   17.  This Plan Approval authorizes temporary operation of the new or modified process equipment and operation of the catalytic oxidizer covered in this Plan Approval provided the following conditions are met (25 Pa. Code § 127.12b).

   a.  The Department must receive written notice from the owner/operator of the completion of the installation of the CATOX and the operator's intent to commence operation of the CATOX at least 5 working days prior to the completion of construction. Once the CATOX is installed increases of production can commence while the remainder of Phase 2 construction is completed.

   b.  Operation is authorized only to facilitate the start-up and shake-down of sources and cleaning devices, to permit operations pending the issuance of an Operating Permit or to permit the evaluation of the sources for compliance with all applicable regulations and requirements.

   c.  This condition authorizes temporary operation of the sources for a period of 180 days from the commencement of increased production, provided the Department receives notice from the owner/operator under subpart (a).

   d.  The owner/operator may request an extension if compliance with all applicable regulations and Plan Approval requirements has not been established. The extension request shall be submitted in writing at least 15 days prior to the end of this periods of temporary operation and shall provide a description of the compliance status of the source, a detailed schedule for establishing compliance and the reasons compliance has not been established.

   e.  The notice submitted by the owner/operator under subpart (a), prior to the expiration of this Plan Approval, shall modify the plan approval expiration date. The new plan approval expiration date shall be 180 days from the date of the written notice.

   Persons wishing to provide the Department with additional information which they believe should be considered prior to the issuance of the Plan Approval may submit the information to the Department at the following address. A 30-day comment period, from the date of this publication, will exist for the submission of comments. Written comments must contain the name, address and telephone number of the person submitting the comments, identification of the proposed Plan Approval (specify the Plan Approval number) and concise statements regarding the relevancy of the information or objections to issuance of the Plan Approval.

   A public hearing may be held, if the Department, in its discretion, decides that a hearing is warranted based on the information received. All persons submitting comments or requesting a hearing will be notified of the decision to hold a hearing by publication in a newspaper or the Pennsylvania Bulletin or by telephone, when the Department determines notification by telephone is sufficient.

   AMS 03038:  Coating and Converting Technologies Corp. (80 East Morris Street, Philadelphia, PA 19148) for installation of an adhesive coater with twin bed regenerative oxidizer. The emissions from the facility are restricted to less than 10 tons of a single HAP and less than 25 tons each of NOx, HAPs combined and VOCs in the City of Philadelphia, Philadelphia County. The plan approval will contain operating and recordkeeping requirements to ensure operation within all applicable requirements.

   AMS 03012:  Southwest Water Pollution Control Plant--Biosolids Recycling Center (8200 Enterprise Avenue, Philadelphia, PA 19153) for installation of four 25.5 mmBtu/hr boilers burning no. 2 fuel oil and digester gas to replace four existing boilers in the City of Philadelphia, Philadelphia County. There will be a reduction of 4.31 tpy of NOx emission because of BAT level controls on the new boilers. The plan approval will contain operating and recordkeeping requirements to ensure operation within all applicable requirements.

   09-00115:  Draper DBS, Inc. (1803 North 5th Street, Perkasie, PA 18944) in Perkasie Borough, Bucks County. The permit is for a non-Title V (State-only Synthetic Minor) facility. The facility's sources includes five spray booths. The permittee has elected to take an emission restriction to be compliant with synthetic minor requirements. The permit will include monitoring, recordkeeping and reporting requirements designed to keep the facility operating within all applicable air quality requirements.

   09-00165:  Boekel Industries, Inc. (855 Pennsylvania Boulevard, Feasterville, PA 19053) for a non-Title V Facility, State-only, Natural Minor Operating Permit in Lower Southampton Township, Bucks County. The permit is for the operation of a vapor degreaser, 2 powder paint booths, a bake oven, a boiler and 12 space heaters at the facility. HAP emissions from the vapor degreaser are restricted to 4 tons per year. VOC and PM emissions from their two paint booths figure to be negligible. Total PM and NOx emissions from the bake oven, boiler and 12 space heaters figure to be less than 2 tons per year. The permit will include monitoring, recordkeeping, reporting and work practice standards designed to keep the facility operating within all applicable air quality requirements.

