[42 Pa.B. 1472]
[Saturday, March 17, 2012]

In a letter dated December 9, 2011, the United States Environmental Protection Agency (EPA) requested that the Department of Environmental Protection (Department) make a written determination regarding certification under section 401 of the Federal Clean Water Act (33 U.S.C.A. § 1341) with respect to two Draft National Pollutant Discharge Elimination System General Permits issued by the EPA, which are scheduled for publication as final General Permits in 2013. The Draft General Permits are the Vessel General Permit (VGP) and Small Vessel General Permit (sVGP). Notice of these Draft General Permits was published at 73 FR 76716 (December 8, 2011). The proposed VGP would generally apply to discharges incidental to the normal operation of vessels that are greater than or equal to 79 feet long (with certain exceptions) into waters of the United States. The proposed sVGP would generally apply to discharges incidental to the normal operation of vessels less than 79 feet long into waters of the United States.

Copies of the draft permits and the accompanying fact sheets are available by contacting Dharmin Pathak at the following address or may be acquired through the EPA's web site at http://cfpub.epa.gov/npdes/vessels/vgpermit.cfm.The Department intends to waive its certification rights under section 401 of the Federal Clean Water Act with respect to the terms and conditions of the draft permit. If any of the terms or conditions of the draft permits are significantly revised in the final permits, the Department reserves the right to reconsider the waiver of its certification rights.

Written comments on the Department's proposed action should be sent to Dharmin Pathak, Department of Environmental Protection, Bureau of Point and Non-Point Source Management, 11th Floor, Rachel Carson State Office Building, P. O. Box 8774, Harrisburg, PA 17105-8467, dpathak@pa.gov and must be received by April 16, 2012.
