Public Comment Period on BAQ-GPA/GP-5 Extended

 At 42 Pa.B. 1187 (March 3, 2012), the Department of Environmental Protection (Department) published a Proposed Revisions to the General Plan Approval and/or General Operating Permit for Natural Gas Production and Processing Facilities (BAQ-GPA/GP-5) notice. That notice requested that written comments be received by May 2, 2012.

 The Department also stated in that notice that the General Permit will not be issued prior to the publication of United States Environmental Protection Agency's (EPA) final New Source Performance Standards and National Emission Standards for Hazardous Air Pollutants for this industry sector. Those standards were scheduled to be finalized, under a consent decree, on April 3, 2012, but that deadline has recently been extended to April 17, 2012, to allow the EPA additional time to consider the extensive public comments that have been received.

 Because the Department recognizes the value in giving potential commentators the opportunity to fully consider the new Federal rules when developing comments, the Department is extending its comment period for BAQ-GPA/GP-5 for an additional 3 weeks.

 The Department requests written comments on the proposed revisions to this General Permit by May 23, 2012. Comments received by facsimile will not be accepted.  Upon issuance of the modified GP-5, the Department will publish a notice in the Pennsylvania Bulletin of the issuance of the modified General Permit.
