Actions on applications under the Surface Mining Conservation and Reclamation Act (52 P. S. §§ 1396.1—1396.19a); the Noncoal Surface Mining Conservation and Reclamation Act (52 P. S. §§ 3301—3326); The Clean Streams Law; the Coal Refuse Disposal Control Act (52 P. S. §§ 30.51—30.66); and The Bituminous Mine Subsidence and Land Conservation Act (52 P. S. §§ 1406.1—1406.20a). FEDERAL WATER POLLUTION CONTROL ACT SECTION 401

 The Department has taken the following actions on previously received permit applications, requests for Environmental Assessment approval and requests for Water Quality Certification under section 401 of the Federal Water Pollution Control Act (FWPCA) (33 U.S.C.A. § 1341).

 Except as otherwise noted, the Department has granted 401 Water Quality Certification certifying that the construction and operation described will comply with sections 301—303, 306 and 307 of the FWPCA (33 U.S.C.A. §§ 1311—1313, 1316 and 1317) and that the construction will not violate applicable Federal and State water quality standards.

 Persons aggrieved by an action may appeal that action to the Environmental Hearing Board (Board) under section 4 of the Environmental Hearing Board Act and 2 Pa.C.S. §§ 501—508 and 701—704. The appeal should be sent to the Environmental Hearing Board, Second Floor, Rachel Carson State Office Building, 400 Market Street, PO Box 8457, Harrisburg, PA 17105-8457, (717) 787-3483.  To realign and expand the intersection of Zeager Road and North Market Street, permanently impacting 0.051 acre of palustrine emergent wetlands, 79.0 lineal feet of unnamed tributary to Conewago Creek (TSF), and temporarily impacting 0.018 acre of palustrine emergent wetlands (Latitude 40°09`41.1", Longitude -76°38`19.5") for the purpose of improving safety at the intersection. To compensate for wetland impacts, the permittee proposes to create 0.054 acre of palustrine emergent wetlands onsite.

 Persons aggrieved by an action may appeal that action to the Environmental Hearing Board (Board) under section 4 of the Environmental Hearing Board Act (35 P. S. § 7514) and 2 Pa.C.S. §§ 501—508 and 701—704 (relating to Administrative Agency Law). The appeal should be send to the Environmental Hearing Board, Second Floor, Rachel Carson State Office Building, 400 Market Street, PO Box 8457, Harrisburg, PA 17105-8457, (717) 787-3483. Appeals must be filed which the Board within 30 days of publication of this notice in the Pennsylvania Bulletin unless the appropriate statute provides a different time period. Water Quality Certification under Section 401 of the Federal Clean Water Act for the Texas Eastern Appalachian to Market 2014 Project

 On February 24, 2013, Texas Eastern filed an application with the Federal Energy Regulatory Commission (FERC) in Docket No. CP13-84-000 under Section 7(b) and (c) of the Natural Gas Act (NGA) seeking a Certificate of Public Convenience and Necessity (Certificate) authorizing abandonment, construction, and operation of the Texas Eastern Appalachia to Market 2014 Project (the TEAM 2014 Project or Project) located in Pennsylvania and other states. The proposed facilities would consist of approximately 33.6 miles of 36-inch-diameter natural gas pipeline comprising seven separate pipeline loops and associated facilities and horsepower (hp) upgrades at four existing compressor stations in Pennsylvania. Additional piping modifications and maintenance would occur at sites within Pennsylvania to accommodate bi-directional flow.

 The four existing compressor station upgrades proposed in Pennsylvania are as follows: the Uniontown Compressor Station in Fayette County; the Delmont Compressor Station in Westmoreland County; the Armagh Compressor Station in Indiana County; and the Entriken Compressor Station in Huntingdon County.

 The pipeline facilities are loops that are collocated with existing natural gas pipelines except for 0.2 mile along the Perulack East Loop. This segment of the Perulack East Loop has been sited away from the existing right-of-way due to a combination of steep vertical and horizontal slope areas. The proposed Project's pipeline facilities in Pennsylvania new loops of 36-inch diameter piping as follows: Holbrook Loop, 6.7 miles, Fayette County; Perulack West Loop, 2.7 miles, Perry County; Perulack East Loop, 5.4 miles, Perry County; Shermans Dale Loop, 7.1 miles, Dauphin County; Grantville West Loop, 2.3 miles, Lebanon County; Grantville East Loop 3.8 miles, Lebanon County; and the Bernville Loop, 5.6 miles, Berks County. The project also includes various aboveground facilities, including pig launchers, pig receivers, and valves, that would be constructed to support the pipeline system expansion in Pennsylvania at these new loops.

 The Department, by this notice, proposes to certify that the construction, operation and maintenance of the Project complies with the applicable provisions of sections 301—303, 306 and 307 of the Federal Clean Water Act (33 U.S.C.A. §§ 1311—1313, 1316 and 1317). The Department further proposes to certify that the construction, operation and maintenance of the projects complies with Commonwealth water quality standards and that the construction, operation and maintenance of the projects does not violate applicable Commonwealth water quality standards provided that the construction, operation and maintenance of the projects complies with the conditions proposed for this certification, including the criteria and conditions of the following permits:

 1. Discharge Permit—Texas Eastern shall obtain and comply with a PADEP National Pollutant Discharge Elimination System (NPDES) permit for the discharge of water from the hydrostatic testing of the pipeline pursuant to Pennsylvania's Clean Streams Law (35 P. S. §§ 691.1—691.1001) and all applicable implementing regulations (25 Pa. Code Chapter 92a).

