Proposed Special Regulation Designations and Redesignations

   The Fish and Boat Commission (Commission) has approved guidelines with regard to encouraging public participation on possible changes to the designation of streams, stream sections or lakes for special regulation programs. Under 58 Pa. Code Chapter 65 (relating to special fishing regulations), the Commission designates certain streams, stream sections and lakes as being subject to special fishing regulations. These designations are effective after Commission approval when they are posted at the site and a notice is published in the Pennsylvania Bulletin. Under the Commission's guidelines, a notice concerning the proposed designation or redesignation of a stream, stream section or lake under special regulations ordinarily will be published in the Pennsylvania Bulletin before the matter is reviewed by the Commissioners.

   At the next Commission meeting on January 26 and 27, 2004, the Commission will consider designating or redesignating the following streams, stream sections and lakes as waters subject to special fishing regulations under 58 Pa. Code Chapter 65, effective January 1, 2005:

58 Pa. Code § 65.1.  Selective Harvest Program.

   The Commission will consider removing the following stream sections from the list of waters regulated and managed under the Selective Harvest Program under 58 Pa. Code § 65.1:

Clinton Young Womans Creek, Right Branch From State forest property line upstream to Beechwood Trail, a distance of 5.5 miles
Potter Lyman Run Lyman Run Lake upstream to Splash Dam Hollow, a distance of 4.0 miles

58 Pa. Code § 65.4b.  All-Tackle Selective Harvest Program.

   The Commission will consider removing the following stream section from the list of waters regulated and managed under the All-Tackle Selective Harvest Program under 58 Pa. Code § 65.4b:

Westmoreland Camp Run From the headwaters downstream to the mouth, a distance of 4.1 miles

58 Pa. Code § 65.6.  Delayed harvest artificial lures only areas.

   The Commission will consider designating the following water as a delayed harvest artificial lures only area to be regulated and managed under 58 Pa. Code § 65.6:

Clinton Young Womans Creek From Beechwood Trail downstream to a point 0.75 mile upstream of the confluence with Young Womans Creek, Left Branch, a distance of 5.7 miles

58 Pa. Code § 65.8.  Warmwater/coolwater species special conservation waters.

   The Commission will consider removing the following lakes from the list of waters regulated and managed as warmwater/coolwater species special conservation waters under 58 Pa. Code § 65.8:

58 Pa. Code § 65.9. Big bass special regulations.

   The Commission will consider designating the following lakes to be regulated and managed under the big bass special regulations and adding them to the list of waters subject to 58 Pa. Code § 65.9:

Westmoreland Northmoreland Lake

58 Pa. Code § 65.10.  Select Trout Stocked Lake Program.

   The Commission will consider adding the following lake to the list of waters regulated and managed under the Select Trout Stocked Lake Program under 58 Pa. Code § 65.10:

Westmoreland Upper Twin Lake

58 Pa. Code § 65.11.  Panfish enhancement special regulation.

   The Commission will consider adding the following lakes to the list of waters to be regulated and managed under the panfish enhancement special regulation under 58 Pa. Code § 65.11:

Westmoreland Northmoreland Lake Sunfish and crappie

58 Pa. Code § 65.13. Wild brook trout enhancement.

   The Commission will consider adding the following waters to the list of waters to be regulated and managed under the wild brook trout enhancement regulations under 58 Pa. Code § 65.13:

Carbon Jeans Run From border of State Game Lands No. 141 upstream on Jeans Run to its headwaters, a distance of 2.5 miles, and all tributaries entering this portion of Jeans Run
Forest and Warren Minister Creek Watershed Entire watershed, which includes 5.0 miles of Minister Creek and its tributaries
Monroe Kistler Run Watershed Entire watershed, which includes 3.1 miles of Kistler Run and its tributaries
Monroe Wolf Swamp Run Watershed Entire watershed, which includes 2.1 miles of Wolf Swamp Run and its tributaries
Perry Shaeffer Run Tuscarora State Forest upstream on Shaeffer Run to its headwaters, a distance of 4.9 miles, and all tributaries entering this portion of Shaeffer Run
Potter Birch Run Watershed Entire watershed, which includes 5.3 miles of Birch Run and its tributaries
Potter Lyman Run Lyman Lake upstream on Lyman Run to its headwaters, a distance of 5.3 miles, and all tributaries entering this portion of Lyman Run
Westmoreland Camp Run Watershed Entire watershed, which includes 4.1 miles of Camp Run and its intermittent flow tributaries

   At this time, the Commission is soliciting public input concerning the designations and redesignations. Persons with comments, objections or suggestions concerning the designations and redesignations are invited to submit comments in writing to Executive Director, Fish and Boat Commission, P. O. Box 67000, Harrisburg, PA 17106-7000, within 30 days after publication of this notice in the Pennsylvania Bulletin. Comments submitted by facsimile will not be accepted.

   Comments also may be submitted to ra-pfbcregs@state.pa.us. A subject heading of the proposal and a return name and address must be included in each transmission. In addition, all electronic comments must be contained in the text of the transmission, not in an attachment. If an acknowledgment of electronic comments is not received by the sender within 2 working days, the comments should be retransmitted to ensure receipt.
