ENCROACHMENTS

   The Department of Environmental Protection (Department) has taken the following actions on previously received permit applications, requests for Environmental Assessment approval, and requests for Water Quality Certification under Section 401 of the Federal Water Pollution Control Act (33 U.S.C.A. § 1341(a)).

   Any person aggrieved by this action may appeal, under Section 4 of the Environmental Hearing Board Act (35 P. S. § 7514), and 2 Pa.C.S. §§ 501--508 and 701--704 (relating to the Administrative Agency Law) to the Environmental Hearing Board, Second Floor, Rachel Carson State Office Building, P. O. Box 8457, Harrisburg, PA 17105-8457, (717) 787-3483. TDD users may contact the Board through the Pennsylvania Relay Service, (800) 654-5984. Appeals must be filed with the Environmental Hearing Board within 30 days of receipt of written notice of this action unless the appropriate statute provides a different time period. To construct, operate and maintain a non-jurisdictional dam across a small, intermittent unnamed tributary to Skippack Creek (TSF) associated with a stormwater management facility for the proposed Greenbrier Estate subdivision. The dam and its associated reservoir will impact approximately 225 linear feet of the channel during a 100-year storm event. The site is located just northeast of the intersection of Old Forty Foot Road (S. R. 1006) and Hedrick Road (Collegeville, PA USGS Quadrangle N:  19.3 inches; W:  0.3 inch) in Towamencin Township, Montgomery County.

   E09-805. Encroachment Permit. Realen Homes, LLC, 1040 Stony Hill Road, Yardley, PA 19067. To remove an existing on-stream non-jurisdictional dam and associated concrete lined reservoir across unnamed tributary to Dyers Creek (WWF). Also to construct, in its place, a reservoir associated with a stormwater management facility to serve the proposed Loberg Tract residential development. The applicant also seeks Environmental Assessment approval to construct an on-stream nonjurisdictional dam impacting approximately 100 linear feet of the stream. The site is located approximately 1,250 feet southeast of the intersection of Dolington Road (S. R. 2075) and Mount Eyre Road (T-363) (Lambertville, PA-NJ USGS Quadrangle N:  2.6 inches; W:  1.2 inches) in Lower Makefield Township, Bucks County.

To grade the right bank within the 100-year floodway of Plum Creek (WWF) in order to construct and maintain a parking lot associated with the development of McSherrystown West II housing development located immediately downstream of PA 116 Bridge (McSherrystown, PA Quadrangle N:  9.0 inches; W:  4.0 inches) in McSherrystown Borough, Adams County. This permit also includes 401 Water Quality Certification.

   E06-539. Encroachment. CPN Berks LLC, William Siderewicz, The Pilot House, 2nd Fl., Boston, MA 02110. To construct and maintain a 6-inch outfall pipe and riprap apron along the Schuylkill River (WWF) at a point approximately 2,200 feet upstream of West Huller Lane (Temple, PA Quadrangle N:  7.7 inches; W:  10.0 inches) in Ontelaunee Township, Berks County. This permit was issued under Section 105.13(e) ''Small Projects.'' This permit also includes 401 Water Quality Certification.

   E22-416. Encroachment. PA Game Commission, 2001 Elmerton Avenue, Harrisburg, PA 17110. To construct and maintain a bridge having a span of 50 feet and an underclearance of 7.5 feet across the channel of Clarks Creek (HQ-CWF) and to impact 0.08 acre of wetlands at a point approximately 5.2 miles upstream of Route 225 (Enders, PA Quadrangle N:  7.8 inches; W:  15.7 inches) in Middle Paxton Township, Dauphin County. The permittee is required to provide a minimum of 0.16 acre of replacement wetlands. This permit also includes 401 Water Quality Certification.

   E36-693. Encroachment. PECO Energy, 1848 Lay Rd., Delta, PA 17314. To perform maintenance dredging to remove accumulated sediment deposits from the north and south cooling water intake bays and the screenwell structure approach apron at the PECO Energy Company Peach Bottom Atomic Power Station located along the right bank in the Conowingo Reservoir on the Susquehanna River (WWF) (Holtwood, PA Quadrangle N:  3.6 inches; W:  4.5 inches) in Drumore Township, Lancaster County. This permit was issued under section 105.13(e) ''Small Projects.'' This permit also includes 401 Water Quality Certification.

