FEDERAL WATER POLLUTION CONTROL ACT, SECTION 401

 The following permit applications, requests for Environmental Assessment approval and requests for 401 Water Quality Certification have been received by the Department. Section 401 of the Federal Water Pollution Control Act (FWPCA) (33 U.S.C.A. § 1341) requires the Commonwealth to certify that the involved projects will not violate the sections 301—303, 306 and 307 of the FWPCA (33 U.S.C.A. §§ 1311—1313, 1316 and 1317) as well as relevant State requirements. Persons objecting to approval of a request for certification under section 401 of the FWPCA, the issuance of a Dam Permit or Water Obstruction and Encroachment Permit or the approval of an Environmental Assessment shall submit comments, suggestions or objections within 30 days of the date of this notice as well as any questions to the office noted before an application. Comments should contain the name, address and telephone number of the person commenting, identification of the certification request to which the comments or objections are addressed and a concise statement of comments, objections or suggestions including the relevant facts upon which they are based.

 The Department may conduct a fact-finding hearing or an informal conference in response to comments if deemed necessary. Each individual will be notified, in writing, of the time and place of a scheduled hearing or conference concerning the certification request to which the comment, objection or suggestion relates. Maps, drawings and other data pertinent to the certification request are available for inspection between 8 a.m. and 4 p.m. on working days at the office noted before the application.

 To remove an existing structure and to 1.) place and maintain fill in 0.33 acre of palustrine emergent wetlands; 2.) construct and maintain a storm water detention facility, permanently impacting 0.03 acre of palustrine emergent wetlands; 3.) place and maintain fill in 847.0 feet of an unnamed tributary to Vessle Run (WWF, MF); 4.) install and maintain an 8.0-inch diameter ductile iron water main under Vessle Run (WWF, MF); 5.) install and maintain a 36.0-inch concrete outfall with rip rap apron in palustrine emergent wetlands, permanently impacting 0.01 acre of wetlands; 6.) install and maintain an 8.0-inch diameter PVC sanitary sewer line with manhole in palustrine emergent wetlands, temporally impacting 0.08 acre of wetlands, and permanently impacting 0.01 acre of wetlands, all for the purpose of constructing an aircraft maintenance instructional building. The project is located immediately east of the intersection of Range Road and Utility Road (Latitude: 40° 26` 11.2"N; Longitude: 76° 34` 30.6"W) in East Hanover Township, Lebanon County. To compensate for the wetland impacts, the applicant proposes to create 0.90 acre of replacement wetlands onsite.

SR 3001 Section A02 Bridge Removal and Roadway Relocation near Wharton, Potter County, ACOE Baltimore District (Wharton, PA Quadrangle; Latitude: 41°31`50"; Longitude -78°01`14").

 PA DOT Engineering District 2-0 proposes to remove the existing single span steel I-beam Bridge on SR 3001 and relocate the roadway along the hillside to improve the intersection with SR 0872. The roadway relocation will result in a hillside cut along the East Fork of Sinnemahoning Creek that will require an NPDES Permit. In addition, the project will require 45 Ft. of gravel bar removal, 40 Ft. of stream bank stabilization and 165 Ft. of channel relocation of a spring that flows down the hillside. The project will not impact any Jurisdictional Wetlands. East Fork of Sinnemahoning Creek is classified as an Exceptional Value Stream by Title 25, Chapter 93 Water Quality Standards. The project will not require mitigation.

 For the Enlow Fork Compensation Site Construction, the applicant proposes to construct an aquatic resource compensation bank site by enhancing, restoring and conserving waters and lands that currently comprise 6,433 linear feet of stream and associated floodplains and 2.59 acres of wetlands. The project, if approved, would provide aquatic resource compensatory mitigation credits within the PA State Water Plan Sub-basin 20 upon successfully meeting performance measures and success criteria. The approved credits would be provided in accordance with the terms and conditions of the previously approved permit MB9915-0001. The enhancement and restoration activities vary along the course of the stream depending upon existing conditions, and propose to result in 6,493 linear feet of stream and associated floodplains and approximately 4.55 acres of wetlands. Additional upland plantings are proposed to certain areas adjacent to the floodplain. The project is located within two unnamed tributaries of Enlow Fork (WWF) (USGS Wind Ridge, PA Quadrangle; N: 20.5 inches; W: 10.8 inches; Latitude: 39° 59` 22"; Longitude: -80° 27` 16"), in Washington Township, Washington County.

 For the N.  Sections I—VI contain actions regarding industrial, animal or sewage wastes discharges, discharges to groundwater, and discharges associated with MS4, stormwater associated with construction activities and CAFOs. Section VII contains notices for parties who have submitted NOIs for Coverage under General NPDES Permits. The approval for coverage under these General NPDES Permits is subject to applicable effluent limitations, monitoring, reporting requirements and other conditions in each General Permit. The approval of coverage for land application of sewage sludge or residential septage under applicable general permit is subject to pollutant limitations, pathogen and vector attraction reduction requirements, operational standards, general requirements, management practices and other conditions in the respective permit. The permits and related documents, effluent limitations, permitting requirements and other information are on file and may be inspected and arrangements made for copying at the contact office noted before the action.

 Persons aggrieved by an action may appeal that action to the Environmental Hearing Board (Board) under section 4 of the Environmental Hearing Board Act (35 P. S. § 7514) and 2 Pa.C.S. §§ 501—508 and 701—704 (relating to Administrative Agency Law). The appeal should be sent to the Environmental Hearing Board, Second Floor, Rachel Carson State Office Building, 400 Market Street, PO Box 8457, Harrisburg, PA 17105-8457, (717) 787-3483.
