act (33 U.S.C.A. § 1341(a)) requires the State to certify that the involved projects will not violate the applicable provisions of 33 U.S.C.A. §§ 1311--1313, 1316 and 1317, as well as relevant State requirements. To remove existing structure and to construct and maintain (2) 36-inch steel culverts across Laurel Run located at a point approximately 0.94 mile east of Elliottsville on T-908 (Brownsfield, PA Quadrangle N: 4.2 inches; W: 5.7 inches) in Wharton Township, Fayette County.

To remove existing structure and to install and maintain a 31.73-foot clear span prestressed concrete adjacent box beam bridge with a minimum underclearance of 8.16 feet on a 52 degree skew across Little Paint Creek (CWF).    E61-203.  Encroachment. Richard Schiffer, P. O. Box 389, Franklin, PA 16323. To install and maintain a 100-foot long by 4-foot diameter stream enclosure in a tributary to French Creek (WWF). This enclosure will have a cast in place concrete inlet and outlet which will connect to two existing concrete enclosures. This enclosure will allow site development for commercial use. The project is located approximatly 1,200 feet north of the intersection of S. R. 0322 and S. R. 0417 in the Village of Rocky Grove, (Franklin, PA Quadrangle N: 6.0 inches; W: 10.75 inches) located in Sugarcreek Borough, Venango County.

The project, known as the S. R. 0080 Westbound Safety Rest Area, is located on westbound S. R. 0080, Section R18, approximately 2.8 miles east of Interchange 42 (Hickory Run, PA Quadrangle N: 14.8 inches; W: 3.6 inches) in Kidder Township, Carbon County (Philadelphia District, Army Corps of Engineers).

   E39-313.  Encroachment. Department of Transportation, 1713 Lehigh Street, Allentown, PA 18103. To remove the existing structure and to construct and maintain a dual 8-span continuous steel girder bridge having a total length of 1,230.0 feet with an underclearance of approximately 56 feet or an alternative design with work consisting of to construct and maintain a dual 9-span prestressed concrete bridge having a total length of 1,201.83 feet with an underclearance of approximately 56 feet across the Lehigh River (TSF) and to construct and maintain approximately 21 feet of 6-foot × 5-foot concrete box culvert to extend an existing arch culvert at Station 226+30 in an unnamed tributary to the Lehigh River. The project, known as the Treichlers Bridge Replacement Project, is located on S. R. 0145, section 01B at its intersection with the Lehigh River (Cementon, PA Quadrangle N: 19.6 inches; W: 5.7 inches) in North Whitehall and Lehigh Township, Lehigh and Northampton County (Philadelphia District, Army Corps of Engineers).

   E40-444.  Encroachment. Bear Creek Village Borough, Box 332, Bear Creek, PA 18602. To construct and maintain a roadway crossing of a tributary to Bear Creek (HQ-CWF) (locally known as Sand Spring Run), consisting of an 8-foot by 4-foot precast concrete box culvert. The purpose of the project is to replace the previous multiculvert crossing, which was washed out during the January 1996 flood event. The crossing is located on East Lake Drive, approximately 300 feet east of the eastern shoreline of Bear Creek Lake (Wilkes-Barre, PA Quadrangle N: 11.0 inches; W: 0.1 inch) in Bear Creek Village Borough, Luzerne County (Philadelphia District, Army Corps of Engineers).

   E40-445.  Encroachment. Craig M. and Carol M. Buckey, P. O. Box 159, Mountaintop, PA 18707-0159. To construct and maintain a road crossing of Bow Creek (CWF), consisting of either a single-span bridge having a span of approximately 37.5 feet and an underclearance of approximately 5 feet, or a 13.8-foot by 9.9-foot corrugated steel pipe-arch culvert, for the purpose of providing access to a proposed single-family residence. The project is located at 272--278 South Main Road (S. R. 2045), approximately 165 feet south of the intersection of S. R. 2045 and S. R. 2042 (Nuangola Road) (Wilkes-Barre West, PA Quadrangle N: 3.6 inches; W: 4.4 inches) in Wright Township, Luzerne County (Baltimore District, Army Corps of Engineers).

   E45-297.  Encroachment. Michael and Thomas McKeown, 956 North Ninth Street, Stroudsburg, PA 18360. To construct and maintain a private pedestrian bridge having a single span of 60.0 feet and an underclearance of approximately 18.0 feet across the Lehigh River (HQ-CWF). The project is located on the south side of S. R. 2013, approximately 0.5 mile upstream from S. R. 4003 (Locust Ridge Road) (Thornhurst, PA Quadrangle N: 9.4 inches; W: 11.1 inches) in Coolbaugh Township, Monroe County (Philadelphia District, Army Corps of Engineers).

