FEDERAL WATER POLLUTION CONTROL ACT, SECTION 401

 The following permit applications, requests for Environmental Assessment approval and requests for 401 Water Quality Certification have been received by the Department. Section 401 of the Federal Water Pollution Control Act (FWPCA) (33 U.S.C.A. § 1341) requires the Commonwealth to certify that the involved projects will not violate the sections 301—303, 306 and 307 of the FWPCA (33 U.S.C.A. §§ 1311—1313, 1316 and 1317) as well as relevant State requirements. Persons objecting to approval of a request for certification under section 401 of the FWPCA, the issuance of a Dam Permit or Water Obstruction and Encroachment Permit or the approval of an Environmental Assessment shall submit comments, suggestions or objections within 30 days of the date of this notice as well as any questions to the office noted before an application. Comments should contain the name, address and telephone number of the person commenting, identification of the certification request to which the comments or objections are addressed and a concise statement of comments, objections or suggestions including the relevant facts upon which they are based.

 The Department may conduct a fact-finding hearing or an informal conference in response to comments if deemed necessary. Each individual will be notified, in writing, of the time and place of a scheduled hearing or conference concerning the certification request to which the comment, objection or suggestion relates. Maps, drawings and other data pertinent to the certification request are available for inspection between 8 a.m. and 4 p.m. on working days at the office noted before the application.

 Persons with a disability who wish to attend the hearing and require an auxiliary aid, service or other accommodation to participate in the proceedings should contact the specified program. TDD users may contact the Department through the Pennsylvania AT&T Relay Service at (800) 654-5984.

 To demolish 6 row homes, remove the debris and to restore the disturbed area along the floodplain of the Chester Creek (TSF) associated with the floodplain site restoration.

 The site is located near the crossing of Powel Road and Gideon Road (Marcus Hook, PA USGS Quadrangle, Latitude: 39.8534; Longitude: -75.3966).

E09-1004. BCP Property, LLC and Playhouse Inn Property, LLC, New Hope Borough, 55 Bridge Street, Lambertville, NJ 08530-2115, New Hope borough, Bucks County, ACOE Philadelphia District.

 To expand and maintain the existing Bucks County Playhouse & Promenade situated along the floodway/floodplain of the Delaware River (WWF, MF) and measuring approximately 145 feet in length and 7 feet wide associated with the Playhouse Promenade Improvements. The improvements also include open terrace, gravel area, enclosed deck, and public access link etc.

 To remove existing bridge and to install and maintain a 214 foot × 48.3 bridge over Manatawny Creek (CWF, MF) with R-4 and R-7 riprap scour protection in Oley Township, Berks County. (Latitude: 40° 20` 52"; Longitude: -75° 44` 38.2"). The project proposes to permanently and temporarily affect 0.01 acre if PEM/PSS EV wetlands respectively.

E05-385: PennDOT Engineering District 9-0, Engineering District 9-0, 1620 North Juniata Street, Hollidaysburg, PA 16648-1080 in West Saint Clair Township, Bedford County, U.S. Army Corps of Engineers Baltimore District.

 To remove existing structure and to (1) install and maintain a 37 × 32.25 foot bridge over Dunning Creek (WWF, MF) with R-8 riprap scour protection. The project proposes to permanently impact 0.05 acre of PEM wetlands, and 63 linear feet of stream channel and temporarily impact 0.02 acre of PEM wetlands for the purpose of improving transportation safety and roadway standards. The project is located in West Saint Clair Township, Bedford Count (-40° 08` 02.1", -78° 37` 58.1").

E08-495. Valley Energy, Inc., 523 South Keystone Avenue, Sayre, PA 18840. The project site is within the Susquehanna River approximately 2,800 linear feet south of the U.S. Route 6 Bridge and 800 linear feet west of State Route 2032 (Leisure Drive), Towanda & Wysox Townships, Bradford County, ACOE Baltimore District (Towanda, PA Quadrangle Latitude: 41.755810; Longitude: -76.434427.

