   The Department of Environmental Protection has taken the following actions on applications received under the Safe Drinking Water Act for the construction, substantial modification or operation of a public water system.

   Persons aggrieved by an action may appeal, under section 4 of the Environmental Hearing Board Act (35 P. S. § 7514) and 2 Pa.C.S. §§ 501--508 and 701--704 (relating to the Administrative Agency Law), to the Environmental Hearing Board, Second Floor, Rachel Carson State Office Building, 400 Market Street, P. O. Appeals must be filed with the Board within 30 days of publication of this notice in the Pennsylvania Bulletin, unless the appropriate statute provides a different time period. HAZARDOUS SITES CLEANUP UNDER THE ACT OF OCTOBER 18, 1988

Notice of Proposed Interim Response

Raymark Industries, Inc. Lower Mill Landfill Site, Manheim Township, Lancaster County

   The Department of Environmental Protection (Department), under the Hazardous Sites Cleanup Act (HSCA) (35 P. S. §§ 6020.102--6020.1303), is proposing an interim response at the Raymark Industries, Inc. (Raymark) Lower Mill Landfill (landfill), Manheim Borough, Lancaster County.

   The former 92-acre Raymark property is in the southeast portion of Manheim Borough, Lancaster County (USGS Manheim, PA Quadrangle map: North 40° 09` 29" latitude and West 76° 24` 34" longitude). This property can be found by measuring 6 1/2 inches north and 2 1/2 inches west of the southeastern corner of the map.

   The 4.7-acre landfill is at the southern and southeastern borders of the Raymark property. This former disposal area (Site) comprises approximately 1.9 acres of the landfill area. The Site consists of a former in-filled lagoon and adjacent railroad right-of-way where waste and contaminated soil were placed. The Site is bordered to the north by the Norfolk Southern Railway Company and Pennsylvania Lines LLC right-of-way, to the west by Chickies Creek, to the east by Doe Run (tributary of Chickies Creek) and to the south by the confluence of Chickies Creek and Doe Run.

   Prior to 1900, the Site was farmland. Plant operations began in 1908. These operations produced dry clutch brake linings or pads and other specialized friction products. The plant has produced these products throughout its history. All manufacturing operations were phased out during the 1990s. The Site was originally used as a settling basin/lagoon. Currently, this area contains lead and asbestos contaminated soil and solid waste with lead and asbestos content.

   The Department proposes an interim response at this Site to protect public health and safety or the environment. This determination is based on the actual and potential human exposure to hazardous substances via inhalation, ingestion and dermal contact.

   The Department is considering three alternatives: (1) No action, which allows the hazardous substances and contaminants to remain in place without modification. (2) Excavation of contaminated soil and waste from the railroad right-of-way with onsite disposal on the existing landfill, adding a 2-foot protective soil cover to the landfill area, institutional controls to prevent intrusive activities in the landfill area and routine groundwater monitoring. (3) Excavation of contaminated soil from the railroad right-of-way, removal of 2 feet of waste from the landfill area with off-site disposal, adding a 2-foot protective soil cover to the landfill area assuming original elevations and institutional controls and routine groundwater monitoring.

   The Department is providing this notice under sections 505(b) and 506(b) of the HSCA (35 P. S. §§ 6020.505(b) and 6020.506(b)) and the publication of this notice starts the administrative record period under the HSCA. The Administrative Record, which contains information about the Site and supports the Department's decision to perform this action at the Site, is available for public review and comment. The Administrative Record can be examined from 8 a.m. to 4 p.m. at the Department's Southcentral Regional Office, 909 Elmerton Avenue, Harrisburg, PA 17110 by contacting Barbara Faletti, (717) 705-4864.    The Administrative Record will be open for comment from the date of publication of this notice in the Pennsylvania Bulletin and will remain open for 90 days.    The public will have an opportunity to present oral comments regarding the proposed action at a public hearing. The hearing has been scheduled for February 4, 2004, at 7 p.m. at the Manheim Central Middle School Auditorium, 123 East Gramby Street, Manheim, PA. The entrance to the auditorium is off Hazel Street. Notice of Proposed Interim Response

Boldan-Davis Site, Penn Township,
Westmoreland County

   The Department, under the HSCA, is proposing an interim response at the Boldan-Davis Site (Site), Penn Township, Westmoreland County. The Site is adjacent to Bolen Lane, approximately 0.25 mile south of Route 130. The Site consists of an area on the Davis and Blaine properties that contains an unknown quantity of buried and partially buried drums.

