COAL AND NONCOAL MINING ACTIVITY APPLICATIONS

 Applications under the Surface Mining Conservation and Reclamation Act (52 P. S. §§ 1396.1—1396.19a); the Noncoal Surface Mining Conservation and Reclamation Act (52 P. S. §§ 3301—3326); The Clean Streams Law (35 P. S. §§ 691.1—691.1001); the Coal Refuse Disposal Control Act (52 P. S. §§ 30.51—30.66); and The Bituminous Mine Subsidence and Land Conservation Act (52 P. S. §§ 1406.1—1406.20a). Mining activity permits issued in response to such applications will also address the applicable permitting requirements of the following statutes: the Air Pollution Control Act (35 P. S. §§ 4001—4015); the Dam Safety and Encroachments Act (32 P. S. §§ 693.1—693.27); and the Solid Waste Management Act (35 P. S. §§ 6018.101—6018.1003).

 The following permit applications to conduct mining activities have been received by the Department. A copy of the application is available for inspection at the district mining office indicated before each application. Notices of requests for 401 Water Quality Certifications are included in individual application notices, as noted.

 Written comments or objections, or requests for an informal conference, or a public hearing, as applicable, on a mining permit application and request for Section 401 water quality certification application may be submitted by any person or any officer or head of any Federal, state or local government agency or authority to the Department at the address of the district mining office indicated before each application within 30 days of this publication, or within 30 days after the last publication of the applicant's newspaper advertisement as provided by 25 Pa. Code §§ 77.121—77.123 and 86.31—86.34.

 Written comments or objections regarding a mining permit application should contain the name, address and telephone number of persons submitting comments or objections, application number and a statement of sufficient detail to inform the Department on the basis of comment or objection and relevant facts upon which it is based.

 A request for an informal conference or a public hearing, as applicable, on a mining permit application, as provided by 25 Pa. Code § 77.123 or § 86.34, must contain the name, address and telephone number of the requestor; the application number; a brief summary of the issues to be raised by the requestor at the conference; and a statement whether the requestor desires to have the conference conducted in the locality of the proposed mining activities.

 When an NPDES number is listed, the mining activity permit application was accompanied by an application for an individual NPDES permit. A separate notice will be provided after the draft NPDES permit is prepared.

FEDERAL WATER POLLUTION CONTROL ACT, SECTION 401

 The following permit applications, requests for Environmental Assessment approval and requests for 401 Water Quality Certification have been received by the Department. Section 401 of the Federal Water Pollution Control Act (FWPCA) (33 U.S.C.A. § 1341) requires the Commonwealth to certify that the involved projects will not violate the sections 301—303, 306 and 307 of the FWPCA (33 U.S.C.A. §§ 1311—1313, 1316 and 1317) as well as relevant State requirements. Persons objecting to approval of a request for certification under section 401 of the FWPCA, the issuance of a Dam Permit or Water Obstruction and Encroachment Permit or the approval of an Environmental Assessment shall submit comments, suggestions or objections within 30 days of the date of this notice as well as any questions to the office noted before an application. Comments should contain the name, address and telephone number of the person commenting, identification of the certification request to which the comments or objections are addressed and a concise statement of comments, objections or suggestions including the relevant facts upon which they are based.

 The Department may conduct a fact-finding hearing or an informal conference in response to comments if deemed necessary. Each individual will be notified, in writing, of the time and place of a scheduled hearing or conference concerning the certification request to which the comment, objection or suggestion relates. Maps, drawings and other data pertinent to the certification request are available for inspection between 8 a.m. and 4 p.m. on working days at the office noted before the application.

 To construct and maintain the following water obstructions and encroachments associated with the Askam Borehole Acid Mine Discharge Remediation Project:

 1. To construct and maintain an on-stream settling pond having a surface area of approximately 1.33 acres and a depth of 10 feet in Nanticoke Creek, with a high-volume aeration/oxidizing unit at the pond inlet.

 2. To construct and maintain a 570-foot long ''high-flow'' riprap-lined trapezoidal bypass channel around the settling pond, having an 18-foot bottom width and 1.5 to 1 side slopes.

 3. To construct and maintain a 250-foot long channel change in Nanticoke Creek immediately upstream of the settling pond. The channel change consists of a riprap-lined trapezoidal channel, having an 18-foot bottom width and 1.5 to 1 side slopes.

 The project will impact approximately 1.6 acres of wetlands and 800 feet of stream channel.

 The project is located on the west side of Dundee Road immediately north of the S.R. 0029 Overpass (Wilkes-Barre West, PA Quadrangle, Latitude: 41°12`1"; Longitude: -75°57`58").

 To construct and maintain a 4-inch diameter PVC concrete encased sanitary sewer line crossing of a tributary to Equinunk Creek. The project is located immediately south of the intersection of SR 0370 (Crosstown Highway) and Reynolds Road (Orson, PA Quadrangle, Latitude: 41°51`8.4"; Longitude: -75°24`4.8").

 To construct and maintain: 1) a new 10,990 square foot playground by replacing the existing grass with a wood mulch play surface and its associated gravel encased perforated pipe underdrain system creating a 5,021 cubic feet (CF) cut in the left 100 year-year floodplain; 2) an 18-foot by 24-foot open-sided pavilion creating an fill of 3.7 CF in the left 100 year-year floodplain; 3) a new 22.5-foot by 25-foot concrete block restroom with associated flood vents creating a fill of 525 CF in the left 100-year floodplain; 4) the proposed fill and sidewalks around the new buildings will produce a fill of 2,009 CF in the left 100-year floodplain of Lawshee Run; 5) Install a 4-inch pipe outfall with subsurface concrete end wall in the left bank of Lawshee Run for subsurface draining of the playground. This project proposes to directly impact 2 linear feet of Lawshee Run, which is classified as a Warm Water Fishery.

 The Taylor 8" Lateral Unit 1H Natural Gas gathering line project will convey natural gas from the Taylor well pad and convey it to the existing Korban to Phelps Natural Gas pipeline located in Lathrop Township, Susquehanna County and to existing the Transco Gas Transmission Line in Dallas Township, Luzerne County. The project will result in 1,033 linear feet (6,525 square feet) of temporary stream impacts and a total of 0.50 acre (21,883 square feet) of wetland impacts all for the purpose of conveyance of natural gas from the Marcellus Shale to market.

A draft instrument has been submitted to the ACOE Districts and PA DEP detailing the operations and development of mitigation banks sites across the Commonwealth. The application is being concurrently process by the ACOE in accordance with the Federal mitigation rule requirements. The application details the establishment of the bank sites, financial assurances, long term ownerships and maintenance as well as other aspects of mitigation bank development as required in the Federal rules.

 The applicant intends to construct, restore and/or enhance aquatic resources for the purpose of selling mitigation credits to meet State and Federal compensatory mitigation requirements.

The approval of coverage for land application of sewage sludge or residential septage under applicable general permit is subject to pollutant limitations, pathogen and vector attraction reduction requirements, operational standards, general requirements, management practices and other conditions in the respective permit. The permits and related documents, effluent limitations, permitting requirements and other information are on file and may be inspected and arrangements made for copying at the contact office noted before the action.

 Persons aggrieved by an action may appeal that action to the Environmental Hearing Board (Board) under section 4 of the Environmental Hearing Board Act (35 P. S. § 7514) and 2 Pa.C.S. §§ 501—508 and 701—704 (relating to Administrative Agency Law). The appeal should be sent to the Environmental Hearing Board, Second Floor, Rachel Carson State Office Building, 400 Market Street, PO Box 8457, Harrisburg, PA 17105-8457, (717) 787-3483.