   17-00018:  Harmony Area School District (R. D. 1, Box 96A, Westover, PA 16692) for their high school in Burnside Township, Clearfield County. The facility's main sources include two bituminous coal/natural gas/no. 2 fuel oil fired boilers. The facility has the potential to emit VOCs, HAPs, PM10, NOx, CO and SOx below the major emission thresholds. The proposed State-only operating permit contains all applicable regulatory requirements including monitoring, recordkeeping and reporting conditions.

   55-00014:  Bingaman and Son Lumber, Inc. (East Main Street, P. O. Box 247, Kreamer, PA 17833), for their lumber manufacturing facility in Middlecreek Township, Snyder County. The facility's main sources include two wood-fired boilers, ten steam heated kilns to dry hardwoods and woodworking operations (sawing, planning drilling, and the like). The facility has the potential to emit VOCs, HAPs, PM10, NOx, CO and SOx below the major emission thresholds. The proposed State-only operating permit contains all applicable regulatory requirements including monitoring, recordkeeping and reporting conditions.

   60-00003:  Pilling's FRP, Inc. (P. O. Box 119, West Milton, PA 17886) for their fiberglass reinforced plastic facility in White Deer Township, Union County. The facility's sources include three natural gas fired heaters, one spray booth, one resin transfer molding room, one prototype/lab room and one sanding booth. The facility has taken restrictions to limit potential HAPs and VOCs emissions below the major emission thresholds. The facility has the PM10, NOx, CO and SOx below the major emission thresholds. The proposed operating permit contains all applicable regulatory requirements including monitoring, recordkeeping and reporting conditions.

   17-00007:  Invensys Energy Metering Systems--North America, Inc. (805 Liberty Boulevard, DuBois, PA 15801) for their gas meter and regulator manufacturing facility in DuBois Borough, Clearfield County. The facility's main sources include three natural gas fired boilers, four natural gas fired air make-up units, two restroom heaters, an emergency generator, a paint burnoff oven, three rubber diaphragm curing ovens, three manual spray booths, an automated surface coating operation, two parts cleaners, resin application, shellac application, adhesive application, ink marking and solvent cleaning of glue guns. The facility has the potential to emit VOCs, HAPs, PM10, NOx, CO and SOx below the major emission thresholds. The proposed State-only operating permit contains all applicable regulatory requirements including monitoring, recordkeeping and reporting conditions.

   41-00037:  MET-FAB, Inc. (P. O. Box 5055, Jersey Shore, PA 17740), for their plant in Loyalsock Township, Lycoming County. The facility's main sources include one natural gas fired burn-off oven, one natural gas fired bake oven, one cold cleaning solvent parts washer, one powder coating booth and welding operations. The facility has the potential to emit SOx, NOx, CO, PM10, VOCs and HAPs below the major emission thresholds. The proposed operating permit contains all applicable regulatory requirements including monitoring, recordkeeping and reporting conditions.

   49-00030:  Sunbury Textile Mills, Inc. (P. O. Box 768, Sunbury, PA 17801), for their broadwoven cotton textile mills facility in City of Sunbury, Northumberland County. The facility's main sources include two natural gas/no. 2 fuel oil fired boilers. The facility has the potential to emit major quantities of SOx. The facility has taken a synthetic minor restriction to limit its SOx emissions below the major emission thresholds. The facility has the potential to emit NOx, CO, PM10, VOCs and HAPs below the major emission thresholds. The proposed operating permit contains all applicable regulatory requirements including monitoring, recordkeeping and reporting conditions.

   17-00019:  Waroquier Coal Co. (P. O. Box 128, Clearfield, PA 16830) for their coal processing facility in Lawrence Township, Clearfield County. The facility's main sources include a coal processing operation and coal rail car loadout operation. These sources have the potential to emit PM (PM10) below the major emission thresholds. The proposed operating permit contains all applicable requirements including Federal and State regulations. In addition, monitoring, recordkeeping and reporting conditions regarding compliance with all applicable requirements are included.

