Requirements of an Arbitration Provision in Private Passenger Uninsured and Underinsured Motorist Coverage; Doc. No. DO97-07-001

   On June 30, 1997, The Insurance Federation of Pennsylvania, Inc. filed a Petition for Declaratory Order seeking a determination by the Insurance Commissioner of Pennsylvania ''that the Insurance Department does not have the authority under existing statutes and regulations to require private passenger auto policies to include an arbitration provision covering uninsured and underinsured motorist disputes.''

   And Now, this 5th day of August, 1997, upon consideration of the Petition for Declaratory Order and the Answer thereto of the Insurance Department, Notice is hereby given under 1 Pa. Code § 35.30 that interested persons desiring to participate shall submit a Petition to Intervene, under 1 Pa. Code §§ 35.27--35.32, on or before September 5, 1997.

   Petitions to Intervene shall be filed with the Docket Clerk of the Administrative Hearing Office, Insurance Department, Capitol Associates Building Room 200, 901 North Seventh Street, Harrisburg, PA 17102.

   Interested persons are reminded of the need to serve all parties with any document which is filed with the Administrative Hearing Office. Copies of pertinent docket material relating to this case may be obtained from F. Karen Bernhard, Acting Assistant Docket Clerk at the above address, (717) 783-2126.
