Actions on applications under the Surface Mining Conservation and Reclamation Act (52 P. S. §§ 1396.1—1396.19a); the Noncoal Surface Mining Conservation and Reclamation Act (52 P. S. §§ 3301—3326); The Clean Streams Law; the Coal Refuse Disposal Control Act (52 P. S. §§ 30.51—30.66); and The Bituminous Mine Subsidence and Land Conservation Act (52 P. S. §§ 1406.1—1406.20a). FEDERAL WATER POLLUTION CONTROL ACT SECTION 401

 The Department has taken the following actions on previously received permit applications, requests for Environmental Assessment approval and requests for Water Quality Certification under section 401 of the Federal Water Pollution Control Act (FWPCA) (33 U.S.C.A. § 1341).

 Except as otherwise noted, the Department has granted 401 Water Quality Certification certifying that the construction and operation described will comply with sections 301—303, 306 and 307 of the FWPCA (33 U.S.C.A. §§ 1311—1313, 1316 and 1317) and that the construction will not violate applicable Federal and State water quality standards.

 Persons aggrieved by an action may appeal that action to the Environmental Hearing Board (Board) under section 4 of the Environmental Hearing Board Act and 2 Pa.C.S. §§ 501—508 and 701—704. The appeal should be sent to the Environmental Hearing Board, Second Floor, Rachel Carson State Office Building, 400 Market Street, PO Box 8457, Harrisburg, PA 17105-8457, (717) 787-3483. TDD users may contact the Board through the Pennsylvania Relay Service, (800) 654-5984. Appeals must be filed with the Board within 30 days of publication of this notice in the Pennsylvania Bulletin unless the appropriate statute provides a different time period. Copies of the appeal form and the Board's rules of practice and procedure may be obtained from the Board. The appeal form and the Board's rules of practice and procedure are also available in Braille or on audiotape from the Secretary to the Board at (717) 787-3483. E09-973. Pennsylvania Turnpike Commission, Bensalem, Bristol, Middletown Townships, Bucks County, ACOE Philadelphia District. This is a modification of the previously published permit.

 To perform the below listed water obstruction and encroachments associated with Pennsylvania Turnpike Phase III widening and improvement construction activities in Section D10 (Milepost 355.9 to Milepost 357.6). The activities include the widening and reconstruction of approximately 1.7 miles of eastbound Pennsylvania Turnpike (I-276) to a four-lane roadway between the I-95 overpass and the I-276 Bridge over SR 0013. It also includes the widening and reconstruction of approximately 0.9 mile of westbound I-276 to a four-lane roadway between the I-95 overpass and 1300' east of the I-276 Bridge over New Rodgers Road (SR 0413). Specific water obstruction and encroachments are:

 1. To fill and relocate the intermittent stream within the proposed construction limits that drains to an unnamed tributary to Mill Creek between stations 141+80 and 142+83 (Langhorne, PA Quadrangle N: 0.75 inch W: 1.75 inches; Latitude: 40° 7` 43.4", Longitude: 74° 53` 14.9"). Permanent impact of 105 linear feet of intermittent stream channel. The existing channel will be filled and relocated into a new channel of the same length (S30-R4-1).

 2. To place fill for the construction of the roadway widening of I-276 in the emergent wetland that drains to an unnamed tributary to Mill Creek between stations 142+83 and 144+79 (Langhorne, PA Quadrangle N: 0.7 inch W: 1.7 inches; Latitude 40° 7` 43.1", Longitude: 74° 53` 12.5"). Permanent impact of 0.037 acre of emergent wetland (E30).

 3. To fill and relocate the intermittent stream within the proposed construction limits that drains to an unnamed tributary to Mill Creek between stations 144+79 and 151+35 (Langhorne, PA Quadrangle N: 0.65 inch W: 1.5 inches; Latitude: 40° 7` 42.3", Longitude: 74° 53` 7.0"). Permanent impact of 658 linear feet of intermittent stream channel. The existing channel will be filled and relocated into a new channel 806 feet in length (S30-R4-2).

 4. To fill and relocate existing culvert for the intermittent stream within the proposed construction limits that drains to an unnamed tributary to Mill Creek between stations 151+35 and 152+64 (Langhorne, PA Quadrangle N: 0.6 inch W: 1.25 inches; Latitude: 40° 7` 41.1", Longitude: 74° 52` 58.8"). Permanent impact of 129 linear feet of intermittent stream channel. The existing culvert will be removed and the intermittent stream will be relocated into a new culvert of the same length (S30-R4-3).

