E21-425: Weis Markets, Inc. 1000 South Second Street, PO Box 471, Sunbury, Pennsylvania 17801, in Hampden Township, Cumberland County, ACOE Baltimore District

 To: 1) fill and maintain 0.18 acre of Palustrine Emergent (PEM) wetland, 2) fill 147.0 linear feet of an unnamed tributary to Pine Creek (WWF), and 3) construct and maintain an 18.0-inch diameter HDPE stormwater outfall, including endwall and riprap rock outlet protection discharging to Pine Creek (WWF). The project is located on the northeast quadrant of the intersection of Wertzville Road and Valley Road in Hampden Township, Cumberland County (Harrisburg West, PA Quadrangle; N: 6.6 inches, W: 13.6 inches; Latitude: 40°17`11", Longitude: -76°58`21"). The purpose of the project is to construct a new Weis Markets grocery store and related infrastructure. The permittee is required to provide a minimum of 0.18 acre of replacement wetland, as well as 75.0 linear feet of streambank stabilization, 75.0 linear feet of shrub plantings, and 100.0 linear feet of random boulder placement within Pine Creek (WWF) to compensate for stream and wetland impacts.

EROSION AND SEDIMENT CONTROL

 The following Erosion and Sediment Control permits have been issued.

 Persons aggrieved by an action may appeal that action to the Environmental Hearing Board (Board) under section 4 of the Environmental Hearing Board Act and 2 Pa.C.S. §§ 501—508 and 701—704. Appeals must be filed with the Board within 30 days of publication of this notice in the Pennsylvania Bulletin unless the appropriate statute provides a different time period. Copies of the appeal form and the Board's rules of practice and procedure may be obtained from the Board. The appeal form and the Board's rules of practice and procedure are also available in Braille or on audiotape from the Secretary to the Board at (717) 787-3483. This paragraph does not, in and of itself, create a right of appeal beyond that permitted by applicable statutes and decisional law.

 Pursuant to Section 507 of the Hazardous Sites Cleanup Act, Act of October 18, 1988, P. L. 756, 35 P. S. §§ 6020.101—6020.1305 (''HSCA''), the Pennsylvania Department of Environmental Protection (''Department'') and United States Environmental Protection Agency (''USEPA'') have negotiated a Partial Consent Decree (''Settlement'') regarding the cleanup of the Remacor, Inc. Superfund Site in Taylor Township, Lawrence County, Pennsylvania (''Site''), and recovery of costs incurred and to be incurred in responding to the release or threat of release of hazardous substances at or in connection with the Site.