   E36-687. Encroachment. Manor Township, 26 Millersville Road, Lancaster, PA 17603. To remove the existing structure and to construct and maintain a reinforced precast concrete spread box beam bridge having a 23.4-foot clear span on a 70 degree skew with a 9.21-foot minimum underclearance over the West Branch Little Conestoga Creek (TSF) on Charlestown Road (T-595) (Columbia East, PA Quadrangle N:  2.6 inches; W:  4.4 inches) in Manor Township, Lancaster County. This permit also includes 401 Water Quality Certification.

   E44-102. Encroachment. Mifflin County School District, East Derry Elementary School, 201 Eighth Street--Highland Park, Lewistown, PA 17044. To construct 375 feet of stream channel relocation of an unnamed tributary to Jacks Creek (TSF) in conjunction with the construction of a 16,770 square foot addition to the west side of the existing East Derry Elementary School building; and, to construct 240 foot long flood control earthen berms along both sides of a non-relocated upstream portion of the tributary to divert flood flows into the relocated portion of the tributary to protect the elementary school and downstream properties from flooding located on the south side of Back Maitland Road (SR 2004) about 0.3 mile east of its intersection with SR 2001 (Alfarata, PA Quadrangle N:  1.0 inches; W:  17.1 inches) in Derry Township, Mifflin County. This permit also includes 401 Water Quality Certification.

   E67-685. Encroachment. Izaak Walton League of America, York County Chapter 97, 7131 Ironstone Hill Rd., Dallastown, PA 17313. To construct and maintain initial phases of a watershed wide stream restoration project in and along the South Branch Codorus Creek (WWF). The project's purpose is to stabilize severely eroded banks, improve water quality and improve fisheries habitat. The watershed projects will implement a natural stream channel design approach and construction activities will include rock vanes, log vanes, cross rock vanes, root wads, bank grading, minor floodway fills, riprap protection, low flow channels, debris jam removal and minor stream relocations. The first two restoration sites of this multi-phase project are located on the Raymond K. Smith property. The first side involves 100 feet of channel restoration located immediately down-stream of the New Freedom Borough Sewage Treatment Plant. The second site will include about 800 feet of restoration located downstream of the SR 0616 bridge (Glen Rock, PA Quadrangle N:  2.5 inches; W:  11.0 inches) in Shrewsbury Township, York County. This permit also includes 401 Water Quality Certification.

   Northcentral Region, Water Management--Soils and Waterways, F. Alan Sever, Chief, 208 West Third St., Williamsport, PA 17701.

   E18-302. Encroachment. Keystone Central School District, 95 West Fourth Street, Lock Haven, PA 17745. To construct and maintain an addition to the Central Mountain High School including access road, tennis courts and parking areas in the flood fringe of Bald Eagle Creek. This project is located approximately 500 feet north of the intersection of Route 150 and SR 2020 (Lusk Run Road) Beech Creek, PA Quadrangle N:  21 inches; W:  1 inch) in Bald Eagle Township, Clinton County. This permit was issued under section 105.13(e) ''Small Projects.''

   E18-304. Encroachment. Fred C. Vilello, R. R. 2, Box 630, Lock Haven, PA 17745. To construct and maintain a 24` × 14` open-sided picnic pavilion supported by eight 6" × 6" treated posts embedded in an existing concrete slab located on Stork Road approximately 0.4 miles from the intersection of Stork Road with Coy Farm Road (Lock Haven, PA Quadrangle N:  5.4 inches; W:  12.8 inches) in Woodward Township, Clinton County. This permit was issued under section 105.13(e) ''Small Projects.'' This permit also includes 401 Water Quality Certification.

   E19-204. Encroachment. Louis N. Scerbo, P. O. Box 12, Orangeville, PA 17859-0012. To modify and maintain an existing seasonal dwelling in the 100-year frequency floodway of Fishing Creek. The modification work shall be limited to the replacement of the dwelling foundation to original elevations with 10-inch concrete block. The project is located along the eastern right-of-way of SR 0487 approximately 800-feet north of SR 4041 and SR 0487 intersection (Bloomsburg, PA Quadrangle N:  16.4 inches; W:  4.2 inches) in Orange Township, Columbia County. This permit was issued under section 105.13(e) ''Small Projects.''

