FEDERAL WATER POLLUTION CONTROL ACT, SECTION 401

 The following permit applications, requests for Environmental Assessment approval and requests for 401 Water Quality Certification have been received by the Department. Section 401 of the Federal Water Pollution Control Act (FWPCA) (33 U.S.C.A. § 1341) requires the Commonwealth to certify that the involved projects will not violate the sections 301—303, 306 and 307 of the FWPCA (33 U.S.C.A. §§ 1311—1313, 1316 and 1317) as well as relevant State requirements. Persons objecting to approval of a request for certification under section 401 of the FWPCA, the issuance of a Dam Permit or Water Obstruction and Encroachment Permit or the approval of an Environmental Assessment shall submit comments, suggestions or objections within 30 days of the date of this notice as well as any questions to the office noted before an application. Comments should contain the name, address and telephone number of the person commenting, identification of the certification request to which the comments or objections are addressed and a concise statement of comments, objections or suggestions including the relevant facts upon which they are based.

 The Department may conduct a fact-finding hearing or an informal conference in response to comments if deemed necessary. Each individual will be notified, in writing, of the time and place of a scheduled hearing or conference concerning the certification request to which the comment, objection or suggestion relates. Maps, drawings and other data pertinent to the certification request are available for inspection between 8 a.m. and 4 p.m. on working days at the office noted before the application.

 Persons with a disability who wish to attend the hearing and require an auxiliary aid, service or other accommodation to participate in the proceedings should contact the specified program. TDD users may contact the Department through the Pennsylvania AT&T Relay Service at (800) 654-5984.

 To perform the following water obstruction and encroachment activities associated with the replacement of the Rosemont Avenue Bridge over Darby Creek (Delaware County Bridge No. 73; SR 7023 Section 073):

 1. To replace the existing Rosemont Avenue Bridge over Darby Creek with a proposed Steel I-Beam bridge having a bridge span of 82 feet (length of the bridge) and regulatory length of approximately 38 feet 8.25 inches (width of roadway) and an underclearance of 12 feet 8 inches in the same footprint space.

 2. To conduct excavation and grading of the stream banks to facilitate the placement of the new bridge abutment and bridge decking connections.

 3. To place temporary cofferdams in the stream at relative locations to facilitate the existing abutment removal and the construction of the proposed abutment consistent with Erosion and Sedimentation control Requirements

 4. To place rip-rap in the stream at the abutment to facilitate the proposed sour prevention design.

 The site is a located approximately 182 feet northeast of the intersection of Bishop Avenue and Rosemount Avenue measuring from the Springfield Township side of the Darby Creek. The bridge site is actually located between Township of Springfield and Township of Upper Darby and serves as a separating boundary in Delaware County (Lansdowne, PA USGS Quadrangle N: 11.85 inches; W: 8.25 inch).

 To amend permit No. E54-347 to authorize the following water obstructions and encroachments associated with roadway improvements along SR 0061:

 1. To amend Impact # 1 to read: To remove the existing structure and to construct and maintain a 35-foot wide road crossing of Pine Creek (CWF, MF) consisting of a bulb tee beam reinforced concrete bridge having a normal span of 73 feet and an approximate underclearance of 5.2 feet.  2. To amend Impact # 2 to read: To remove the existing structure and to construct and maintain an 85-foot wide road crossing of Pine Creek (CWF, MF) consisting of a bulb tee beam reinforced concrete bridge having a normal span of 69 feet and an approximate underclearance of 10.1 feet.  3. To amend Impact # 9 to read: To remove the existing structure and to construct and maintain a stream enclosure of a tributary to Pine Creek (CWF,MF) consisting of a 182-foot long, 91-inch x 58-inch reinforced concrete elliptical pipe with an R-7 riprap apron.  The following activities were associated with roadway improvements along SR 0061 and were authorized by Permit No. E54-347.

