   The Independent Regulatory Review Commission met publicly at 10:30 a.m., Thursday, October 5, 2000, and took the following action:

Regulation Approved:

   Department of Agriculture #2-124: Agricultural Land Conservation Assistance Grant Program (amends 7 Pa. Code Chapter 138h).

Regulation Deemed Approved in Accordance With Section 5.1(e) of the Regulatory Review Act--Effective October 17, 2000.

   Department of Transportation #18-359: Display of Registration Plates (institutes rear window registration stickers for the Philadelphia area).

Department of Agriculture--Agricultural Land Conservation Assistance Grant Program; Regulation No. 2-124

   On January 24, 2000, the Independent Regulatory Review Commission (Commission) received this proposed regulation from the Department of Agriculture (Department). This rulemaking amends 7 Pa. Code Chapter 138h. The proposed regulation was published in the February 5, 2000 Pennsylvania Bulletin, with a 30-day public comment period. The final-form regulation was submitted to the Commission on September 14, 2000.

   The Department is amending its regulations governing the Agricultural Land Conservation Assistance Grant Program to eliminate ambiguities and unnecessary language.

   We have determined this regulation is consistent with the statutory authority of the Department of Agriculture (3 P. S. §  1207.3) and the intention of the General Assembly. Having considered all of the other criteria of the Regulatory Review Act, we find promulgation of this regulation is in the public interest.

Dear Secretary Mallory:

   The Commission considered this regulation at our public meeting on October 5, 2000. A motion to disapprove the regulation resulted in a 2-2 tie vote. A second motion to approve also resulted in a 2-2 tie vote. Because the Commission did not disapprove the regulation, it will be deemed approved following the expiration of our review period, in accordance with Section 5.1(e) of the Regulatory Review Act (71 P. S. §  745.5a(e)).

   The Commission's review period ends on October 16, 2000. Therefore, this regulation will be deemed approved on October 17, 2000.
