FEDERAL WATER POLLUTION CONTROL ACT SECTION 401

 The Department has taken the following actions on previously received permit applications, requests for Environmental Assessment approval and requests for Water Quality Certification under section 401 of the Federal Water Pollution Control Act (FWPCA) (33 U.S.C.A. § 1341).

 Except as otherwise noted, the Department has granted 401 Water Quality Certification certifying that the construction and operation described will comply with sections 301—303, 306 and 307 of the FWPCA (33 U.S.C.A. §§ 1311—1313, 1316 and 1317) and that the construction will not violate applicable Federal and State water quality standards.

 Persons aggrieved by an action may appeal that action to the Environmental Hearing Board (Board) under section 4 of the Environmental Hearing Board Act and 2 Pa.C.S. §§ 501—508 and 701—704. The appeal should be sent to the Environmental Hearing Board, Second Floor, Rachel Carson State Office Building, 400 Market Street, PO Box 8457, Harrisburg, PA 17105-8457, (717) 787-3483.  To conduct the following activities associated with the realignment of S.R. 1006, Section A01 immediately west of S.R. 321 at Wilcox:

 1. To remove the existing bridge and stabilize approximately 75 feet of the right bank and 81 feet of the left bank of the West Branch Clarion River.

 2. To construct and maintain a 31.4 foot long prestressed concrete beam bridge on integral abutments having a clear span of 92.7 feet and an underclearance of 12.9 feet on a 75 degree skew across Wilson Run on a new roadway alignment.

 3. To permanently impact 0.012 acre of EV wetland adjacent to Wilson Run and West Branch Clarion River associated with fill for the roadway approach to the bridge.

 4. To temporarily impact 0.045 acre of EV wetland.

 5. To install and maintain a 36 inch diameter culvert to maintain flow in an existing ditch through the proposed roadway embankment and discharging into the wetland area along West Branch Clarion River.

ENVIRONMENTAL ASSESSMENTS

EA25-051, US Army Corps of Engineers (Buffalo District), 1776 Niagara Street, Buffalo, NY 14207. Erie Harbor Dredging 2011, request for Section 401 Water Quality Certification. Environmental Assessment to Dredge the Erie Harbor, and Place Dredge Material in Open Lake Disposal Area, in City of Erie, Millcreek Township, Presque Isle State Park, Erie Harbor, Erie County, ACOE Pittsburgh District:

 (Erie Harbor Dredging: Erie North PA Quadrangle N: approx. 5.25 inches; W: approx. 10.25 inches).

 (Open Lake Disposal: Erie North PA Quadrangle N: approx. 14.0 inches; W: approx. 8.25 inches).

 To conduct maintenance dredging of authorized Federal navigational channels of Erie Harbor, which include the Entrance Channel, Harbor Basin, Approach Area, and two Harbor Areas, in order to maintain sufficient depth for deep-draft commercial vessels. An estimated total of approximately 210,000 cubic yards of material is proposed to be dredged during this dredging cycle from Erie Harbor Federal Navigation Channels. The majority of materials are expected to be dredged from the Entrance Channel, Harbor Basin, and Approach Area portions of the Harbor.

 To discharge the associated dredged materials from the Federal navigational channels of Erie Harbor, described above, at the existing, authorized one-mile square, open-lake discharge area used for dredged material discharge since the 1930's, located approximately 3.3 miles from the Erie Harbor Pierhead Light, at an azimuth of 009 degrees, 00 minutes, into Lake Erie.

 This dredging project proposes to impact 246.6 acres of Lake Erie, Erie Channel and Presque Isle Bay. The open-lake disposal project proposes to impact 1 square mile of Lake Erie.