   14-00024:  Shain/Shop-Bilt, Inc. (509 Hemlock Street, Philipsburg, PA 16866) for their furniture manufacturing facility in South Philipsburg Borough, Centre County. The facility's main sources are two spray coating booths, one no. 2 fuel oil fired boiler, one no. 2 fuel oil fired heater, one no. 2 fuel oil storage tank and various pieces of woodworking machinery. The facility is classified as a natural minor facility since its potential to emit for PM-PM10, CO, VOCs, NOx, SOx and HAPs are below the major emission thresholds. The proposed operating permit contains all applicable requirements including Federal and State regulations. In addition, monitoring, recordkeeping and reporting conditions regarding compliance with all applicable requirements are included.

   59-00015:  Dalrymple Gravel and Contracting Co., Inc. (2105 South Broadway, Pine City, NY 14871) for their asphalt concrete plant in Richmond Township, Tioga County. The facility's main sources are one no. 2 fuel oil/natural gas fired drum mix asphalt plant and three no. 2 fuel oil storage tanks. The facility is classified as a natural minor facility since its potential to emit for PM-PM10, CO, VOCs, NOx, SOx and HAPs are below the major emission thresholds. The proposed operating permit contains all applicable requirements including Federal and State regulations. In addition, monitoring, recordkeeping and reporting conditions regarding compliance with all applicable requirements are included.

   17-00009:  Marathon Equipment Co. (901 Industrial Park Road, Clearfield, PA 16830), for their MECO-North plant in Lawrence Township, Clearfield County. The facility's main sources include 2 paint spray booths, 2 cold cleaning solvent parts washers, welding operations, 5 storage tanks and 70 combustion units. The facility has the potential to emit major quantities of VOCs and HAPs. The facility has taken a synthetic minor restriction to limit its VOCs and HAPs emissions below the major emission thresholds. The facility has the potential to emit SOx, NOx, CO and PM10 below the major emission thresholds. The proposed operating permit contains all applicable regulatory requirements including monitoring, recordkeeping and reporting conditions.

   59-00009:  Mansfield University (Brooks Maintenance Building, Mansfield University, Mansfield, PA 16933) for renewal of the State-only operating permit for the University campus in Mansfield Borough, Tioga County. The facility is currently operating under NMOP 59-00009, which was issued April 19, 1999. The facility's main sources include 3 main boilers, 22 emergency generators, 2 no. 2 fuel oil storage tanks and 41 other combustion units. The facility has the potential to emit SOx, NOx, CO, PM10, VOCs and HAPs below the major emission thresholds. The proposed operating permit contains all applicable regulatory requirements including monitoring, recordkeeping and reporting conditions.

   49-00048:  Blank Funeral Home (395 State Street, Sunbury, PA 17801) for their facility in Upper Augusta Township, Northumberland County. The facility's main source is a crematory incinerator. The facility is classified as a natural minor facility since its potential to emit for PM-PM10, CO, VOCs, NOx, SOx and HAPs are below the major emission thresholds. The proposed operating permit contains all applicable requirements including Federal and State regulations. In addition, monitoring, recordkeeping and reporting conditions regarding compliance with all applicable requirements are included.

   49-00038:  F. B. Leopold Co., Inc. (P. O. Box 128 Watsontown, PA 17777) for their coal drying, sizing and packaging facility in Delaware Township, Northumberland County. The facilities main sources include a fluid bed dryer, conveying, packaging, screening and storage equipment. These sources have the potential to emit CO, NOx, PM-PM10, SOx and VOC below the major emission thresholds. PUBLIC HEARINGS

   OP-23-0003:  ConocoPhillips Co. (4101 Post Road, Trainer, PA 19061) for approval of Reasonably Available Control Technology (RACT) Plan in Trainer Borough, Delaware County.

   This is notice of a proposed revision to the State Implementation Plan (SIP) for NOx and VOCs, and notice of public hearing.

   The Department has made a preliminary determination to approve a RACT plan as an amendment to the SIP for the facility. The proposed SIP revision does not adopt any new regulations. It incorporates the provisions and requirements contained in the RACT approval for this facility to comply with current regulations.

   This preliminary determination, if finally approved, will be incorporated into Plan Approvals and/or Operating Permits for the facility and will be submitted to the EPA as a revision to the Commonwealth's SIP.