 1. To remove the existing structure and to construct and maintain a 35-foot wide road crossing of Pine Creek (CWF, MF) consisting of a bulb tee beam reinforced concrete bridge having a normal span of 73 feet and an approximate underclearance of 6.5 feet. (Latitude: 40°37`56", Longitude: -76°3`42")

 2. To remove the existing structure and to construct and maintain an 85-foot wide road crossing of Pine Creek (CWF, MF) consisting of a bulb tee beam reinforced concrete bridge having a normal span of 69 feet and an approximate underclearance of 10.5 feet. (Latitude: 40°37`9", Longitude: -76°3`29")

 3. To construct and maintain a 52-foot wide road crossing of Pine Creek (CWF, MF) consisting of a steel girder bridge with a concrete deck having a normal span of 136 feet and an approximate underclearance of 7.0 feet. (Latitude: 40°37`12", Longitude: -76°3`26")

 4. To construct and maintain a roadway crossing of a tributary to Pine Creek (CWF, MF) consisting of a 90-foot long, 30-inch diameter concrete pipe depressed 6-inches with an R-4 riprap apron. (Latitude: 40°37`8", Longitude: -76°3`27")

 5. To remove the existing structure and to construct and maintain a road crossing of a tributary to Pine Creek (CWF, MF) consisting of an 80-foot long, 42-inch diameter reinforced concrete pipe with an R-7 riprap apron. (Latitude: 40°37`5", Longitude: -76°3`37")

 7. To relocate 190 feet of a tributary to Pine Creek (CWF, MF). The relocation consists of removing the existing structures and to construct and maintain a road crossing consisting of dual 70-foot long, 53-inch by 34-inch reinforced concrete elliptical pipes with an R-6 riprap apron that outlets into a new 161-foot long channel having a 14-foot bottom width and 2:1 side slopes, that will then outlet into Pine Creek. (Latitude: 40°37`8", Longitude: -76°3`26")

 8. To remove the existing 335-foot long stream enclosure and to construct and maintain a stream enclosure of a tributary to Pine Creek (CWF, MF) consisting of a 180-foot long dual 60-inch diameter reinforced concrete elliptical pipes with an R-7 riprap apron that outlets into a new 128-foot long channel having a 4 foot bottom width and 2:1 side slopes. (Latitude: 40°37`33", Longitude: -76°3`52")

 9. To remove the existing structure and to construct and maintain a stream enclosure of a tributary to Pine Creek (CWF,MF) consisting of a 182-foot long, 91-inch x 58-inch reinforced concrete elliptical pipe with an R-8 riprap apron. (Latitude: 40°37`54", Longitude: -76°3`52")

 10. To construct and maintain an extension of an existing 254-foot stream enclosure of a tributary to Pine Creek (CWF, MF). The extension will consist of 63 feet of 42-inch diameter reinforced concrete pipe with an R-7 riprap apron. (Latitude: 40°36`48", Longitude: -76°2`16")

 11. To remove the existing structure and to construct and maintain a stream enclosure of a tributary to Pine Creek (CWF, MF) consisting of 133 feet of 38-inch x 60-inch reinforced concrete elliptical pipe with an R-7 riprap apron. (Latitude: 40°37`57", Longitude: -76°3`56")

 12. To relocate 386 feet of a tributary to Pine Creek (CWF, MF). The relocation consists of removing the existing structure and to construct and maintain 170 feet of 30-inch diameter reinforced concrete pipe with an R-7 riprap apron that outlets into a 216-foot long channel having a 2-foot bottom width and 2:1 side slopes, which will then outlet back into Pine Creek. (Latitude: 40°38`7", Longitude: -76°4`7")

 13. To remove an existing 127-foot long stream enclosure and to construct and maintain a stream enclosure of a tributary to Pine Creek (CWF, MF) consisting of a 150 feet of 42-inch diameter concrete pipe with an R-7 riprap apron.

 14. To construct and maintain six stormwater outfalls in Pine Creek (CWF, MF) five of which consist of 18-inch diameter pipes with riprap aprons and one consisting of a channel outfall with turf reinforcing matting.

 15. To construct and maintain three stormwater outfalls in tributaries to Pine Creek (CWF, MF) one consisting of an 18-inch diameter pipe with a riprap apron and two consisting of channel outfalls.

