APPLICATIONS RECEIVED UNDER SECTION 401:  FEDERAL WATER POLLUTION CONTROL ACT

ENCROACHMENTS

   The following Dam Safety and Encroachment permit applications, requests for Environmental Assessment approval and requests for water quality certification have been received by the Department of Environmental Protection (Department). Section 401(a) of the Federal Water Pollution Control Act (33 U.S.C.A. § 1341(a)) requires the State to certify that the involved projects will not violate the applicable provisions of 33 U.S.C.A. §§ 1311--1313, 1316 and 1317, as well as relevant State requirements. Initial requests for 401 certification will be published concurrently with the permit application. Persons objecting to approval of a request for certification under section 401 or to the issuance of a Dam Safety or Encroachment Permit or the approval of Environmental Assessments must submit comments, suggestions or objections within 30 days of the date of this notice as well as any questions to the office noted above the application.

   E09-764. Encroachment. Borough of Quakertown, 15-35 North Second Street, P. O. Box 727, Quakertown, PA 18951. To place fill material in 0.37 acre of wetlands (PFO) associated with the proposed expansion of the existing Quakertown Borough Wastewater Treatment Plant. The project is located along the south side of Erie Road at a point approximately 2,000 feet north from the intersection of Doylestown Pike (SR 0309) and Nick Luca Drive (Quakertown, PA Quadrangle N:  12.4 inches; W:  10.1 inches) in Richland Township, Bucks County.

   E46-796. Encroachment. Abington Township, 1176 Old York Rd. Abington, PA 19001. To excavate and maintain fill within the assumed 100-year floodway of an unnamed tributary to Sandy Run (TSF) and to relocate approximately 100 feet of this stream through a proposed stormwater management facility. This application is also a request for an Environmental Assessment approval for two onstream nonjurisdictional dams to be constructed as stormwater management facilities. This site is located approximately 300 feet east of the intersection of Jackson Avenue and Spear Avenue and is associated with the Susquehanna Woods Stormwater Management Control Project (Germantown USGS Quadrangle N:  21.9 inches, W:  3.3 inches) in Abington Township, Montgomery County.

   E46-797. Encroachment. SEPTA, 1234 Market St, 12th Floor, Philadelphia, PA 19107-3780. To replace the existing superstructure of Bridge 5.74 of the Warminster Regional Rail Line and place and maintain R-6 rock as scour protection around the ten bridge piers and two abutments. The work also consists of the construction of a temporary road crossing for construction access to the site. Bridge 5.74 spans Pennypack Creek and an unnamed tributary to Pennypack Creek near the rail lines intersection with Warminster Road (Hatboro, PA Quadrangle N:  7.3 inches; W:  14.8 inches) in Hatboro Borough and Upper Moreland Township, Montgomery County.

   E09-765. Encroachment. AT&T Corporation.Promenade Annex PA 189, 1200 Peachtree Street, NE, Atlanta, GA 30309. To install and maintain a fiber optic utility line across the following streams and wetlands:  1.  Unnamed tributary to Tinicum Creek (EV-CWF) (Lumberville, PA-NJ USGS Quadrangle N:  21.1 inches, W:  11.7 inches) and adjacent wetland; 2.  Unnamed tributary to Tinicum Creek (EV-CWF) (Bedminster, PA USGS Quadrangle N:  17.4 inches, W:  0.15 inch) and adjacent wetland; 3.  Tinicum Creek (EV-CWF, SR) (Bedminster, PA USGS Quadrangle N:  16.9 inches, W:  1.0 inch) and adjacent wetland; 4.  Tohickon Creek (CWF, SR) (Bedminster, PA USGS Quadrangle N:  15.5 inches, W:  5.1 inches) and adjacent wetland; 5.  Unnamed Tributary to Tohickon Creek (TSF) (Quakertown, PA USGS Quadrangle N:  7.8 inches, W:  7.9 inches) and adjacent wetland; 6.  Morgan Creek (TSF) (Quakertown, PA USGS Quadrangle N:  7.2 inches, W:  12.3 inches) and adjacent wetland; 7.  Beaver Run (EV-TSF) and an unnamed tributary to Beaver Run (EV-TSF) (Quakertown, PA USGS Quadrangle N:  9.6 inches, W:  15.7 inches) and adjacent wetland; 8.  A wetland crossing along an unnamed tributary to Beaver Run (EV-TSF) (Quakertown, PA USGS Quadrangle N:  12.1 inches; W:  15.9 inches). This project is a segment of the AT&T Fiber Optic Cable Installation Project which extends from Cherryville, NJ to Lanark, PA. Wetland disturbance will be minimized by either directional boring or utilizing existing conduits. This is a linear utility project which affects Tinicum Township, Bedminster Township, Richland Township and Quakertown Borough in Bucks County.