 The site for this project is located in Towanda and Wysox Townships in Bradford County, Pennsylvania within the Susquehanna River (North Branch). Currently, an existing natural gas pipeline has become exposed at two locations along the river bed where the pipeline crosses the Susquehanna River; 24 feet and 60-65 feet, located within the Valley Energy pipeline right-of-way. The purpose of this proposed work is to protect the exposed natural gas pipeline in the two locations where it has become unearthed along the river bed. The work will consist of the placement and anchoring of cable concrete mats over top of the exposed pipeline in order to protect the pipeline's structural integrity and prevent any future damage to the pipeline.

E14-569. Pennsylvania Department of Transportation, Engineering District 2-0, 70 PennDOT Drive, Clearfield, PA 16830. SR 2018, Section A01 Bridge Replacement over Pine Creek in Haines Township, Centre County, ACOE Baltimore District (Coburn, PA Quadrangle; Latitude: 40° 52` 37"; Longitude -77° 26` 13").

 PA DOT Engineering District 2-0 proposes to replace a Two Span Steel I-Beam Bridge with a Single Span Concrete Bulb T-Beam Bridge on the existing horizontal and vertical alignment. The existing bridge has a total span of 77.62 Ft., a skew of 75 degrees, an underclearance of 14.05 Ft., and a low chord of 1,046.75 Ft. and a hydraulic opening of 900.8 Ft2. The proposed single span bridge has a span of 72.75 Ft., a skew of 70 degrees, an underclearance of 12.71 Ft., and a low chord of 1,045.40 Ft. and a hydraulic opening of 897.2 Ft2. The project will not impact any jurisdictional wetlands. The project will utilize a detour to convey traffic. The project will include a temporary pedestrian bridge. The existing structure is considered a contributing element of the Brush Valley Historical District. The proposed bridge will include architectural treatment to mimic the existing structure. Pine Creek is classified as an Exceptional Value Stream by Title 25, Chapter 93 Water Quality Standards and Class A Wild Trout stream by PA Fish and Boat Commission.

E17-496. Aqua Pennsylvania Wastewater Inc., 665 South Dock Street, Sharon, PA 16146. Aqua Wolf Run Sanitary Sewer Replacement Project. Wolf Run, Columbia County, USACOE Pittsburgh District (Sabula, PA Quadrangle Latitude: 41° 10` 57"; Longitude: 78° 44` 00").

 The applicant is seeking authorization to operate and maintain a 16-inch diameter sanitary sewer crossing Wolf Run (CWF, MF) which was replaced under Emergency Permit No. E1715502. Authorized as Phase 1 by EP1715502, the 16-inch diameter sanitary sewer beneath Wolf Run was encased in concrete. Authorized as Phase 2 by EP1715502, a section of eroded stream bed and channel side slopes were restored to uniform cross-section and stabilized with R-4 rip rap. As fully completed under EP1715502, the project permanently impacted 120-feet of channel with no temporary or permanent wetland impacts incurred. The project is located immediately south of Samana Cay Road and Treasure Lake Road intersection in Sandy Township, Clearfield County. This after-the-fact permit application is being reviewed under Section 105.13(e) ''Small Projects.''

Transcontinental Gas Pipe Line Company, LLC, 2800 Post Oak Blvd, Level 6, Houston, TX 77056, Atlantic Sunrise Pipeline Project, in Lenox Township, Susquehanna County, U.S. Army Corps of Engineers, Baltimore District. The proposed project starts near the intersection of SR 2020 and SR 2043 (Russell Road) (Lenoxville, PA Quadrangle N: 41° 42` 57.96"; W: 75° 42` 25.66") and ends at the Susquehanna/Wyoming County Line (Hop Bottom, PA Quadrangle N: 41° 38` 35.53"; W: 75° 45` 39.41").

 This notice previously appeared at 46 Pa.B. 2211 (April 30, 2016). PADEP is extending the written public comment period for this application for an additional 60 days from Tuesday, May 31, 2016. PADEP will accept written comments through Monday, August 1, 2016.

