LAND RECYCLING AND ENVIRONMENTAL REMEDIATION
UNDER ACT 2, 1995
PREAMBLE 1
Acknowledgment of Notices of Intent to Remediate Submitted under the Land Recycling and Environmental Remediation Standards Act (35 P. S. §§ 6026.101--6026.908).
Sections 302--305 of the Land Recycling and Environmental Remediation Standards Act (act) require the Department of Environmental Protection (Department) to publish in the Pennsylvania Bulletin an acknowledgment noting receipt of Notices of Intent to Remediate. An acknowledgment of the receipt of a Notice of Intent to Remediate is used to identify a site where a person proposes to, or has been required to, respond to a release of a regulated substance at a site. Persons intending to use the Background Standard, Statewide Health Standard, the Site-Specific Standard or who intend to remediate a site as a special industrial area must file a Notice of Intent to Remediate with the Department. A Notice of Intent to Remediate filed with the Department provides a brief description of the location of the site, a list of known or suspected contaminants at the site, the proposed remediation measures for the site and a description of the intended future use of the site. A person who demonstrates attainment of one, a combination of the cleanup standards or who receives approval of a special industrial area remediation identified under the act will be relieved of further liability for the remediation of the site for any contamination identified in reports submitted to and approved by the Department. Furthermore, the person shall not be subject to citizen suits or other contribution actions brought by responsible persons not participating in the remediation.
Under sections 304(n)(1)(ii) and 305(c)(2) of the act, there is a 30-day public and municipal comment period for sites proposed for remediation using a Site-Specific Standard, in whole or in part, and for sites remediated as a special industrial area. This period begins when a summary of the Notice of Intent to Remediate is published in a newspaper of general circulation in the area of the site. For the sites identified, proposed for remediation to a Site-Specific Standard or as a special industrial area, the municipality within which the site is located may request to be involved in the development of the remediation and reuse plans for the site if the request is made within 30 days of the date specified. During this comment period, the municipality may request that the person identified as the remediator of the site develop and implement a public involvement plan. Requests to be involved and comments should be directed to the remediator of the site.
For further information concerning the content of a Notice of Intent to Remediate, contact the environmental cleanup program manager in the Department regional office before which the notice appears. If information concerning this acknowledgment is required in an alternative form, contact the community relations coordinator at the appropriate regional office. Socks, Response Env., Inc., 912 Spring Cir., Mechanicsburg, PA 17055 on behalf of MaryAnn Riess, 3232 Limestone Rd., Cochranville, PA 19330 has submitted a Notice of Intent to Remediate. Soil at the site was impacted with No. 2 fuel oil. Oil filled a second AST without equalizing the oil between two tanks causing the overflow. The property is residential.
2345-51 South Swanson Street Property, City of Philadelphia, Philadelphia County. Darryl Borrelli, Manko, Gold, Katcher & Fox, LLP, 401 City Ave., Suite 500, Bala Cynwyd, PA 19004 on behalf of James Piacentino, Trustee for Pearla Piacentino, 918 Eisenhower St., Woodlyn, PA 19094 has submitted a Notice of Intent to Remediate. Soil and groundwater at the site have been contaminated with other organics and inorganics. The site was used to manufacture dyes and as a scrap yard. The proposed future use of the property will be for use as a vocational school.

