Reasonably Available Control Technology; Public Hearings

   Approval of Reasonably Available Control Technology (RACT) Plans for:

   Occidental Chemical Corporation (Lower Pottsgrove Township, Montgomery County)

   Quaker Chemical Corporation (Whitemarsh Township, Montgomery County)

   SmithKline Beecham Pharmaceuticals (Upper Merion Township, Montgomery County)

   American Inks and Coatings Corporation (Schuylkill Township, Chester County)

   Norwood Industries, Inc. (East Whiteland Township, Chester County)

   Brown Printing Company (Upper Hanover Township, Montgomery County)

   DEP has made a preliminary determination to approve RACT plans as amendments to the State Implementation Plan (SIP) for the above facilities. The proposed SIP revisions do not adopt any new regulations. They incorporate the provisions and requirements contained in RACT approvals for these facilities to comply with current regulations.

   These preliminary determinations, if finally approved, will be incorporated into Plan Approvals and/or Operating Permits for the facilities and will be submitted to the U. S. Environmental Protection Agency (EPA) as revisions to Pennsylvania's SIP.

   One public hearing will be held for the purpose of receiving comments on the proposed SIP revisions. The hearing will be held at 2 p.m. on August 29, 1996, at the Department of Environmental Protection Southeast Regional Office, Lee Park, 555 North Lane, Suite 6010, Conshohocken, PA. The hearing will represent the opportunity for oral comment to DEP on the proposed SIP revisions and will not be a question and answer session. Persons wishing to present testimony at the hearing are encouraged to contact Clarke Rupert, DEP Community Relations Coordinator, at (610) 832-6020 to register prior to the hearing, but may also register at the hearing. Notice of Intent to Issue Title V Operating Permit #03-076

   Under 25 Pa. Code § 127.521, the Department of Environmental Protection (DEP) intends to issue a Title V Operating Permit to The Peoples Natural Gas Coompany for the Girty compressor station. Girty compressor station is located in South Bend Township, Armstrong County. The Peoples Natural Gas Company representative to contact regarding this application is William Runyan, P.E., Safety, Environmental and Compliance, 625 Liberty Avenue, Pittsburgh, PA 15222-3197.

   The Girty compressor station is primarily used for the storage and distribution of natural gas. As a result of the levels of nitrogen oxides emitted, Girty is a major stationary source as defined in Title I, Part D of the Clean Air Act Amendments. The facility is therefore subject to the Title V permitting requirements adopted in 25 Pa. Code, Chapter 127, Subchapter G.

   Copies of the application, DEP's analysis and other documents used in evaluation of the application are available for public inspection during normal business hours at the Department of Environmental Protection, 400 Waterfront Drive, Pittsburgh, PA 15222.

   Any person wishing to provide the Department of Environmental Protection with additional information which they believe should be considered prior to the issuance of this permit may submit the information to the Department of Environmental Protection at the address shown above. A 30-day comment period, from the date of this publication, will exist for the submission of comments. Each written comment must contain the following:

   *  Name, address and telephone number of the person submitting the comments.

   *  Identification of the proposed permit (specify permit #03-076).

   *  Concise statements regarding the relevancy of the information or objections to issuance of the permit. A public hearing may be held, if the Department of Environmental Protection, in its discretion, decides that such a hearing is warranted based on the information received. All persons submitting comments or requesting a hearing will be notified of the decision to hold a hearing by publication in the newspaper or by the Pennsylvania Bulletin, or by telephone, where the Department of Environmental Protection determines such notification by telephone is sufficient. Notice of Plan Approval Application Minor Source

   The following stationary sources have filed a request for a plan approval with the Department of Environmental Protection (DEP), Bureau of Air Quality. Persons wishing to file protests or comments on the proposed plan approval have 30 days to submit the protests or comments to the Regional Office at the address listed below. Interested persons may also request that a hearing be held concerning the plan approval application by filing a request with the Regional Office stating the reason for the request.

   The Department will evaluate and consider all protests and comments received. The Department will, where appropriate, modify the proposed plan approval based on the protests and comments received.

