FEDERAL WATER POLLUTION CONTROL ACT, SECTION 401

   The following permit applications, requests for Environmental Assessment approval and requests for 401 Water Quality Certification have been received by the Department of Environmental Protection (Department). Section 401 of the Federal Water Pollution Control Act (FWPCA) (33 U.S.C.A. § 1341) requires the State to certify that the involved projects will not violate the applicable provisions of sections 301--303, 306 and 307 of the FWPCA (33 U.S.C.A. §§ 1311--1313, 1316 and 1317) as well as relevant State requirements. Persons objecting to approval of a request for certification under section 401 of the FWPCA or to the issuance of a Dam Permit, Water Obstruction and Encroachment Permit or the approval of an Environmental Assessment must submit comments, suggestions or objections within 30 days of the date of this notice, as well as questions, to the regional office noted before the application. Comments should contain the name, address and telephone number of the person commenting, identification of the certification request to which the comments or objections are addressed and a concise statement of comments, objections or suggestions including the relevant facts upon which they are based.

   The Department may conduct a fact-finding hearing or an informal conference in response to comments if deemed necessary. Individuals will be notified, in writing, of the time and place of a scheduled hearing or conference concerning the certification request to which the comment, objection or suggestion relates. Maps, drawings and other data pertinent to the certification request are available for inspection between 8 a.m. and 4 p.m. on each working day at the regional office noted before the application.

   Persons with a disability who wish to attend a hearing and require an auxiliary aid, service or other accommodation to participate in the proceedings should contact the specified program. TDD users should contact the Department through the Pennsylvania AT&T Relay Service at (800) 654-5984.


Applications received under the Dam Safety and Encroachments Act (32 P. S. §§ 693.1--693.27) and section 302 of the Flood Plain Management Act (32 P. S. § 679.302) and requests for certification under section 401(a) of the FWPCA (33 U.S.C.A. § 1341(a)).

   E58-267. Susquehanna County, Susquehanna Courthouse, P. O. Box 218, Montrose, PA 18801, in Lenox Township, Susquehanna County, United States Army Corps of Engineers, Baltimore District.

   To remove the remnants of the structure of County Bridge No. 23 from the floodway of Tunkhannock Creek (CWF). The project is located approximately 600 feet east of SR 0092, along T-461. (Lenoxville, PA Quadrangle N:  14.1 inches; W:  6.3 inches).

   E48-363. Signature Homes by J. T. Maloney, Inc., 610 Farm Lane, Doylestown, PA 18901, in Tatamy Borough, Northampton County, United States Army Corps of Engineers, Philadelphia District.

   To construct and maintain a 48-inch diameter stormwater outfall pipe and energy dissipator in a tributary to Bushkill Creek (HQ-CWF). The project is associated with a planned residential subdivision known as Tatamy Farms and is located northeast of the intersection of Main Street and 4th Street (Nazareth, PA Quadrangle N:  21.5 inches; W:  0.6 inch).

   E66-134. Mehoopany Creek Watershed Association, P. O. Box 73, Mehoopany, PA 18629, in Forkston Township, Wyoming County, United States Army Corps of Engineers, Baltimore District.

   To relocate approximately 1,165 feet of North Branch Mehoopany Creek (CWF) to its historic channel and to restore/enhance approximately 2,695 feet of stream channel as part of a stream restoration project located at a point beginning 2,765 feet upstream of the SR 3001 bridge and continuing downstream of the bridge approximately 570 feet (Jenningsville, PA Quadrangle N:  6.8 inches; W:  0.5 inch).

   E54-322. Jamie and Penny Wolfe, 463 Swopes Valley Road, Pine Grove, PA 17963, in Pine Grove Township, Schuylkill County, United States Army Corps of Engineers, Baltimore District.

