Actions on applications under the Surface Mining Conservation and Reclamation Act (52 P.S. §§ 1396.1—1396.19a); the Noncoal Surface Mining Conservation and Reclamation Act (52 P.S. §§ 3301—3326); The Clean Streams Law; the Coal Refuse Disposal Control Act (52 P.S. §§ 30.51—30.66); and The Bituminous Mine Subsidence and Land Conservation Act (52 P.S. §§ 1406.1—1406.20a). FEDERAL WATER POLLUTION CONTROL ACT SECTION 401

 The Department has taken the following actions on previously received permit applications, requests for Environmental Assessment approval and requests for Water Quality Certification under section 401 of the Federal Water Pollution Control Act (FWPCA) (33 U.S.C.A. § 1341).

 Except as otherwise noted, the Department has granted 401 Water Quality Certification certifying that the construction and operation described will comply with sections 301—303, 306 and 307 of the FWPCA (33 U.S.C.A. §§ 1311—1313, 1316 and 1317) and that the construction will not violate applicable Federal and State water quality standards.

 Persons aggrieved by an action may appeal that action to the Environmental Hearing Board (Board) under section 4 of the Environmental Hearing Board Act and 2 Pa.C.S. §§ 501—508 and 701—704. The appeal should be sent to the Environmental Hearing Board, Second Floor, Rachel Carson State Office Building, 400 Market Street, PO Box 8457, Harrisburg, PA 17105-8457, (717) 787-3483. TDD users may contact the Board through the Pennsylvania AT&T Relay Service, (800) 654-5984. Appeals must be filed with the Board within 30 days of publication of this notice in the Pennsylvania Bulletin unless the appropriate statute provides a different time period. The exposed pipeline will be protected with an 8-foot wide cable-concrete mat which spans across the river. Approximately 0.055 acre of wetland will be impacted.

 The site is located at 1,100 feet north of the Norfolk Southern Railroad bridge over the Schuylkill River (Phoenixville—PA USGS Quadrangle Latitude: 40.164114, Longitude: -75.527961).

 The issuance of this permit also constitutes approval of a Water Quality Certification under Section 401 of the Federal Water Pollution Control Act (33 U.S.C.A. § 1341(a)).

 2) To stabilize and maintain a 33-foot reach of a UNT to North Branch Susquehanna River (CWF, MF) consisting of a 33-foot long, 25-foot wide articulating grout mat along the western bank and within the stream channel.

 3) To stabilize and maintain a 27-foot reach of a UNT to North Branch Susquehanna River (CWF, MF) consisting of a 27-foot long, 10-foot wide articulating grout mat along the eastern bank.

 4) To stabilize and maintain a 53-foot reach of a UNT to North Branch Susquehanna River (CWF, MF) consisting of a 53-foot long, 5-foot high concrete revetment wall along the eastern bank.

 5) To construct and maintain a rock cross vane drop structure within a UNT to North Branch Susquehanna River (CWF, MF) consisting of fifty-three (53) boulders stacked in two rows.

 The proposed project impacts include a total of 0.05 acre of temporary impacts to PEM wetlands and less than 0.01 acre of permanent impacts to PEM wetlands. The project is located approximately 300 feet northeast of the intersection of U.S. Route 11 and Mingle Inn Road in Salem Township, Luzerne County (Berwick Quadrangle Latitude: 41° 6` 36"; Longitude: -76° 8` 9").

 Permanently impact approximately 0.98 acre of wetlands within the watershed of Conewango Creek (WWF) for the construction of a new auto dealership and associated infrastructure at a point approximately 400 feet northwest of the US Route 62 and Hatch Run Road intersection and to mitigate for the wetland impacts by constructing approximately 1.21 acre of replacement wetlands within the watershed of Conewango Creek at a site approximately 0.5 mile northwest of the US Route 62 and Hatch Run Road intersection.

E25-785, Mid-Atlantic Interstate Transmission, 341 White Pond Drive, Akron, OH 44320. Erie East Substation Expansion, in North East Township, Erie County, ACOE Pittsburgh District (North East, PA Quadrangle N: 42°, 09`, 57.82"; W: 79°, 50`, 11.19").

 Expand the existing Erie East Electric Substation located along Arnold Road in North East Township, Erie County (North East PA Quadrangle N: 42°09`57.82"; W: 79°50`11.19") including expansion of the station footprint, installation of stormwater management facilities, relocation of the access road, installation of utility poles in wetlands to accommodate re-routing of electric lines, and installation of a temporary powerline to by-pass the station during construction resulting in permanent impact to 0.191 acre of wetland, temporary impact to 0.257 acre of wetland, and temporary impact to 11 linear feet of UNT Twelvemile Creek.  The applicant proposes to remove an existing bridge and associated structures and (1) to construct and maintain a prefabricated steel beam bridge with timber decking having a single waterway opening of 164.18 square feet and associated structures, (2) place and maintain fill on both left and right floodways of South Fork Straight Creek (HQ-CWF/EV, MF) totaling 2,702 square feet of temporary floodway impacts and 3,045 square feet of permeant floodway impacts, (3) fill in three wetland areas (PSS, PFO & PSS/PFO) totaling 0.003 acre in permanent wetland impacts and 0.024 acre of temporary wetland impacts.

 The project will result in 48 linear feet of permanent stream impacts, a total of 2,702 square feet of temporary floodway impacts and 3,045 square feet of permeant floodway impacts. Total wetland impacts include 0.024 acre of temporary impacts and 0.003 acre of permanent impacts.

 Approval of a Reasonably Available Control Technology (RACT II) plan for KME Corporation located in Nesquehoning Borough, Carbon County.

 In accordance with 25 Pa. Code §§ 129.96—129.100, the Department of Environmental Protection has made a preliminary determination to approve a RACT II plan and an amendment to the State Implementation Plan (SIP) for the mobile equipment manufacturing solvent cleaning operations owned and operated by KME Corporation in Nesquehoning Borough, Carbon County.

 The proposed SIP revision does not adopt any new regulations. It incorporates the provisions and requirements contained in the amended RACT II approval for the facility, which are intended to satisfy the requirements for the 1997 National Ambient Air Quality Standard (NAAQS) and the 2008 NAAQS for ozone.

 The proposed amendments to the RACT II determination have been incorporated into the revised operating permit (13-00008) for the facility. The relevant RACT II requirements will be submitted to the U.S. Environmental Protection Agency (EPA) as a revision to Pennsylvania's State Implementation Plan and will remain in effect until replaced pursuant to 40 CFR 51 and approval by the EPA. Requirements that are not part of the RACT II determination will be excluded from the SIP submittal.

 The following is a summary of the proposed amendments to the RACT II determination for this operation that will be submitted to the EPA as a SIP revision:

National Fuel Gas Supply Corporation—Roystone Compressor Station (1878 Route 6, Sheffield, PA 16347) located in Sheffield Township, Warren County, for approval of a Reasonably Available Control Technology (RACT II) plan.

 The facility has potential emissions of nitrogen oxides (NOx) and volatile organic compounds (VOC) above major source thresholds and is subject to RACT II requirements. Plan approval No 62-141H is for the proposed replacement of the existing in-stack flares in the dehydrator units (Source 049 & Source 050) with a new thermal oxidizer for RACT II compliance.