AIR QUALITY
PLAN APPROVAL AND OPERATING PERMIT APPLICATIONS
NEW SOURCES AND MODIFICATIONS The Department of Environmental Protection (Department) has developed an ''integrated'' plan approval, State operating permit and Title V operating permit program. This integrated approach is designed to make the permitting process more efficient for the Department, the regulated community and the public. This approach allows the owner or operator of a facility to complete and submit all the permitting documents relevant to its application one time, affords an opportunity for public input and provides for sequential issuance of the necessary permits.
The Department has received applications for plan approvals and/or operating permits from the following facilities.
Copies of the applications, subsequently prepared draft permits, review summaries and other support materials are available for review in the regional office identified in this notice. Persons interested in reviewing the application files should contact the appropriate regional office to schedule an appointment.
Persons wishing to receive a copy of a proposed plan approval or operating permit must indicate their interest to the Department regional office within 30 days of the date of this notice and must file protests or comments on a proposed plan approval or operating permit within 30 days of the Department providing a copy of the proposed document to that person or within 30 days of its publication in the Pennsylvania Bulletin, whichever comes first. Interested persons may also request that a hearing be held concerning the proposed plan approval and operating permit. Comments or protests filed with the Department regional offices must include a concise statement of the objections to the issuance of the Plan approval or operating permit and relevant facts which serve as the basis for the objections. If the Department schedules a hearing, a notice will be published in the Pennsylvania Bulletin at least 30 days prior the date of the hearing.

This facility will generate electric power for the electric power grid from landfill gas generated by the Blue Ridge Landfill. The facility is in Greene Township, Franklin County.
36-05087B: Morgan Corp. (P. O. Box 588, 35 Thousand Oaks Boulevard, Morgantown, PA 19543-0588) for installation of a new paint booth with high volume low pressure spray guns. This source will be controlled by the use of dry filters to control particulate matter emissions. The facility is in Ephrata Borough, Lancaster County.

40-302-149: Fairchild Semiconductor (125 Crestwood Road, Mountaintop, PA 18707) for construction of a 12.5 mmBtu/hr natural gas and No. 2 fuel oil fired boiler at their manufacturing facility, in Wright Township, Luzerne County. This facility is not a Title V facility. The boiler will utilize low-NOx burners and flue gas recirculation to reduce NOx emissions to a maximum of 2.84 tons per year. Potential emissions of carbon monoxide and sulfur dioxide will be 4.5 tons per year and 0.6 ton per year, respectively. The boiler in the operation is subject to Subpart Dc of the Federal Standards of Performance for New Stationary Sources for Small Industrial-Commercial-Institutional Steam Generating Units, 40 CFR 60.40c--60.48c. The plan approval will include all appropriate monitoring, fuel restrictions, recordkeeping and reporting requirements designed to keep the boiler operating within all applicable air quality requirements.
45-301-029: H G Smith Wilbert Vault Co. (2120 North Fifth Street, Stroudsburg PA 18360) for installation of a new Animal Remains Crematory Incinerator at their facility in Stroudsburg, Monroe County. The unit will have a rated capacity of 75 lbs/hr and fire on natural gas. The minimum operating temperature of 1,800° F shall be maintained with a minimum gas retention time of 1 second. Particulate emissions shall not exceed 0.08 grain/dscf, corrected to 7% O2. Visible air contaminants shall not be emitted in a way that the opacity of the emissions is equal to or greater than 10% for a period or periods aggregating more than 3 minutes in any 1 hour; or equal to or greater than 30% at any time. The company currently has a Title V Natural Minor Permit NM45-00010. The Plan Approval and Operating Permit will include testing, monitoring, recordkeeping and reporting requirements designed to keep the source operating within all applicable air quality requirements. The Plan Approval will, in accordance with 25 Pa. Code § 127.450, be incorporated into the Title V Natural Minor Operating Permit through an administrative amendment at a later date.
45-317-002: Horizon Milling LLC (P. O. Box 147, Mount Pocono, PA 18344) for construction and operation of their new C-Mill whole wheat process and associated air cleaning device (fabric filter) at their facility on Harvest Lane and Route 940 in Mt. Pocono Borough, Pocono Township, and Tobyhanna Township, Monroe County. The particulate emissions from the new C-Mill will be controlled by a new baghouse. The expected particulate emission rate will be less than 0.02 grain/dscf. The company will operate the process and maintain the equipment in accordance with the good engineering practices to assure proper operation of the system. The Plan Approval and Operating permit will contain additional record keeping and operating restrictions, that are designed to keep the facility operating within all applicable air quality requirements once the equipment is constructed and operational in compliance with all requirements, in accordance with 25 Pa. Code § 127.450.

