COAL AND NONCOAL MINING ACTIVITY APPLICATIONS

   Applications under the Surface Mining Conservation and Reclamation Act (52 P. S. §§ 1396.1--1396.19a); the Noncoal Surface Mining Conservation and Reclamation Act (52 P. S. §§ 3301--3326); The Clean Streams Law (35 P. S. §§ 691.1--691.1001); the Coal Refuse Disposal Control Act (52 P. S. §§ 30.51--30.66); and The Bituminous Mine Subsidence and Land Conservation Act (52 P. S. §§ 1406.1--1406.21). Mining activity permits issued in response to applications will also address the applicable permitting requirements of the following statutes: the Air Pollution Control Act (35 P. S. §§ 4001--4015); the Dam Safety and Encroachments Act (32 P. S. §§ 693.1--693.27); and the Solid Waste Management Act (35 P. S. §§ 6018.101--6018.1003).

   The following permit applications to conduct mining activities have been received by the Department of Environmental Protection (Department). A copy of an application is available for inspection at the district mining office indicated before an application. Where a 401 Water Quality Certification is needed for any aspect of a particular proposed mining activity, the submittal of the permit application will serve as the request for certification.

   Written comments, objections or requests for informal conferences on applications may be submitted by any person or any officer or head of any Federal, State or local government agency or authority to the Department at the district mining office indicated before an application within 30 days of this publication, or within 30 days after the last publication of the applicant's newspaper advertisement, as provided by 25 Pa. Code §§ 77.121--77.123 and 86.31--86.34.

   Where any of the mining activities listed will have discharges of wastewater to streams, the Department will incorporate NPDES permits into the mining activity permits issued in response to these applications. NPDES permits will contain, at a minimum, technology-based effluent limitations as identified in this notice for the respective coal and noncoal applications. In addition, more restrictive effluent limitations, restrictions on discharge volume or restrictions on the extent of mining which may occur will be incorporated into a mining activity permit, when necessary, for compliance with water quality standards (in accordance with 25 Pa. Code Chapters 93 and 95). Persons or agencies who have requested review of NPDES permit requirements for a particular mining activity within the previously mentioned public comment period will be provided with a 30-day period to review and submit comments on the requirements.

   Written comments or objections should contain the name, address and telephone number of the person submitting comments or objections; the application number; and a statement of sufficient detail to inform the Department on the basis of comment or objection and relevant facts upon which it is based. Requests for an informal conference must contain the name, address and telephone number of requestor; the application number; a brief summary of the issues to be raised by the requestor at the conference; and a statement whether the requestor wishes to have the conference conducted in the locality of the proposed mining activities.

Box 40, 178 Chess Mine Road, Dilliner, PA 15327-0040), to renew the permit and related NPDES permit and revise the permit for the Dunkard Mine No. 2 in Dunkard Township, Greene County to use coal ash for mine reclamation. AMFIRE Mining Company, LLC, One Energy Place, Latrobe, PA 15650, commencement, operation and restoration of a bituminous surface-auger mine in Jenner Township, Somerset County, affecting 120.1 acres. Receiving streams: UNTs to Quemahoning Reservoir to Quemahoning Creek to the Stoney Creek River to the Conemaugh River classified for the following use: CWF. The first downstream potable water supply intake from the point of discharge is Cambria-Somerset Authority. FEDERAL WATER POLLUTION CONTROL ACT, SECTION 401

   The following permit applications, requests for Environmental Assessment approval and requests for 401 Water Quality Certification have been received by the Department of Environmental Protection (Department). Section 401 of the Federal Water Pollution Control Act (FWPCA) (33 U.S.C.A. § 1341) requires the State to certify that the involved projects will not violate the applicable provisions of sections 301--303, 306 and 307 of the FWPCA (33 U.S.C.A. §§ 1311--1313, 1316 and 1317) as well as relevant State requirements. Persons objecting to approval of a request for certification under section 401 of the FWPCA or to the issuance of a Dam Permit, Water Obstruction and Encroachment Permit or the approval of an Environmental Assessment must submit comments, suggestions or objections within 30 days of the date of this notice, as well as questions, to the regional office noted before the application. Comments should contain the name, address and telephone number of the person commenting, identification of the certification request to which the comments or objections are addressed and a concise statement of comments, objections or suggestions including the relevant facts upon which they are based.

