Rescission Order

By the Commission:

   On May 23, 2002, Law Bureau Prosecutory Staff filed a Formal Complaint against International Telcom, Ltd. (Respondent), an IXC reseller certificated at A-310436, for failure to file its 2000 Annual Report. Respondent's certificate was cancelled by Default Order entered October 29, 2002 based upon Respondent's failure to respond to the Complaint. The notice of the Default Order was published on November 9, 2002, at 32 Pa.B. 5596.

   A subsequent review of Commission records has revealed that Respondent actually filed its 2000 Annual Report on April 4, 2001, prior to the issuance of the Complaint. Apparently, Commission records used by Prosecutory Staff to compile its list of 2000 Annual Report delinquencies were in error; while this does not adequately explain the Respondent's failure to answer the Complaint, it must be viewed as sufficient ground to rescind our prior default Order. Additionally, Commission records also show that Respondent is current with its assessments and is compliant with other Commission filing requirements. We note that the Commission has granted Respondent's request to abandon its CLEC certificate. See Docket No. A-310436F2001. Accordingly, Respondent's IXC authority at A-310436 is hereby reinstated; Therefore,

It Is Ordered That:

   1.  The Default Order entered October 29, 2002 at this docket against International Telcom, Ltd. is hereby rescinded.

   2.  A copy of this order be published in the Pennsylvania Bulletin.