   E46-799. Encroachment. East Norriton Shopping Center Assoc. LP, 701 East Gate Drive, Ste 225, Mt. Laurel, NJ 08054. To perform the following activities associated with the East Norriton Crossing Shopping Center:  1.  To construct and maintain a stream crossing consisting of a 8.92-foot by 16.00-foot arch bridge and a 9.42-foot by 20.75-foot arch bridge. This structure will provide roadway access across the East Branch of Stoney Run; 2.  To perform regrading along the floodway of the East Branch of Stoney Run; 3.  To cap an existing spring. This site is located on the northern corner of the intersection of Germantown Pike (S. R. 422) and DeKalb (S. R. 202) (Lansdale, Pa Quadrangle N:  3.2 inches; W:  8.8 inches) in East Norriton Township, Montgomery County.

   E40-487. Encroachment. Frederick R. and Dana L. Buckman, 7 Bramblewood Drive, Shavertown, PA 18708. To construct and maintain a private recreational dock/boathouse in Harveys Lake (HQ-CWF). The proposed structure has dimensions of 50 feet (Lakeward) by 30 feet. The project is located at Pole 169.5 Lakeside Drive (Harveys Lake, PA Quadrangle N:  21.5 inches; W:  7.5 inches), in Harveys Lake Borough, Luzerne County (Baltimore District, U.S. Army Corps of Engineers).

   E40-488. Encroachment. William B. and Mary Lynn Pizzolato, 3 Bramblewood Drive, Shavertown, PA 18708. To construct and maintain a pile-supported private recreational dock/boathouse in Harveys Lake (HQ-CWF). The proposed structure has dimensions of 50 feet (Lakeward) by 30 feet. The project is located at Pole No. 170, Lakeside Drive (Harveys Lake, PA Quadrangle N:  21.5 inches; W:  7.5 inches) in Harveys Lake Borough, Luzerne County (Baltimore District, U. S. Army Corps of Engineers).

   E40-489. Encroachment. SADG-6 Limited Partnership, 100 Colliery Road, Dickson City, PA 18519. To construct and maintain a stream enclosure of Toby Creek (CWF), consisting of approximately 300 linear feet of twin 14-foot by 6-foot concrete box culverts, for the purpose of construction of a Rite Aid Pharmacy. The project is located on the west side of S. R. 0415 at the intersection of S. R. 0415 and S. R. 0309 (Kingston, PA Quadrangle N:  14.7 inches; W:  11.0 inches) in Dallas Borough, Luzerne County (Baltimore District, U.S. Army Corps of Engineers).

   E45-335A. Encroachment. Anthony Ponder, 860 Penn Estates, East Stroudsburg, PA 18301. To amend Permit No. E45-335 to include the placement of fill in an additional 0.03 acre of wetlands for the purpose of constructing an attached one-car garage and wooden deck. The total wetland encroachment is approximately 0.08 acre. The project is located at Lot 154 of Penn Estates Residential Subdivision, Section D, approximately 1.7 miles west of the intersection of S. R. 0447 and S. R. 0191 (East Stroudsburg, PA Quadrangle N:  6.7 inches; W:  15.9 inches) in Stroud Township, Monroe County (Philadelphia District, U. S. Army Corps of Engineers).