   The Department may conduct a fact-finding hearing or an informal conference in response to comments if deemed necessary. Individuals will be notified, in writing, of the time and place of a scheduled hearing or conference concerning the certification request to which the comment, objection or suggestion relates. Maps, drawings and other data pertinent to the certification request are available for inspection between 8 a.m. and 4 p.m. on each working day at the regional office noted before the application.

   To authorize the deepening and expansion of a reservoir of a nonjurisdictional dam having a surface area of approximately 0.3 acre located across a tributary to Bertsch Creek (CWF) and to maintain a dry fire hydrant in a 90 square foot pile supported private recreational dock in the reservoir area. This work was conducted during the repair and restoration of the dam embankment that was damaged by floodwaters.    To install a 12-foot by 7-foot precast concrete box culvert depressed 1 foot in a UNT to Shermans Creek (WWF), located 35 feet upstream of Sleepy Hollow Road existing 10-foot by 7-foot CMPA on Shermans Dale, PA Quadrangle, Latitude: 40° 21` 35"; Longitude: 77° 08` 33", N:  19.9 inches, W:  2.5 inches in Carroll Township, Perry County.

   E07-401: Richard Himes & Son, 1218C Pleasant Valley Boulevard, Altoona, PA 16602 in Logan Township, Blair County, ACOE Baltimore District.

   To construct and maintain a 1-foot depressed, 48-inch diameter by 100-foot long CPEP pipe culvert and a 6-inch diameter sanitary sewer line at a UNT to Spring Run (WWF) located along Avalon Road about 3,000 feet southwest from its intersection with Juniata Gap Road (Altoona, PA Quadrangle N:  8.3 inches; W:  8.8 inches; Latitude: 40° 32` 44"; Longitude: 78° 26` 20"), a 24-inch diameter outfall pipe and a temporary 15-foot long by 12-foot wide ford crossing located about 700 feet downstream of the proposed culvert (Altoona, PA Quadrangle N:  8.5 inches; W:  8.6 inches; Latitude: 40° 32` 49"; Longitude: 78° 26` 13") in Logan Township, Blair County.

   Northcentral Region: Water Management Program Manager, 208 West Third Street, Williamsport, PA 17701, (570) 327-3636.

   E19-251. Harold Hafer, 1939 Old Reading Road, Lot 19, Catawissa, PA 17820. Roaring Creek Forest Property Owners Association, in Roaring Creek Township, Columbia County, ACOE Baltimore District (Ashland, PA Quadrangle N:  22.5 inches; W:  8.9 inches).

   The applicant is proposing to remove the existing three celled culvert crossing and replace it with a single 5-foot 9-inch by 8-foot 2-inch culvert crossing along with a 30-inch culvert pipe along the side for additional flow. This crossing is located on an unnamed tributary to Roaring Creek and carries a water quality designation of HQ-CWF. No wetland impacts are proposed with this application.

   Southwest Region: Watershed Management Program Manager, 400 Waterfront Drive, Pittsburgh, PA 15222-4745.

   E02-1531. Allegheny County Airport Authority, P. O. Box 12370, Pittsburgh, PA 15231. To fill a stream channel in Moon Township, Allegheny County, Pittsburgh ACOE District. (Oakdale, PA Quadrangle N:  20.8 inches; W:  9.9 inches and Latitude: 40° 29` 19"--Longitude: 80° 11` 48"). The applicant proposes to fill and maintain 1,539 ft. of stream channel and a total of 0.27 acre of PEM/PSS wetlands in UNTs and drainage areas of McClearens Run (TSF) to prepare portions of a 160-acre site for anticipated development. The applicant also proposes to construct and maintain stormwater outfalls. The project is located adjacent to Business SR 60 southeast of the Pittsburgh International Airport in Moon Township. Total proposed impacts are approximately 1,539 ft. of stream channel and 0.27 acre of wetland.

