   The Department of Environmental Protection has taken the following actions on applications received under the Pennsylvania Safe Drinking Water Act (35 P. S. §§ 721.1--721.17) for the construction, substantial modification or operation of a public water system.

   Plan Description: Mark and Pamela Mummert, A3-67960-287-2. The proposed plan revision consists of a five lot single-family residential subdivision on 86.95 acres with total estimated sewage flows of 1,600 gpd to be treated by individual onlot disposal systems. The plan was disapproved because the hydrogeologic study included in the planning module submission that was received by the Department and required by 25 Pa. Code § 71.62(c) contained information indicating the groundwater is presently polluted on the property and that the onsite sewage systems for the subdivision will further pollute the waters of this Commonwealth in violation of The Clean Streams Law. This condition is considered a nuisance and is prohibited. In addition, well water samples used for the hydro-study are greater than 1 year old.

HAZARDOUS SITES CLEAN-UP UNDER THE ACT OF OCTOBER 18, 1988

Prompt Interim Response

Lewis Run Municipal Well Site, Lewis Run Borough, McKean County.

   The Department of Environmental Protection (Department), under the authority of the Hazardous Sites Cleanup Act (HSCA) (35 P. S. §§ 6020.101--6020.1305), is conducting a Prompt Interim Response at the Lewis Run Municipal Well Site (Site). The Site is located in Lewis Run Borough, McKean County, PA, in the area between the East Branch of Tunungwant Creek and Big Shanty Road. The Site contains several light industrial-manufacturing facilities, separated by lightly wooded areas. The Site also contains a well used as a supplemental public water supply (Well 3) by the Borough of Lewis Run, McKean County, impacted by Site related constituents. The Borough owns two other water supply wells (Well 1 and Well 2) and a spring that are used to supply water to local residents and businesses..

   VOCs, primarily tetrachloroethene, trichloroethene and 1,2-dichloroethene, have been detected in groundwater at the Site, including in samples from Well 3. The VOC contamination appears to have multiple sources, including at least one source on the McCourt Label Cabinet Company property within the Site.

   On April 8, 2003, the Department issued a Statement of Decision for the Site documenting the Department's implementation of a Prompt Interim Response under section 506 of HSCA (35 P. S. § 6020.506). The April 8, 2003, Statement of Decision concluded that the Department would replace the existing Well 3 with a new municipal water supply well and abandon Well 3. The Department has not yet completed the connection of the new municipal water supply well.

   In the summer of 2005, Lewis Run Borough's routine VOC sample results indicated a detection for benzene in the water system. In September, 2005, the Department obtained additional sample results indicating the presence of benzene in Well 1 and Well 2, confirmed by additional sampling in November 2005, December 2005, and January 2006. As a result, Lewis Run Borough stopped using Well 1 and Well 2. Thus, Lewis Run Borough's only remaining source of water is the spring. The flow of the spring is effected by seasonal water table variations, and it is anticipated that the spring will not be able to supply sufficient water for local residents and businesses after May, 2006. Lewis Run would normally rely on Well 3 to supplement its water supply, but it is unavailable due to the release of hazardous substances at the Site. Moreover, the Department will not be able to complete the connection of the new municipal well before the end of May, 2006.

   As a result of the foregoing, the Department is proposing an emergency replacement source of supplemental water for Lewis Run Borough. For this Prompt Interim Response, the Department considered three alternatives for the Site: Alternative 1, no action and ongoing monitoring; Alternative 2, the provision of bottled water when the alternative water source becomes necessary; Alternative 3, interconnection with the Bradford City Water Authority System.

   Each alternative was evaluated with respect to four comparison criteria: (1) the extent to which each alternative protects the public health and the environment; (2) the extent to which each alternative complies with or otherwise addresses Applicable or Relevant and Appropriate Requirements; (3) the extent to which each alternative is feasible, effective, implementable and permanent; and (4) the relative cost of each alternative.

   Furthermore, this comparative analysis evaluated the relative performance of each alternative in relation to each specific comparison criterion. The comparative analysis identified advantages and disadvantages of each alternative so that tradeoffs between the alternatives could be determined.

   Based on the comparative analysis, the Department chose to implement Alternative 3 as the prompt interim response for the Site. This alternative was selected because it would, in the most cost-effective manner, protect the public from possible human health risks associated with ingestion of Site-related hazardous substances while meeting the response objective of providing an immediate and reliable, potable backup public water supply source.

   This notice is being provided under section 506(b) of HSCA. The administrative record, which contains the information that forms the basis and documents the selection of this response, is available for public review and comment. The administrative record is located at the Department's Northwest Regional Office, 230 Chestnut Street, Meadville, PA 16335 and is available for review Monday through Friday from 8 a.m. to 4 p.m. Telephone beforehand for an appointment, (814) 332-6648. A duplicate administrative record will be maintained at the Lewis Run Borough Building, 60 Main Street, Lewis Run, PA 16738.

   The administrative record will be open for comment from May 13, 2006, until August 11, 2006. Persons may submit written comments into the record during this time only by sending them to Harold Nye, Project Manager at the Department's Northwest Regional Office or by delivering them to the office in person.

   In addition, persons may present oral comments for inclusion in the administrative record at a public hearing. Persons wishing to present comments must register with Harold Nye at the Department's Northwest Regional Office before June 16, 2006, by telephone or in writing. Persons interested in finding out if anyone has registered should contact Harold Nye for information concerning the time, date and location of the meeting. If no one registers to present oral comments before June 16, 2006, the public meeting will not be held.
