NATIONAL POLLUTION DISCHARGE ELIMINATION SYSTEM PROGRAM (NPDES)

INDUSTRIAL WASTE AND SEWERAGE WASTEWATER

   The Department of Environmental Protection (Department) has taken the following actions on previously received permit applications and requests for plan approval.

   Persons aggrieved by this action may appeal, under Section 4 of the Environmental Hearing Board Act (35 P. S. § 7514) and 2 PA C.S. §§ 501--508 and 701--704 (relating to the Administrative Agency Law), to the Environmental Hearing Board, Second Floor, Rachel Carson State Office Building, P. O. Box 8457, Harrisburg, PA 17105-8457, (717) 787-3483. TDD users may contact the Board through the Pennsylvania Relay Service, (800) 654-5984. Appeals must be filed with the Environmental Hearing Board within 30 days of receipt of written notice of this action unless the appropriate statute provides a different time period. Copies of appeal form and the Board's rules of practice and procedure may be obtained from the Board. The appeal form and the Board's rules of practice and procedure are also available in Braille or on audiotape from the Secretary of the Board at (717) 787-3483.    These actions of the Department of Environmental Protection (Department) may be appealed to the Environmental Hearing Board (Board), Second Floor, Rachel Carson State Office Building, 400 Market Street, P. O. Box 8457, Harrisburg, PA 17105-8457, (717) 787-3483, by any aggrieved person under the Environmental Hearing Board Act (35 P. S. § 7514) and 2 PA C.S. §§ 501--508 and 701--704 (relating to the Administrative Agency Law). APPROVALS TO USE NPDES AND/OR OTHER GENERAL PERMITS

   The following parties have submitted: (1) Notices of Intent (NOIs) for Coverage Under (1) General NPDES Permits to Discharge Wastewater into the Waters of the Commonwealth. The approval for coverage under these general NPDES permits is subject to applicable effluent limitations. Monitoring, reporting requirements and other conditions set forth in the general permit: (2) General Permits for Beneficial Use of Sewage Sludge or Residential Septage by Land Application in Pennsylvania; (3) General NPDES Permit Authorizing the Discharge of Stormwater Associated with Construction Activities to Waters of the Commonwealth.

   The approval of coverage for land application of sewage sludge or residential septage under these general permits is subject to pollutant limitations, pathogen and vector attraction reduction requirements, operational standards, general requirements, management practices and other conditions set forth in the respective permit. The Department of Environmental Protection approves the following coverage under the specific General Permit.

   The EPA Region III Administrator has waived the right to review or object to this permit action under the waiver provision 40 CFR 123.24.

   The application and related documents, effluent limitations, permitting requirements and other information are on file and may be inspected and arrangements made for copying at the contact office noted.

   Plan Description:  The Plan provides for Kidder Township to purchase the existing Split Rock treatment plant from Summit Management Utilities, Inc., and expand/upgrade the treatment facility, and construct a sewage collection system to serve portions of the Split Rock/Lake Harmony area that presently utilize on-lot sewage disposal. The permitted capacity of the treatment plant will be increased to 0.400 MGD, from its present capacity of 0.150 MGD. The receiving stream is Shingle Mill Run. The plan includes an arrangement to provide for a portion of the effluent from the treatment plant to be seasonally land-applied at the Split Rock Golf Course. The owner of the golf course will secure the necessary permits for and own and operate the golf course spray irrigation system. The plan also provides for Kidder Township to implement an on-lot sewage management program in remaining areas of the Township.

   Plan Description:  The approved plan provides for the replacement of a sanitary sewer interceptor, currently 12 and 15 inch lines, from Maple Street to the Northeastern York County Sewer Authority Wastewater Treatment Plant with 14, 18, and 21 inch sewer lines. The capacity of the interceptor is expected to increase from 1.95 MGD to 8.40 MGD. The project area is located along Chestnut Street in Mount Wolf Borough, York County. The Department has taken action on the following plans and reports under the Land Recycling and Environmental Remediation Standards Act (35 P. S. §§ 6026.101--6026.908).