D04-047EA and D04-048EA. Pennsylvania Fish and Boat Commission, 450 Robinson Lane, Bellefonte, PA 16823, Franklin Township, Beaver County. Project proposes to breach and remove Upper and Lower Hereford Manor Dams across Doe Run (WWF) for the purpose of eliminating a threat to public safety and restoring the stream to a free flowing condition. Draft Hazardous Permit

Public Hearing Notice and Notice of Intent to Issue a Hazardous Waste Permit

 The Commonwealth of Pennsylvania, Department of Environmental Protection (DEP) intends to issue to Copperhead Chemical Company, Inc. (Copperhead) a Solid Waste Management Act Permit. This permit is a renewal of the permit to operate a Hazardous Waste treatment facility located in Tamaqua, Pennsylvania. The Copperhead Chemical facility is a manufacturer of nitrate esters, pharmaceutical grade nitroglycerin, and other products for use in pharmaceutical blends. The thermal treatment units are located in an isolated area of the Copperhead property, and are for the safe disposal of waste materials generated in the manufacturing process, as well as off specification products.

 The public will be given forty-five (45) days to comment on the draft permit, issued February 25, 2011 and prepared under the Solid Waste Management Act. The comment period will begin on March 1, 2011 and will end on April 15, 2011. Any person interested in commenting on the application or draft permit must do so within this comment period. Copies of the application, draft permit and fact sheet for the Hazardous Waste Facility may be reviewed at the Pennsylvania Department of Environmental Protection, Northeast Regional Office at 2 Public Square, Wilkes-Barre, PA 18701-1915.  All persons wishing to comment on any of the permit conditions or permit application should submit the comments in writing to the Department of Environmental Protection (DEP), Waste Management Program, 2 Public Square, and Wilkes-Barre, PA 18701-1915; Attention William Tomayko, Regional Solid Waste Manager. Comments should include all reasonably available references, factual grounds and supporting materials.

 A public hearing is scheduled for March 28, 2011 at 10:00 AM. The hearing will be held at the Walker Township Building, 9 Township Road, Tamaqua, PA. The public hearing will be held on the Department of Environmental Protection's draft permit for Hazardous Waste Treatment.

 When making a determination regarding the issuance of a hazardous waste permit to Copperhead Chemical Company, Inc., the Department of Environmental Protection will consider all written comments received during the comment period, and oral or written statements received during the public hearing, the requirements of the hazardous waste regulations of 25 Pa. Code Chapter 260-270 and the Department of Environmental Protection's permitting policies.

Notice of Certification to Perform Radon-Related Activities in Pennsylvania

 In the month of February 2011 the Department of Environmental Protection of the Commonwealth of Pennsylvania, under the authority contained in the Radon Certification Act, act of July 9, 1987, P. L. 238, No. 43 (63 P. S. Sections 2001-2014) and regulations promulgated thereunder at 25 Pa. Code Chapter 240, has certified the persons listed below to perform radon-related activities in Pennsylvania. Mining Permit Revision, Related NPDES Permit and Request for Section 401 Water Quality Certification

Request for Comments on the Proposed Total Maximum Daily Load (TMDL) Developed for the
Beaverdam Creek Watershed in Adams County

 The Department of Environmental Protection will accept comments on the proposed TMDL developed for the Beaverdam Creek Watershed in Adams County, PA. This TMDL was established in accordance with the requirements of Section 303(d) of the Clean Water Act. The Pennsylvania Integrated Water Quality Monitoring and Assessment Report included impaired stream segments in this watershed. The listings of these waterbodies were due to use impairments caused by excessive siltation.

 There currently are no state or federal instream numerical water quality criteria for siltation. Therefore, the Department utilized a reference watershed approach to implement the applicable narrative criteria. This proposed TMDL set allowable loadings of sediment in the Beaverdam Creek Watershed. The sediment loadings were allocated among cropland, hay/pasture land, transitional land and streambank categories present in the watershed. Data used in establishing these TMDLs was generated using a water quality analysis model (AVGWLF) designed by the Pennsylvania State University.

 The following table shows the estimated current sediment loadings for the watershed. Overall load reductions necessary in order to meet the TMDL is also identified.
