PUBLIC WATER SUPPLY (PWS) PERMITS

   The Department of Environmental Protection has taken the following actions on applications received under the Pennsylvania Safe Drinking Water Act (35 P. S. §§ 721.1--721.17) for the construction, substantial modification or operation of a public water system.

   Persons aggrieved by an action may appeal, under section 4 of the Environmental Hearing Board Act (35 P. S. § 7514) and 2 Pa.C.S. §§ 501--508 and 701--704 (relating to the Administrative Agency Law), to the Environmental Hearing Board, Second Floor, Rachel Carson State Office Building, 400 Market Street, P. O. Box 8457, Harrisburg, PA 17105-8457, (717) 787-3483. TDD users should contact the Environmental Hearing Board (Board) through the Pennsylvania Relay Service, (800) 654-5984. Appeals must be filed with the Board within 30 days of publication of this notice in the Pennsylvania Bulletin, unless the appropriate statute provides a different time period. Copies of the appeal form and the Board's rules of practice and procedure may be obtained from the Board. The appeal form and the Board's rules of practice and procedure are also available in Braille or on audiotape from the Secretary of the Board at (717) 787-3483. This paragraph does not, in and of itself, create any right of appeal beyond that permitted by applicable statutes and decision law.

   For individuals who wish to challenge an action, appeals must reach the Board within 30 days. A lawyer is not needed to file an appeal with the Board.

LAND RECYCLING AND ENVIRONMENTAL REMEDIATION

UNDER ACT 2, 1995

PREAMBLE 2


The following plans and reports were submitted under the Land Recycling and Environmental Remediation Standards Act (35 P. S. §§ 6026.101--6026.908).

   Provisions of Chapter 3 of the Land Recycling and Environmental Remediation Standards Act (act) require the Department of Environmental Protection (Department) to publish in the Pennsylvania Bulletin a notice of submission of plans and reports. A final report is submitted to document cleanup of a release of a regulated substance at a site to one of the act's remediation standards. A final report provides a description of the site investigation to characterize the nature and extent of contaminants in environmental media, the basis for selecting the environmental media of concern, documentation supporting the selection of residential or nonresidential exposure factors, a description of the remediation performed and summaries of sampling analytical results which demonstrate that remediation has attained the cleanup standard selected. Submission of plans and reports, other than the final report, shall also be published in the Pennsylvania Bulletin. These include the remedial investigation report, risk assessment report and cleanup plan for a site-specific standard remediation. A remedial investigation report includes conclusions from the site investigation, concentration of regulated substances in environmental media; benefits of refuse of the property and, in some circumstances, a fate and transport analysis. If required, a risk assessment report describes potential adverse effects caused by the presence of regulated substances. If required, a cleanup plan evaluates the abilities of potential remedies to achieve remedy requirements.

   For further information concerning plans or reports, contact the Environmental Cleanup Program manager in the Department regional office after which the notice of receipt of plans or reports appears. If information concerning plans or reports is required in an alternative form, contact the Community Relations Coordinator at the appropriate regional office. Box 744,West Chester, PA 19381 has submitted a combined remedial investigation/risk assessment and cleanup plan (on behalf of her client Sunoco, Inc. (R & M) P. O. Box 1135, Post Road and Blueball Avenue, Marcus Hook, PA 19061) regarding the remediation of a pipeline release of gasoline in soils and groundwater. The combined reports were submitted in partial fulfillment of the Site-Specific Standard. A public notice regarding the submittal of the combined reports was published in The Times Leader on December 13, 2006.

   Lehigh Valley Tropicana (former Agere South Campus), City of Allentown, Lehigh County. Richard Lake, Senior Environmental Scientist, Geo-Technology Associates, Inc., 24 Worlds Fair Drive, Suite B, Somerset, NJ 08873 has submitted a combined remedial investigation report/cleanup plan on behalf of Rich Ruden, Tropicana Pennsylvania, LLC, 609 Hamilton Mall, Suite 1, Allentown, PA 18101) concerning the remediation of soil and/or groundwater found or suspected of having been contaminated by arsenic and TCE related to a septic system as the result of the property's historic industrial use. The applicant proposes to meet the site-specific standard. A Public Notice was published in The Morning Call on November 22, 2006. The proposed future use of the property will be for commercial purposes.

   Lehigh County Minor League Ballpark (former Agere South Campus), City of Allentown, Lehigh County. Richard Lake, Senior Environmental Scientist, Geo-Technology Associates, Inc., 24 Worlds Fair Drive, Suite B, Somerset, NJ 08873 has submitted a combined remedial investigation report/cleanup Plan (on behalf of Glenn Solt, County of Lehigh, Government Center, 17 South Seventh Street, Allentown, PA 18101 and Rich Ruden, LV Red, LLC, 2390 E. Camelback Road, Suite 400, Phoenix, AZ 85016) concerning the remediation of soils and/or groundwater found or suspected to have been contaminated by arsenic, nickel, silver, TCE and mercury as the result of the property's historic industrial use. The applicant proposes to meet the site-specific standard. A Public Notice was published in The Morning Call on December 1, 2006. The proposed future use of the property will be for the development of the Lehigh County Minor League Ballpark.

