FEDERAL WATER POLLUTION CONTROL ACT SECTION 401

   The Department of Environmental Protection (Department) has taken the following actions on previously received permit applications, requests for Environmental Assessment approval and requests for Water Quality Certification under section 401 of the Federal Water Pollution Control Act (FWPCA) (33 U.S.C.A. § 1341).

   Except as otherwise noted, the Department has granted 401 Water Quality Certification certifying that the construction and operation described will comply with the applicable provisions of sections 301--303, 306 and 307 of the FWPCA (33 U.S.C.A. §§ 1311--1313, 1316 and 1317) and that the construction will not violate applicable Federal and State water quality standards.

   Persons aggrieved by an action may appeal, under section 4 of the Environmental Hearing Board Act (35 P. S. § 7514) and 2 Pa.C.S. §§ 501--508 and 701--704 (relating to the Administrative Agency Law), to the Environmental Hearing Board, Second Floor, Rachel Carson State Office Building, 400 Market Street, P. O. Box 8457, Harrisburg, PA 17105-8457, (717) 787-3483. TDD users should contact the Environmental Hearing Board (Board) through the Pennsylvania Relay Service, (800) 654-5984. Appeals must be filed with the Board within 30 days of publication of this notice in the Pennsylvania Bulletin, unless the appropriate statute provides a different time period. Copies of the appeal form and the Board's rules of practice and procedure may be obtained from the Board. The appeal form and the Board's rules of practice and procedure are also available in Braille or on audiotape from the Secretary of the Board at (717) 787-3483. This paragraph does not, in and of itself, create any right of appeal beyond that permitted by applicable statutes and decision law.

   For individuals who wish to challenge an action, appeals must reach the Board within 30 days. A lawyer is not needed to file an appeal with the Board.

   To construct and maintain a road crossing consisting of an open-bottom aluminum box culvert having a span of 14-feet 1-inch and an underclearance of 6-feet 2-inches in Cranberry Creek (HQ-CWF) and 0.01 acre of EV, PSS wetlands for the purpose of providing access to a lumber stockpile area. The permittee is required to provide 0.01 acre of replacement wetlands. The project is located on the east side of SR 0191, approximately 0.2 mile south of SR 1009 (Buck Hill Falls, PA Quadrangle N:  4.6 inches; W:  4.5 inches). Subbasin:  1E.

   To construct a 10-foot wide pedestrian trail beginning in Loganville Borough Park and ending near Richard Nixon County Park, consisting of the following six stream crossings of UNTs to East Branch Codorus Creek (CWF) and two wetland crossings. The project is located in Loganville and Jacobus Boroughs, in Springfield Township, York County. The permittee proposes to construct and maintain:

   a)  A 25-foot long, 14-foot wide by 10-inch diameter span bridge having an underclearance of 4.8-feet (York, PA, Quadrangle:  Latitude:  39° 52` 45.86"; Longitude:   76° 43` 37.21", N:  0.25 inch; W:  13.9 inches).

   b)  A 45-foot long, 14-foot wide by 12-inch diameter span bridge having an underclearance of 7-feet (Glen Rock, PA, Quadrangle: Latitude:  39° 52` 19.15"; Longitude:   76° 43` 18.82", N:  24 inches; W:  13.7 inches).

   c)  Replacement of an existing corrugated metal arch pipe with a 54-foot long, 49-inch by 33-inch corrugated metal arch pipe (Glen Rock, PA Quadrangle; Latitude: 39° 52` 16.35"; Longitude:  76° 43` 16.73", N:  22 inches; W:  13.45 inches).

   d)  A 40-foot long, 14-foot wide by 12-inch diameter span bridge having an underclearance of 5.2-feet (Glen Rock, PA Quadrangle; Latitude:  39° 52` 10.82"; Longitude:   76° 43` 3.49", N:  21.7 inches; W:  12.95 inches).

   e)  A 33-foot long, 60-inch diameter corrugated metal pipe (Glen Rock, PA Quadrangle; Latitude:  39° 52` 10.45"; Longitude:  76° 43` 59.4", N:  21.65 inches; W:  12.8 inches).

   f)  A 65-foot long, 14-foot wide by 12-inch diameter span bridge having an underclearance of 5.0-feet (Glen Rock, PA Quadrangle; Latitude:  39° 51` 36.13"; Longitude:  76° 42` 32.76", N:  19.95 inches, W:  11.75 inches).

