   The following NPDES Individual Permits for Discharges of Stormwater Associated with Construction Activities have been issued.

   These actions of the Department of Environmental Protection (Department) may be appealed to the Environmental Hearing Board (Board), Second Floor, Rachel Carson State Office Building, 400 Market Street, P. O. APPROVALS TO USE NPDES AND/OR OTHER GENERAL PERMITS

   The following parties have submitted:  (1) Notices of Intent (NOIs) for Coverage under (1) General NPDES Permits to Discharge Wastewater into the Waters of the Commonwealth. The approval for coverage under these general NPDES permits is subject to applicable effluent limitations. Monitoring, reporting requirements and other conditions set forth in the general permit:  (2) General Permits for Beneficial Use of Sewage Sludge or Residential Septage by Land Application in Pennsylvania; (3) General NPDES Permit Authorizing the Discharge of Stormwater Associated with Construction Activities to Waters of the Commonwealth; (4) Notification for First Use Application of Sewage Sludge.

   The approval of coverage for land application of sewage sludge or residential septage under these general permits is subject to pollutant limitations, pathogen and vector attraction reduction requirements, operational standards, general requirements, management practices and other conditions set forth in the respective permit. The Department of Environmental Protection approves the following coverage under the specific General Permit.

   The EPA Region III Administrator has waived the right to review or object to this permit action under the waiver provision 40 CFR 123.23(d).

   The application and related documents, effluent limitations, permitting requirements and other information are on file and may be inspected and arrangements made for copying at the contact office noted.

   Plan Description:  The proposed Official Plan revision, Grantham Crossing (A3-67907-180-2), consists of a 29 lot single-family residential subdivision on 27 acres with total estimated sewage flows of 11,600 gpd to be treated by a combination of individual on-lot sewage disposal systems and small flow treatment facilities. The project site is located on Jennifer Lane and along the north side of Al Pat Drive, east of Chestnut Grove Road in Carroll Township, York County. The plan, as submitted, was disapproved because it fails to document that the short and long term sewage disposal needs of all the lots in the subdivision would be met as required by Chapter 71, Section 71.52. Additionally, the proposal, as submitted, fails to document the technical and administrative feasibility of the chosen method of sewage disposal for all the lots in subdivision as required by Chapter 71, Section 71.52.

LAND RECYCLING AND ENVIRONMENTAL REMEDIATION

UNDER ACT 2, 1995

PREAMBLE 2


The following final reports were submitted under the Land Recycling and Environmental Remediation Standards Act (35 P. S. §§ 6026.101--6026.908).

   Provisions of Chapter 3 of the Land Recycling and Environmental Remediation Standards Act (Act) require the Department of Environmental Protection (Department) to publish in the Pennsylvania Bulletin a notice of submission of final reports. A final report is submitted to document cleanup of a release of a regulated substance at a site where one of the Act's remediation standards. A final report provides a description of the site investigation to characterize the nature and extent of contaminants in environmental media, the basis for selecting the environmental media of concern, documentation supporting the selection of residential or nonresidential exposure factors, a description of the remediation performed and summaries of sampling analytical results which demonstrate that remediation has attained the cleanup standard selected.

   For further information concerning the final report, contact the Environmental Cleanup Program Manager in the Department of Environmental Protection Regional Office under which the notice of receipt of a final report appears. If information concerning a final report is required in an alternative form, contact the Community Relations Coordinator at the appropriate Regional Office listed.    The Department has received the following final reports:

   Former Penn Linen and Uniform Services, City of Bethlehem, Lehigh County. Marco M. Odah, P.E., EnviroRemedy International, Inc., 401 S. Clairborne Road, Suite 303, Olathe, KS 66062 has submitted a Final Report (on behalf of his client, John Chen, Environmental Engineer, Cintas Corporation, 1300 Washington Street, Kansas City, MO 64105) concerning site soils found or suspected to have been contaminated with solvents. The report was submitted to document remediation of the site to meet the Statewide health standards.

   Northcentral Region:  Environmental Cleanup Program Manager, 208 West Third Street, Williamsport, PA 17701.

   Charus L. Goss Estate, Wysox Township, Bradford County. Chambers Environmental Group, Inc., on behalf of Charus L. Goss Estate, Route 6 and Sullivan Street, Towanda, PA 18848, has submitted a Final Report concerning remediation of site soil and groundwater contaminated with lead, BTEX and PHCs. The report is intended to document remediation of the site to meet the Site-specific Standard.

   Northwest Region:  Environmental Cleanup Program Manager, 230 Chestnut Street, Meadville, PA 16335-3481.

   JSP International (Former Spang Tool Facility), 150 East Brook Lane, East Butler, PA, East Butler Township, Butler County, has submitted a Cleanup Plan concerning remediation of the site soil, groundwater and surface water contaminated with PCBs, lead, heavy metals, solvents, BTEX, free cyanide and the surface water with total cyanide. The report is intended to document remediation of the site to meet the Site Specific Standard.

   Engelhard Corporation/Mallinckrodt Inc., South Parcel, 1729 East Avenue, City of Erie, Erie County, has submitted a Final Report concerning remediation of the ground water. The site has been found to be contaminated with lead, heavy metals and solvents. The report is intended to document remediation of the site to meet the Statewide Health Standard.

LAND RECYCLING AND ENVIRONMENTAL REMEDIATION

The Department has taken action on the following plans and reports under the Land Recycling and Environmental Remediation Standards Act (35 P. S. §§ 6026.101--6026.908).

   Provisions of 25 Pa. Code § 250.8, Administration of the Land Recycling and Environmental Remediation Standards Act (Act) requires the Department of Environmental Protection (Department) to publish in the Pennsylvania Bulletin a notice of its final actions on plans and reports. A final report is submitted to document cleanup of a release of a regulated substance at a site to one of the remediation standards of the Land Recycling and Environmental Remediation Standards Act. Plans and reports required by provisions of the Act for compliance with selection of remediation to a site-specific standard, in addition to a final report, include a remedial investigation report, risk assessment report and cleanup plan. A remedial investigation report includes conclusions from the site investigation, concentration of regulated substances in environmental media; benefits of refuse of the property and, in some circumstances, a fate and transport analysis. If required, a risk assessment report describes potential adverse effects caused by the presence of regulated substances. A cleanup plan evaluates the abilities of potential remedies to achieve remedy requirements. A final report provides a description of the site investigation to characterize the nature and extent of contaminants in environmental media, the basis of selecting the environmental media of concern, documentation supporting the selection of residential or nonresidential exposure factors, a description of the remediation performed and summaries of sampling methodology and analytical results which demonstrate that the remediation has attained the cleanup standard selected. The Department may approve or disapprove plans and reports submitted. This notice provides the Department's decision and, if relevant, the basis for disapproval.

Wilson, Director, Environmental Assessment and Remediation, Bethlehem Steel Corporation, 1170 Eighth Avenue, Bethlehem, PA 18016 submitted a Final Report concerning the characterization of soils located on the subject property. The report was submitted to document that site soils meet both the Background and Statewide health standards and was approved on July 30, 2001.

   Turner Residence, Franklin Township, Luzerne County. Gary Marshall, Senior Project Manager, TCI Environmental Services, Inc., 100 North Wilkes-Barre Boulevard, Wilkes-Barre, PA 18701 submitted a Final Report (on behalf of his client, Ray Turner, Jr., Brace and Orange Roads, Orange, PA 18612) concerning the remediation of site soils contaminated with no. 2 fuel oil. The final report demonstrated attainment of the Statewide health standard and was approved on August 10, 2001.