   E01-191. Encroachment. Latimore Township, David Myers, P. O. Box 218, York Springs, PA 17372. To remove a 30 foot long by 10 foot wide gravel bar in an unnamed tributary to Latimore Creek and to realign the stream in this section located west of Bonner's Hill Road bridge just south of Mountain Road (Dillsburg, PA Quadrangle N:  5.8 inches; W:  14.5 inches) in Latimore Township, Adams County.

   E05-260. Encroachment. Hyndman Borough, Sharon Shaffer, P. O. Box 486, Hyndman, PA 15545. To construct and maintain concrete floodwalls for an overall total length of 369 feet along the right bank of Wills Creek located immediately upstream and downstream of Schellsburg Street Bridge (Hyndman, PA Quadrangle N:  13.6 inches; W:  13.8 inches) in Hyndman Borough, Bedford County.

   E06-509. Encroachment. Gerard and Rhoda Nissley, 313 Steeplechase Drive, Elverson, PA 19520. To construct and maintain a driveway crossing consisting of twin 84-inch culverts in the channel of a tributary to the Conestoga River at a point approximately 400 feet downstream of Route 23 (Morgantown, PA Quadrangle N:  5.6 inches; W:  0.6 inch) in Caernarvon Township, Berks County.

   E06-510. Encroachment. Heidelberg Township, Russ Rogers, P. O. Box 241, Robesonia, PA 19551. To remove an existing structure and to construct and maintain a bridge having a clear span of 30 feet and an underclearance of 5 feet across the channel of Spring Creek at a point at Heidelberg Road (Sinking Spring, PA Quadrangle N:  18.0 inches; W:  13.3 inches) in Heidelberg and Lower Heidelberg Townships, Berks County.

   E36-650. Encroachment. PA Turnpike Commission, Andrew Lutz, P. O. Box 67676, Harrisburg, PA 17106. To rehabilitate and maintain two mainline five-span Turnpike bridges by widening the decks and four piers at each bridge. Gabion slope wall protection will be placed under each bridge from the abutments to edge of stream for slope stabilization. Bridge EB-533 spans the Cocalico Creek at Milepost 282.40 and bridge EB-535 crosses the Little Cocalico Creek at MP 283.06 (Ephrata, PA Quadrangle N:  20.9 inches; W:  2.4 inches) in East and West Cocalico Townships, Lancaster County.

   E38-117. Encroachment. Pine Meadows Golf Course, Larry Raybold, 199 W. McKinley Ave., Myerstown, PA 17067. To enlarge, reshape and excavate to deepen five existing golf course ponds to provide additional storage capacity for golf course irrigation. The ponds are to be maintained and cleaned out on drainage tributaries to the Little Swatara Creek. The Pine Meadows Golf Course is located on the west side of SR 343 (Fredericksburg, PA Quadrangle N:  6.5 inches; W:  7.0 inches) in Bethel Township, Lebanon County.

   Northcentral Region, Water Management, Soils and Waterways Section, F. Alan Sever, Chief, 208 West Third St., Suite 101, Williamsport, PA 17701.

   E17-317. Encroachment. J. Richard Fullington Jr., 929 S. 6th St., Clearfield, PA 16830. To place and maintain fill for a driveway in the floodway of Stinky Run and across 0.015 acre of wetlands located off Clark Street approximately 600 feet east of the RT 879 overpass (Clearfield, PA Quadrangle N:  3.0 inches; W:  7.2 inches) in Lawrence Township, Clearfield County. The stream is designated CWF and this project will impact 180 feet of stream and 0.015 acre of wetlands.