06-05002F: Lehigh Cement Co. (537 Evansville Road, Fleetwood, PA 19522-8541) for construction and modification of their clinker handling system controlled by seven fabric collectors in Maidencreek Township, Berks County. The approval will permit the applicant to replace the existing handling system with a new system that will minimize the handling of the clinker and improve the emission control efficiency. The facility is subject to 40 CFR Part 63, Subpart LLL, National Emission Standards for Hazardous Air Pollutants from Portland Cement Plants. The plan approval will include monitoring, testing, work practices, recordkeeping and reporting requirements designed to keep the source operating within all applicable air quality requirements. The facility is presently covered by the Title V Operating Permit No. 06-05002. The plan approval will be incorporated into this permit in accordance with 25 Pa. Code § 127.450.
07-03049A: AP Green Refractories, Inc. (R. D. No. 1, Box 588D, Claysburg, PA 16625) for modification of the rotary dryer and No. 2 castable processes and the replacement of a ball mill and various fabric collectors in Greenfield Township, Blair County. This is a non-Title V (State-Only) facility. Standard recordkeeping and operating restrictions will be included to keep the facility operating within all applicable air quality requirements.
28-05034A: Grove US LLC (1565 Buchanan Trail East, Shady Grove, PA 17256) for modification of a chrome electroplating system at their plant in Quincy Township, Franklin County. The modifications include the installation of mist eliminators and scrubbers for emissions control. This action will not measurably impact emissions from the facility. The chrome electroplating system is subject to 40 CFR Part 63, Subpart N--National Emission Standards for Chromium Emissions from Hard and Decorative Chromium Electroplating and Chromium Anodizing Tanks. The plan approval will include provisions for testing, recordkeeping, monitoring, reporting and work practice standards to ensure the facility complies with the applicable air quality requirements.

The plan approval will include emission limits and provisions for recordkeeping, monitoring, training and reporting to ensure the facility complies with the applicable air quality requirements.
44-05002D: CNH America LLC (36 Maple Street, Belleville, PA 17004) for modification of the annual VOC emission limits for the plant in Union Township, Mifflin County. Total plant VOC emissions will not change. This action will establish a plant-wide VOC emissions limit that will replace the existing emission limits on various paint lines. The plan approval will include emission limits and provisions for recordkeeping, monitoring and reporting to ensure the facility complies with the applicable air quality requirements. The plant currently operates under Title V Operating Permit No. 44-05002.
67-05004H: P. H. Glatfelter Co. (228 South Main Street, Spring Grove, PA 17362-0500) for installation of a selective noncatalytic control system on Power Boiler No. 5 in Spring Grove Borough, York County. The system will utilize aqueous ammonia (less than 20% by weight) and is expected to lower NOx emissions by 200 tons per year. The plan approval will include monitoring, recordkeeping, reporting and work practice standards designed to keep the facility operating within all applicable air quality requirements.

PA-30-00077A: Texas Eastern Transmission, LP (P. O. Box 1642, Houston, TX 77251-1642) for modification of an existing turbine at their Holbrook Compressor Station in Wind Ridge, Greene County.
In accordance with 25 Pa. Code §§ 127.44(b) and 127.424(b), the Department of Environmental Protection (Department) intends to issue Air Quality Plan Approval PA-30-00077A to Texas Eastern Transmission, L.P., P. O. Box 1642, Houston, TX 77251-1642, for their Holbrook Compressor Station located in Wind Ridge, Greene County. The facility currently has a Title V Operating Permit No. TV-30-00077. The provisions of this plan approval will subsequently be incorporated into the Title V Operating Permit through an amendment in accordance with 25 Pa. Code § 127.450.
The proposed modification of an existing turbine is subject to the applicable requirements of 25 Pa. Code Chapter 127. The Department believes that the facility will meet these requirements by complying with the following Plan Approval conditions:
The facility is to be constructed in accordance with the plans submitted with the application (as approved).
Upon completion of the turbine modification, an amendment to Title V Operating Permit No. TV-30-00077 must be obtained. Notify the Department when the turbine modification is completed so that the modified equipment can be inspected.
1. This Plan Approval authorizes Texas Eastern Transmission, L. P. to modify an existing Solar Model Mars 100-14000s stationary gas turbine to a Solar Model Mars 100-15000s stationary gas turbine and operate the modified gas turbine at the company's Holbrook Compressor Station located in Wind Ridge, Greene County. (25 Pa. Code § 127.12b)
2. The modified turbine shall be equipped with dry low NOx combustors for use during the combustion of natural gas. (25 Pa. Code § 127.12b)
3. The emissions of NO2, CO and VOCs from the turbine, with the operation of the DLN combustors during the combustion of natural gas, on a 12 consecutive month rolling average basis shall not exceed the following (25 Pa. Code § 127.12b)

