Appeal of Saeid Alemo, M. D. under the Medical Care Availability and Reduction of Error (MCARE) Act (40 P. S. §§ 1303.101--1303.910);
Doc. No. MM08-02-011

   On or before March 11, 2008, MCARE shall file a concise statement explaining why it denied coverage for a claim reported to the health care provider and the insurer in November 2007, before the 60 days allowed for payment of the ''Health Care Provider Experience Rated Invoice'' expired on December 3, 2007. The statement may be in narrative form or in numbered paragraphs, but in either event shall not exceed two pages.

   On or before March 25, 2008, the appellant shall file a concise statement setting forth the factual and/or legal basis for the disagreement with MCARE's February 1, 2008, determination. The statement may be in narrative form or in numbered paragraphs, but in either event shall not exceed two pages. A prehearing telephone conference initiated by this office is scheduled for April 1, 2008, at 10 a.m. Each party shall provide a telephone number to be used for the telephone conference to the Hearings Administrator on or before March 4, 2008. A hearing date shall be determined, if necessary, at the prehearing telephone conference.

   Motions preliminary to those at hearing, protests, petitions to intervene or notices of intervention, if any, must be filed on or before March 18, 2008, with the Hearings Administrator, Administrative Hearings Office, Capitol Associates Building, Room 200, 901 North Seventh Street, Harrisburg, PA 17102. Answer to petitions to intervene, if any shall be filed on or before March 25, 2008.