   E53-311. Encroachment. DCNR, Bureau of Forestry, 3150 E. Second St., Coudersport, PA 16915-0673. To construct and maintain a 122-inch wide by 75-inch high corrugated metal pipe with associated fill and riprap in the East Fork of Sinnemahoning Creek located at a gas pipeline crossing which is approximately 3,000 feet southeast of the Rock Ridge Road and SR 0044 intersection (Cherry Springs, PA Quadrangle N:  7.42 inches; W:  14.6 inches) in Summit Township, Potter County. Estimated stream disturbance is 60 linear feet with no wetland impact; stream classification is EV.

   E59-358. Encroachment. Gordon and Ester Brace, 249 S. Elk Run Rd., Mainesburg, PA 16932. To construct and maintain an overflow channel approximately 500 feet long and to replace, stabilize and maintain a gravel dike approximately 300 feet in length along Elk Run (Roseville, PA Quadrangle N:  11.0 inches; W:  12.2 inches) in Sullivan Township, Tioga County. Estimated stream disturbance is approximately 500 feet with no wetland impacts; stream classification is Stock Trout Fishery.

   Southwest Regional Office, Soils and Waterways Section, 400 Waterfront Drive, Pittsburgh, PA 15222-4745.

   E04-253. Encroachment. Empire Terminal, Inc., Suite 110, 731--733 Washington Road, Pittsburgh, PA 15228-0999. To modify the existing barge dock by constructing and maintaining a 270 foot long sheet pile wall along the left bank of the Ohio River (WWF) near River Mile 23.7 (Beaver PA, Quadrangle N:  11.1 inches; W:  1.7 inches) in Monaca Borough, Beaver County. Note site was originally permitted under E04-079.

   E11-259. Encroachment. The Home Depot, 3096 Hamilton Boulevard, South Plainfield, NJ 07080. To place and maintain fill in 0.2 acre of wetlands (PEM); for the purpose of developing a commercial site. The applicant proposes to meet the wetland replacement obligation by contributing to the Pennsylvania Wetland Replacement Fund. The project is located just south of the Johnstown-Cambria County Airport (Giestown, PA Quadrangle N:  10.5 inches; W:  11.5 inches) in Richland Township, Cambria County.

   E02-1221. Encroachment. Oak Park Associates, Inc., P. O. Box E, Irwin, PA 15642. To place and maintain rip-rap bank protection for a distance of approximately 350 feet along the left bank of Jacks Run (HQ-TSF) and to widen the channel of said stream located just east of the intersection of Long Run Road and Lincoln Way Road (McKeesport, Pa Quadrangle N:  15.9 inches; W:  7.9 inches) in White Oak Borough, Allegheny County.

   E02-1222. Encroachment. Plum Borough Municipal Authority, 4575 New Texas Road, Pittsburgh, PA 15239. To place and maintain fill in 0.3 acre of wetlands (PEM); to place and maintain fill in the floodway and to construct and maintain a 2.2 mg sewage detention facility in the floodway fringe of Plum Creek (WWF). The project is located on the north east side of Leechburg Road at the confluence of Plum Creek and Little Plum Creek (Braddock PA Quadrangle N:  21.7 inches; W:  4.8 inches) in Plum Borough, Allegheny County. The applicant proposes to meet the wetland replacement requirements by contributing to the Wetland Replacement Fund.

   E02-1223. Encroachment. Chatfield Properties, L. P., South Pittsburgh Technology Park, 3117 Washington Park, Bridgeville, PA 15017-1496. To construct and maintain a 118 foot long by 11 foot high concrete gabion wall along the right bank of Coal Run (WWF). The project is located on the south side of Bursca Drive near its intersection with Washington Pike Road (S. R. 0519) (Bridgeville PA Quadrangle N:  17.8 inches; W:  15.6 inches) in South Fayette Township, Allegheny County.

