FEDERAL WATER POLLUTION CONTROL ACT SECTION 401

 The Department has taken the following actions on previously received permit applications, requests for Environmental Assessment approval and requests for Water Quality Certification under section 401 of the Federal Water Pollution Control Act (FWPCA) (33 U.S.C.A. § 1341).

 Except as otherwise noted, the Department has granted 401 Water Quality Certification certifying that the construction and operation described will comply with sections 301—303, 306 and 307 of the FWPCA (33 U.S.C.A. §§ 1311—1313, 1316 and 1317) and that the construction will not violate applicable Federal and State water quality standards.

 Persons aggrieved by an action may appeal that action to the Environmental Hearing Board (Board) under section 4 of the Environmental Hearing Board Act and 2 Pa.C.S. §§ 501—508 and 701—704.  3. To place temporary timber matting through 347-LF of PEM/PSS wetlands within the Meadow Run (HQ-CWF, MF) watershed (Pleasant View Summit, PA Quadrangle Latitude: 41°12`39.5" Longitude: -75°43`23.78") in Bear Creek Township, Luzerne County.

 To remove existing structures and to install and maintain the following over and in an unnamed tributary to Little Conestoga Creek (WWF, MF): 1) 100 linear of concrete curb and 5 foot wide concrete sidewalk 2) 22.75 lineal feet of 47 inch high by 71 inch wide corrugated metal pipe, a 10 foot by 10 foot inlet box, 18.25 lineal feet of 44 inches high by 70 inches wide corrugated metal pipe, and 10 lineal feet of 18 inch diameter smooth lined corrugated plastic pipe; linking 2 existing culverts, creating a 192 foot long stream enclosure. Both activities are proposed to increase safety standards.  For the purposes of replacing the existing S.R. 3098 (Glass Run Road) bridge, a structurally deficient structure, over Glass Run with permanent impacts of 145 feet and temporary impacts of 10 feet.  To 1.) the placement and maintenance of fill in 0.16 acre of palustrine emergent wetlands; and 2.) the placement and maintenance of R-4 rip rap in an unnamed tributary to Mann's Run (WWF, MF) impacting 8 linear feet of stream, all for the purpose of maintaining and enhancing wetlands that were previously impacted by the draining of a manmade on-line pond.