   Provisions of 25 Pa. Code § 250.8, Administration of the Land Recycling and Environmental Remediation Standards Act (Act) requires the Department of Environmental Protection (Department) to publish in the Pennsylvania Bulletin a notice of its final actions on plans and reports. A final report is submitted to document cleanup of a release of a regulated substance at a site to one of the remediation standards of the Land Recycling and Environmental Remediation Standards Act. Plans and reports required by provisions of the Act for compliance with selection of remediation to a site-specific standard, in addition to a final report, include a remedial investigation report, risk assessment report and cleanup plan. A remedial investigation report includes conclusions from the site investigation, concentration of regulated substances in environmental media; benefits of refuse of the property and, in some circumstances, a fate and transport analysis. If required, a risk assessment report describes potential adverse effects caused by the presence of regulated substances. A cleanup plan evaluates the abilities of potential remedies to achieve remedy requirements. A final report provides a description of the site investigation to characterize the nature and extent of contaminants in environmental media, the basis of selecting the environmental media of concern, documentation supporting the selection of residential or non-residential exposure factors, a description of the remediation performed and summaries of sampling methodology and analytical results which demonstrate that the remediation has attained the cleanup standard selected. The Department may approve or disapprove plans and reports submitted. This notice provides the Department's decision and, if relevant, the basis for disapproval.

ENSR, 35 Nagog Park, Acton, MA 01720 submitted a Final Report (on behalf of its client, Moen of PA, Rt. 645 and Roberts Road, Pine Grove, PA 17963-0098) concerning the characterization and/or remediation of site soils, groundwater, surface water, and sediments found or suspected to have been contaminated with solvents (chlorinated volatile organic compounds). The report documented attainment of the site-specific standard and was approved on January 9, 2001.

   PPL Electric Utilities Corporation--Former Honesdale Manufactured Gas Plant, Honesdale Borough, Wayne County. PPL, Environmental Management Division, 2 North Ninth Street, Allentown, PA, 18101-1179 submitted a Final Report concerning the characterization and/or remediation of site soils and groundwater found or suspected to have been contaminated with polycyclic aromatic hydrocarbons and BTEX (benzene, toluene, ethylbenzene and xylene) compounds. The report demonstrated attainment of the site-specific standard, and was approved on January 4, 2001.

The final report demonstrated attainment of the Statewide health standard, and was approved by the Department on January 17, 2001.

   PPL Distribution Pole 40449S26363 (Site 116), City of Lancaster, Lancaster County. PPL Generation LLC, Two North Ninth Street, Allentown, PA 18101 submitted a Final Report concerning remediation of site soils contaminated with PCBs. The final report demonstrated attainment of the Statewide health standard, and was approved by the Department on January 19, 2001.

   PPL Distribution Pole 21180S33244 (Site 124), Hampden Township, Cumberland County. PPL Generation LLC, Two North Ninth Street, Allentown, PA 18101 submitted a Final Report concerning remediation of site soils contaminated with PCBs. The final report demonstrated attainment of the Statewide health standard, and was approved by the Department on January 22, 2001.

   PPL Distribution Pole 25017S33555 (Site 74), City of Harrisburg, Dauphin County. PPL Generation LLC, Two North Ninth Street, Allentown, PA 18101 submitted a Final Report concerning remediation of site soils contaminated with PCBs. The final report demonstrated attainment of the Statewide health standard, and was approved by the Department on January 22, 2001.

   Northwest Region: Environmental Cleanup Program Manager, 230 Chestnut Street, Meadville, PA 16335-3481.

   Tops Markets, Inc., City of Bradford, McKean County. Raymond F. LaPort, of GZA Geo Environmental, 364 Nagel Drive, Buffalo, NY on behalf of Tops Markets, Inc., 6363 Main St., Amherst, NY 14221, has submitted a Baseline Environmental Report concerning the remediation of site soils and groundwater contaminated with lead, heavy metals, solvents, BTEX and PAHs. The report was approved. The report demonstrated attainment of the site specific standard and was approved by the Department on January 17, 2001.
