PUBLIC WATER SUPPLY PERMITS

 The Department has taken the following actions on applications received under the Pennsylvania Safe Drinking Water Act (35 P. S. §§ 721.1—721.17) for the construction, substantial modification or operation of a public water system.

 Persons aggrieved by an action may appeal that action to the Environmental Hearing Board (Board) under section 4 of the Environmental Hearing Board Act and 2 Pa.C.S. §§ 501—508 and 701—704. The appeal should be sent to the Environmental Hearing Board, Second Floor, Rachel Carson State Office Building, 400 Market Street, PO Box 8457, Harrisburg, PA 17105-8457, (717) 787-3483. TDD users may contact the Board through the Pennsylvania Relay Service, (800) 654-5984. Appeals must be filed with the Board within 30 days of publication of this notice in the Pennsylvania Bulletin unless the appropriate statute provides a different time period. Copies of the appeal form and the Board's rules of practice and procedure may be obtained from the Board. The appeal form and the Board's rules of practice and procedure are also available in Braille or on audiotape from the Secretary to the Board at (717) 787-3483. This paragraph does not, in and of itself, create a right of appeal beyond that permitted by applicable statutes and decisional law.

 For individuals who wish to challenge an action, the appeal must reach the Board within 30 days. A lawyer is not needed to file an appeal with the Board.

HAZARDOUS SITES CLEAN-UP
UNDER THE ACT OF
OCTOBER 18, 1988

Notice of Proposed Interim Response
Kwiatkowski Landfill Site
Hickory Township, Lawrence County

 The Pennsylvania Department of Environmental Protection (''Department''), under the authority of the Hazardous Sites Cleanup Act, 35 P. S. § 6020.101 et. seq. (''HSCA''), has determined that an interim response is necessary at the Kwiatkowski Landfill Site (''site''). The site is located approximately one mile east of the city of New Castle in Hickory Township, Lawrence County, Pennsylvania, on the north side of County Line Road.

 The site consists of an approximately 85-acre abandoned mixed waste landfill, currently owned by the estates of brothers, Rudolph and Chester Kwiatkowski. The site lies to the north of County Line Road. An industrial area is located at the main entrance to the site. The main disposal area is located 100 feet west of the industrial area. Part of the site has three waste disposal impoundments, located in the southwest corner of the site, immediately adjacent to County Line Road. The impoundments are accessed from County Line Road via an access road. Two of these areas (''sludge lagoon 1 & 2'') contain industrial sludge wastes. Each lagoon measures approximately 40 feet by 15 feet by 5 feet deep. A third area (''pottery waste impoundment'') previously contained pottery waste which has degraded over time. The pottery waste impoundment measures approximately 90 feet by 40 feet by 1 foot. Collectively, sludge lagoons 1 & 2 and the pottery waste impoundment are identified as Operable Unit 1. Operable Unit 1 is the subject of this response.

 In, 1985, 1987 and 1993 the United States Environmental Protection Agency (''USEPA'') conducted environmental investigations at the Site that included sampling the wastes and sediments in Operable Unit 1. In 1995, 1996 and 2004, the Department also investigated and sampled surface wastes and surface water at Operable Unit 1 the site.

 These investigations revealed elevated levels of chlorinated solvents, and aromatic compounds. Specifically, soils and sediments in Operable Unit 1 contained high concentrations trichloroethylene, xylene, 1,1,2,2-tetra- chloroethane, 1,1,2-trichloroethane, 1,2-dichloroethene, 1,2-dichloropropane, benzene, bromodichloromethane, carbon tetrachloride, chloroform, methyl chloride, tetra- chloroethene, toluene, vinyl chloride, 2,4-dinitro-phenol, bis(2-chloroethyl)ether, hexachlorobenzene, m-nitro- aniline, N-nitrosodi-N-propylamine, and pentachloro- phenol. Several heavy metals, including lead, arsenic were also detected over the Statewide Health Standards for Residential Direct Contact pursuant to the Pennsylvania Land Recycling and Environmental Remediation Standards Act (''Act 2'').