5. The hourly emission limits established above do not apply during startup and shutdown. Startup/shutdown emissions and emissions during a failure of the emission controls must be included in determination of compliance with annual emission limits. (25 Pa. Code § 127.12b)
6. The stationary turbine is subject to the applicable requirements of the 40 CFR Part 60, Subpart GG--Standards of Performance for Stationary Gas Turbines. (25 Pa. Code § 127.12b)
7. The owner/operator shall record hours of operation for the turbine and the amount of fuel (natural gas) consumed on a daily basis. (25 Pa. Code § 127.12b)
8. The owner/operator shall comply with the applicable reporting requirements of 40 CFR 60.7 and 60.334.
9. In accordance with 40 CFR 60.4, copies of all requests, reports, applications, submittals and other communications shall be forwarded to both the Environmental Protection Agency and the Department at the following addresses, unless otherwise noted:

Pittsburgh, PA 15222-474510. The owner/operator shall maintain a current tariff sheet that specifies that the maximum total sulfur content of the natural gas fuel is 20.0 grains/100 SCF, or less. (40 CFR 334(h)(3i)). Fuel nitrogen content is not required to be monitored since the NOx standard was calculated using an F value of zero. (40 CFR 60.334(h)(2))
11. All logs and required records shall be maintained for a minimum of 5 years and be made available to the Department upon request. (25 Pa. Code § 127.12b)
12. Compliance with the turbine emission limitations for NOx, CO and VOC shall be demonstrated through performance testing. (25 Pa. Code § 127.12b)
a. All stack testing shall be performed in accordance with 40 CFR 60.8 and 60.335, 25 Pa. Code Chapter 139 and the most recent version of the Department's Source Testing Manual.
b. Two copies of the performance test protocol shall be submitted to the Department at least 60 days in advance of the performance test date. Performance testing shall not take place until the owner/operator has received written approval of the performance test protocol.
c. The owner/operator shall notify the Department of the date and time of the performance test at least two weeks prior to the tests so that an observer may be present.
d. Two copies of the performance test results shall be submitted to the Department within 60 days of the completion of the test.
e. In regards to initial performance testing shall be performed within 60 days of achieving maximum firing rate but no later than 180 days after the initial startup.
f. The owner/operator shall record all pertinent operating data during the performance test and include this data with the performance test results.
13. The opacity of the exhaust from the turbine at this facility shall not exceed 10% at any time. (25 Pa. Code § 127.12b)
14. Particulate emissions shall not exceed 0.02 grain per dry standard cubic foot. (25 Pa. Code § 127.1)
15. In accordance with 25 Pa. Code § 123.21(b), SO2 emissions from the turbine shall not exceed 500 ppmvd.
16. This Plan Approval authorizes the temporary operation of the sources covered by this Plan Approval provided that the following conditions are met (25 Pa. Code § 127.12b):
a. The Department must receive written notice from the owner/operator of the anticipated date that sources will commence operation.
b. Operation is authorized only to facilitate the startup and shakedown of the sources, to permit operation of the sources pending the issuance of an Operating Permit, or to permit the evaluation of the sources for compliance with all applicable regulations and requirements.
c. This condition authorizes temporary operation of the sources for a period of 180 days from the start of commencement of operation, provided that the Department receives notice from the owner/operator under to Subpart (a).
d. Owner/operator may request an extension of this Plan approval if compliance with all applicable regulations and Plan Approval requirements has not been established. The extension request shall be submitted in writing at least 15 days prior to the end of this period of temporary operation and shall provide a description of the compliance.
