NATIONAL POLLUTION DISCHARGE ELIMINATION SYSTEM (NPDES) PERMITS
NPDES APPLICATIONS
PART I PERMITS Pursuant to the Federal Clean Water Act and the Pennsylvania Clean Streams law, the following parties have applied for an NPDES permit or to renew their current permit to discharge controlled wastewaters into the waters of this Commonwealth or to conduct other activities required by the NPDES permit. For renewal applications, the Department of Environmental Protection (Department) has made a tentative determination to reissue these permits for five years subject to effluent limitations and monitoring and reporting requirements in their current permits, with appropriate and necessary updated requirements to reflect new and changed regulations and other requirements. For all new permit applications, renewal application with major changes or applications for permits not waived by EPA, the Department will make a tentative determination upon the completion of its technical reviews. These determinations will be published as proposed actions prior to taking the actions.
Unless indicated otherwise below, the EPA Region III Administrator has waived the right to review or object to this proposed permit action under the waiver provision 40 CFR 123.6E.
Persons wishing to comment on the proposed permit are invited to submit a statement, to the office noted above the application within 30 days from the date of this public notice. Comments received within this 30-day comment period will be considered in the formulation of the final determinations regarding this application. The comments should include the name, address, and telephone number of the writer and a concise statement to inform the Department of the exact basis of a comment and the relevant facts upon which it is based. A public hearing may be held if the responsible office considers the public response significant. Following the comment period, the Department's Water Management Program Manager will make a final determination regarding these applications. Notice of this final determination will be published in the Pennsylvania Bulletin at which time this determination may be appealed to the Environmental Hearing Board.
The renewal application, including proposed effluent limitations and special conditions, is available on file. For new permit applications, information submitted with the applications is available on file. The information may be inspected and arrangements made for copying at the office indicated above the application.

This application is for renewal of an NPDES Permit to discharge treated sewage to the Allegheny River in Oil City, Venango County. This is an existing discharge.
The receiving water is classified for the following uses: Warm Water Fishes, aquatic life, water supply and recreation. For the purpose of evaluating effluent requirements for TDS, NO2--NO3, Fluoride and Phenolics, the existing/proposed downstream potable water supply considered during the evaluation is the Emlenton Water Company on the Allegheny River located at Emlenton, approximately 33 miles below point of discharge.

Mike Mullady has submitted an application for an NPDES permit for an existing concentrated animal feeding operation (CAFO) known as Purina Wide Awake Farm, located on Jay Road in Monroe Township, Bedford County. The CAFO is situated near West Branch Sidling Hill Creek, which is classified as Exceptional Value Waters (EV). The CAFO is designed to maintain an animal population of 676.61 animal equivalent units (AEUs), consisting of 168 sows with litter, 1,152 gestating sows, 27 boars, 3,250 nursery pigs, and 70 finishing pigs.
Manure generated at the facility flows by gravity to an existing earthen storage facility with an HDPE liner containing an approximate storage capacity of approximately 2,666,000 gallons. Manure is stored in an existing concrete structure at a second facility with a capacity of approximately 30,000 gallons. A release or discharge to waters of the Commonwealth under normal operating conditions is not expected. Normal operating conditions are defined as conditions below a 25-year, 24-hour storm event.
The Department of Environmental Protection (DEP) has conducted administrative and technical reviews of the application. Based on the preliminary review and application of lawful standards and regulations including the Final CAFO Strategy, the Department has made a tentative determination to issue an individual NPDES permit for the operation subject to the terms and conditions and monitoring and reporting requirements specified in the draft permit.
DEP has scheduled a public hearing to receive testimony and comments on the proposed CAFO NPDES permit. The hearing will be held on Wednesday, February 21, 2001 beginning at 7 p.m. at the Monroe Township Municipal Building, 247 Rock Hill Church Road, Clearville, PA 15535.
Any person intending to testify at the hearing should register by Friday, February 15, 2001, by calling Ms. Charlotte Bonafair at (717) 705-4703. If no person registers to present oral comments by this deadline, the hearing will not be held. Persons interested in finding out if anyone has registered, and if the hearing will be held, also should contact Ms. Bonafair at the same number. In addition, any person wishing to submit testimony but cannot attend the hearing, may do so in writing by February 21, 2001. Written comments should be sent to Mr. Edward Muzic, Water Management Program, Permits Section, DEP Southcentral Regional Office, 909 Elmerton Avenue, Harrisburg, PA 17110-8200.
All testimony should be to the point. Each individual will have up to 10 minutes for his/her presentation. To ensure that all speakers have a fair and equal opportunity to present their testimony, relinquishing of time will be prohibited. Further details relating to the procedures to be followed at the hearing will be outlined at the beginning of the proceedings.
The permit application and proposed draft permit are on file at the Southcentral Regional Office in Harrisburg. An appointment to review the files may be scheduled by calling Ms. Mary DiSanto at (717) 705-4732 between the hours of 8 a.m. and 4 p.m., Monday through Friday.
All comments received will be considered in formulating the Department's final determination regarding the application. All comments should include the name, address, and telephone number of the writer and a concise statement to inform the Department of the basis of the comment and the relevant facts upon which it is based.
Following the 30-day comment period, the Water Management Program Manager will make a final determination regarding the proposed permit. Notice of this determination will be published in the Pennsylvania Bulletin at which time the determination may be appealed to the Environmental Hearing Board.
The Environmental Protection Agency (EPA) permit review waiver provision under 40 CFR 123.24(e) does not apply to this NPDES permit.
