NUTRIENT MANAGEMENT PLANS RELATED TO APPLICATIONS FOR NPDES PERMITS FOR CAFOs

 The State Conservation Commission has taken the following actions on previously received applications for nutrient management plans under 3 Pa.C.S. Chapter 5, for agricultural operations that have or anticipate submitting applications for new, amended or renewed NPDES permits or NOIs for coverage under a general permit for CAFOs under 25 Pa. Code Chapter 92a. This notice is provided in accordance with 25 Pa. Code Chapter 92a and 40 CFR Part 122, implementing The Clean Streams Law and the Federal Clean Water Act.

Notice of Proposed Interim Response
Franklin Glass Site
City of Butler, Butler County

 The Pennsylvania Department of Environmental Protection (''Department''), under the authority of the Hazardous Sites Cleanup Act, 35 P. S. Section 6020.101 et. seq. (''HSCA''), proposes to conduct an interim response at the Franklin Glass Site (''site''). The site is located in the City of Butler, Butler County, Pennsylvania. The site consists of residential and unimproved land where glass manufacturing wastes were historically disposed and the associated impacted soils containing arsenic. The waste disposal area is intersected by Coal Run and its receiving stream, Connoquenessing Creek. Potential human health exposure results from underlying wastes and impacted soils exposed by the eroding stream banks of those waterways. Specific sections of those streams currently have more extensive erosion and pose a more urgent threat than other sections.

 The Department has investigated the site and has thus far identified three Areas Of Concern (''AOC'') at the site: The Upstream Reach of Coal Run; the Downstream Reach of Coal Run; and the Residential/Park Area.

 For this proposed interim response, the Department considered five alternatives for the Upstream Reach of Coal Run:

 Alternative 1. No action with ongoing monitoring;

 Alternative 2. Vegetated Slope with Riprap at Stream Level/Existing Stream Alignment;

 Alternative 3. Vegetated Slope with Riprap at Stream Level/ Stream Re-Alignment;

 Alternative 4. Vegetated Slope with Gabions at Stream Level/Existing Stream Alignment;

 Alternative 5. Vegetated Slope with Gabions at Stream Level/ Stream Re-Alignment.

 For the Downstream Reach of Coal Run, the Department considered two alternatives:

 Alternative 1. No Action with ongoing monitoring;

 Alternative 2. Installation of Temporary Fencing

 For the Residential/Park Area, the Department considered three alternatives:

 Alternative 1. No Action;

 Alternative 2. Restrictions on Subsurface Activities and Groundwater Use;

 Alternative 3. Excavation and Off-Site Disposal of Contaminated Soils.

 Each alternative was evaluated with respect to four comparison criteria of: 1) Effectiveness; 2) Implementability; 3) Ability to meet state and federal requirements; and 4) Cost. Furthermore, this comparative analysis evaluated the relative performance of each alternative in relation to each specific comparison criterion. The comparative analysis identified advantages and disadvantages of each alternative, so that tradeoffs between the alternatives could be determined.

 As the prompt interim response at the site, the Department proposes to implement the following alternatives:

 1. Upstream Reach of Coal Run: Alternative 2. Vegetated Slope with Riprap at Stream Level/Existing Stream Alignment.

 2. Downstream Reach of Coal Run: Alternative 2. Installation of Temporary Fencing

 3. Residential/Park area at the site: Alternative 2. Restrictions on Subsurface Activities and Groundwater Use.

 The Department chose these alternatives because they each protect the public and environmental receptors from the risks associated with the hazardous substances at each AOC at the site in the most cost-effective manner.

 The proposed interim response is not a final remedial response pursuant to Section 504 of HSCA, and, therefore, is not required to meet the cleanup standards that apply to final remedial responses. However, the proposed alternatives are consistent with any potential future remedial actions and future investigation activities.