 These elements and chemical compounds are ''hazardous substances'' pursuant to Section 103 of the HSCA, 35 P. S. § 6020.103. The presence of these hazardous substances in Site surface water, sediment, and waste and soil constituted a ''release'' and ''threatened release'' of hazardous substances at the Site pursuant to Section 103 of the HSCA, 35 P. S. § 6020.103.

 The Department's two main objectives of the interim response action proposed for the site were: 1) to protect the public and environmental receptors from direct contact and inhalation risks with site-related hazardous substances, and 2) to eliminate the ongoing release and threat of release of hazardous substances into the environment from contaminated soil.

 The Department considered three alternatives for the interim response: 1) no action, 2) fencing Operable Unit 1, and 3) excavation and removal of wastes contained in Operable Unit 1 and associated contaminated soils for proper off-site disposal.

 In light of the above objectives, the Department evaluated each alternative to determine: (1) the extent to which each alternative protects the public health and the environment; (2) the extent to which each alternative is feasible, effective, implementable and permanent; (3) the relative cost of each alternative; and (4) the extent to which each alternative complies with or otherwise addresses the cleanup standards of Act 2, Pennsylvania Solid Waste Management Act, the Pennsylvania Clean Streams Law, and other Applicable or Relevant and Appropriate Requirements (''ARARs''); the extent to which each alternative was feasible, effective, implementable and permanent; and the relative cost effectiveness of each alternative.

 Pursuant to Section 505(b) of HSCA, 35 P. S. § 6020.505(b), the Department proposes Alternative 3 as the interim response at the site. Alternative 3 is proposed because it would, in the most cost effective manner, protect the public and environmental receptors from direct contact with site-related hazardous substances and eliminate the ongoing release and threat of release of hazardous substances into the environment.

 The response protects the public health and environment; complied with or otherwise addressed all ARARs relating contaminated soil removal and disposal, was feasible, implementable, permanent and effective to the maximum extent practicable; and was cost effective. The proposed action addressed the identified immediate threats to human health and the environment.

 The proposed interim response is not a final remedial response pursuant to Section 504 of HSCA, and, therefore, is not required to meet the cleanup standards that apply to final remedial responses. However, the proposed alternative is consistent with any potential future remedial actions and future investigation activities.

 This notice is being provided pursuant to Section 506(b) of HSCA. The administrative record, which contains the information that forms the basis and documents the selection of this response, is available for public review and comment. The following plans and reports were submitted under the Land Recycling and Environmental Remediation Standards Act (35 P. S. §§ 6026.101—6026.907).

 Provisions of Sections 301—308 of the Land Recycling and Environmental Remediation Standards Act (act) (35 P. S. §§ 6026.301—6026.308) require the Department to publish in the Pennsylvania Bulletin a notice of submission of plans and reports. A final report is submitted to document cleanup of a release of a regulated substance at a site to one of the act's remediation standards. A final report provides a description of the site investigation to characterize the nature and extent of contaminants in environmental media, the basis for selecting the environmental media of concern, documentation supporting the selection of residential or nonresidential exposure factors, a description of the remediation performed and summaries of sampling analytical results which demonstrate that remediation has attained the cleanup standard selected. Submission of plans and reports, other than the final report, will also be published in the Pennsylvania Bulletin. These include the remedial investigation report, risk assessment report and cleanup plan for a site-specific standard remediation. A remedial investigation report includes conclusions from the site investigation; concentration of regulated substances in environmental media; benefits of reuse of the property; and, in some circumstances, a fate and transport analysis. If required, a risk assessment report describes potential adverse effects caused by the presence of regulated substances. If required, a cleanup plan evaluates the abilities of potential remedies to achieve remedy requirements.

A work plan for conducting a baseline remedial investigation is required by the act for compliance with selection of a special industrial area remediation. The baseline remedial investigation, based on the work plan, is compiled into the baseline environmental report to establish a reference point to show existing contamination, describe proposed remediation to be done and include a description of existing or potential public benefits of the use or reuse of the property. The Department may approve or disapprove plans and reports submitted. This notice provides the Department's decision and, if relevant, the basis for disapproval.