   The following is a summary of the preliminary RACT determination for this facility:

   One public hearing will be held for the purpose of receiving comments on the proposed SIP revision. The hearing will be held at 2 p.m. on February 18, 2004, at the Department's Southeast Regional Office, 2 East Main Street, Norristown, PA. The hearing will offer the opportunity for oral comment to the Department on the proposed SIP revision and will not be a question and answer session. Persons wishing to present testimony at the hearing are encouraged to register prior to the hearing, but may also register at the hearing, by contacting Lynda Rebarchak, Community Relations Coordinator, (484) 250-5820. COAL AND NONCOAL MINING ACTIVITY APPLICATIONS

   Applications under the Surface Mining Conservation and Reclamation Act (52 P. S. §§ 1396.1--1396.19a); the Noncoal Surface Mining Conservation and Reclamation Act (52 P. S. §§ 3301--3326); and The Clean Streams Law (35 P. S. §§ 691.1--691.1001); the Coal Refuse Disposal Control Act (52 P. S. §§ 30.51--30.66); and The Bituminous Mine Subsidence and Land Conservation Act (52 P. S. §§ 1406.1--1406.21). Mining activity permits issued in response to the applications will also address the applicable permitting requirements of the following statutes: the Air Pollution Control Act (35 P. S. §§ 4001--4015); the Dam Safety and Encroachments Act (32 P. S. §§ 693.1--693.27); and the Solid Waste Management Act (35 P. S. §§ 6018.101--6018.1003).

   The following permit applications to conduct mining activities have been received by the Department of Environmental Protection (Department). A copy of the application is available for inspection at the District Mining Office indicated before an application. Where a 401 Water Quality Certification is needed for any aspect of a particular proposed mining activity, the submittal of the permit application will serve as the request for certification.

   Written comments, objections or requests for informal conferences on applications may be submitted by any person or any officer or head of any Federal, State or local government agency or authority to the Department at the same address within 30 days of this publication, or within 30 days after the last publication of the applicant's newspaper advertisement, as provided by 25 Pa. Code §§ 77.121--77.123 and 86.31--86.34.

   Where any of the mining activities listed will have discharges of wastewater to streams, the Department will incorporate NPDES permits into the mining activity permits issued in response to these applications. NPDES permits will contain, at a minimum, technology-based effluent limitations as identified in this notice for the respective coal and noncoal applications. In addition to the previous, more restrictive effluent limitations, restrictions on discharge volume or restrictions on the extent of mining which may occur will be incorporated into a mining activity permit, when necessary, for compliance with water quality standards (in accordance with 25 Pa. Code Chapters 93 and 95). Persons or agencies who have requested review of the NPDES permit requirements for a particular mining activity within the previously mentioned public comment period will be provided with a 30 day period to review and submit comments on those requirements.

   Written comments or objections should contain the name, address and telephone number of the person submitting comments or objections; application number; and a statement of sufficient detail to inform the Department on the basis of comment or objection and relevant facts upon which it is based. Requests for an informal conference must contain the name, address and telephone number of requestor; application number; a brief summary of the issues to be raised by the requestor at the conference; and a statement whether the requestor wishes to have the conference conducted in the locality of the proposed mining activities.

FEDERAL WATER POLLUTION CONTROL ACT, SECTION 401

   The following permit applications, requests for Environmental Assessment approval and requests for 401 Water Quality Certification have been received by the Department of Environmental Protection (Department). Section 401 of the Federal Water Pollution Control Act (FWPCA) (33 U.S.C.A. § 1341) requires the State to certify that the involved projects will not violate the applicable provisions of sections 301--303, 306 and 307 of the FWPCA (33 U.S.C.A. §§ 1311--1313, 1316 and 1317) as well as relevant State requirements. Persons objecting to approval of a request for certification under section 401 of the FWPCA or to the issuance of a Dam Permit, Water Obstruction and Encroachment Permit or the approval of an Environmental Assessment must submit comments, suggestions or objections within 30 days of the date of this notice, as well as questions, to the office noted before the application. Comments should contain the name, address and telephone number of the person commenting, identification of the certification request to which the comments or objections are addressed and a concise statement of comments, objections or suggestions including the relevant facts upon which they are based.

