   The following parties have applied for an NPDES permit to discharge stormwater from a proposed construction activity into the surface waters of the Commonwealth. Unless otherwise indicated on the basis of preliminary review and application of lawful standards and regulations, the Department of Environmental Protection proposes to issue a permit to discharge, subject to certain limitations set forth in the permit and special conditions. These proposed determinations are tentative. Limitations are provided in the permit as erosion and sedimentation control measures and facilities which restrict the rate and quantity of sediment discharged.

   Where indicated, the EPA, Region III, Regional Administrator has waived the right to review or object to this proposed permit action under the waiver provision 40 CFR 123.24(d).

   Persons wishing to comment on the proposed permit are invited to submit a statement to the Regional Office or County Conservation District Office indicated as the responsible office, within 30 days from the date of this public notice. A copy of the written comments should be sent to the County Conservation District Office. Comments reviewed within this 30-day period will be considered in the formulation of the final determinations regarding this application. Responses should include the name, address and telephone number of the writer and a concise statement to inform the Regional Office of the exact basis of a comment and the relevant facts upon which it is based. A public hearing may be held if the Regional Office considers the public response significant.

   Following the 30-day comment period, the Water Program Manager will make a final determination regarding the proposed permit. Notice of this determination will be published in the Pennsylvania Bulletin at which time this determination may be appealable to the Environmental Hearing Board.

   The application and related documents, including the erosion and sedimentation control plan for the construction activity, are on file and may be inspected at the County Conservation District Office or the Department Regional Office indicated above the application.

   Persons objecting on the grounds of public or private interest to the approval of an application or submitted plan may file a written protest with the Department of Environmental Protection at the address indicated above each permit application or plan. Each written protest should contain the following: name, address and telephone number, identification of the plan or application to which the protest is addressed and a concise statement in sufficient detail to inform the Department of the exact basis of the protest and the relevant facts upon which it is based. The Department may conduct a fact-finding hearing or an informal conference in response to any given protest or protests. Each commenter will be notified in writing of the time and place if a hearing or conference concerning the plan or action or application to which the protest relates is held. To insure consideration by the Department prior to final action on permit applications and proposed plans, initial protests and additions or amendments to protests already filed should be filed within 15 calendar days from the date of this issue of the Pennsylvania Bulletin.    A.  1096501.  Public water supply. The Municipal Authority of the Borough of Greenville, 44 Clinton Street, P. O. Box 638, Greenville, PA 16125. This proposal involves the extension of water service to the St. Paul's Nursing Home. In exchange for this extension, St. Paul's Nursing Home will give to the Authority the two 100,000 gallon water storage tanks currently owned by St. Paul's Nursing Home. To utilize these tanks, the Authority must install a water booster pumping station and create a separate pressure zone for this area in Greenville Borough, Mercer County.

Acknowledgment of Notices of Intent to Remediate

   Sections 302 and 303 of the Land Recycling and Environmental Remediation Standards Act (the Act) require the Department of Environmental Protection to publish in the Pennsylvania Bulletin an acknowledgment noting receipt of any Notices of Intent to Remediate. An acknowledgment of the receipt of a Notice of Intent to Remediate identifies a site where a person proposes to, or has been required to, respond to a release of a regulated substance at a site. Persons intending to use the background or Statewide health standard to remediate a site must file a Notice of Intent to Remediate with the Department. A Notice of Intent to Remediate filed with the Department must provide a brief description of the location of the site, a list of known contaminants at the site, the proposed remediation measures for the site, and a description of the intended future use of the site. A person who demonstrates attainment of one or a combination of the cleanup standards identified under the Act will be relieved of further liability for the remediation of the site for any contamination identified in reports submitted to and approved by the Department and shall not be subject to citizen suits or other contribution actions brought by responsible persons not participating in the remediation.

   Graner Property Remediation Site, Lowhill Township, Lehigh County. Douglas Sammak, Project Director with American Resource Consultants, Inc., P. O. Box 2227, Doylestown has submitted a Notice of Intent to Remediate (on behalf of Riding Brook, Inc.) site soils contaminated with lead. The applicant proposes to remediate the site to meet the Statewide health standard. Notice of Administrative Record Reopening Under the Pennsylvania Hazardous Sites Cleanup Act

   Under sections 506(g) and (h) of the Pennsylvania Hazardous Sites Cleanup Act (HSCA) (35 P. S. §§ 6020.506(g) and (h)) the Department of Environmental Protection (Department) hereby reopens the administrative record for the prompt interim response it conducted June, 1994 through January, 1995 at the Ingram-Richardson Manufacturing Facility (Ing-Rich) site in Beaver Falls, PA.