 This notice is being provided pursuant to Section 506(b) of HSCA. The administrative record, which contains the information that forms the basis and documents the selection of this response, is available for public review and comment. The administrative record is located at the Department's Northwest Regional Office, 230 Chestnut Street, Meadville, PA 16335, and is available for review Monday through Friday from 8:00 a.m. to 4:00 p.m. Please telephone beforehand for an appointment (telephone: 814-332-6648).

 The administrative record will be open for comment from December 15, 2012 until March 15, 2013. Persons may submit written comments into the record during this time only, by sending them to Mr. Chris Saber, Project Manager, at the Department's Northwest Regional Office or by delivering them to the office in person.

 In addition, persons may present oral comments, for inclusion in the administrative record, at a public hearing. The public hearing will be held at the Center Avenue School Auditorium, 102 Lincoln Ave., Butler, PA on January 15 beginning at 6:30 pm. Persons wishing to present comments must register with Mr. Saber at the Department's Northwest Regional Office by January 7, 2013, by telephone or in writing. Persons interested in finding out if anyone has registered should contact Mr. Saber. If no one registers to present oral comments by January 7, 2013, the public meeting will not be held.

LAND RECYCLING AND ENVIRONMENTAL REMEDIATION

UNDER ACT 2, 1995

The following plans and reports were submitted under the Land Recycling and Environmental Remediation Standards Act (35 P. S. §§ 6026.101—6026.907).

 Provisions of Sections 301—308 of the Land Recycling and Environmental Remediation Standards Act (act) (35 P. S. §§ 6026.301—6026.308) require the Department to publish in the Pennsylvania Bulletin a notice of submission of plans and reports. A final report is submitted to document cleanup of a release of a regulated substance at a site to one of the act's remediation standards. A final report provides a description of the site investigation to characterize the nature and extent of contaminants in environmental media, the basis for selecting the environmental media of concern, documentation supporting the selection of residential or nonresidential exposure factors, a description of the remediation performed and summaries of sampling analytical results which demonstrate that remediation has attained the cleanup standard selected. Submission of plans and reports, other than the final report, will also be published in the Pennsylvania Bulletin. These include the remedial investigation report, risk assessment report and cleanup plan for a site-specific standard remediation. A remedial investigation report includes conclusions from the site investigation; concentration of regulated substances in environmental media; benefits of reuse of the property; and, in some circumstances, a fate and transport analysis. If required, a risk assessment report describes potential adverse effects caused by the presence of regulated substances. If required, a cleanup plan evaluates the abilities of potential remedies to achieve remedy requirements.

The report is intended to document remediation of the site to meet a combination of the Site-Specific and Residential Statewide Health standards.

PBM, Inc., Facility, 1071 Sandy Hill Road, City of Irwin, (Penn Township), Westmoreland County. Civil & Environmental Consultants, Inc. 4000 Triangle Lane, Suite 200, Export PA 15632 on behalf of PBM Inc., 1070 Sandy Hill Road, Irwin, PA 15642 has submitted a Remedial Investigation Report and Final Report concerning the remediation of elevated concentrations of Barium, PAH's, and VOC's in groundwater and lead in subsurface soils. The site is currently used for valve manufacturing and will remain unchanged.

Dick Industrial Inc., Large Site, Jefferson Borough, Allegheny County. Penn E&R, 100 Ryan Court, Suite 100, Pittsburgh, PA 15205 on behalf of Dick Industrial Inc., 1900 State Route 51, Large, PA 15025 has submitted a Remedial Investigation Report, Risk Assessment Report and Final Report concerning the remediate of site soil and groundwater contaminated with solvents and petroleum products from prior operations at the site. The future use of the site will be non-residential light industrial, or commercial.

Pennsylvania Tectonics, Inc., 826 Main Street, Peckville, Pa 18452 on behalf of Staiman Recycling, Inc., 201 Hepburn Street, Williamsport, Pa 17703 has submitted a Final Report concerning remediation of site soil and surface water contaminated with diesel fuel, hydraulic oil and used motor oil. The Final Report intended to document remediation of the site to meet the Statewide Health Standard.