   The Department may conduct a fact-finding hearing or an informal conference in response to comments if deemed necessary. Individuals will be notified, in writing, of the time and place of a scheduled hearing or conference concerning the certification request to which the comment, objection or suggestion relates. Maps, drawings and other data pertinent to the certification request are available for inspection between 8 a.m. and 4 p.m. on each working day at the office noted before the application.

   To remove the existing structure and to construct and maintain a single-span prestressed concrete adjacent box beam bridge having a clear span of approximately 115 feet on a 45 degree skew, a minimum underclearance of approximately 7.1 feet and a width of 40 feet across Bowman Creek (HQ-CWF). The project is along SR 0029, Section 770, approximately 0.1 mile northwest of its intersection with SR 0309. The project also includes the construction of a temporary bridge approximately 40 feet downstream having a clear span of 100 feet and a width of approximately 25 feet (Noxen, PA Quadrangle N: 11.4 inches; W: 2.8 inches).

   To remove an existing 72-inch diameter corrugated metal pipe and to install and maintain a new 128-inch by 83-inch arch pipe 31 feet in length across Wildcat Run (CWF) for the purpose of promoting natural stream flow through an existing impoundment area approximately 3.4 miles east of Millerstown at a point along Hollow Road (T-494) (Reward, PA Quadrangle N: 7.38 inches; W: 14.8 inches) in Greenwood Township, Perry County.

   E08-410.  Department of Transportation, Engineering District 3-0, P. O. Box 218, Montoursville, PA 17754. Bridge replacement in Windham Township, Bradford County, ACOE Baltimore District (Windham, PA Quadrangle N: 10.66 inches; W: 15.41 inches).

   To: (1) remove the existing reinforced concrete slab bridge which has a normal clear span of 14.0 feet, a curb-to-curb width of 25.2 feet, a design underclearance of 5.33 feet and is on a 90° skew; and (2) construct and maintain a 14.0-fppt by 5.0-foot by 43-foot long reinforced concrete box culvert on a 90° skew with a curb-to-curb width of 26.0 feet, depressed 1 foot in the streambed with an effective waterway opening of 14 feet by 14 feet and with concrete wingwalls and R-6 rock protection placed at the wings and inlet and outlet cut off walls. The project will disturb approximately 0.42 acre of earth. The project will not impact wetlands while impacting approximately 50 feet of waterway. The West Branch of Parks Creek is a CWF.

   E17-387.  Ferguson Township, 1555 McGee Road, Curwensville, PA 16833-8120. Wendell Road bridge replacement over Gazzam in Ferguson Township, Clearfield County, ACOE Baltimore District (Curwensville, PA Quadrangle N: 2.9 inches; W: 11.2 inches).

   To remove an existing bridge and construct, operate and maintain a single-span bridge to carry Wendell Road (T-426) across Gazzam Run (HQ-CWF). The single-span bridge shall be constructed with a prestressed concrete spread box beams that provide a minimum normal span of 50 feet, clear width of 26 feet and underclearance of 4.5 feet. Since Gazzam Run is protected as a wild trout and stocked trout fishery, no construction or future repair work shall be conducted in or along the stream channel between October 1 and December 31 or April 1 and June 15 without the prior written permission from the Fish and Boat Commission. Bridge construction shall be conducted in stream low flow conditions and all in-stream abutment and wingwall construction shall be completed in dry work conditions through dam and pumping or fluming stream flow around work areas. Construction work also includes the installation of R-8 rock for footing scour protection. All rock scour protection shall have openings or voids choked with small, clean stone materials to avoid stream flow loss. The bridge construction project will permanently impact 0.01 acre of wetland while impacting 65 feet of waterway. The bridge construction project is long the eastern right-of-way of SR 0729 approximately 675 feet east of SR 0729 and Wendell Road (T-426) intersection. This permit authorizes the construction, operation, maintenance and removal of temporary stream diversions, cofferdams, road crossings and causeways. All temporary structures shall be constructed with clean rock, clear of fines; upon completion of the bridge, all structures removed with disturbed areas being restored to original contours and elevations. The 0.01 acre of wetland impacts incurred by bridge removal and construction are deemed de minimis and replacement of wetland 0.01 acre of wetland shall not be required.