 The project consists of the installation and maintenance of approximately 6.7 miles of 30-inch diameter pipeline and appurtenant structures. The proposed project impacts in Susquehanna County include a total of 747 linear feet of temporary impacts to Willow Brook (CWF, MF), Tributaries to Willow Brook (CWF, MF), Tributaries to Millard Creek (CWF, MF) and Tributaries to Tower Branch (CWF, MF); 94 linear feet of permanent impacts to Willow Brook (CWF, MF), Tributaries to Willow Brook (CWF, MF), Tributaries to Millard Creek (CWF, MF) and Tributaries to Tower Branch (CWF, MF); 1.34 acre of floodway impacts; 1.47 acre of temporary impacts to PEM, PSS and PFO wetlands; and 0.32 acre of permanent impacts to PEM, PSS and PFO wetlands. To compensate for the proposed permanent project impacts in Susquehanna County, the applicant is proposing 1.39 acre of wetland mitigation through a combination of wetland creation and wetland enhancement. The proposed project impacts in this permit application are associated with a proposed transmission pipeline project extending approximately 195 miles in Pennsylvania between Lennox Township, Susquehanna County, PA and Drumore Township, Lancaster County, PA.

Central Penn Line—South in the remainder of the County is a proposed 42 inch pipeline to extend 22.1 miles in the remainder of Columbia County, PA. The approval of coverage for land application of sewage sludge or residential septage under applicable general permit is subject to pollutant limitations, pathogen and vector attraction reduction requirements, operational standards, general requirements, management practices and other conditions in the respective permit. The permits and related documents, effluent limitations, permitting requirements and other information are on file and may be inspected and arrangements made for copying at the contact office noted before the action.

 Persons aggrieved by an action may appeal that action to the Environmental Hearing Board (Board) under section 4 of the Environmental Hearing Board Act (35 P.S. § 7514) and 2 Pa.C.S. §§ 501—508 and 701—704 (relating to Administrative Agency Law). The appeal should be sent to the Environmental Hearing Board, Second Floor, Rachel Carson State Office Building, 400 Market Street, PO Box 8457, Harrisburg, PA 17105-8457, (717) 787-3483. TDD users may contact the Board through the Pennsylvania AT&T Relay Service, (800) 654-5984. STATE CONSERVATION COMMISSION

NUTRIENT MANAGEMENT PLANS RELATED TO APPLICATIONS FOR NPDES PERMITS FOR CAFOs

 The State Conservation Commission has taken the following actions on previously received applications for nutrient management plans under 3 Pa.C.S. Chapter 5, for agricultural operations that have or anticipate submitting applications for new, amended or renewed NPDES permits or NOIs for coverage under a general permit for CAFOs under 25 Pa. Code Chapter 92a. This notice is provided in accordance with 25 Pa. Code Chapter 92a and 40 CFR Part 122, implementing The Clean Streams Law and the Federal Clean Water Act.

 Persons aggrieved by an action may appeal under 3 Pa.C.S. § 517, section 4 of the Environmental Hearing Board Act and 2 Pa.C.S. §§ 501—508 and 701—704 to the Environmental Hearing Board, Second Floor, Rachel Carson State Office Building, 400 Market Street, P.O. Box 8457, Harrisburg, PA 17105-8457, (717) 787-3483. TDD users should contact the Environmental Hearing Board (Board) through the Pennsylvania AT&T Relay Service at (800) 654-5984. Appeals must be filed with the Board within 30 days of publication of this notice in the Pennsylvania Bulletin. Copies of the appeal form and the Board's rules of practice and procedure may be obtained from the Board. The appeal form and the Board's rules of practice and procedure are also available in Braille or on audiotape from the Secretary of the Board at (717) 787-3483. This paragraph does not, in and of itself, create a right of appeal beyond that permitted by applicable statutes and decision law.

 For individuals who wish to challenge actions, appeals must reach the Board within 30 days. A lawyer is not needed to file an appeal with the Board.

 Important legal rights are at stake, however, so individuals should show this notice to a lawyer at once. Persons who cannot afford a lawyer may qualify for pro bono representation. Call the Secretary of the Board at (717) 787-3483 for more information.
