FEDERAL WATER POLLUTION CONTROL ACT SECTION 401

 The Department has taken the following actions on previously received permit applications, requests for Environmental Assessment approval and requests for Water Quality Certification under section 401 of the Federal Water Pollution Control Act (FWPCA) (33 U.S.C.A. § 1341).

 Except as otherwise noted, the Department has granted 401 Water Quality Certification certifying that the construction and operation described will comply with sections 301—303, 306 and 307 of the FWPCA (33 U.S.C.A. §§ 1311—1313, 1316 and 1317) and that the construction will not violate applicable Federal and State water quality standards.

 Persons aggrieved by an action may appeal that action to the Environmental Hearing Board (Board) under section 4 of the Environmental Hearing Board Act and 2 Pa.C.S. §§ 501—508 and 701—704. The appeal should be sent to the Environmental Hearing Board, Second Floor, Rachel Carson State Office Building, 400 Market Street, PO Box 8457, Harrisburg, PA 17105-8457, (717) 787-3483. TDD users may contact the Board through the Pennsylvania Relay Service, (800) 654-5984. Appeals must be filed with the Board within 30 days of publication of this notice in the Pennsylvania Bulletin unless the appropriate statute provides a different time period.  To perform the following water obstruction and Encroachment activities across/along Brock Creek associated with the construction of a residential development at the existing US Magnet site (Cold Springs):

 1. To construct and maintain a 95-foot long, 6-foot wide, and 8.5-foot high pedestrian bridge.

 2. To construct and maintain four outfall structures and one temporary road crossing.

 3. To stabilize and maintain approximately 30 linear feet of streambank.

 4. To place fill in the floodway associated with the removal of an existing stilling basin.

 The site is located near the intersection of Newtown Road and West Afton Avenue (Trenton West, NJ-PA USGS Quadrangle N: 21.5 inches; W: 13.4 inches).

 The issuance of this permit also constitutes approval of a Water Quality Certification under Section 401 of the Federal Water Pollution Control Act [33 U.S.C.A. 1341(a)].

E09-907. County Line Storage, Inc., 13131 -R Townsend Road, Philadelphia, PA 19154, Warminster Township, Bucks County, ACOE Philadelphia District.

 To construct and maintain the following water obstructions and encroachments associated with a proposed public storage facility:

 1. To relocate approximately 338 linear feet of an unnamed tributary of Southampton Creek (TSF-MF) around a proposed public storage facility by enclosing the stream within 325 linear feet of various pipe segments. The stream enclosure will consist of Headwall No. 6, 8, LF of 36" pipe, manhole No. 5, 44 LF of 36" pipe, manhole No. 4, 189 LF of 36" pipe, manhole No. 3, 63 LF of 36" pipe, manhole No. 2, 7 LF of 36" pipe, Endwall No. 1 and associated stilling basin.

 2. To place fill within approximately a 320 linear-foot reach of abandoned channel.

 3. To place fill within 0.10 acre of adjacent wetland (PFO).

 The permittee proposes to construct 0.18 acre of onsite wetland replacement to compensate for wetland losses associated with this project. The wetland replacement will enlarge an existing wetland area with minor grading and the diversion of water from the stream enclosure at manhole No. 3, routed through 78 LF of 15: pipe, to an outfall adjacent to the proposed wetland.

 The project is located along County Line Road approximately 700 feet southeast of the intersection of County Line Road and Centennial Roads (Hatboro, PA, USGS Quadrangle N: 9.1 inches, W: 10.9 inches).

 The issuance of this permit also constitutes approval of a Water Quality Certification under Section 401 of the Federal Water Pollution Control Act [33 U.S.C.A. 1341(a)].

E51-176. City of Philadelphia, Capital Program Office, 1515 Arch Street, 11th Floor, One Parkway Building, Philadelphia, Pa, 19102, City and County of Philadelphia, ACOE Philadelphia District.

 To perform the following activities associated with amendment of permit No E51-176 along a section of the Manayunk Canal (WWF) situated within the 100-year floodplain of the Schuylkill River:

 To remove sediment at three locations along the canal. The three sections are located at Domino Lane, the Parker Avenue outfall area, and the sluice house. Also, two 18-inch diameter valves will be installed in the existing steel sheet piling at the sluice gate to allow water flow to the canal.

 The site is located adjacent to the Schuylkill River starting at Lock Street (Germantown, PA, USGS Quadrangle N: 4.5 inches; W: 13.8 inches) and terminates west of Parker Avenue (Germantown, PA, USGS Quadrangle N: 5.7 inches; W: 15.3 inches).

 1. Placement of additional embankment material up to approximately 1 foot above existing grade along approximately 200 feet of the northwest reach of the levee

 3. Installation of sheet piling up to a height of approximately 3 feet above existing grade along approximately 750 feet of the south reach of the levee.

Plan Description: The approved plan provides for an expansion of the existing 0.41 MGD Sewage Treatment Plant (STP) in multiple phases. Hydraulic loading at the STP would increase to 0.89 MGD along with an upgrade to the Monroe Pump Station. The subsequent phase would increase hydraulic loading at the STP to 1.3 MGD. Further expansion of the STP will necessitate additional planning. The Department's review of the sewage facilities update revision has not identified any significant environmental impacts resulting from this proposal. Any required NPDES Permits or WQM Permits must be obtained in the name of the municipality or authority as appropriate.