Rutkowski 6H Wellsite, 3846 Glenwood Road, Lenox Township, Susquehanna County, Dawn Washo, Resource Environmental, has submitted a Final Report on behalf of her client, Andy Mehalko, Cabot Oil & Gas, 5 Penn Center West, Suite 401, Pittsburgh, PA 15276, concerning the remediation of soil resulting from virgin brine (superior liquid salt-bulk brine solution) release. The report documented attainment of the Background Standard for soil and was approved on June 25, 2013. The report was submitted within 90 days of the release.

Herbert, Rowland & Grubic, Inc., 1820 Linglestown Road, Harrisburg, PA 17110, on behalf of Landisville Railroad, LLC, 3901 Nolt Road, Landisville, PA 17538, and Amherst Industries, Inc., 3901 Nolt Road, Landisville, PA 17538, submitted a combined Remedial Investigation and Final Report concerning remediation of site soils and groundwater contaminated with VOCs, SVOCs and inorganics. Hershey 19 East Facility—The Hershey Company, 19 East Chocolate Avenue, Hershey, PA 17033, Derry Township, Dauphin County. Langan Engineering and Environmental Services, PO Box 1569, Doylestown, PA 18901, on behalf of Chocolate Realty DST, 10 Tara Boulevard, Suite 103, Nashua, NH 03062 and The Hershey Company, 100 Crystal A Drive, Hershey, PA 17033, submitted a Remedial Investigation Report concerning remediation of site soils and groundwater contaminated with VOCs, SVOCs, pesticides and inorganics. The Report was disapproved by the Department on June 18, 2013. The site is being remediated to a combination of the Residential Statewide Health and Site Specific standards.

Norfolk Southern / Rutherford Intermodal Transfer Facility, 5050 Paxton Street, Harrisburg, PA 17111, Swatara Township, Dauphin County. Liberty Environmental, Inc., 50 North 5th Street, 5th Floor, Reading, PA 19601, on behalf of Greater Berks Development Fund, PO Box 8621, Reading, PA 19603-8621, submitted a Baseline Remedial Investigation Work Plan concerning the remediation of site soils and groundwater contaminated with VOCs, SVOCs, and metals. The site is being remediated as a Special Industrial Area. The Work Plan was approved by the Department on June 21, 2013.

Former Exxon Mobil Oil Corporation—Mt. Union Terminal #37-058, 15534 Croghan Pike, Mt. Union, PA 17260, Shirley Township, Huntingdon County. Groundwater & Environmental Services, Inc., 301 Commerce Park Drive, Cranberry Township, PA 16066, on behalf of ExxonMobil Environmental Services, 38 Varick Street, Brooklyn, NY 11222, submitted a combined Remedial Investigation Report and Final Report concerning remediation of site soils and groundwater contaminated with leaded and unleaded gasoline. The modification is in accordance with 25 Pa. Code § 127.463. The permit expires April 30, 2017. NRG Power New Castle Power Plant is a major facility and is subject to the Title V Operating Permit requirements adopted in 25 Pa. Code Chapter 127, Subchapters F and G. The facility is subject to multiple State and Federal Regulations. The modification involves the incorporation of the requirements of 40 CFR 63 Subpart DDDDD—National Emission Standards for Hazardous Air Pollutants (NESHAPs) for Major Sources: Industrial, Commercial, and Institutional Boilers and Process Heaters. These requirements became effective April 1, 2013. The Department is required to revise the permit because the expiration date of the current permit is more than 3 years from the effective date of Subpart DDDDD. The facility has an auxiliary boiler used for building heat and freeze protection. Source 030 is a Clayton Industries boiler (model EO-204-1) rated at 8.2 mmbtu/hr. The boiler is fueled with #2 oil. This boiler is subject to the tune-up and energy assessment work practice standards of Subpart DDDDD.

 Minor changes were also made to the permit to reflect the amended language of 40 CFR 63 Subpart ZZZZ—NESHAPs for Stationary Reciprocating Internal Combustion Engines. The four existing emergency generators are subject to 40 CFR part 63 Subpart ZZZZ. All applicable requirements of Subpart ZZZZ have been included in the permit during this renewal. The facility has changed Hexavalent Chrome to Trivalent Chrome in the plating operation. All revised 40 CFR Part 63, Subpart N requirements have been included in the source level. The emissions of pollutants from the facility are less than Title V threshold limits. Thus, the facility is a natural minor.