   E49-236. Encroachment. Municipal Authority of the City of Sunbury, 225 Market Street, Sunbury, PA 17801-3482. To place and maintain fill in 0.19 acre of wetland and to construct and maintain an outfall structure to Shamokin Creek in Sunbury, Northumberland County (Sunbury, PA Quadrangle N:  18.5 inches; W:  6.5 inches) for the purpose of increasing sewage treatment capacity at the Municipal Authority's wastewater treatment facility.

   Southwest Regional Office:  Soils & Waterways Section, 400 Waterfront Drive, Pittsburgh, PA 15222-4745.

   E30-192. Encroachment. Pennsylvania Department of Transportation, Engineering District 12-0, P. O. Box 459, Uniontown, PA 15401. To remove the existing structure and to construct and maintain a prestressed concrete I-beam bridge having a single normal span of 30.1 meters and an underclearance of 2.0 meters across Pursley Creek (HQ-WWF). Also to construct and maintain a temporary stream crossing, a 525 mm diameter pipe outfall, and two 450 mm diameter pipe outfalls in Pursley Creek. The project is located on S. R. 3013 in the village of Oak Forest (Oak Forest, PA Quadrangle N:  17.0 inches; W:  15.6 inches) in Center Township, Greene County. This permit was issued under Section 105.13(e) ''Small Projects.'' This permit also includes 401 Water Quality Certification.

   E32-419. Encroachment. Green Township, 1492 Route 240 Highway, Commodore, PA 15729. To remove the existing pipe culvert and to construct and maintain a 60-foot long, 5-foot diameter pipe culvert (invert depressed 6 inches) in Whitaker Run (HQ-CWF) located on Barr Road (T-654) approximately 0.25 mile south of intersection of SR 1014 and Barr Road. Also, to construct and maintain bank protection at the culvert's approaches (Commodore, PA Quadrangle N:  6.6 inches; W:  7.9 inches) in Green Township, Indiana County. This permit was issued under Section 105.13(e) ''Small Projects.'' This permit also includes 401 Water Quality Certification.

   E56-295. Encroachment. Pennsylvania Turnpike Commission, P. O. Box 67676, Harrisburg, PA 17106-7676. To remove the existing structure and to construct and maintain a 0.3-meter depressed, 40.0-meter long, 4.3-meter × 3.0-meter concrete box culvert in an unnamed tributary to Kimberly Run (CWF) for the purpose of improving safety standards. The permit also authorizes the relocation and maintenance of 50 meters of this tributary to Kimberly Run downstream from the proposed box culvert, the placement and maintenance of fill in 0.003 hectares of PEM/PSS wetlands and wetland replacement at the PennDOT Somerset Wetland Bank. The project is located at milepost 114.5 of the Pennsylvania Turnpike (Route 76) (Murdock, PA Quadrangle N:  21.2 inches; W:  0.5 inch) in Somerset Township, Somerset County.

Notice of Plan Approval Under the Municipal Waste Planning Recycling and Waste Reduction Act of 1988, Act 101

   The Department of Environmental Protection (Department) approved a revision to the Snyder County Municipal Waste Management Plan on September 29, 2000.

Notice of Planning Grant Awards Under Section 901 of the Municipal Waste Planning Recycling and Waste Reduction Act of 1988, Act 101

   The Department of Environmental Protection (Department), announces the following grants to counties under section 901 of the Municipal Waste Planning, Recycling and Waste Reduction Act (53 P. S. § 4000.901) (Act 101) and section 208 of the Waste Tire Recycling Act/Small Business and Household Pollution Prevention Act (Act 190 of 1996). This notice is being published to correct the amount of a grant award published in the Pennsylvania Bulletin on September 23, 2000.

   Planning grants are awarded to counties for 80% of approved costs for preparing municipal waste management plans as required by Act 101, for carrying out related studies, surveys, investigations, inquiries, research and analysis, including those related to siting, environmental mediation, education programs on pollution prevention and household hazardous waste and providing technical assistance to small businesses for pollution prevention. Grants may be awarded for feasibility studies and project development for municipal waste processing or disposal facilities, except for facilities for the combustion of municipal waste that are not proposed to be operated for the recovery of energy. All grant awards are predicated on the receipt of recycling fees required by sections 701 and 702 of Act 101, and the availability of moneys in the Recycling Fund.