   E48-234.  Encroachment. Katherine L. Nichols, 304 Kromer Road, Wind Gap, PA 18091. To enlarge the reservoir surface area of a nonjurisdictional dam to approximately 0.65 acre by reshaping, extending and raising the earth embankment. The project is located on the south side of T615 (Kromer Road), approximately 0.2 mile west of its intersection with S. R. 1001 (Wind Gap, PA Quadrangle N: 12.8 inches; W: 8.4 inches) in Bushkill Township, Northampton County (Philadephia District, Army Corps of Engineers).

   E52-142.  Encroachment. Department of Transportation, Engineering District 4-0, P. O. Box 111, Scranton, PA 18501. To maintain a roadway crossing of Billings Creek (HQ-CWF), consisting of three side-by-side 71-inch × 47-inch elliptical corrugated metal pipes, located on S. R. 4004, Segment 0210, Offset 2200. The crossing was constructed under an Emergency Permit, which also authorized removal of the former flood-damaged crossing at this location. The crossing is located approximately 0.2 mile west of the intersection of S. R. 0739 and S. R. 4004 (Pecks Pond, PA Quadrangle N: 21.2 inches; W: 9.2 inches) in Blooming Grove Township, Pike County (Philadelphia District, Army Corps of Engineers).

   E54-222.  Encroachment. Borough of Shenandoah, 15 West Washington Street, Shenandoah, PA 17976. To modify and maintain the existing structure in Kehly Run (CWF) with work consisting of the following: to construct and maintain approximately 81 linear feet of 9.0 foot × 4.0 foot concrete box culvert sleeved within the existing stream enclosure having a varying width of approximately 9 feet, 7 inches to 12 feet, 5 inches and height of approximately 2 feet, 6 inches to 5 feet; to remove the existing deteriorated roof slab and to construct and maintain approximately 35 linear feet of concrete roof slab on the existing stream enclosure from station 0+05 to station 0+40; to remove the existing deteriorated roof slab and to construct and maintain approximately 60 linear feet of concrete cap and associated chain link fence on top of the existing stone masonry walls, on either side of the stream from station 2+25 to station 2+85. The project is located approximately 0.04 mile south east of the intersection of Center Street and Bridge Street (Shenandoah, PA Quadrangle N: 13.0 inches; W: 9.5 inches) in Shenandoah Borough, Schuylkill County (Baltimore District, Army Corps of Engineers).

   E58-212.  Encroachment. Department of Transportation, Engineering District 4-0, P. O. Box 111, Scranton, PA 18501. To place fill in 0.33 acre of PEM and POWZx wetlands, to widen the Interstate 81 Bridge carrying the southbound lanes across Trowbridge Creek (CWF) and to place fill in the floodway of Trowbridge Creek for construction of a proposed welcome center. This project is located between S. R. 0011 and I-81 along the north side of Trowbridge Creek (Great Bend, PA Quadrangle N: 19.8 inches; W: 16.9 inches) in Great Bend Township, Susquehanna County (Baltimore District, Army Corps of Engineers).

   E64-168.  Encroachment. Ariel Land Owners, Inc., 513 W. 15th Street, Honesdale, PA 18431. To remove the existing concrete slab bridge and to construct and maintain a road crossing consisting of two 66-inch × 51-inch CMP arch culverts in Ariel Creek (HQ-CWF). The project is located on Schlager Road, in the Lake Ariel Development, approximately 150 feet downstream of Lake Ariel Dam and 0.25 mile northwest of the intersection of S. R. 3025 and S. R. 3011 (Lakeville, PA Quadrangle N: 12.0 inches; W: 16.3 inches), in Lake Township, Wayne County (Philadelphia District, Army Corps of Engineers).

   E66-107.  Encroachment. Paul and Lynda Jenceleski, 52 Armstrong Street, Edwardsville, PA 18704. To construct and maintain a steel I-beam bridge with wood decking across Leonard Creek (HQ-CWF) having a single-span of approximately 38.0 feet and an underclearance of approximately 4.0 feet to provide access to a private residential building site. The project is located on the east side of S. R. 309, approximately 500 feet southeast of the intersection of S. R. 309 and S. R. 29 (Noxen, PA Quadrangle N: 10.8 inches; W: 2.3 inches) in Monroe Township, Wyoming County (Baltimore District, Army Corps of Engineers).