   To construct and maintain a private road crossing consisting of three 24-inch diameter culverts in Swope Valley Run (CWF). The project is located on the south side of Swopes Valley Road, approximately 2 miles west of SR 0645 (Pine Grove, PA Quadrangle N:  3.1 inches; W:  5.6 inches).

   Southcentral Region: Water Management Program Manager, 909 Elmerton Avenue, Harrisburg, PA 17110.

   E06-600: Upper Bern Township, 25 North 5th Street, Shartlesville, PA 19609 in Upper Bern Township, Berks County, ACOE Baltimore District.

   To realign approximately 40 feet of a UNT of Wolf Creek on the eastern side of Valley Road in Upper Bern Township, Berks County, prior to the Valley Road culvert (Bernville USGS Quadrangle, 40° 29` 04"N, 76° 05` 53"W). The realignment is proposed to reduce further streambank erosion along Valley Road. The existing streambank will be stabilized as part of this project.

   E21-374: Upper Allen Township, 100 Gettysburg Pike, Mechanicsburg, PA 17055 in Upper Allen Township, Cumberland County, ACOE Baltimore District.

   To remove an existing 27-foot long by 36-inch CMP and to construct and maintain a 27-foot long by 72-inch wide by 36-inch high concrete box culvert with upstream and downstream wingwalls; to excavate accumulated sediments, regrade the channel, and line the channel with R-5 riprap for a distance of 315 linear feet; and to construct and maintain eight 15-inch RCP stormwater outfalls with associated concrete headwalls and R-4 riprap aprons all within the channel of a UNT to Yellow Breeches Creek at a point (Latitude: 40° 10` 11"; Longitude: 76° 59` 12") along Bumble Bee Hollow Road in Upper Allen Township, Cumberland County. The project proposes to directly affect approximately 403 linear feet of stream channel.

   E38-145: Department of Transportation, Engineering District 8-0, 2140 Herr Street, Harrisburg, PA 17103-1699 in Bethel Township, Lebanon County, ACOE Baltimore District.

   To remove the existing structures and then to construct and maintain single span bridge of 100 feet on a 75° skew with a minimum underclearance of 11.3 feet across the Little Swatara Creek (WWF) on SR 1014, Section 004, Segment 0170, Offset 0418 and associated improvements to improve the safety condition of the road located at the village of Greble (Bethel, PA Quadrangle N:  10.0 inches; W:  15.2 inches) in Bethel Township, Lebanon County.

   E21-370: Silver Springs Square II, LLC, 8618 Westwood Center Drive, Suite 300, Vienna, VA 22182 in Hampden and Silver Springs Township, Cumberland County, ACOE Baltimore District. To construct and maintain a bridge having a span of 137.9 feet, a width of 35.4 feet, and an average underclearance of 10.8 feet on Trindle Spring Run (HQ-CWF) at a point (Wertzville, PA Quadrangle Latitude: 40° 15` 06", Longitude: 77° 00` 27") approximately 1,950 feet downstream of the Carlisle Pike (SR 11) bridge crossing of Trindle Spring Run, and to construct and maintain a 12-inch stormwater outfall structure located approximately 60 feet downstream of the proposed bridge in Silver Spring Township, Cumberland County.

   E36-601: Department of Transportation, Engineering Disrict 8-0, 2140 Herr Street, Harrisburg, PA 17103-1699 in Little Britain Township, Lancaster County and Lower Oxford Township, Chester County, ACOE Baltimore District

   To rehabilitate and maintain the two span bridge with a total span of 198 feet with a minimum underclearance of 12.5 feet across Octoraro Creek (WWF) on SR 2006, Section 001, Segment 0100, Offset 1917.5 by replacing the steel beams, timber decks, sidings and associated improvements to improve the safety condition of the road located at the Village of Pine Grove (Kirkwood, PA Quadrangle N:  7.9 inches; W:  6.3 inches) in Little Britain Township, Lancaster County and Lower Oxford Township Chester County.