e. Status of the source, a detailed schedule for establishing compliance, and the reasons that compliance has not been established.
f. The notice submitted by the owner/operator under to Subpart (a), prior to the expiration date of this Plan Approval, shall modify the Plan Approval expiration date. The new Plan approval expiration date shall be 180 days from the date of the start-up.
Copies of the application, Department's analysis and other documents used in the evaluation of the application are available for public review during normal business hours at 400 Waterfront Drive, Pittsburgh, PA 15222.
Interested persons may submit written comments, suggestions or objections concerning the proposed Plan Approval to the regional office within 30 days of publication of this notice. Written comments submitted to the Department during the 30-day public comment period shall include the following:
1. Name, address and telephone number of the commentator.
2. Identification of the proposed Plan Approval: PA-30-00077A.
3. A concise statement regarding the relevancy of the information or objections to the issuance of the permit.
A public hearing may be held, if the Department, in its discretion, decides that a hearing is warranted based on the comments received. All persons submitting comments or requesting a hearing will be notified of the decision to hold a hearing by publication in the newspaper, the Pennsylvania Bulletin or by telephone, when the Department determines notification by telephone is sufficient. Monitoring and recordkeeping requirements have been added to the permit to address the applicable limitations.
46-00019: Lockheed Martin Corp. (P. O. Box 8048, Building 10, Room 2164, Philadelphia, PA 19101-8048) for a renewal of Title V operating permit 46-00019 in Upper Merion Township, Montgomery County. The original Title V Operating Permit was issued on March 31, 2000, and became effective on May 1, 2000. The facility's major emission points include boilers, generators and small miscellaneous VOC sources. The renewed Title V operating permit will contain sufficient monitoring, recordkeeping, reporting and work practice standards to keep the facility operating within all applicable air quality requirements. No sources at this facility are subject to CAM (40 CFR Part 64).

The facility will be required to limit the emissions to less than 100 tons of particulate, SOx, NOx and CO, 50 tons for VOCs and 10/25 tons for HAPs, during any consecutive 12-month period. Records of the solvent usage and resulting emissions will be required monthly and 12-month rolling totals. The permit will include monitoring, work practices, recordkeeping and reporting requirements to keep the facility operating within all applicable air quality requirements.
07-03048: Chimney Rocks Animal Rest, Inc. (R. R. 1, Box 136, Chimney Rocks Road, Hollidaysburg, PA 16648-9501) for operation of a crematory for animal remains in Blair Township, Blair County. The facility's emission source includes a propane operated crematory, which primarily emits NOx. The facility has the potential to emit less than 2 tons of NOx per year. The state only operating permit will contain monitoring and recordkeeping requirements to keep the facility operating within all applicable air quality requirements.

The school incorporates one anthracite coal-fired boiler, one No. 2 fuel oil-fired boiler and one propane-fired emergency generator. The air contaminant emissions from the school are not expected to exceed 17.26 tons of NOx, 52.17 tons of SOx, 6.09 tons of CO, .51 ton of VOCs, .197 ton of combined HAPs and 11.21 tons of particulate matter (including PM10) per year under any circumstances and should realistically be far less than this.
The respective facility is not a major (Title V) facility for any air contaminant.
The Department proposes to incorporate into the operating permit to be issued conditions requiring compliance with all applicable regulatory requirements pertaining to the emission of air contaminants and a condition requiring the submission of coal and oil samples, or analyses, as the Department may request.