   E26-336. South Union Township, 151 Township Drive, Uniontown, PA 15401. To construct a culvert in South Union Township, Fayette County, Pittsburgh ACOE District. (New Salem, PA Quadrangle N:  8.0 inches; W:  0.9 inch and Latitude: 39° 55` 07"--Longitude: 79° 49` 22"). The applicant proposes to construct and maintain a 54 LF long, 26 ft. span 8 ft. vertical clearance, natural bottom, arch culvert in Jennings Run (WWF) with a drainage area of 4.34 square miles; fill and maintain 0.01 acre of adjacent PEM wetland; and construct and maintain adjacent stormwater outfalls. This project provides for safety improvements to SR 40 through the relocation of the existing Duck Hollow road intersection with SR 40 and connection of the proposed Matthew Drive to the relocated portion of Duck Hollow Road. The project is located approximately 2 miles northwest of Uniontown on the border of Menallen Township and South Union Township. Total proposed impacts are approximately 54 ft. of stream channel and 0.01 acre of wetland.

   Northwest Region: Watershed Management Program Manager, 230 Chestnut Street, Meadville, PA 16335-3481

   E25-700, Erie County Convention Center Authority, 809 French Street, Erie, PA 16501. Dobbins Landing Wall and Pedestrian Bridgein the City of Erie, Erie County, ACOE Pittsburgh District (Erie North, PA Quadrangle N:  2.0 inches; W:  12.6 inches).

   The applicant proposes to construct and maintain a pedestrian overpass bridge having a clear span of 174 feet and an underclearance of 69.0 feet above the entrance channel to the West Canal Basin (Erie North, PA Quadrangle N:  2.0 inches; W:  12.6 inches) in Presque Isle Bay, Lake Erie in the City of Erie, Erie County. The bridge would connect a proposed Sheraton Hotel and the Erie County Convention Center. Also, to construct and maintain a soldier pile wall having a length of 113 feet along the southern wall of West Dobbins Landing in the West Canal Basin to provide public access and for site aesthetics.

   Also, to transfer a portion of DEP Permit No. E25-696 from the Erie-Western Pennsylvania Port Authority (EWPPA) to the Erie County Convention Center Authority (ECCCA). Permit E25-696 authorized EWPPA to conduct the following activities within the West Canal Basin, Presque Isle Bay, Lake Erie within the City of Erie, Erie County:

   1.  To remove the existing wall and to construct and maintain a 260-foot long soldier pile wall on the easterly portion of the south wall of West Dobbins Landing.

   2.  To fill the former boat hoist area near the midsection of the south wall of West Dobbins Landing and a basin area at the east end of the south wall of West Dobbins Landing. The total area of fill is 0.18 acre.

   3.  To construct and maintain approximately an 8-foot wide header dock having a length of approximately 530 feet along the south wall of West Dobbins Landing.

   4.  To remove five existing finger piers along the south wall of West Dobbins Landing.

   5.  To construct and maintain two approximately 85-foot long finger pier extensions to the existing finger piers that extend north from the north wall of the Presque Isle Yacht Club.

   6.  To remove the existing wall and to construct and maintain the 250-foot long north vertical wall of the Presque Isle Yacht Club.

   7.  To remove an approximately 310-foot long sheet pile wall and associated docks and to construct and maintain a 310-foot long revetment slope 6-foot wide header dock having a length of approximately 300 feet along the east side of the Presque Isle Yacht Club in the south portion of the West Canal Basin.

   The following activities are transferred from EWPPA's DEP Permit No. E25-696 to the proposed ECCCA DEP Permit No. E25-700.

   1.  To remove the existing wall and to construct and maintain a 260-foot long soldier pile wall on the easterly portion of the south wall of West Dobbins Landing.

   2.  To fill the former boat hoist area near the midsection of the south wall of West Dobbins Landing and a basin area at the east end of the south wall of West Dobbins Landing. The total area of fill is 0.18 acre.