   E03-368. Encroachment. PA Department of Transportation, District 10-0, P. O. Box 429, Route 286 South, Indiana, PA 15701. To remove the existing structure and to construct and maintain a single span bridge having a normal span of 106.0 feet and an underclearance of 11.6 feet across Buffalo Creek (TSF) for the purpose of improving transportation safety and roadway alignment. Also proposed, is the construction and maintenance of two rock lined outfall channels at the proposed bridge. The project is located on S. R. 3015, Section 150 approximately 3,500 feet south of the Village of West Winfield (Worthington, PA Quadrangle N:  6.2 inches; W:  8.8 inches) in North Buffalo Township, Armstrong County.

   E65-687. Encroachment. PA Department of Transportation, P. O. Box 459, Uniontown, PA 15401-0459. To remove the existing structure and to construct and maintain a bridge having a clear span of 11.0 feet and an underclearance of 7.0 feet across Belson Run (WWF) located on S. R. 3089 Section G 01. The project includes construction and maintenance of a temporary stream crossing consisting of one 72-inch diameter pipe culvert (Mt. Pleasant, Pa Quadrangle N:  14.6 inches; W:  17.1 inches) in Hempfield Township, Westmoreland County.

   E65-688. Encroachment. Hempfield Township Supervisors, R. R. 6, Box 500 Woodward Drive, Greensburg, PA 15601-9301. To remove the existing structure and to construct and maintain a bridge having a clear span of 16.0 feet and an underclearance of 6.5 feet across an Unnamed Tributary to Jacks Run (WWF) located on Bothwell Road (T-798) at a point approximately 1,600 feet north of the intersection of Blank School Road and Bothwell Road (Greensburg PA, Quadrangle N:  13.7 inches; W:  3.7 inches) in Hempfield Township, Westmoreland County.

   E65-689. Encroachment. Hempfield Township Supervisors, R. R. 6, Box 500 Woodward Drive, Greensburg, PA 15601-9310. To remove the existing bridge and to construct and maintain a bridge having a clear span of 12 feet and an underclearance of 6.5 feet across an Unnamed Tributary to Brush Creek (WWF) located on Old Route 66 approximately 400 feet south of the intersection of Old Route 66 and S. R. 1032. The project includes construction and maintenance of a temporary roadway crossing (Greensburg, Pa Quadrangle N:  17.0 inches; W:  8.5 inches) in Hempfield Township, Westmoreland County.

DAM SAFETY


Applications received under the Dam Safety and Encroachments Act (32 P. S. §§ 693.1--693.27) and section 302 of the Flood Plain Management Act (32 P. S. § 679.302) and requests for certification under section 401 of the Federal Water Pollution Control Act.

Box 203, 585 Freeman School Road, Harleysville, PA 19428 is authorized to discharge from a facility located in Lower Salford Township, Montgomery County, to an unnamed tributary to East Branch Perkiomen Creek.

   NPDES Permit No. PA0053074. Sewage. Valley Green Corporate Center, 1767 Sentry Parkway West, Suite 205, Blue Bell, PA 19422, is authorized to discharge from a facility located in Whitemarsh Township, Montgomery County into Sandy Run Creek.

INDIVIDUAL PERMITS

   The following parties have submitted Notices of Intent (NOIs) for Coverage under (1) General NPDES Permit(s) to discharge wastewater into the surface waters of this Commonwealth. The approval of coverage under these general NPDES permits is subject to applicable effluent limitations, monitoring, reporting requirements and other conditions set forth in the general permit; (2) General Permit(s) for Beneficial Use of Sewage Sludge or Residential Septage by Land Application in Pennsylvania. The approval of coverage for land application of sewage sludge or residential septage under these general permits is subject to pollutant limitations, pathogen and vector attraction reduction requirements, operational standards, general requirements, management practices and other conditions set forth in the respective general permit. The Department of Environmental Protection approves the following coverages under the specified General Permit.

   The EPA Region III Regional Administrator has waived the right to review or object to this permit action under the waiver provision:  40 CFR 123.24.
