Availability of Pennsylvania General Permit for Processing/Beneficial Use of Residual Waste (WMGR096)

   The Department of Environmental Protection (Department) authorizes General Permit WMGR096 for the beneficial use of regulated fill when moved offsite or received onsite. Under this General Permit, regulated fill may only be moved to a property that is approved for construction and that is zoned and used exclusively for commercial and industrial uses or that is unzoned but is exclusively used for commercial and industrial uses (excluding parks, playgrounds, nursing homes, child care facilities, schools or other residential-style facilities or recreation areas). This General Permit does not authorize blending or processing of material to meet concentration limits specified in Table GP-1 of the General Permit. This General Permit is issued under the authority of the Solid Waste Management Act (35 P. S. §§ 6018.101--6018.1003), the Pennsylvania Used Oil Recycling Act (58 P. S. §§ 471--480), The Clean Streams Law (35 P. S. §§ 691.1--691.1001), sections 1905-A, 1917-A and 1920-A of The Administrative Code of 1929 (71 P. S. §§ 510-5, 510-17 and 510-20) and the Municipal Waste Planning, Recycling and Waste Reduction Act (53 P. S. §§ 4000.101--4000.1904).

   Notice for public comment on proposed General Permit WMGR096 was published at 33 Pa.B. 5573 (November 8, 2003) with provision for a 62-day public comment period, which concluded on January 9, 2004.

   This General Permit begins on April 13, 2004, and will expire at 12 a.m. on April 13, 2009.
