NUTRIENT MANAGEMENT PLANS RELATED TO APPLICATIONS FOR NPDES PERMITS FOR CAFOs

 The State Conservation Commission has taken the following actions on previously received applications for nutrient management plans under 3 Pa.C.S. Chapter 5, for agricultural operations that have or anticipate submitting applications for new, amended or renewed NPDES permits or NOIs for coverage under a general permit for CAFOs under 25 Pa. Code Chapter 92a. This notice is provided in accordance with 25 Pa. Code Chapter 92a and 40 CFR Part 122, implementing The Clean Streams Law and the Federal Clean Water Act.

 Persons aggrieved by an action may appeal under 3 Pa.C.S. § 517, section 4 of the Environmental Hearing Board Act and 2 Pa.C.S. §§ 501—508 and 701—704 to the Environmental Hearing Board, Second Floor, Rachel Carson State Office Building, 400 Market Street, P. O. Box 8457, Harrisburg, PA 17105-8457, (717) 787-3483. TDD users should contact the Environmental Hearing Board (Board) through the Pennsylvania AT&T Relay Service at (800) 654-5984. Appeals must be filed with the Board within 30 days of publication of this notice in the Pennsylvania Bulletin. Plan Description: The approved plan (C1-21908-ACT) examines alternatives for the provision of appropriate sewer service to the Phase I Planning Area of Dickinson Township. The planning area generally includes the northeastern portion of the Township and is bounded on the north by West Pennsboro Township, to the east by South Middleton Township, to the west by a portion of Alexander Spring Creek, and to the south by several parcels of land just south of Walnut Bottom Road. Sewer service will be provided by the collection and conveyance of sewage through existing lines in South Middleton Township and/or Carlisle Borough, with treatment taking place at the Borough of Carlisle Water Pollution Control Facility. The implementation of this plan will be developer driven. Additional planning approvals will be necessary as the sewerage is extended for each development. In addition, Dickinson Township has committed to submitting an Act 537 Plan Update for the Phase II portion of the township within three (3) years from Phase I approval. The Department's review of the sewage facilities update revision has not identified any significant environmental impacts resulting from this proposal. Any required NPDES Permits or WQM Permits must be obtained in the name of the municipality or authority, as appropriate.

Plan Description: Approval of an amendment to a previously approved revision to the official plan of Robeson Township, Berks County. The project is known as the Green Hill Estates Subdivision. The plan provides for 55 new single family residential lots to be served by a new wastewater treatment plant. The treatment plant will be designed to accept flows of 35,000 gallons per day from the 55 proposed single family residences as well as from an additional 44 existing equivalent dwelling units from the surrounding area. In the original approved revision the proposed wastewater treatment plant discharge was to an unnamed tributary to Allegheny Creek on the site of the new development. The present revision changes the discharge point to the Allegheny Creek downstream of Green Hills Lake. The sewage will be conveyed via the right of way along Green Hills Road and Lake Shore Drive and then via a right of way through the lands of MB Investments. The Department's review of the plan revision has not identified any significant impacts resulting from this proposal. The DEP Code Number for this planning module is A3-06954-247-3A and the APS Id is 867796. Any permits must be obtained in the name of the developer.

 The Havertown PCP Site is a National Priority List Site under CERCLA which is located along Eagle Road in Havertown, PA, approximately one mile north of Route 3 (West Chester Pike). The Site consists of soils and groundwater contamination associated with the former operation of a wood processing facility. Significant groundwater contamination at the Site has migrated under Eagle Road and beneath the former location of the Philadelphia Gum Corporation (''Philadelphia Gum Property'') where it enters a storm sewer draining into Naylors Run, a water of the Commonwealth. In addition to other remedial action, the USEPA, in conjunction with the Department, has implemented a groundwater treatment system for contaminated groundwater at the Site.

 1315 Lawrence Road Holdings LP, and GLCC Associates, LP, is acquiring a portion of the Havertown PCP Site located at 1315 Lawrence Road, Haverford, PA. 1315 Lawrence Road Holdings LP, and GLCC Associates, LP, have asserted and the Department has no information to indicate otherwise, that, other than potential liability associated with its purchase of this property, 1315 Lawrence Road Holdings LP, and GLCC Associates, LP having neither caused, contributed to, nor is otherwise liable for any contamination at the Havertown PCP Site. Under the terms of the Agreement with the Department, 1315 Lawrence Road Holdings, LP, and GLCC Associates, LP have agreed to: (1) to contribute $25,000.00 towards the Department's response costs for the Havertown PCP Site; (2) not to exacerbate any existing contamination at the Site; and (3) to provide access and right of entry to the Department for future performance of any potential response actions related to the Havertown PCP Site in exchange for a covenant not to sue and contribution protection from the Commonwealth.

 This notice is provided under Section 1113 of HSCA, 35 P. S. § 6020.1113. The Agreement may be examined from 8 a.m. to 4 p.m. at the Department's Offices at 2 East Main Street, Norristown, PA 19401 by contacting either Ragesh Patel at (484) 250-5719 or Anderson Lee Hartzell at (484) 250-5866. A public comment period on the Agreement will extend for a period of 60 days from the date of publication of this Notice. Interested persons may submit written comments regarding the PPA to the Department by submitting them to Mr. Patel at the above address.

LAND RECYCLING AND ENVIRONMENTAL REMEDIATION

PREAMBLE 2


The following plans and reports were submitted under the Land Recycling and Environmental Remediation Standards Act (35 P. S. §§ 6026.101—6026.907).

 Provisions of Sections 301—308 of the Land Recycling and Environmental Remediation Standards Act (act) (35 P. S. §§ 6026.301—6026.308) require the Department to publish in the Pennsylvania Bulletin a notice of submission of plans and reports. A final report is submitted to document cleanup of a release of a regulated substance at a site to one of the act's remediation standards. A final report provides a description of the site investigation to characterize the nature and extent of contaminants in environmental media, the basis for selecting the environmental media of concern, documentation supporting the selection of residential or nonresidential exposure factors, a description of the remediation performed and summaries of sampling analytical results which demonstrate that remediation has attained the cleanup standard selected. Submission of plans and reports, other than the final report, will also be published in the Pennsylvania Bulletin. These include the remedial investigation report, risk assessment report and cleanup plan for a site-specific standard remediation. A remedial investigation report includes conclusions from the site investigation; concentration of regulated substances in environmental media; benefits of reuse of the property; and, in some circumstances, a fate and transport analysis. If required, a risk assessment report describes potential adverse effects caused by the presence of regulated substances. If required, a cleanup plan evaluates the abilities of potential remedies to achieve remedy requirements.