   Northcentral Region: Water Management Program Manager, 208 West Third Street, Williamsport, PA 17701, (570) 327-3636.

   E08-430. Edward C. Blackburn, R. R. 2, Box 220-A, New Albany, PA 18833, Bridge, in Terry Township, Bradford County, ACOE Baltimore District (Dushore, PA Quadrangle N:  22.15; W:  0.15 inch).

   To construct and maintain a 60 foot by 4 foot wide long single span steel walk bridge supported by 2 foot by 2 foot by 5 foot concrete headwalls over Sugar Creek on the north side of SR 2010 about 2 miles east of Evergreen. The project will not impact wetlands while impacting about 4 feet of waterway, Sugar Run is a CWF stream.

   E57-107. Department of Transportation, Engineering District 3-0, P. O. Box 218, Montoursville, PA 17754, in Elkland Township, Sullivan County, ACOE Baltimore District (Overton, PA Quadrangle N:  1.50 inches; W:  16.00 inches).

   To remove the existing stone masonry arch which is on a 50° skew with the roadway and has a normal clear span of 12.0 feet, a curb-to-curb width of 12.5. feet, an underclearance of 6.0 feet and a hydraulic opening of about 57 square feet and to construct and maintain a 14 foot by 7 foot by 83 foot long reinforced concrete box culvert depressed 1 foot in the streambed, placed with a 30° skew, with a curb-to-curb width of 22.0 feet and an effective waterway opening of 84 square feet and to construct and maintain a temporary rock-lined bypass channel. The project is located in Blackwater Run on SR 4014 about 1,500 feet east of Estella. The project will not impact wetlands while impacting about 80 feet of waterway. Blackwater Run is a HQ-CWF Stream.

   Southwest Region: Watershed Management Program Manager, 400 Waterfront Drive, Pittsburgh, PA 15222-4745.

   E02-584. Hanson Aggregates PMA, Inc., 2200 Springfield Pike, Connellsville, PA 15425. To reissue and amend commercial sand and gravel dredging permit in Allegheny, Armstrong, Beaver and Westmoreland Counties, Pittsburgh ACOE District (starting at East Brady, PA Quadrangle N:  20.9 inches; W:  15.7 inches and ending at East Liverpool North, OH-PA-WV Quadrangle N:  2.2 inches; W:  2.7 inches) (starting at Latitude: 40° 51` 54"--Longitude: 79° 36` 49" and ending at Latitude: 40° 30` 44" and Longitude: 80° 31` 10"). The applicant proposes to continue performing commercial sand and gravel dredging in select areas of the Allegheny River (WWF) within the Emsworth Pool and Pools 2--5 and 7--9 and in the Ohio River (WWF) within the Emsworth, Dashields, Montgomery and New Cumberland Pools, subject to review of mussel surveys and prescribed setbacks in Allegheny, Armstrong, Beaver and Westmoreland Counties. The site specific currently approved dredging locations are as follows:

If the daily turbidity tests indicate an increase in turbidity, permittee may be required to perform additional MPEs during dredging.

To reissue and amend commercial sand and gravel dredging permit in Allegheny, Armstrong, Beaver and Westmoreland Counties, Pittsburgh ACOE District (starting at East Brady, PA Quadrangle N:  20.9 inches; W:  15.7 inches and ending at East Liverpool North, OH-PA-WV Quadrangle N:  2.2 inches; W:  2.7 inches) (starting at Latitude: 40° 51` 54"--Longitude: 79° 36` 49" and ending at Latitude: 40° 30` 44" and Longitude: 80° 31` 10"). The applicant proposes to continue performing commercial sand and gravel dredging in select areas of the Allegheny River (WWF) within the Emsworth Pool and Pools 2--5 and 7--9 and in the Ohio River (WWF) within the Emsworth, Dashields, Montgomery and New Cumberland Pools, subject to review of mussel surveys and prescribed setbacks in Allegheny, Armstrong, Beaver and Westmoreland Counties. The daily turbidity test results are to be submitted to the Department of Environmental Protection, Water Supply Management, 400 Waterfront Drive, Pittsburgh, PA 15222-4745 on a weekly basis. If the daily turbidity tests indicate an increase in turbidity, permittee may be required to perform additional MPEs during dredging.