   The permittee proposes to permanently fill:

   g)  0.01 acre of PFO wetland for a permanent road crossing approximately 300 feet south of the intersection of T-521 and the proposed trail (Glen Rock, PA Quadrangle; Latitude:  39° 52` 23.53"; Longitude:  76° 43` 24.87", N:   22.35 inches; W:  13.75 inches).

   h)  0.01 acre of PFO wetland for a permanent road crossing along Water Street approximately 450 feet southeast of the intersection of Water Street and the propose SR 0214 (Glen Rock, PA Quadrangle; Latitude:  39° 51` 38.20"; Longitude:   76° 42` 34.64", N:  20.0 inches, W:  11.85 inches).

   The amount of wetland impact is considered a de minimis impact of 0.02 acre and wetland replacement is not required.

   E67-808: York Railway Company, 2790 West Market Street, York, PA 17404 in Spring Garden Township, York County, ACOE Baltimore District.

   To construct and maintain a 24-foot by 11.5-foot by 30.5-foot precast concrete arch bridge, a 24-foot by 11-foot by 35.8-foot precast concrete arch bridge, a 24-foot by 12.6-foot by 37.8-foot precast concrete arch bridge and remove a collapsed retaining wall and restore approximately 90 feet of stream channel all in and along Poorhouse Run (WWF) at a point west of Loucks Mill Road and east of the Codorus Creek (York, PA Quadrangle N:  17.5 inches; W:  14.0 inches, Latitude:  39° 58` 19"; Longitude:  76° 43` 31") in Spring Garden Township, York County.

   To construct and maintain: (1) a two span concrete box beam bridge with a clear span of 96.0 feet and minimum underclearance of 2.5 feet carrying the proposed West College Avenue extension over Conoy Creek (TSF) (Elizabethtown, PA Quadrangle N:  3.9 inches; W:  14.6 inches, Latitude:  40° 08` 46.4"; Longitude:  76° 36` 16.5"); (2) a sewer line crossing consisting of a 21-inch PVC pipe with concrete encasement under Conoy Creek (TSF) (Elizabethtown, PA Quadrangle N:   3.9 inches; W:  14.6 inches, Latitude:  40° 08` 47.2"; Longitude:  76° 36` 16.6"); (3) a water line crossing consisting of a 12-inch PVC pipe with concrete encasement under Conoy Creek (Elizabethtown, PA Quadrangle N:  3.8 inches; W:  14.6 inches, Latitude:  40° 08` 46.4"; Longitude:  76° 36` 16.5"); (4) a concrete retaining wall within the 100-Year Floodway of a UNT to Conoy Creek (TSF) (Elizabethtown, PA Quadrangle N:  3.9 inches; W:  14.7 inches, Latitude:  40° 08` 46.1"; Longitude:  76° 36` 14.7"); (5) a stormwater outfall and associated scour protection at a UNT to Conoy Creek (TSF) (Elizabethtown, PA Quadrangle N:  3.9 inches; W:  14.9 inches, Latitude:  40° 08` 46.4"; Longitude:  76° 36` 16.1"); (6) a vegetated swale outfalling to Conoy Creek (TSF) (Elizabethtown, PA Quadrangle N:  3.9 inches; W:  14.3 inches, Latitude:  40° 08` 46.4"; Longitude:  76° 36` 16.7"); and (7) the removal of gabion baskets within the stream channel of Conoy Creek (TSF) (Elizabethtown, PA Quadrangle N:  3.9 inches; W:  14.6 inches, Latitude:  40° 08` 46.4"; Longitude:  76° 36` 16.5"); all for the purpose of improving traffic safety within Elizabethtown Borough, Lancaster County.