   The final plan approval will contain terms and conditions to ensure that the source is constructed and operated in compliance with the Department's regulations contained in 25 Pa. Code Chapters 121 through 143 and the requirements of the Federal Clean Air Act. A notice of the Department's final decision on the proposed plan approval will be published in the Pennsylvania Bulletin. Air contaminants emitted from these sources are less than the amounts that would trigger major new source review requirements. MINING ACTIVITY APPLICATIONS

   Applications under the Surface Mining Conservation and Reclamation Act (52 P. S. §§ 1396.1--1396.19a); the Noncoal Surface Mining Conservation and Reclamation Act (52 P. S. §§ 3301--3326); The Clean Streams Law (35 P. S. §§ 691.1--691.1001); the Coal Refuse Disposal Control Act (52 P. S. §§ 30.51--30.66); The Bituminous Mine Subsidence and Land Conservation Act (52 P. S. §§ 1406.1--1406.21). Mining activity permits issued in response to such applications will also address the applicable permitting requirements of the following statutes: the Air Pollution Control Act (35 P. S. §§ 4001--4015); the Dam Safety and Encroachments Act (32 P. S. §§ 693.1--693.27); and the Solid Waste Management Act (35 P. S. §§ 6018.101--6018.1003).

   The following permit applications to conduct mining activities have been received by the Department of Environmental Protection. A copy of the application is available for inspection at the District mining office indicated above each application. Where a 401 water quality certification is needed for any aspect of a particular proposed mining activity, the submittal of the permit application will serve as the request for such certification.

   Written comments or objections, or requests for informal conferences on applications, may be submitted by any person or any officer or head of any Federal, State or local government agency or authority to the Department at the same address within 30 days of this publication, or within 30 days after the last publication of the applicant's newspaper advertisement, as provided by 25 Pa. Code §§ 77.121--77.123 and 86.31--86.34 (relating to public notices of filing of permit applications, opportunity for comment and informal conferences).

   Where any of the mining activities listed below will have discharges of wastewater to streams, the Department will incorporate NPDES permits into the mining activity permits issued in response to these applications. Such NPDES permits will contain, at a minimum, technology-based effluent limitations (as described in the Department's regulations--25 Pa. Code §§ 77.522, 87.102, 88.92, 88.187, 88.242, 89.52 and 90.102) for iron, manganese, suspended solids, settleable solids, alkalinity and pH. In addition to the above, more restrictive effluent limitations, restrictions on discharge volume or restrictions on the extent of mining which may occur will be incorporated into a mining activity permit when necessary for compliance with water quality standards (in accordance with 25 Pa. Code Chs. 93 and 95). Persons or agencies which have requested review of the NPDES permit requirements for a particular mining activity within the above-mentioned public comment period will be provided with a 30-day period to review and submit comments on those requirements.

   Written comments or objections should contain the name, address and telephone number of persons submitting comments or objections, application number and a statement of sufficient detail to inform the Department on the basis of comment or objection and relevant facts upon which it is based. Requests for an informal conference must contain the name, address and telephone number of requestor, application number, a brief summary of the issues to be raised by the requestor at the conference and a statement whether the requestor desires to have the conference conducted in the locality of the proposed mining activities.

Remove the existing structure and to construct and maintain a single span bridge with a clear normal span of 34.0 feet and minimum underclearance of 5.4 feet over Pine Creek on Pine Creek Road at the second crossing of Pine Creek off of T-515. This project will be a de minimus impact (.02 acre) to existing wetlands (Woodward, PA Quadrangle N: 10.4 inches; W: 11.5 inches) in Haines Township, Centre County. Estimated stream disturbance less than 250.0 lineal feet; stream classification is HQ-CWF.

   E19-156.  Water obstruction and encroachment. Dept. of Transportation, 715 Jordan Ave., Montoursville, PA 17754. Repair the existing structure by paving aprons, cutoff walls, concrete jacket applications and general patching of the abutments over an unnamed tributary to Coles Creek on SR 487 about 1 mile northeast of the village of Tri Mills (Red Rock, PA Quadrangle N: 3.8 inches; W: 11.9 inches) in Sugarloaf Township, Columbia County. Estimated stream disturbance less than 250.0 linear feet; stream classification is CWF.

   E41-373.  Water obstruction and encroachment. CBBH, R. R. 1, Box 169A, Allenwood, PA 17810. To remove the existing structure and to construct and maintain a steel beam bridge with a single span of 42 feet and underclearance of 6.9 feet across White Deer Hole Creek. This project is located just north of SR 2002 about 3.2 miles west of Rt. 44 (Williamsport SE, PA Quadrangle N: 21.1 inches; W: 10.6 inches) in Washington Township, Lycoming County. Estimated steam disturbance is 40 feet with no wetland impact; stream classification is HQ-CWF.

