   On December 30, 2000 the Department of Environmental Protection published, in the Pennsylvania Bulletin, notice of the following application received in the Southwest Regional Office: Soils and Waterways Section, 400 Waterfront Drive, Pittsburgh, PA 15222-4745.

   It has come to the Department's attention that the permit was issued without proper public notice. As a result, the permit has been suspended. The following notice will provide proper notice. Persons wishing to question or comment on the permit application must submit such comments or questions to the office noted above within 30 days of the date of this notice.

   E02-494.  Encroachment. The Lane Construction Company, 1 Rutgers Road, Second Floor, Pittsburgh, PA 15205. To perform commercial sand and gravel dredging in select areas of the Allegheny River (WWF) within pool 2, 3, 4, 5, 7, and 8 and in the Ohio River (WWF) within the Dashield Pool and Montgomery Pool, subject to review of mussel surveys and prescribed set backs (Starting at Ambridge, PA Quadrangle N:  14.7 inches; W:  6.8 inches) in Allegheny, Armstrong and Westmoreland Counties. For a site-specific location of the dredging locations refer to attachments 1 (Allegheny County) and 2 (Armstrong County). Note this permit application incorporates DEP Permit No. E03-174.    EA46-032CO.  Talamore at Oak Terrace, 723 Talamore Drive, Ambler, PA 19002. Horsham Township, Montgomery County, ACOE Philadelphia District. To remove a partially breached dam across a tributary to Park Creek (WWF, MF) for the purpose of restoring the stream to a free flowing condition. The dam is located approximately 1100 feet northeast of the intersection of Talamore Drive and State Route 63 (Ambler, PA Quadrangle N:  12.75 inches; W:  10.75 inches).

   D24-022EA.  Saint Marys Area Water Authority (429 Ridgway Road, P. O. Box 33, Saint Marys, PA 15857). Fox Township, Elk County, To breach and remove the Laurel Run Reservoir Dam across Laurel Run (CWF) for the purpose of restoring the stream to a free flowing condition. The dam is located approximately 2000 feet upstream of the Route 255 bridge crossing Laurel Run (Saint Marys, PA, Quadrangle N:  1.4 inches; W:  7.2 inches).

SPECIAL NOTICES

   Plan revision being reviewed under the Pennsylvania Sewage Facilities Act (35 P. S. §§ 750.1--750.20).

   Regional Office: Water Management Program Manager, Southwest Region, 400 Waterfront Drive, Pittsburgh, PA 15222-4745.

   Location:  Frazer Township, Allegheny County, 2129 Butler Logan Road, Tarentum, PA 15084.

   The plan revision proposes the development of four major department stores, movie theater, food court and approximately 105 small shops. A power center is also proposed which will include 11 stores. Out parcels are planned for a hotel and additional eating establishments. An area for office building development is also provided. The estimated sanitary sewage flow will be 271,420 gallons per day or 775 equivalent dwelling units. Sewage will be collected on-site by a gravity line which in turn will flow to a proposed 3,500 gallon per minute pump station. The sewage will then be pumped via a 10-inch force main approximately 2,500 feet long across Route 28 and up to a point along Murray Hill Road. A new 18-inch gravity line approximately 6,500 feet long will then convey the sewage to the Upper Allegheny Joint Sanitary Authority's existing 42 interceptor which connects directly to the wet well of the sewage treatment plant located on Old Route 28.

BUREAU OF DEEP MINE SAFETY

   The Bureau of Deep Mine Safety has received a request for variance from Rosebud Mining Company. The following notification contains a summary of this request. A complete copy of the variance request may be obtained from Allison Gaida by calling (724) 439-7469 or from the BDMS web site at http://www.dep.state.pa.us/dep/deputate/minres/dms/dms.htm.

   The Department is publishing a summary of the request in order to solicit comments from affected parties on the proposed variance request. Comments may be used by the Bureau to assist in its investigation of the variance request. Comments will be accepted for 30 days following the publication of this notice. All comments should be addressed to: Richard E. Stickler, Director, Bureau of Deep Mine Safety, Fayette County Health Center, 100 New Salem Road, Room 167, Uniontown, PA 15401.

   Section 702 of the Bituminous Coal Mine Act, 52 P. S. §§ 701--702, provides a mechanism for operators to obtain variances from specific requirements of the Act to accommodate the adoption of new machinery, equipment, tools, supplies, methods, or processes.

   Section 242(c) states that where belt conveyors are installed, main stoppings and regulators shall be so arranged as to reduce the quantity of air traveling in the belt conveyor entry to a minimum for effective ventilation and to provide an intake air split as an escapeway from the face area to the main air current.

   Summary of the request: Rosebud Mining Company requests a variance to use point carbon monoxide early warning fire detection system and entries in common with the belt conveyor entry in short term panels at the Twin Rocks Mine.

NOTICE OF PERMIT TRANSFERS FOR FACILITIES

   The Department of Environmental Protection proposes to transfer certain permits, licenses and approvals at the following facilities. Certain permits, licenses and approvals previously issued to PECO Energy Company are proposed to be transferred to Exelon Generation Company, LLC. A complete listing of the permits, licenses and approvals proposed for transfer is listed below. Questions should be directed to the contact identified below.    Persons wishing to comment on the proposed permit transfers are invited to submit their comments to the contact identified below within 30 days from the date of this public notice. Comments received within this 30-day period will be considered in the formulation of the final determination regarding the proposed transfers. Comments should include the name, address and telephone number of the writer and a concise statement to inform the Department of the exact basis of the comment and the relevant facts upon which it is based. A public hearing may be held if the Department considers the public response significant.

   Following the 30-day comment period, the Department will make a final decision concerning the permit, license and approval transfers. Notice of this determination will be published in the Pennsylvania Bulletin at which time the determination may be appealed to the Environmental Hearing Board.