   Under 35 P. S. § 6020.506, the Department originally published the administrative record on July 30, 1994, in order to provide the public the opportunity to comment on the action it took during the prompt interim response to investigate site conditions and to remove hazardous substances that were disposed of at the site. The Department closed the administrative record on December 6, 1994.

   The Department is now reopening the administrative record so that it can include in the record:

   (a)  consistent with 35 P. S. § 6020.506(g)(1), additional information the Department obtained during the implementation of the response action and believes to be of central relevance to the selected action; and

   (b)  consistent with 35 P. S. § 6020.506(g)(3), documentation of its response costs.

   The reopened administrative record containing this new information is now available for public review and comment. The record can be examined from 8 a.m. to 4 p.m. during business hours at the Department's offices at 400 Waterfront Drive, Pittsburgh, PA. Individuals interested in examining the reopened administrative record should arrange for an appointment with Ed Duval or other personnel in the Department's Regional Files Office at (412) 442-4000.

   The reopened administrative record will be available for public review and comment for a 60 day period beginning the date of this notice through April 26, 1996. Persons may submit written comments on the reopened administrative record to Jeffrey J. Upon their receipt, all public comments will be included in the administrative record.

   Upon request, the Department will conduct a public hearing so that persons may present oral comments on the reopened administrative record for inclusion in the record. A request for a public hearing must be made in writing and must be postmarked no later than 30 days after the publication of this notice, or by March 26, 1996. Notice of Settlement Under the Hazardous Sites Cleanup Act

   The Department of Environmental Protection (Department) under the Authority of the Hazardous Sites Cleanup Act (HSCA) (35 P. S. §§ 6020.101--6020.1305), has entered into a settlement regarding the Department's costs incurred for response activities at the Giordano Waste Materials (Giordano) site. This settlement is entered into under section 1102 of HSCA (35 P. S. § 6020.1102). The settlement involves a Consent Order and Agreement (COA) between the Department and Consolidated Rail Corporation (Conrail), a party potentially responsible for the hazardous substances which the Department removed from the Giordano site.

   The Giordano site is an approximately 7-acre parcel of land in Butler Township, Schuylkill County. The site includes a right-of-way owned by Conrail. The right-of-way is located on the western side of the site. The surrounding area is predominantly rural, although some residential areas and a school are located nearby. Investigations revealed the presence of lead contaminated battery casings and lead contaminated smelter ash at the site. The releases and threatened releases from the battery casings posed a substantial danger to public health and safety and the environment. The Department deemed it appropriate to implement an interim response to address threats to the public health and safety and the environment posed by the battery casings at the site. The Department, under the authority of HSCA, implemented an interim response which included the removal of lead contaminated battery casings from the site. The interim response was completed on April 27, 1990.

   Through the implementation of the interim response, the Department incurred costs at the site. The Department may conduct an additional response action to address contamination remaining on site. On February 5, 1996, a COA was executed between the Department and Conrail. Under the terms of this agreement, Conrail is required to make a payment of $60,000 to reimburse the Department for past and future costs at the Giordano site.

   This notice is provided under section 1113 of HSCA (35 P. S. § 6020.1113). This section also provides that the settlements will become final upon the filing of the Department's response to significant written comments. The COA that contains the specific terms of the settlement is available for public review and comment. The COA can be examined from 8 a.m. to 4 p.m. at the Department's office at 2 Public Square, Wilkes-Barre, PA 18711, by contacting Joseph Iannuzzo at (717) 826-2511 or through the PA AT&T Relay Service at 1 (800) 654-5984 (TDD). A public comment period on the COA will extend for 60 days from today's date.    24-328-002.  The Department intends to issue an air quality operating permit to CNG Transmission Corporation (P. O. Box 2450, Clarksburg, WV 26302) for the operation of a low NOx combuster in Benzette Township, Elk County. This source is subject to Federal New Source Performance Standards 40 CFR Part 6, Subpart GG.

