(Part I Permits)

   The following parties have applied for an NPDES permit to discharge controlled wastewaters into the surface waters of this Commonwealth. Unless otherwise indicated on the basis of preliminary review and application of lawful standards and regulations, the Department of Environmental Protection (Department) proposes to issue a permit to discharge, subject to certain effluent limitations and special conditions. These proposed determinations are tentative.

   Where indicated the EPA, Region III, Administrator has waived the right to review or object to this proposed permit action under the waiver provision 40 CFR 123.6E.

   Persons wishing to comment on the proposed permit are invited to submit a statement to the office noted above the application within 30 days from the date of this public notice. Comments received within this 30-day comment period will be considered in the formulation of the final determinations regarding this application. Responses should include the name, address and telephone number of the writer and a concise statement to inform the Department of the exact basis of a comment and the relevant facts upon which it is based. A public hearing may be held if the responsible office considers the public response significant.

   Following the 30-day comment period, the Water Management Program Manager will make a final determination regarding the proposed permit. Notice of this determination will be published in the Pennsylvania Bulletin at which time this determination may be appealed to the Environmental Hearing Board.

   The application and related documents, proposed effluent limitations and special conditions, comments received and other information are on file and may be inspected and arrangements made for copying at the office indicated above the application.

   The receiving stream is classified for the following uses: cold water fishery, aquatic life, water supply and recreation.

   For the purpose of evaluating effluent requirements for TDS, NO2-NO3, fluoride and phenolics, the existing downstream potable water supply (PWS) considered during the evaluation is Keystone Water Company, Yardley District, located on the Delaware River.

   This application is for issuance of an NPDES permit for a new discharge of treated sewage to Conodoguinet Creek, in North Middleton Township, Cumberland County.

   The receiving stream is classified for warm water fishery, recreation, water supply and aquatic life. For the purpose of evaluating effluent requirements for TDS, NO2-NO3, fluoride and phenolics, the existing downstream potable water supply intake considered during the evaluation was Carlisle Borough Water Treatment Facility located in North Middleton Township. The discharge is not expected to impact any potable water supply.

   PA 0088234.  Franklin Family Farms, Inc., 419 West High Street, Elizabethtown, PA 17022.

   Franklin Family Farms, Inc. has submitted an application to the Department of Environmental Protection (Department) for an individual NPDES permit relating to an existing concentrated animal feeding operation (CAFO). The CAFO is located at 14627 Lurgan Road, Orrstown, PA 17244, in Lurgan Township, Franklin County. The CAFO is located near a tributary to Paxton Run, which is classified as a warm water fishery in the Conodoguinet Creek watershed. No construction of a new manure storage facility is proposed as the applicant proposes to continue to use two existing manure storage facilities.

   The CAFO is an existing 2,800 sow to finish operation with 1,303 animal equivalent units.

   The existing manure storage consists of a two stage HDPE lagoon system having a total capacity of 2.47 million gallons providing for a leak detection system meeting the requirements of the Department's Final Strategy for Meeting Federal Requirements for Controlling the Water Quality Impacts of Concentrated Animal Feeding Operations. The CAFO will be operated so that there will be no release or discharge to waters of the Commonwealth under normal operating conditions. Normal operating conditions are defined as conditions below a 25-year, 24-hour storm event.

   The Department has conducted administrative and technical reviews of the application. On the basis of preliminary review and application of lawful standards and regulations and the Final CAFO Strategy, the Department proposes to issue an individual NPDES permit for the operation subject to the terms and conditions, effluent limitations, monitoring and reporting requirements specified in the draft permit. The proposed determination is tentative.

   The permit application and proposed draft permit are on file at the Southcentral Regional Office of the Department. Persons may make an appointment to review the files by calling Mary DiSanto, File Review Coordinator, at (717) 705-4732.

   The Environmental Protection Agency (EPA) permit review waiver provision under 40 CFR 123.24(e) does not apply to this NPDES permit. The Administrator of EPA Region III may review or object to any proposed NPDES permit actions.

   Persons wishing to comment on the proposed permit are invited to submit written comment to the previous address within 30 days from the date of this public notice. Comments received within this 30-day period will be considered in formulating the Department's final determination regarding the application. All comments should include the name, address and telephone number of the writer and a concise statement to inform the Department of the basis of the comment and the relevant facts upon which it is based. A public meeting/hearing may be held if the Department considers the public response or interest significant.

   Following the 30-day comment period, the Water Management Program Manager will make a final determination regarding the proposed permit. Notice of this determination will be published in the Pennsylvania Bulletin at which time the determination may be appealed to the Environmental Hearing Board.

   PA 0003565.  Industrial waste, SIC: 2895, Morgan Advanced Materials and Technology, Inc., 441 Hall Avenue, St. Marys, PA 15857.

   This proposed action is for renewal of an NPDES permit for an existing discharge of treated industrial wastewater to Mill Creek in Eulalia Township, Potter County.

   The receiving stream is classified for the following uses: high quality cold water fishery, aquatic life, water supply and recreation. For the purposes of evaluating effluent requirements for TDS, NO2-NO3, fluoride and phenolics, the existing downstream potable water supply (PWS) considered during the evaluation is the PA/NY border approximately 36 river miles downstream.

   The proposed effluent limits for Outfall 001, based on a design flow of 0.5 mgd, are:

   This application is for renewal of an NPDES permit to discharge treated process water, cooling water, stormwater, leachate and untreated cooling water stormwater from Neville Chemical in Neville Township, Allegheny County.

   The following effluent limitations are proposed for discharge to the receiving waters, Ohio River, (Main Channel and Back Channel), classified as a warm water fishery with existing and/or potential uses for aquatic life, water supply and recreation. The first existing/proposed downstream potable water supply (PWS) is Robinson Township Authority, located at Mile 8.8--Ohio River, 2.43 miles below the discharge point.

   Outfall 101: existing discharge, design flow of 0.134 mgd.

   This application is for renewal of an NPDES permit to discharge treated sewage from the Suburban Terrace Mobile Home Park Sewage Treatment Plant in Hopewell Township, Beaver County.

   The following effluent limitations are proposed for discharge to the receiving waters, known as unnamed tributary of Boggs Run, which are classified as a warm water fishery with existing and/or potential uses for aquatic life, water supply and recreation.