 5. To fill and relocate the intermittent stream within the proposed construction limits that drains to an unnamed tributary to Mill Creek between stations 152+64 and 302+30 (Langhorne, PA Quadrangle N: 0.6 inch W: 1.2 inches; Latitude: 40° 7` 41.1", Longitude: 74° 52` 58.8"). Permanent impact of 352 linear feet of intermittent stream channel. The existing channel will be filled and relocated into a new channel 327 feet in length. There will be a loss of 25 feet of intermittent stream channel (S30-R4-4).

 6. To fill and relocate existing culvert for the intermittent stream within the proposed construction limits that drains to an unnamed tributary to Mill Creek between stations 302+30 and 304+68 (Langhorne, PA Quadrangle N: 0.5 inch W: 1.0 inches; Latitude: 40° 7` 41.1" Longitude: 74°52` 58.8"). Permanent impact of 79 linear feet of intermittent stream channel. The existing culvert will be removed and the intermittent stream will be relocated into a new culvert of the same length (S30-R4-5).

 7. To fill and relocate the intermittent stream within the proposed construction limits that drains to Mill Creek between stations 304+68 and 311+50 (Langhorne, PA Quadrangle N: 0.55 inch W: 0.8 inch; Latitude: 40° 7` 40.1", Longitude: 74° 52` 51.8"). Permanent impact of 697 linear feet of intermittent stream channel. The existing channel will be filled and relocated into a new channel 602 feet in length. There will be a loss of 95 feet of intermittent stream channel (S30-R4-6).

 8. To place fill for the construction of the roadway widening of I-276 in the scrub-shrub wetland that drains to Mill Creek between stations 678+77 and 679+44 (Langhorne, PA Quadrangle N: 0.7 inch W: 0.75 inches; Latitude: 40° 7` 40.7", Longitude: 74° 52` 47.9"). Permanent impact of 0.006 acre of scrub-shrub wetland (S20C).

 9. To fill and relocate/re-align the perennial stream within the proposed construction limits that drain to Mill Creek between stations 311+31 and 312+73 (Langhorne, PA Quadrangle N: 0.6 inch W: 0.6 inch; Latitude: 40° 7` 40.2", Longitude: 74° 52` 47.1"). Permanent impact of 580 linear feet and temporary impact or 25 linear feet of perennial stream channel. The existing channel will be partially filled and relocated/re-aligned into a new channel 580 feet in length (S20A-R2).

 10. To place fill for the construction of the roadway widening of I-276 in the scrub-shrub wetland that drains to Mill Creek between stations 213+09 and 213+34 (Langhorne, PA Quadrangle N: 0.4 inch W: 0.55 inch; Latitude: 40° 7` 36.7", Longitude: 74° 52` 44.9"). Permanent impact of 0.004 acre and a temporary impact of 0.008 acre of scrub-shrub wetland (E29B).

 11. To place fill for the construction of the roadway widening of I-276 in the emergent/forested/scrub-shrub wetland that drains to an unnamed tributary to Mill Creek between stations 219+37 and 226+67 (Langhorne, PA Quadrangle N: 0.4 inch W: 0.1 inch; Latitude: 40°7` 35.0", Longitude: 74°52` 31.4") Permanent impact of 0.163 acre and temporary impact of 0.116 acre of emergent/forested/scrub-shrub wetlands (E29).

 12. To fill and relocate into a culvert and new channel the perennial stream within the proposed construction limits that drains to Mill Creek between stations 489-01 and 489-82. Permanent impact of 141 linear feet of perennial stream channel; 52 linear feet (south side of turnpike) and 89 linear feet (north side of turnpike) of permanent impacts. (Langhorne, PA Quadrangle N: 0.45 inch W: 0.1 inch EB-Latitude: 40°7` 35.1" Longitude: 74°52` 32.5" WB-Latitude: 40° 07` 37.03" Longitude: 74° 52` 32.63"). The existing channel will be placed into two culvert extensions, one north of and one south of the turnpike for a permanent impact of 73 linear feet of new culvert and 48 linear feet of new relocated perennial stream channel. There will be a loss of 20 linear feet of perennial stream channel (E29A-R2).