   The Department has recently completed an investigation of the Site and is currently conducting an interim response at the Boldan Landfill Site (landfill), which is immediately adjacent to the south of the Site. William Bolen, the original owner and operator of the landfill, also owned the Site. William Bolen began operating an unpermitted landfill in 1958 that apparently included the landfill as well as the Site. Prior to waste disposal, the Site was used for coal strip mining. It appears that waste was deposited in pits left from the mining operation. The Site is currently used for residential purposes.

   During the investigation, it was determined that waste is buried in a semicircle area at the base of the large hill on the Site. The buried waste portion of the Site is approximately 0.5 acre in size and contains pockets of industrial wastes including numerous 55-gallon drums and various amounts of debris. Samples collected during the investigation indicated the presence of hazardous substances in Site soil, groundwater and waste materials. The buried drums are in various states of deterioration. Continued deterioration of the buried drums will lead to a larger release of hazardous substances and a more extensive clean up. Several drums are also exposed at the surface presenting a direct contact threat. The current Site conditions present a substantial danger to the public health and the environment.

   The Department considered several alternatives at the Site, including: no action; securing of the site; and removal and disposal of the hazardous substances at the Site. The Department determined that removal and disposal of the hazardous substances was the appropriate course of action. This alternative was selected because it complied with all applicable laws and regulations and was determined to be the most environmentally sound procedure for the Site.

   Fieldwork for the prompt interim response to remove and dispose of the waste at the Site is anticipated to begin in early January 2004. All hazardous materials at the Site will be removed and properly disposed. The Department, following the public hearing and comment period, will complete a Statement of Decision and Response to Comments.

   This notice is being provided under sections 505(b) and 506(b) of the HSCA. The administrative record contains the information that forms the basis and documents the selection of this response action is available for public review and comment at the Department's Southwest Regional Office in Pittsburgh and is available for review Monday through Friday from 8 a.m. to 4 p.m.

   The administrative record will be open for comment from December 20, 2003, until March 20, 2004. LAND RECYCLING AND ENVIRONMENTAL REMEDIATION

UNDER ACT 2, 1995

PREAMBLE 2


The following plans and reports were submitted under the Land Recycling and Environmental Remediation Standards Act (35 P. S. §§ 6026.101--6026.908).

   Provisions of Chapter 3 of the Land Recycling and Environmental Remediation Standards Act (act) require the Department of Environmental Protection (Department) to publish in the Pennsylvania Bulletin a notice of submission of plans and reports. A final report is submitted to document cleanup of a release of a regulated substance at a site to one of the act's remediation standards. A final report provides a description of the site investigation to characterize the nature and extent of contaminants in environmental media, the basis for selecting the environmental media of concern, documentation supporting the selection of residential or nonresidential exposure factors, a description of the remediation performed and summaries of sampling analytical results which demonstrate that remediation has attained the cleanup standard selected. Submission of plans and reports, other than the final report, shall also be published in the Pennsylvania Bulletin. These include the remedial investigation report, risk assessment report and cleanup plan for a site-specific standard remediation. A remedial investigation report includes conclusions from the site investigation, concentration of regulated substances in environmental media; benefits of refuse of the property and, in some circumstances, a fate and transport analysis If required, a risk assessment report describes potential adverse effects caused by the presence of regulated substances. If required, a cleanup plan evaluates the abilities of potential remedies to achieve remedy requirements.

   For further information concerning plans or reports, contact the Environmental Cleanup Program Manager in the Department regional office after which the notice of receipt of plans or reports appears. If information concerning plans or reports is required in an alternative form, contact the Community Relations Coordinator at the appropriate regional office.    Mancill Mill Road Site, Upper Merion Township, Montgomery County. Matthew D. Williams, Advantage Engineering, 20 S. 36th St., Camp Hill, PA 17011, has submitted a Remedial Investigation Report concerning remediation of site soil contaminated with asbestos.