   E62-406, Department of Transportation, District 1-0, 255 Elm Street, P. O. Box 398, Oil City, PA 16301-1412. SR 0069, Section B00, Segment 0280, Offset 0046 Bridge in Sugar Grove Borough, Warren County, ACOE Pittsburgh District (Sugar Grove, PA Quadrangle N:  19.4 inches; W:  12.6 inches).

   The applicant proposes to remove the existing structure and to construct and maintain a concrete box beam bridge having a clear span of 43.0 feet and an underclearance of 10.0 feet across Stillwater Creek (Sugar Grove, PA Quadrangle N:  19.4 inches; W:  12.6 inches) on SR 0069, Section B00, Segment 0280, Offset 0046 in Sugar Grove Borough, Warren County approximately 75 feet east of the intersection of SR 0069 and SR 957.

   Stillwater Creek is a perennial stream classified as a CWF. The project proposes to impact approximately 100 feet of stream.

ENVIRONMENTAL ASSESSMENTS

   Southcentral Region: Water Management Program Manager, 909 Elmerton Avenue, Harrisburg, PA 17110.

   EA22-002: Dauphin County Conservation District, 1451 Peters Mountain Road, Dauphin, PA 17018 in Wiconisco Township, Dauphin County, ACOE Baltimore District.

   The Dauphin County Conservation District proposes treatment of an abandoned mine discharge, the ''Lykens Tunnel,'' and two minor seeps. The passive treatment system will involve the construction of three sedimentation basins. These will encroach on 695` linear feet (5,250 square feet) of 4 UNTs to Bear Creek (CWF--Lykens Quad; Latitude: 40° 34` 56", Longitude: 76° 41` 59"). This a joint project between five agencies that will improve the water quality and fishery of Bear Creek, Wiconisco Township, Dauphin County.

FINAL ACTIONS TAKEN FOR NATIONAL POLLUTION DISCHARGE ELIMINATION SYSTEM (NPDES) PERMITS AND WATER QUALITY MANAGEMENT (WQM) PERMITS

   The Department of Environmental Protection (Department) has taken the following actions on previously received applications for new, amended and renewed NPDES and WQM permits, applications for permit waivers and Notices of Intent (NOI) for coverage under general permits. This notice is provided in accordance with 25 Pa. Code Chapters 91 and 92 and 40 CFR Part 122, implementing provisions of The Clean Streams Law (35 P. S. §§ 691.1--691.1001) and the Federal Clean Water Act.

   Sections I--VI contain actions related to industrial, animal or sewage wastes discharges, discharges to groundwater and discharges associated with municipal separate storm sewer systems (MS4), stormwater associated with construction activities and concentrated animal feeding operations (CAFOs). Section VII contains notices for parties who have submitted NOIs for coverage under general NPDES permits. The approval for coverage under general NPDES permits is subject to applicable effluent limitations, monitoring, reporting requirements and other conditions set forth in each general permit. The approval of coverage for land application of sewage sludge or residential septage under applicable general permit is subject to pollutant limitations, pathogen and vector attraction reduction requirements, operational standards, general requirements, management practices and other conditions set forth in the respective permit. Permits and related documents, effluent limitations, permitting requirements and other information are on file and may be inspected and arrangements made for copying at the contact office noted before the action.

   Persons aggrieved by an action may appeal, under section 4 of the Environmental Hearing Board Act (35 P. S. § 7514) and 2 Pa.C.S. §§ 501--508 and 701--704 (relating to the Administrative Agency Law), to the Environmental Hearing Board, Second Floor, Rachel Carson State Office Building, 400 Market Street, P. O. Box 8457, Harrisburg, PA 17105-8457, (717) 787-3483. TDD users should contact the Environmental Hearing Board (Board) through the Pennsylvania Relay Service, (800) 654-5984. Appeals must be filed with the Board within 30 days of publication of this notice in the Pennsylvania Bulletin, unless the appropriate statute provides a different time period. Copies of the appeal form and the Board's rules of practice and procedure may be obtained from the Board. The appeal form and the Board's rules of practice and procedure are also available in Braille or on audiotape from the Secretary of the Board at (717) 787-3483. This paragraph does not, in and of itself, create any right of appeal beyond that permitted by applicable statutes and decision law.