   33-329-003.  The Department intends to issue an air quality operating permit to CNG Transmission Corporation (P. O. Box 2450, Clarksburg, WV 26302) for the operation of an internal combustion engine in Gaskill Township, Jefferson County.

   42-399-029.  The Department intends to issue an air quality operating permit to McKean County Solid Waste Authority (P. O. Box 448, Mt. Jewett, PA 16740) for the operation of two leachate tanks and an aerobic unit in Sergeant Township, McKean County.

   13-301-012A.  The Department intends to issue an air quality plan approval modification to Campton Funeral Home Inc. (525 Delaware Ave., Palmerton, PA 18071) for a crematory located in Palmerton Borough, Carbon County. The modification consists of a change of address for the location of the source from 525 Delaware Avenue to 517--519 (Rear) Delaware Avenue and for a change in the opacity limit to conform to the Department's minimum permitting criteria for crematory incinerators.

   This is a correction to two publications in the Pennsylvania Bulletin: 25 Pa.B. 4159 (September 30, 1995) and 25 Pa.B. 5648 (December 9, 1995).


Reasonably Available Control Technology; Public Hearings

   The Department of Environmental Protection proposes to approve an amendment to the Pennsylvania State Implementation Plan (SIP) for the operation of a municipal waste resource recovery incinerator (MWI) facility owned by Montenay Montgomery Limited Partnership, located at 1155 Conshohocken Road, Plymouth Township, Montgomery County, PA 19425 (a/k/a Dravo and Montenay), in compliance with 25 Pa. Code §§ 129.91--129.95 as a Reasonably Available Control Technology (RACT) determination for nitrogen oxides (NOx) and volatile organic compound (VOC) emissions from the facility.

   The proposed revision to the SIP does not adopt any new State of Pennsylvania regulations. The requirements of the proposed revision to the SIP will be contained in the proposed Plan Approval PA-46-0010. The proposed revision, if approved, will be submitted to the United States Environmental Protection Agency as a revision to the PA SIP with an oxides of nitrogen emission limit of 0.383 LB/MM Btu and volatile organic compound emission limit of less than 25 tons/year.

   The proposed Plan Approval PA-46-0010 will change the emission limits and operating parameters for Montenay and are different from those previously indicated in Operating Permit 46-340-0002 issued on May 9, 1994. It will also allow the burning of municipal-like residual waste as referenced in Waste Management permit application no. 400558.

   The changes in proposed Plan Approval PA-46-0010 compared to Operating Permit 46-340-0002 will include: 1) revisions to facility emission limits for--a. toxic metals, b. nitrogen oxides, c. volatile organic compounds; 2) revised operating requirements to permit this acceptance of municipal-like residual waste acceptance criteria.

   One public hearing will be held for the purpose of receiving comments on the proposal. The hearing will be held at 7 to 9 p.m. on March 18, 1996, at the Plymouth Township Municipal Building, located at 700 Belvior Road, Norristown, PA 19428. Persons interested in commenting on the proposed SIP revision should notify John Gerdelmann, Community Relations Coordinator, at (610) 832-6228, that they want to make a presentation at the public hearing. Notice of Plan Approval Application Minor Source

   The following stationary sources have filed a request for a plan approval with the Department of Environmental Protection (Department), Bureau of Air Quality. Persons wishing to file protests or comments on the proposed plan approval have 30 days to submit the protests or comments to the Regional Office at the address listed below. Interested persons may also request that a hearing be held concerning the plan approval application by filing a request with the Regional Office stating the reason for the request.

   The Department will evaluate and consider all protests and comments received. The Department will, where appropriate, modify the proposed plan approval based on the protests and comments received.

   The final plan approval will contain terms and conditions to ensure that the source is constructed and operated in compliance with the Department's regulations contained in 25 Pa. Code Chapters 121 through 143 and the requirements of the Federal Clean Air Act. A notice of the Department's final decision on the proposed plan approval will be published in the Pennsylvania Bulletin. Air contaminants emitted from these sources are less than the amounts that would trigger major new source review requirements. This source is subject to Federal New Source Performance Standard 40 CFR Part 60, Subpart Dc.

   43-318-030. The Department received a plan approval application from Spang & Company, Power Control Division (5241 Lake Street, Sandy Lake, PA 16145) for the construction of a surface coating operation (dip tank and drying oven @ 500 cycles/yr, 16 gals varnish/cycle) located in Stoneboro, Mercer County.