 2. Erosion and Sediment Control Permit—Texas Eastern shall obtain and comply with PADEP's Chapter 102 Erosion and Sediment Control General Permit for Earth Disturbance Associated with Oil and Gas Exploration, Production, Processing or Treatment issued pursuant to Pennsylvania's Clean Streams Law and Storm Water Management Act (32 P. S. §§ 680.1—680.17) and all applicable implementing regulations (25 Pa. Code Chapter 102).

 3. Water Obstruction and Encroachment Permits—Texas Eastern shall obtain and comply with a PADEP Chapter 105 Water Obstruction and Encroachment Permits for the construction, operation and maintenance of all water obstructions and encroachments associated with the project pursuant to Pennsylvania's Clean Streams Law, Dam Safety and Encroachments Act (32 P. S. §§ 673.1—693.27), and Flood Plain Management Act (32 P. S. §§ 679.101—679.601.) and all applicable implementing regulations (25 Pa. Code Chapter 105).

 4. Water Quality Monitoring—PADEP retains the right to specify additional studies or monitoring to ensure that the receiving water quality is not adversely impacted by any operational and construction process that may be employed by Texas Eastern.

 5. Operation—For each Project under this certification, Texas Eastern shall at all times properly operate and maintain all Project facilities and systems of treatment and control (and related appurtenances) which are installed to achieve compliance with the terms and conditions of this Certification and all required permits. Proper operation and maintenance includes adequate laboratory controls, appropriate quality assurance procedures, and the operation of backup or auxiliary facilities or similar systems installed by Texas Eastern.

 6. Inspection—The Projects, including all relevant records, are subject to inspection at reasonable hours and intervals by an authorized representative of PADEP to determine compliance with this Certification, including all required permits required, and Pennsylvania's Water Quality Standards. A copy of this Certification shall be available for inspection by the PADEP during such inspections of the Projects.

 7. Transfer of Projects—If Texas Eastern intends to transfer any legal or equitable interest in the Projects which is affected by this Certification, Texas Eastern shall serve a copy of this Certification upon the prospective transferee of the legal and equitable interest at least thirty (30) days prior to the contemplated transfer and shall simultaneously inform the PADEP Regional Office of such intent. Notice to PADEP shall include a transfer agreement signed by the existing and new owner containing a specific date for transfer of Certification responsibility, coverage, and liability between them.

 8. Correspondence—All correspondence with and submittals to PADEP concerning this Certification shall be addressed to the Department of Environmental Protection, South-central Regional Office, Scott Williamson, Waterways and Wetlands Program Manager, 909 Elmerton Avenue, Harrisburg, PA 17110-8200.

 9. Reservation of Rights—PADEP may suspend or revoke this Certification if it determines that Texas Eastern has not complied with the terms and conditions of this Certification. PADEP may require additional measures to achieve compliance with applicable law, subject to Texas Eastern's applicable procedural and substantive rights.

 10. Other Laws—Nothing in this Certification shall be construed to preclude the institution of any legal action or relieve Texas Eastern from any responsibilities, liabilities, or penalties established pursuant to any applicable federal or state law or regulation.

 11. Severability—The provisions of this Certification are severable and should any provision of this Certification be declared invalid or unenforceable, the remainder of the Certification shall not be affected thereby.

 The Environmental Assessment prepared by FERC may be viewed on FERC's website at www.ferc.gov under the Docket No. CP13-84-000.

 Prior to final action on the proposed section 401 Water Quality Certification, consideration will be given to any comments, suggestions or objections which are submitted in writing within 30 days of this notice. Comments concerning the proposed 401 Water Quality Certification should be directed to Mr. Scott Williamson, South-central Region Waterways and Wetlands Program Manager at the above address or through the Pennsylvania AT&T Relay Service at (800) 654-5984 (TDD). Comments must be submitted in writing and contain the name, address and telephone number of the person commenting and a concise statement of comments, objections or suggestions on this proposal. No comments submitted by facsimile will be accepted. The Department will consider all relevant and timely comments received. Comments must be submitted within 30 days of this notice.

The Clean Streams Law; Proposed Consent Decree with Waste Treatment Corporation

 The Department of Environmental Protection (Department), intends to enter into a proposed Consent Decree with Waste Treatment Corporation (Waste Treatment) in accordance with the Pennsylvania Clean Streams Law. Waste Treatment owns and operates a wastewater treatment plant located at 341 West Harmar Street, Warren, Pennsylvania 16365, which discharges oil and gas and other wastewaters to the Allegheny River.

 Biological surveys of the Allegheny River conducted by the Department in 2012 indicate that the discharges from Waste Treatment's plant are adversely impacting the River's water quality and biological community. The proposed Consent Decree identifies the corrective actions that Waste Treatment must take to resolve these adverse impacts.

 The proposed Consent Decree requires Waste Treatment to, among other things: apply to the Department for the permit to install the additional treatment necessary for the wastewater discharges to meet or exceed the effluent limits identified in the Consent Decree, including the effluent limit of 500 mg/l for Total Dissolved Solids and 250 mg/l for Chlorides; verify, through biological surveys, that this additional treatment is successful in restoring the water quality and biological community of the Allegheny River; and install the additional treatment and complete all other requirements of the proposed Consent Decree by January 1, 2016.

 The public comment period for this proposed Consent Decree extends for 30 days from the date of publication of this notice in the Pennsylvania Bulletin. A press release has been submitted to local news organizations announcing the proposed Consent Decree and the 30-day public comment period.

Persons may submit written comments on the proposed Consent Decree within the 30 day comment period to the Department at the same address.

 After the close of the 30-day public comment period, the Department will file responses to the comments that it received during the public comment period. If applicable based on the comments received, the Department and Waste Treatment will then file a Joint Motion requesting that the Pennsylvania Commonwealth Court approve the entry of the Consent Decree. The Consent Decree will be final upon the Commonwealth Court's approval and entry of the Decree.