 13. To place fill for the construction of the roadway widening of I-276 in the forested wetland that drains to Mill Creek between stations 692+56 and 696+71 (Trenton West, NJ-PA Quadrangle N: 0.25 inch W: 17.25 inches; Latitude: 40° 7` 36.9" Longitude: 74° 52` 26.5") Permanent impact of 0.217 acre and a temporary impact of 0.083 acre of forested wetlands (E24).

 14. To place fill for the construction of the roadway widening of I-276 in the forested wetland that drains to an unnamed tributary to Mill Creek between stations 233+37 and 236+19. (Trenton West, NJ-PA Quadrangle N: 0.1 inch W: 17.1 inches; Latitude: 40° 7` 33.1" Longitude: 74° 52` 17.6") Permanent impact of 0.010 acre and a temporary impact of 0.034 acre to forested wetlands (E28).

 15. To fill and relocate the intermittent stream within the proposed construction limits that drains to an unnamed tributary to Mill Creek between stations 213+30 and 215+25 (Langhorne, PA Quadrangle N: 0.1 inch W: 0.50 inch; Latitude: 40° 07` 33.9" Longitude: 74° 52` 46.10"). Permanent impact of 238 linear feet of intermittent stream channel. The existing channel will be filled and relocated into a new channel of the same length (E29C-R4).

 16. To fill and extend a culvert located on the intermittent stream within the proposed construction limits that drains to an unnamed tributary to Mill Creek at station 237+09. (Trenton West, NJ-PA Quadrangle N: 0.1 inch W: 16.8 inches Latitude: 40° 7` 33.1" Longitude: 74° 52` 17.6"). Permanent impact of 24 linear feet of intermittent stream channel. The existing channel will be filled and placed into a culverted extension of an existing culverted section of intermittent stream channel (E28A-R4).

 17. To fill, culvert and relocate the intermittent stream within the proposed construction limits that drains to an unnamed tributary to Mill Creek between stations 514+21 and 514+80 (Trenton West, NJ-PA Quadrangle N: 0.1 inch W: 16.4 inches; Latitude: 40° 7` 31.2" Longitude: 74° 52` 3.6"). Permanent impact of 232 linear feet of intermittent stream channel. The existing channel will be filled and relocated into a new channel 168 feet in length and 64 feet of culvert (S27-R4).

 18. To fill, culvert and relocate the intermittent stream within the proposed construction limits that drains to an unnamed tributary to Mill Creek between stations 513+00 and 513+01 (Trenton West, NJ-PA Quadrangle N: 0.1 inch W: 16.4 inches; Latitude: 40° 7` 31.2" Longitude: 74° 52` 3.6"). Temporary impact of 13 linear feet of intermittent stream channel. The existing channel will be filled and relocated into a new channel 13 feet in length (E20-R4).

 19. To place fill for the construction of the roadway widening of I-276 in the emergent wetland that drains to an unnamed tributary to Mill Creek between stations 513+12 and 513+24 (Trenton West, NJ-PA Quadrangle N: 0.2 inch W: 16.4 inches; Latitude: 40° 7` 31.2" Longitude: 74° 52` 3.6"). Permanent impact of 0.006 acre and a temporary impact of 0.008 acre of emergent wetlands (E27).

 20. To fill and relocate the intermittent stream within the proposed construction limits that drains to an unnamed tributary to Mill Creek between stations 536+04 to 541+10 (Bristol, PA-NJ Quadrangle N: 22.5 inches W: 15.5 inches; Latitude: 40° 7` 28.8" Longitude: 74° 51` 39.9"). Permanent impact of 390 linear feet of intermittent stream channel. The existing channel will be filled and relocated into a new channel 137 feet in length. There will be a loss of 253 feet of intermittent stream channel (E15A-R4).

 21. To place fill for the construction of the roadway widening of I-276 in the forested wetland that drains to an unnamed tributary to Mill Creek between stations 537+45 and 540+82 (Bristol, PA Quadrangle N: 22.5 inches West: 15.5 inches; Latitude: 40° 07` 27.41" Longitude: 74° 51` 34.53"). Permanent impact of 0.122 acre and temporary impact of 0.129 acre of forested wetlands (E15).