   E17-388.  Ferguson Township, 1555 McGee Road, Curwensville, PA 16833-8120. Wagoner Road bridge replacement over Gazzam in Ferguson Township, Clearfield County, ACOE Baltimore District (Curwensville, PA Quadrangle N: 0.7 inch; W: 11.4 inches).

All temporary structures shall be constructed with clean rock, clear of fines; upon completion of the bridge, all structures removed with disturbed areas being restored to original contours and elevations. The 0.03 acre of wetland impacts incurred by bridge removal and construction are deemed de minimis and replacement of wetland 0.03 acre of wetland shall not be required.

   E18-369.  Department of Transportation, Engineering District 2-0, 1924-30 Daisy Street Extension, P. O. Box 342, Clearfield, PA 16830. SR 0144, Section A02, Structure Replacement over Drury Run in Noyes Township, Clinton County, ACOE Baltimore District (Renovo-West, PA Quadrangle N: 6.50 inches; W: 5.90 inches).

   To remove the existing bridge and to construct and maintain: (1) a 55-foot single-span prestressed concrete spread box beam bridge with a waterway opening of 312 square feet; and (2) R-8 riprap for scour protection on the left and right bank for 40 feet upstream and 25 feet downstream. This project proposes to permanently impact 150 feet of Drury Run (CWF) without any wetland impacts.

   E53-395.  Harrison Township, P. O. Box 92, Harrison Valley, PA 16927. Fox Hill Road bridge replacement over an unnamed tributary to Cowanesque River in Harrison Township, Potter County, ACOE Baltimore District (Potter Brook, PA Quadrangle N: 10.7 inches; W: 16.7 inches).

   To remove an existing single-span bridge and construct, operate and maintain a public road crossing an unnamed tributary to the Cowanesque River (CWF). The public road crossing shall be constructed to carry T-485 (Fox Hill Road) across the unnamed tributary with a single corrugated metal culvert pipe. The corrugated metal culvert pipe shall have a minimum diameter of 6 feet and a depression of 0.5 foot below the existing streambed elevations. The 6-foot diameter culvert pipe shall be installed between existing concrete bridge abutment with R-7 rip rap outlet protection along both stream banks. The public road crossing shall also include timber-cribbing headwalls. All construction and future work shall be conducted at stream low flow. As proposed, the project will not impact wetlands while impacting 50 feet of waterway. The Fox Hill Road project is along the northern right-of-way of SR 0049 approximately 4,100 feet north of T-485 and SR 0049 intersection. This permit does not authorize any temporary or permanent wetland impacts and as such, the permittee shall ensure no wetland impacts result from the removal of the existing bridge or construction of the proposed road crossing.

   E33-219,  Department of Transportation, District 10-0, 2550 Oakland Avenue, P. O. Box 429, Indiana, PA 15701-0429. DuBois-Jefferson County Airport access Road I-80 Interchange in Washington Township, Jefferson County, ACOE Pittsburgh District (Hazen, PA Quadrangle N: 4.8 inches; W: 1.9 inches).

   To conduct the following activities associated with construction of an interchange on I-80 approximately 300 feet west of the existing T-544 overpass 4 miles west of Falls Creek Borough as part of the construction of the DuBois-Jefferson County Airport Access Road Project:

   1.  Fill a total of 0.885 acre of wetland (consisting of 0.446 acre PEM, 0.122 acre PSS and 0.317 acre PFO) for construction of the realignment of T-544 and the entrance and exit ramps off of I-80.

   2.  Extend and maintain the existing 68-foot long, 10-foot wide by 6.5-foot high reinforced concrete box culvert in Norris Run (CWF) under the eastbound lanes of I-80 an additional 34 feet on the upstream end, resulting in a total structure length of 102 feet.

   3.  Realign approximately 150 linear feet of the channel of Norris Run extending upstream from the inlet of the extended box culvert under the eastbound lanes of I-80.

   4.  Extend and maintain the existing 74.5-foot long, 12-foot wide by 6.5-foot high reinforced concrete box culvert in Norris Run under the westbound lanes of I-80 an additional 25 feet on the downstream end, resulting in a total structure length of 99.5 feet.

   Project proposes creation of 1.263 acres of replacement wetlands along I-80 in the headwaters of Kyle Run upstream of Kyle Lake.