   Spring Mill Development Inc., Plymouth Township, Montgomery County. Michael Christie, P. G., Penn E & R, Inc., 2755 Bergey Rd., Hatfield, PA 19440, has submitted a Final Report concerning remediation of site soil contaminated with lead, heavy metals, pesticides, solvents, BTEX, PHC and PAH. The report is intended to document remediation of the site to meet Site-Specific Standards.

   Simpson Mid-Town, City of Philadelphia, Philadelphia County. Richard A. Pellissier, Accredited Environmental Technologies, Inc., 28 N. Pennell Rd., Media, PA 19063, on behalf of Simpson Mid-Town, Rev. David Powell, 150 Monument Rd., Suite 405, Bala Cynwyd, PA 19004, has submitted a Remedial Investigation/Final Report concerning remediation of site soil contaminated with lead. The report is intended to document remediation of the site to meet Site-Specific Standards.

   Northcentral Region:  Environmental Cleanup Program Manager, 208 West Third Street, Williamsport, PA 17701.

   Ocker's Fuel Oil, Inc., Loyalsock Township, Lycoming County. Converse Consultants, on behalf of Robert Ocker, 1 Woodbryn Drive, Williamsport, PA 17701, has submitted a Final Report concerning site soil and groundwater contaminated with BTEX and PHCs. This Final Report is intended to demonstrate remediation of this site to meet the Site-Specific Standard.

   SMS Sutton, Bellefonte Borough, Centre County. Chambers Environmental Group, Inc., on behalf of SMS Eumoco, Inc., 234 South Potter Street, Bellefonte, PA 16823, has submitted a Remedial Investigation Report and Risk Assessment Report concerning soil and groundwater contaminated with lead and inorganics. These reports have been submitted in partial fulfillment of the Site-Specific Standard. See additional information in the Actions section of this Pennsylvania Bulletin.

   Mifflinburg Area School District Bus Barn, Mifflinburg Borough, Union County. Molesevich Environmental on behalf of Mifflinburg Area School District, 178 Maple Street, P. O. Box 285, Mifflinburg, PA 17844 has submitted Remedial Investigation Report and a Final Report concerning soil and groundwater contaminated with diesel fuel, leaded gasoline and unleaded gasoline. This combined submission is intended to demonstrate remediation of this site to meet the Site-Specific Standard.

LAND RECYCLING AND ENVIRONMENTAL REMEDIATION

A final report is submitted to document cleanup of a release of a regulated substance at a site to one of the remediation standards of the act. A final report provides a description of the site investigation to characterize the nature and extent of contaminants in environmental media, the basis of selecting the environmental media of concern, documentation supporting the selection of residential or nonresidential exposure factors, a description of the remediation performed and summaries of sampling methodology and analytical results which demonstrate that the remediation has attained the cleanup standard selected. Plans and reports required by provisions of the act for compliance with selection of remediation to a Site-Specific Standard, in addition to a final report, include a remedial investigation report, risk assessment report and cleanup plan. A remedial investigation report includes conclusions from the site investigation, concentration of regulated substances in environmental media, benefits of refuse of the property and, in some circumstances, a fate and transport analysis If required, a risk assessment report describes potential adverse effects caused by the presence of regulated substances. If required, a cleanup plan evaluates the abilities of potential remedies to achieve remedy requirements. A work plan for conducting a baseline remedial investigation is required by provisions of the act for compliance with selection of a special industrial area remediation. The baseline remedial investigation, based on the work plan, is compiled into the baseline environmental report to establish a reference point to show existing contamination, describe proposed remediation to be done and include a description of existing or potential public benefits of the use or reuse of the property. The Department may approve or disapprove plans and reports submitted. This notice provides the Department's decision and, if relevant, the basis for disapproval.

   For further information concerning the plans and reports, contact the environmental cleanup program manager in the Department regional office after which the notice of the plan or report appears. If information concerning a final report is required in an alternative form, contact the community relations coordinator at the appropriate regional office. The report documented attainment of the Statewide Health Standard and was approved on November 25, 2003.

This submission was made in partial fulfillment of the Site-Specific Standard. This report was approved by the Department on November 25, 2003.

Chambers Environmental Group, Inc., on behalf of SMS Eumoco, Inc., 234 South Potter Street, Bellefonte, PA 16823, has submitted a Remedial Investigation Report and Risk Assessment Report concerning soil and groundwater contaminated with lead and inorganics.