A remedial investigation report includes conclusions from the site investigation; concentration of regulated substances in environmental media; benefits of reuse of the property; and, in some circumstances, a fate and transport analysis. If required, a risk assessment report describes potential adverse effects caused by the presence of regulated substances. If required, a cleanup plan evaluates the abilities of potential remedies to achieve remedy requirements. A work plan for conducting a baseline remedial investigation is required by the act for compliance with selection of a special industrial area remediation. The baseline remedial investigation, based on the work plan, is compiled into the baseline environmental report to establish a reference point to show existing contamination, describe proposed remediation to be done and include a description of existing or potential public benefits of the use or reuse of the property. The Department may approve or disapprove plans and reports submitted. This notice provides the Department's decision and, if relevant, the basis for disapproval.

If information concerning a final report is required in an alternative form, contact the community relations coordinator at the appropriate regional office. Charles Artinian, 725 Street Road, Cochranville, PA 19330, submitted a Remedial Investigation Report for site soils and groundwater contaminated with gasoline. The Report was approved by the Department on November 29, 2012. The site is being remediated to meet the Site-Specific standard.

Northwest Region: Environmental Cleanup Program Manager, 230 Chestnut Street, Meadville, PA 16335-3481

Former McInnes Steel Facility, City of Corry, Erie County. Urban Engineers, Inc., 1319 Sassafras Street, Erie, PA 16501 on behalf of The Redevelopment Authority in the City of Corry, 1524 Enterprise Road, Corry, PA 16407 has submitted a Cleanup Plan concerning the remediation of site soil contaminated with Arsenic, Iron, and Manganese. The Cleanup Plan was approved by the Department on November 29, 2012.

Alice T. Sprankle No. 2, Perry Township, Jefferson County. Hull & Associates, Inc., 300 Business Center Drive, Suite 320, Pittsburgh, PA 15205 on behalf of XTO Energy—Appalachia Division, 395 Airport Road, Indiana, PA 15701 submitted a Final Report concerning the remediation of site soil contaminated with Hexane, Xylene (total), Benzene, Toluene, Ethylbenzene, 1,2,4-trimethylbenzene, 1,3,5-trimethylbenzene, Cyclohexane, Barium, Manganese, Selenium, Boron, and Zinc. The site was remediated within 90 days of the release. The Final Report demonstrated attainment of the Statewide Health Standard and was approved by the Department on November 30, 2012.

 The Chelsea Tank Farm is a major facility for volatile organic compounds (VOC) emissions with a potential to emit 47.5 tons per year (12 month rolling sum). The facility is a minor source for hazardous air pollutants (HAPs) with a potential to emit of 6.08 tons/year, also on a 12-month rolling basis. The Chelsea Tank Farm comprises eleven (11) storage tanks, pumping stations and pipelines. Minor sources at the facility include an office heater (0.145 MMBtu/hr boiler), an emergency generator (150 kW) and a groundwater and soil remediation system, with emissions controlled by carbon beds and a catalytic oxidizer.

 Regulations promulgated since the last time the Operating Permit was renewed, are included in this issuance. These regulations include the following Subparts from 40 CFR Part 63: Subpart BBBBBB, the National Emission Standards for Hazardous Air Pollutants (NESHAPs) for Gasoline Distribution Bulk Terminals, Bulk Plants and Pipeline Facilities; Subpart JJJJJJ, NESHAPs for Industrial, Commercial, and Institutional Boilers Area Sources; and Subpart ZZZZ, NESHAPs for Stationary Reciprocating Internal Combustion Engines. Upon final approval, the permit will be renewed for a period of five (5) years.

Units #2 and #3 are equipped with natural gas reburn (NGR) systems. In addition, the installation of Flue Gas Desulfurization (FGD) systems in 2009 has greatly reduced SO2 and PM10 emissions from all three units at the station. Supporting equipment at this facility includes coal, limestone and gypsum processing and handling equipment, emergency diesel engines, anhydrous ammonia storage tanks and space heaters.