   E33-220,  Punxsutawney Borough, 301 East Mahoning Street, Punxsutawney, PA 15767. Center Alley Outfall/Headwall in Borough of Punxsutawney, Jefferson County, ACOE Pittsburgh District (Punxsutawney, PA Quadrangle N: 12.3 inches; W: 16.2 inches).

   To construct and maintain a 24-inch diameter storm sewer with a concrete endwall at a point approximately 400 feet southwest of the intersection of SR 36 and Grace Way just south of Water Street and discharging to the Mahoning Creek (WWF).

   E33-221,  Department of Transportation, District 10-0, Bells Mills Bridge No. 2 in McCalmont Township, Jefferson County, ACOE Pittsburgh District (Reynoldsville, PA Quadrangle N: 2.0 inches; W: 3.3 inches).

   To remove the existing concrete arch bridge having a single clear span of 31 feet, an under clearance of 8 feet, an approximate instream length of 17 feet and is set at a 75 degree left skew and to place fill within approximately 0.02 acre and temporarily impact an additional 0.02 acre of emergent/scrub-shrub wetlands and to construct and maintain a precast concrete box culvert having a clear span of 26 feet, an effective under clearance of 7 feet, an instream length of 40 feet and is set at a 75 degree skew carrying SR 2019, Section 551 across Bug Run (CWF) at Segment 0050, Offset 0797.

   E61-264,  Wyattville Country Store, 2810 US 322, Franklin, PA 16323. Wyattville Country Store Greenhouses in Sugarcreek Borough, Venango County, ACOE Pittsburgh District (Utica, PA Quadrangle N: 13.5 inches; W: 3.0 inches).

   To complete construction and operate and maintain greenhouse buildings and associated fill area measuring approximately 250 feet long by 150 feet wide by 1.5 feet deep within the mapped FEMA floodway of Sugar Creek between the existing building along SR 322 just east of SR 427 and the left bank of Sugar Creek. No in-stream work or wetland impacts occur as a result of this project.

FINAL ACTIONS TAKEN FOR NATIONAL POLLUTION DISCHARGE ELIMINATION SYSTEM (NPDES) PERMITS AND WATER QUALITY MANAGEMENT (WQM) PERMITS

   The Department of Environmental Protection (Department) has taken the following actions on previously received applications for new, amended and renewed NPDES and WQM permits, applications for permit waivers and Notices of Intent (NOI) for coverage under General Permits. This notice is provided in accordance with 25 Pa. Code Chapters 91 and 92 and 40 CFR Part 122, implementing provisions of The Clean Streams Law (35 P. S. §§ 691.1--691.1001) and the Federal Clean Water Act.

   Sections I--VI contain actions related to industrial, animal or sewage wastes discharges, discharges to groundwater and discharges associated with municipal separate storm sewer systems (MS4), stormwater associated with construction activities and concentrated animal feeding operations (CAFOs). Section VII contains notices for parties who have submitted NOI for coverage under General NPDES Permits. The approval for coverage under these General NPDES Permits is subject to applicable effluent limitations, monitoring, reporting requirements and other conditions set forth in each general permit. The approval of coverage for land application of sewage sludge or residential septage under applicable general permit is subject to pollutant limitations, pathogen and vector attraction reduction requirements, operational standards, general requirements, management practices and other conditions set forth in the respective permit. The permits and related documents, effluent limitations, permitting requirements and other information are on file and may be inspected and arrangements made for copying at the contact office noted before the action.

   Persons aggrieved by an action may appeal, under section 4 of the Environmental Hearing Board Act (35 P. S. § 7514) and 2 Pa.C.S. §§ 501--508 and 701--704 (relating to the Administrative Agency Law), to the Environmental Hearing Board, Second Floor, Rachel Carson State Office Building, 400 Market Street, P. O. Box 8457, Harrisburg, PA 17105-8457, (717) 787-3483. TDD users may contact the Environmental Hearing Board (Board) through the Pennsylvania Relay Service, (800) 654-5984. Appeals must be filed with the Board within 30 days of publication of this notice in the Pennsylvania Bulletin, unless the appropriate statute provides a different time period. Copies of the appeal form and the Board's rules of practice and procedure may be obtained from the Board.