The applicant proposes to construct and maintain a 260 LF relocation of a UNT to Jacobs Creek (CWF) (Mammoth, PA Quadrangle N:  2.4 inches; W:  13.3 inches and Latitude: 40° 8` 21"--Longitude: 79° 28` 15") with a drainage area of 41 acres. The applicant also proposes to extend 4 culverts ranging in size from 18 to 36 inches, a total of 182 LF in UNTs to Jacob's Creek (CWF) (Mammoth Quadrangle starting at 40° 8` 36`--Longitude: 79° 29` 0" and ending at Latitude: 40° 7` 51"--Longitude: 79° 26` 23"). This project is associated with the widening of SR 31 extending approximately 2.25 miles southeast of the Village of Laurelville.

   E32-473. Indiana County Conservation District, USDA Service Center, 1432 Route 286 Highway East, Indiana, PA 15701-1467. To construct an outfall structure in Canoe Township, Indiana County, Pittsburgh ACOE District (Rochester Mills, PA Quadrangle N:  16.3 inches; W:  6.3 inches and Latitude: 40° 50` 25"--Longitude: 78° 55` 15"). The applicant proposes to construct and maintain an outfall structure in the left bank of North Branch of Little Mahoning Creek (HQ-CWF) for the purpose of construction of a passive abandoned mine drainage treatment system.

   E65-882. Department of Transportation, District 12-0, P. O. Box 459, Uniontown, PA 15401. To construct an extension to an existing culvert in Allegheny Township, Westmoreland County, Pittsburgh ACOE District (Vandergrift, PA Quadrangle N:  18.2 inches; W:  14.3 inches and Latitude: 40° 36` 03"--Longitude: 79° 36` 33"). The applicant proposes to construct and maintain a 13 LF extension to an existing 90 LF long 8.0 foot diameter CMP culvert and relocate 50 LF of UNT to Pine Run (WWF) with a drainage area of 516 acre; and fill 0.03 acre of PEM wetlands (N:  19.5 inches; W:  14.3 inches and Latitude: 40° 36` 26"--Longitude: 79° 36` 15"). The applicant also proposes to extend 3 culverts ranging in size from 16 to 18 inches, a total of 35 LF and relocate a total of 80 LF of UNTs to Pine Run (WWF) (Vandergrift, PA Quadrangle starting at N:  17.8 inches; W:  15.3 inches and ending at N:  19.5 inches; W:  14.3 inches). This project is associated with the widening of SR 4048 mostly between this road's intersections with SR 356 to the south and SR 56 to the north.

   D45-289. Ski Shawnee, Inc., P. O. Box 339, Shawnee On Delaware, PA 18356. To construct and repair an existing deteriorated earth fill dam that impounds water for the purpose of snow making at the ski area. Work includes dredging and removal of accumulated sediments for the existing 9.4 acre pond. (Bushkill, PA-NJ Quadrangle N:  7.2 inches; W:  11.4 inches) in Middle Smithfield Township, Monroe County.

   The following Storage Tank Site-Specific Installation Permit application has been received by the Department of Environmental Protection (Department) and is currently under review. Persons wishing to comment on the proposed permit are invited to submit a statement to the Bureau of Land Recycling and Waste Management, Division of Storage Tanks, P. O. Box 8763, Harrisburg, PA 17105-8763, within 30 days from the date of this publication. Comments received within this 30-day period will be considered in the formulation of the final determinations regarding this application. Responses should include the name, address and telephone number of the writer and a concise statement to inform the Department of the exact basis of the comment and the relevant facts upon which it based.
