THE CLEAN STREAMS LAW AND THE FEDERAL CLEAN WATER ACT--NPDES AND WQM PART II PERMITS

INDUSTRIAL WASTE AND SEWERAGE WASTEWATER

   The Department of Environmental Protection has taken the following actions on previously received permit applications and requests for plan approval.

   Persons aggrieved by an action may appeal, under section 4 of the Environmental Hearing Board Act (35 P. S. § 7514) and 2 Pa.C.S. §§ 501--508 and 701--704 (relating to the Administrative Agency Law), to the Environmental Hearing Board, Second Floor, Rachel Carson State Office Building, 400 Market Street, P. O. Box 8457, Harrisburg, PA 17105-8457, (717) 787-3483. TDD users may contact the Environmental Hearing Board (Board) through the Pennsylvania Relay Service, (800) 654-5984. Appeals must be filed with the Board within 30 days of publication of this notice in the Pennsylvania Bulletin, unless the appropriate statute provides a different time period. Copies of the appeal form and the Board's rules of practice and procedure may be obtained from the Board. The appeal form and the Board's rules of practice and procedure are also available in Braille or on audiotape from the Secretary to the Board at (717) 787-3483.    NPDES Permit No. PA0095044, Sewage, Northgate Townhouses Condo Association, 380 Z Northgate Drive, Apollo, PA 15613 is authorized to discharge from a facility located at Northgate Townhouses STP, Washington Township, Westmoreland County to receiving waters named unnamed tributary of Pine Run.

   NPDES Permit No. PA0096091 Amendment No. 1, Sewage, Aleppo Township Authority, P. O. Box 81, Sewickley, PA 15143-0081 is authorized to discharge from a facility located at the I-79 North STP, Aleppo Township, Allegheny County to receiving waters named Kilbuck Run.

INTENT TO ESTABLISH ALTERNATE SITE-SPECIFIC WATER QUALITY CRITERIA FOR COPPER

   NPDES Permit PA0027618. Bethel Park Municipal Authority, 5100 West Library Avenue, Bethel Park, PA 15102.

   Under 25 Pa. Code § 16.24(e), the Department proposes to amend NPDES Permit PA0027618 (Piney Fork STP) by incorporating the results of a water-effect ratio (WER) into the calculation of the water quality based effluent limit for copper. The WER is a biological determination of a site-specific aquatic life criterion, determined by conducting toxicity testing on sensitive aquatic species using site or simulated site water and comparing it to testing performed using lab dilution water. The WER procedure recognizes that the physical and chemical characteristics of site water can influence the toxicity of a chemical on aquatic life. On January 28, 2002, the Bethel Park Municipal Authority submitted a WER proposal to modify their NPDES copper limits for the Piney Fork STP. Following intensive review of their sampling protocol and study results, the EPA and the Department determined that the following WER is approvable.

   An alternate site-specific criteria for copper has been developed by multiplying the fish and aquatic life copper criteria contained in 25 Pa. Code Chapter 16, Appendix A., Table 1 by the WER for the POTW. The WER acts as a multiplier in the calculation of the NPDES permit limits for copper. These changes will affect the copper limits of the Piney Fork STP only.

   Comments must be received within 30 days from the date of this public notice. Comments received within this 30-day comment period will be considered in the formulation of the final determination regarding this proposal. Responses should include the name, address and telephone number of the writer and a concise statement to inform the Department of the exact basis of a comment and the relevant facts upon which it is based.

   Following the 30-day comment period, the Water Management Program Manager will amend the NPDES permit to reflect the WER calculated effluent limits for copper. A separate notice will be published in the Pennsylvania Bulletin for the permit action.

APPROVALS TO USE NPDES AND/OR OTHER GENERAL PERMITS

   The following parties have submitted: (1) Notices of Intent for Coverage under (1) General NPDES Permits to Discharge Wastewater into the Waters of the Commonwealth. The approval for coverage under these general NPDES permits is subject to applicable effluent limitations.    The approval of coverage for land application of sewage sludge or residential septage under these general permits is subject to pollutant limitations, pathogen and vector attraction reduction requirements, operational standards, general requirements, management practices and other conditions set forth in the respective permit. The Department of Environmental Protection approves the following coverage under the specific General Permit.

   The EPA Region III Administrator has waived the right to review or object to this permit action under the waiver provision 40 CFR 123.23(d).

PUBLIC WATER SUPPLY PERMITS

   The Department of Environmental Protection has taken the following actions on applications received under the Safe Drinking Water Act for the construction, substantial modification or operation of a public water system.

   Persons aggrieved by an action may appeal, under section 4 of the Environmental Hearing Board Act (35 P. S. § 7514) and 2 Pa.C.S. §§ 501--508 and 701--704 (relating to the Administrative Agency Law), to the Environmental Hearing Board, Second Floor, Rachel Carson State Office Building, 400 Market Street, P. O. Box 8457, Harrisburg, PA 17105-8457, (717) 787-3483. TDD users may contact the Environmental Hearing Board (Board) through the Pennsylvania Relay Service, (800) 654-5984. Appeals must be filed with the Board within 30 days of publication of this notice in the Pennsylvania Bulletin, unless the appropriate statute provides a different time period. Copies of the appeal form and the Board's rules of practice and procedure may be obtained from the Board. The appeal form and the Board's rules of practice and procedure are also available in Braille or on audiotape from the Secretary to the Board at (717) 787-3483. This paragraph does not, in and of itself, create any right of appeal beyond that permitted by applicable statutes and decision law.

   For individuals who wish to challenge an action, appeals must reach the Board within 30 days. A lawyer is not needed to file an appeal with the Board.

   Important legal rights are at stake, however, so individuals should show this notice to a lawyer at once. Persons who cannot afford a lawyer may qualify for free pro bono representation. Call the Secretary to the Board at (717) 787-3483 for more information.