 The overall improvements will impact 0.17 acre PEM wetlands, 0.02 acre PSS wetlands, and 0.09 acre PFO wetlands, and require 13 stream crossings, totaling 1,962 feet of permanent impacts and 655-feet of temporary impacts. The permittee is required to provide 267 feet of stream mitigation and 0.37 acre of replacement wetlands. The proposed project is located along a 3.5 mile section of SR 61 starting at the intersection of SR 2014 and ending 3.0 miles north of the intersection of SR 895 East (Auburn and Orwigsburg, PA Quadrangles Latitude: 40° 37` 39"; Longitude: -76° 03` 31") in West Brunswick Township and Deer Lake Borough, Schuylkill County.

E66-155. American Asphalt Company, 500 Chase Road, Shavertown, PA 18708, in Eaton Township, Wyoming County, U.S. Army Corps of Engineers, Baltimore District.

 To construct and maintain a road crossing consisting of a 20-foot wide bridge across Sugar Hollow Creek (HQ-CWF, MF) having a span of 45-feet and an underclearance of 5-feet. The project site is located on the north side of Sugar Hollow Road approximately 0.20 mile from the intersection of State Route 0029 (Tunkhannock, PA Quadrangle; Latitude: 41° 30` 24.9"; Longitude: -75° 59` 9.2") in Eaton Township, Wyoming County.

E58-298. R. Dennis Withers, 3982 East Brook Haven Drive N.E., Atlanta, GA 30319-2861, in Silver Lake Township, Susquehanna County, U.S. Army Corps of Engineers, Baltimore District.

 To fill a 0.8-acre open body of water for the purpose of constructing a liquid propane refurbishing facility. The project is located at 1255 Route 6 (Shohola, PA Quadrangle, Latitude: 41°23`34"; Longitude: -74°58`58").

 To: 1) install and maintain a 88.0-linear foot concrete box culvert with concrete wing walls in Black Valley Creek (WWF, MF), and 2) place 3,780.0 cubic feet of fill within the floodway of Black Valley Creek (WWF,MF), for the purpose of access to the slag site. E36-913: Greenleaf Estates Phase 2, 1509 Lampeter Road, Lancaster, Pennsylvania 17602, in West Lampeter Township, Lancaster County, ACOE Baltimore District

 To: 1) remove an existing 162.0-foot long, 12.0-inch diameter smooth-lined, corrugated plastic pipe stream enclosure, and 2) install and maintain a 164.0-foot long, 30.0-inch diameter smooth-lined, corrugated plastic pipe stream enclosure in an unnamed tributary to Big Spring Run (WWF), for the purposed of constructing a residential subdivision. The project is located near the intersection of Lampeter Road and Pioneer Road (Latitude: 39°59`53", Longitude: -76°14`27") in West Lampeter Township, Lancaster County.

 The applicant proposes to amend Permit No. E02-364:

 1. to construct and maintain an approximately 220` long extension of an existing retaining wall (this new, sloped retaining wall will be constructed using precast concrete blocks, and will vary in height, along its length, up to 25` high),

 2. to rehabilitate, reinforce and maintain the existing retaining wall, by installing precast concrete blocks in front of the existing wall, which will also vary in height, along its length, up to 25` high),

 3. to construct and maintain an approximately 320` extension of an existing access road, in front of the aforementioned, new, sloped, retaining wall, which will be supported by another, approximately 6.5` high, block wall,

 4. to rehabilitate, reinforce and maintain the retaining wall that supports the existing length of access road, by installing an approximately 6.5` high block wall, in front of this existing wall, and

 5. to place and maintain approximately 2000 cubic yards of cast-in-place concrete behind these walls and underneath the access road extension for the purpose of rehabilitating an existing retaining wall, strengthening an existing crane base, and to allow for the future unloading of barges at this facility, using mobile, hydraulic, material handlers.

 The current project is Phase I of a two (2) phase project. Phase II will address issues with shoreline protection and barge mooring; no loading and/or unloading of barges will take place until after any future, additional, required permits and authorizations have been obtained and Phase II has been completed. The project is located along approximately 500` of the Monongahela River, at the terminus of First Street, in West Elizabeth Borough, Allegheny County. (Glassport, PA Quadrangle N: 4.93 inches; W: 1.74 inches, Sub-basin 19C, Chapter 93 Type WWF, N; Latitude: 40° 16` 37.78"; Longitude: 79° 53` 14.94").

