Promulgation of Local Rule of Criminal Procedure 543; No. 0004-21 MD 2007 (1793 S 1989); AO-28-2007

Order

   And Now, this 26th day of July 2007, Dauphin County Local Rule of Criminal Procedure 543 is promulgated as follows:

Rule 543. Disposition of Case at Preliminary Hearing
(1)  Pursuant to Pa.R.Crim.P. 543(D)(3), if an issuing authority holds a preliminary hearing in absentia and holds the case for court, s/he shall immediately forward the transcript to the Clerk of Court with a request that a bench warrant be issued by the Court of Common Pleas.
(2)  The Clerk of Court shall immediately docket and forward the transcript and request for bench warrant to the Court Administrator's Office for review and presentation to the Court.
(3)  Upon receipt of a signed bench warrant, the Clerk of Court shall immediately make the appropriate notation on the docket and transmit a copy of the warrant to the sheriff.
This rule shall be effective September 4, 2007.