   Southcentral Region: Environmental Cleanup Program Manager, 909 Elmerton Avenue, Harrisburg, PA 17110.

   Sindall Trucking Services, Inc., New Holland Borough, Lancaster County. Alternative Environmental Solutions, Inc., 930 Pointview Avenue, Suite B, Ephrata, PA 17522, on behalf of Sindall Trucking Services, Inc., 461 Diller Avenue, P. O. Box 165, New Holland, PA 17557, submitted a Final Report concerning remediation of site soils and groundwater contaminated with waste oil leaked during removal of an underground storage tank. The report is intended to document remediation of the site to the Statewide Health Standard.

   Northwest Region: Environmental Cleanup Program Manager, 230 Chestnut Street, Meadville, PA 16335-3481.

   Art Keller, (Lyons Property), Pine Creek Township, Jefferson County. Blazosky Associates Inc., 2525 Freen Tech Drive, Suite D, State College, PA 16803 has submitted a Final Report on behalf of Shortway Service Inc., 311 Jackson Street, Reynoldsville, PA 15851 concerning remediation of site contaminated with VOCs and SVOCs such as BTEX, fluorene and phenanthrene. The report is intended to document remediation of the site to meet the Statewide Health Standard.

A remedial investigation report includes conclusions from the site investigation, concentration of regulated substances in environmental media, benefits of refuse of the property and, in some circumstances, a fate and transport analysis. If required, a risk assessment report describes potential adverse effects caused by the presence of regulated substances. If required, a cleanup plan evaluates the abilities of potential remedies to achieve remedy requirements. A work plan for conducting a baseline remedial investigation is required by provisions of the act for compliance with selection of a special industrial area remediation. The baseline remedial investigation, based on the work plan, is compiled into the baseline environmental report to establish a reference point to show existing contamination, describe proposed remediation to be done and include a description of existing or potential public benefits of the use or reuse of the property. The Department may approve or disapprove plans and reports submitted. This notice provides the Department's decision and, if relevant, the basis for disapproval.

   Eileen McArdle Residence, New Berlin Borough, Union County. Northridge Group, Inc., 1172 Ridge Road, Northumberland, PA 17857 on behalf of Eileen McArdle, 525 Market Street, New Berlin, PA 17855 has submitted a Final Report within 90 days of a release concerning remediation of soil and surface groundwater contaminated with No. 2 heating oil. The Final Report demonstrated attainment of the Statewide Health Standard and was approved by the Department on December 29, 2006.

   Long Hallow Creek (P-47), Liberty Township, Mckean County. PPL Gas Utilities Corp, 2 North 9th Street, Allentown, PA 18101 on their behalf has submitted a Final Report concerning remediation of site soils contaminated with small amounts of mercury. The Final Report, which demonstrated attainment of the Statewide Health Standard was approved by the Department on December 29, 2006.

   P. C. Meter & Regulator (P-43), Port Allegany Borough, McKean County. PPL Gas Utilities Corp, 2 North 9th Street, Allentown, PA 18101 on their behalf has submitted a Final Report concerning remediation of site soils contaminated with small amounts of mercury. The Final Report, which demonstrated attainment of the Statewide Health Standard was approved by the Department on December 29, 2006.

   Scherer Farm Check (P-48) Port Allegany Borough, McKean County. PPL Gas Utilities Corp, 2 North 9th Street, Allentown, PA 18101 on their behalf has submitted a Final Report concerning remediation of site soils contaminated with small amounts of mercury. The Final Report, which demonstrated attainment of the Statewide Health Standard was approved by the Department on December 29, 2006.

   Wright Check (P-149), Liberty Township, McKean County. PPL Gas Utilities Corp., 2 North 9th Street, Allentown, PA 18101 on their behalf has submitted a Final Report concerning remediation of site soils contaminated with small amounts of mercury. The Final Report, which demonstrated attainment of the Statewide Health Standard was approved by the Department on December 29, 2006.

   Zuck Road Property Tract 78 (formerly known as Legacy Woods Condominiums), Erie County. Burt Waite, Moody & Associates, Inc., 11548 Cotton Road, Meadville, PA 16335 on behalf of Peter and Mary Fedorka, 2500 South Shore Drive, Erie, PA 16505 has submitted remedial investigation report and cleanup plan concerning remediation of site soils contaminated with lead. The Department approved the plans on September 1, 2006.

OPERATE WASTE PROCESSING OR DISPOSAL AREA OR SITE


Major Permit Modification issued Under the Solid Waste Management Act (35 P. S. §§ 6018.101--6018.1003), the Municipal Waste Planning, Recycling and Waste Reduction Act (53 P. S. §§ 4000.101--4000.1904) and Regulations to Operate Solid Waste Processing or Disposal Area or Site.