   E41-377.  Water obstruction and encroachment. Alan and Elizabeth Metzger, R. R. 1, Box 379, Williamsport, PA 17701. To remove the existing structure and to construct and maintain a 6 foot diameter pipe culvert in Lick Run. The project is located off LR 41133 about 900 feet north of the intersection with Warrensville Road (Montoursville North, PA Quadrangle N: 8.29 inches; W: 9.09 inches) in Eldred Township, Lycoming County. Estimated stream disturbance 40 feet of stream with no wetland impact; stream classification is TSF.

   E49-201.  Water obstruction and encroachment. Municipal Authority of Sunbury, 225 Market St., Sunbury, PA 17801. To maintain an existing levee and concrete wall flood protection project along the Susquehanna River and Shamokin Creek (Sunbury, PA Quadrangle N: 20.5 inches; W: 6.5 inches) in the City of Sunbury, Northumberland County. Stream classification is WWF.

   E57-070.  Water obstruction and encroachment. Dept. of Transportation, 715 Jordan Ave., Montoursville, PA 17754. Repair and maintain the existing bridge by repairing eroded abutments, wings, deck and foundations and paving a section of the stream bed slab over Double Run on SR 154 just southeast of Double Run Road (Eagles Mere, PA Quadrangle N: 16.6 inches; W: 10.8 inches) in Forks Township, Sullivan County. Estimated stream disturbance less than 250.0 linear feet; stream classification is CWF.

   E59-323.  Water obstruction and encroachment. Monroe Muffler Brake, 200 Holleder Pkwy., Rochester, NY 14615. To place and maintain fill in the floodway of an unnamed tributary to the Tioga River. This project is located on Business Route 15 about 800 feet south of its intersection with SR 2027 (Mansfield, PA Quadrangle N: 5.4 inches; W: 9.4 inches) in Richmond Township, Tioga County. Estimated stream disturbance approximately 200 feet and 0.1 acre of wetlands; stream classification is CWF.

To place and maintain fill in 0.7 acre of a pond/wetland (PEM) complex in the Bally Gwynedd Subdivision located approximately 1,600 feet southwest of the intersection of Stump Road and PA Route 309 (Amber, PA Quadrangle N: 17.5 inches; W: 15.7 inches) in Montgomery Township, Montgomery County.

   E10-238.  Encroachment. Spang and Company, 100 Brugh Avenue, Box 751, Butler, PA 16003-0751. To enclose 480 linear feet of stream enclosure of a tributary of Bonnie Brook Creek (WWF) with a 14-foot wide by 6-foot high arched top concrete box culvert to allow for the expansion of an existing industrial facility. The project is located directly southwest of Grant Avenue (SR1011) approximately 800 feet east of the intersection of Grant Avenue (SR1011) and SR2004, (East Butler, PA Quadrangle N: 0.2 inch; W: 13.1 inches) in East Butler Borough, Butler County.

   E10-242.  Encroachment. Butler County Commissioners, P. O. Box 1208, Butler, PA 16003-1208. To remove existing bridge superstructure and to install and maintain new structural steel girders, reinforced concrete deck and steel guide rails on Heck Bridge (County Bridge No. 68) across Bonnie Brook Creek (WWF). The project is located across Bonnie Brook Creek on Fallecker Road (T-620) approximately 500 feet northwest of the intersection of Fallecker Road (T-620) and Welter Road (T-601), East Butler (PA Quadrangle N: 3.9 inches; W: 6.3 inches) in Oakland Township, Butler County.

   E16-095.  Encroachment. Dept. of Transportation, Engineering District 10-0, P. O. Box 429, Route 286 South, Indiana, PA 15701. To remove the existing two span through truss bridge with two 135.5-foot clear spans and to construct and maintain a three span steel girder bridge with two 90.75-foot clear spans for the end spans and a 125.5-foot clear span for the center section with a minimum underclearance of 25.4 feet on a 90 degree skew across the Clarion River (CWFR). This project will also include construction of temporary causeways and cofferdams for pier removal and pier construction. To remove an existing 36-inch corrugated metal pipe culvert and associated headwalls and to install and maintain a 64-inch wide by 43-inch high oblong corrugated metal pipe culvert and associated headwalls in Brown Run (CWF). The Municipal Authority of the Township of North Sewickley, Beaver County, has submitted an application to acquire initial water rights for the acquisition of water from the Beaver River. The applicant is requesting permission to withdraw a maximum of 700,000 gallons per day of water as a daily peak, from the Beaver River, in North Sewickley Township, Beaver County, PA.