   The applicant proposes to remove 94.0-lineal feet of existing culvert and stabilize 258 lineal feet of a UNT to Conoy Creek (TSF) (Elizabethtown, PA Quadrangle N:  4.0 inches; W:  14.6 inches, Latitude:  40° 08` 47.4"; Longitude:  76° 36` 11.5") as mitigation for the new bridge.

(Clymer, PA Quadrangle N:  3.6 inches; W:  13.6 inches, Latitude:   40° 38` 39"; Longitude:  79° 5` 55"). To place and maintain fill in a de minimis wetland, on a UNT to Two Lick Creek (CWF). The project is located on the north side of Hood School Road east of the intersection with Fyock Road.

   E10-424. St. Kilian Parish, P. O. Box 394, 212 Hook Street, Mars, PA 16046. Church expansion project in Cranberry Township, Butler County, ACOE Pittsburgh District. The applicant proposes to construct the following activities as part of a church expansion project east of Franklin Road south of the intersection with SR 228 in Cranberry Township:

   1.  To install and maintain a Con/Span bridge having a waterway opening of 6.67 feet and a span of 54 feet with a length of 68 feet.

   2.  To install and maintain a 130-foot long box culvert having a clear span of 12 feet and an underclearance of 3 feet on a tributary to Kaufman Run.

   3.  To remove a road crossing with existing 18-inch and 30-inch culverts and restore approximately 30 feet of stream channel.

   4.  Permanent impacts to 0.40 acre of wetland (PEM, PSS, PFO) for construction of driveways, parking area and stormwater detention pond.

   5.  To restore approximately 130 feet of tributary 1 to Kaufman Run as mitigation for the proposed box culvert stream enclosure.

   The applicant proposes a combination of onsite wetland mitigation of 0.26 acre and a contribution to the Wetland Replacement Fund for the remaining 0.20 acre, total mitigation required 0.46 acre (Mars Quadrangle N: 40° 40` 52.8"; W: 80° 04` 25.5").

   E20-550, Cochranton Borough, 109 East Adams Street, P. O. Box 66, Cochranton, PA 16314. Cochranton Borough Sewage Facilities Project, in Cochranton Borough and Wayne Township, Crawford County, ACOE Pittsburgh District (Cochranton, PA Quadrangle N:  4.0 inches; W:  8.5 inches).

   The applicant proposes to construct and maintain a sewage collection and treatment system for the Borough of Cochranton consisting of approximately 44,000 linear feet of gravity sewer line and 8,800 linear feet of pressure sewer line, pump stations and a sewage treatment plant involving: 1) to construct and maintain 13 sewer line stream crossings of UNTs to French Creek by the open trench method and a sewer line crossing of Little Sugar Creek by directional drilling; 2) to construct and maintain five sewer line crossings of PEM, PSS and PFO wetlands; 3) to permanently fill 0.007 acre of wetland for the construction of an access drive; 4) to construct and maintain a 1-foot diameter PVC plastic sewage treatment plant outfall to French Creek (N:  41° 30` 10"; W:  80° 02` 20"); 5) to construct and maintain three pump stations at the Fairgrounds (N:  41° 31` 9.8"; W:  80° 03` 11.4"), South Atlantic Avenue (N:  41° 30` 45.3"; W:  80° 02` 24") and Lee Lane (N:  41° 30` 38.6"; W:  80° 02` 28.7"), with a net fill of 1,109 cubic yards within the FEMA floodplain; and 6) to construct and maintain a floodplain fill mitigation area consisting of the removal of approximately 1,112 cubic yards of earthen material from the FEMA floodplain near the proposed sewage treatment plant (N:  41° 30` 12.5"; W:  80° 02` 11.9"). Little Sugar Creek is a perennial stream classified as a CWF. The tributaries to French Creek and French Creek are classified as WWF.