 The Applicant proposes to construct and maintain a 6 inch diameter C-900 PVC force main crossing of Trout Run and adjoining floodplain wetlands via directional drill at a point approximately 300 feet west of the West Street and West 2nd Street intersection.

E37-194, Sheetz, Inc., 5700 Sixth Avenue, Altoona, PA 16602. Sheetz Convenience Store, in Union Township, Lawrence County, ACOE Pittsburgh District (Edinburg, PA Quadrangle N: 41°, 0`, 51"; W: 80°, 23`, 48").

 To permanently fill 0.193 acre of wetlands (0.014 acre PEM, and 0.179 acre PEM/PSS) in the Shenango River watershed (WWF) for the construction of a Sheetz Convenience Store located northwest of the intersection of State Route 224 and Dworman Lane in New Castle, PA. The applicant proposes to mitigate for the wetland impacts by constructing approximately 0.22 acre of PEM/PSS replacement wetlands within the same watershed and on property owned by Union Towne Center in Union Township, Lawrence County (N: 41°, 1`, 9.39; W: 80°, 23`, 34.68"). Construction of a temporary stream crossing, including temporary impact to 50 LF of a tributary to the Shenango River, has been proposed to gain access to the wetland mitigation area.

 15) a temporary road crossing using a timber mat bridge and a 12 inch steel gas line impacting 38 linear feet of an unnamed tributary to Muncy Creek (EV) (Elk Grove, PA Quadrangle 41°22`03"N, 76°23`20"W);

 16) a temporary road crossing using timber mat bridge impacting 12 linear feet of an unnamed tributary to Muncy Creek (EV) (Elk Grove, PA Quadrangle 41°22`06"N, 76°23`13"W);

 17) a temporary road crossing using timber mat bridge and a 12 inch steel gas line impacting 83 linear feet of an unnamed tributary to Sullivan Branch (HQ-CWF) (Red Rock, PA Quadrangle 41°22`18"N, 76°21`35"W)

 The project will result in 3,123 square feet (0.07 acre) of temporary wetland impacts and 498 linear feet of temporary stream impacts will result from the installation of a 12 inch steel gas line and associated access roadways in Davidson Township, Sullivan County. The permittee will provide 9,636 square feet (0.22 acre) of compensatory mitigation at the Hershberger Mitigation Site (Washingtonville, PA Quadrangle 41°05`16"N, 76°42`43"W) in Limestone Township, Montour County.

E0829-071: PVR NEPA Gas Gathering, LLC, 101 West Third Street, Williamsport, PA 17701, Franklin, Monroe, Burlington and Towanda Township, Bradford County, ACOE Baltimore District.

 To construct, operate and maintain:

 1. a temporary timber mat bridge impacting 30 linear feet of an unnamed tributary to French Run (CWF, MF) (Powell, PA Quadrangle, Latitude: 41°42`58", Longitude: -76°31`36");

The approval for coverage under these General NPDES Permits is subject to applicable effluent limitations, monitoring, reporting requirements and other conditions in each General Permit. The approval of coverage for land application of sewage sludge or residential septage under applicable general permit is subject to pollutant limitations, pathogen and vector attraction reduction requirements, operational standards, general requirements, management practices and other conditions in the respective permit. The permits and related documents, effluent limitations, permitting requirements and other information are on file and may be inspected and arrangements made for copying at the contact office noted before the action.

 Persons aggrieved by an action may appeal that action to the Environmental Hearing Board (Board) under section 4 of the Environmental Hearing Board Act (35 P. S. § 7514) and 2 Pa.C.S. §§ 501—508 and 701—704 (relating to Administrative Agency Law). The appeal should be sent to the Environmental Hearing Board, Second Floor, Rachel Carson State Office Building, 400 Market Street, PO Box 8457, Harrisburg, PA 17105-8457, (717) 787-3483. TDD users may contact the Board through the Pennsylvania Relay Service, (800) 654-5984. Appeals must be filed with the Board within 30 days of publication of this notice in the Pennsylvania Bulletin unless the appropriate statute provides a different time period. The appeal form and the Board's rules of practice and procedure are also available in Braille or on audiotape from the Secretary to the Board at (717) 787-3483. This paragraph does not, in and of itself, create a right of appeal beyond that permitted by applicable statutes and decisional law.
