Public Hearing and Business Meeting

 The Delaware River Basin Commission (Commission) will hold a public hearing on Wednesday, November 14, 2018. A business meeting will be held the following month on Wednesday, December 12, 2018. The hearing and business meeting are open to the public and will take place at the Washington Crossing Historic Park Visitor Center, 1112 River Road, Washington Crossing, PA.

Public hearing. The public hearing on November 14, 2018, will begin at 1:30 p.m. Hearing items subject to the Commission's review include draft dockets for withdrawals, discharges and other projects that could have a substantial effect on the basin's water resources.

 Written comments on matters scheduled for hearing on November 14, 2018, will be accepted through 5 p.m. on November 19, 2018. Time permitting, an opportunity for open public comment will be provided upon the conclusion of Commission business at the December 12, 2018, business meeting.

 The public is advised to check the Commission's web site periodically prior to the hearing date, as items scheduled for hearing may be postponed if additional time is deemed necessary to complete the Commission's review and items may be added up to 10 days prior to the hearing date. In reviewing docket descriptions, the public is also asked to be aware that project details commonly change in the course of the Commission's review, which is ongoing.

 1. Forest Park Water, D-1965-076 CP-12. An application to renew the approval of an existing discharge of up to 2.0 million gallons per day (mgd) of filter backwash from the Forest Park Water Filtration Plant (WFP). The WFP will continue to discharge treated effluent to Pine Run through Outfalls Nos. 1 and 2 at River Mile 115.63—40.0—0.1 (Delaware River—Neshaminy Creek—Pine Run) and River Mile 115.63—40.0—0.2 (Delaware River—Neshaminy Creek—Pine Run) in Chalfont Borough, Bucks County, PA.

 2. Womelsdorf Sewer Authority, D-1967-084 CP-4. An application to renew the approval of the existing 0.475 mgd Womelsdorf Wastewater Treatment Plant (WWTP) and its discharge. The WWTP will continue to discharge treated effluent to Tulpehocken Creek at River Mile 92.5—76.5—24.1 (Delaware River—Schuylkill River—Tulpehocken Creek) in Heidelberg Township, Berks County, PA.

 3. Bristol Borough Water & Sewer, D-1969-066 CP-4. An application to renew the approval of the applicant's existing 2.7 mgd WWTP and its discharge. The WWTP will continue to discharge treated effluent to Otter Creek, a tidal tributary of Delaware River Water Quality Zone 2, at River Mile 118.9—0.3 (Delaware River—Otter Creek) in Bristol Borough, Bucks County, PA.

 4. Matamoras Municipal Authority, D-1981-078 CP-9. An application to renew the approval of an existing groundwater withdrawal of up to 15.0 million gallons per month (mgm) from Wells Nos. 3, 5, 7, 8 and 8A for use in the docket holder's public water system. Wells Nos. 3 and 5 are completed in the Mahantango Formation and Wells Nos. 7, 8 and 8A are screened in unconsolidated Pleistocene-aged outwash in the Shimers Brook-Delaware River and Shingle Kill-Delaware River watersheds in Matamoras Borough and Westfall Township, Pike County, PA. All wells are located within the drainage area of the section of the main stem Delaware River known as the Middle Delaware, which the Commission has classified as Special Protection Waters.

 5. American Nickeloid Company, D-1985-030-3. An application to renew the approval of the applicant's existing 0.045 mgd industrial wastewater treatment plant (IWTP) and its discharge. The IWTP will continue to discharge treated effluent to the Lehigh River at River Mile 183.7—45.1 (Delaware River—Lehigh River) in Walnutport Borough, Northampton County, PA, within the drainage area of the section of the main stem Delaware River known as the Lower Delaware, which the Commission has classified as Special Protection Waters.

 6. Morrisville Municipal Authority, D-1987-008 CP-4. An application to renew the approval of the existing 7.1 mgd Morrisville WWTP and its discharge. The WWTP will continue to discharge treated effluent directly to Delaware River Water Quality Zone 2 at River Mile 133.0 in Morrisville Borough, Bucks County, PA.

 7. Middle Smithfield Township, D-1990-080 CP-4. An application to renew the approval of the existing 1.0 mgd Fernwood WWTP and its discharge. The WWTP will continue to discharge treated effluent to Bush Kill at River Mile 226.9—2.3 (Delaware River—Bush Kill) in Middle Smithfield Township, Monroe County, PA, within the drainage area of the section of the main stem Delaware River known as the Middle Delaware, which the Commission has classified as Special Protection Waters.

 8. Sinking Spring Borough, D-1994-031 CP-4. An application to renew the approval of the existing 1.25 mgd Sinking Spring Borough WWTP and its discharge. The WWTP will continue to discharge treated effluent to Cacoosing Creek at River Mile 92.5—76.8—4.0—3.4 (Delaware River—Schuylkill River—Tulpehocken Creek—Cacoosing Creek) in Spring Township, Berks County, PA.

 9. Evonik Corporation, D-1996-011-4. An application to renew the approval of the docket holder's existing 1.8 mgd IWTP and its discharge. The IWTP will continue to discharge treated effluent directly to Delaware River Water Quality Zone 4 at River Mile 82.2 in the City of Chester, Delaware County, PA.

 10. Womelsdorf-Robesonia Joint Authority, D-1998-023 CP-3. An application to renew the approval of an existing groundwater withdrawal with a decrease in allocation from 23.0 mgm to 17.0 mgm to supply the applicant's public water supply distribution system from existing Wells Nos. 1, 2, 8 and 9. Project Wells Nos. 1 and 9 are completed in Cambrian-age Leithsville and Richland formations, repectively. Wells Nos. 2 and 8 are completed in Precambrian-age felsic to mafic gneiss. The project is located in the Tulpehocken Watershed in Millcreek Township, Lebanon County, PA, and the Spring Creek Watershed in Heidelberg Township, Berks County, PA.

 11. Upper Makefield Township, D-2002-017 CP-3. An application to renew the approval of the applicant's existing 0.173 mgd Heritage Hills WWTP and its discharge to surface water and to land by means of underground recharge basins. The WWTP surface water discharge is to Delaware River Water Quality Zone 1E at River Mile 141.9, in the drainage area of the section of the main stem Delaware River known as the Lower Delaware, which the Commission has classified as Special Protection Waters. The WWTP and its discharges are located in Upper Makefield Township, Bucks County, PA.

 12. Greater Pottsville Area Sewer Authority, D-2002-041 CP-3. An application to renew the approval of the applicant's existing 8.2 mgd WWTP and its discharge. The WWTP will continue to discharge treated effluent to the Schuylkill River at River Mile 92.47—122.9 (Delaware River—Schuylkill River) in the City of Pottsville, Schuylkill County, PA.

 13. WestRock Converting Company, D-2006-041-3. An application to renew the approval of the applicant's existing 0.06 mgd IWTP and its discharge. The IWTP will continue to discharge treated industrial process wastewater and noncontact cooling water (NCCW) to Brodhead Creek at River Mile 213—1.1 (Delaware River—Brodhead Creek) in Smithfield Township, Monroe County, PA, within the drainage area of the section of the main stem Delaware River known as the Middle Delaware, which the Commission has classified as Special Protection Waters.

 14. Green Walk Trout Hatchery, Inc., D-2008-008-2. An application to renew the approval of an existing groundwater withdrawal of up to 14.285 mgm to supply the applicant's trout hatchery from existing Wells Nos. 1 and 2. The project wells are completed in the Martinsburg Formation. The requested allocation is not an increase from the previous allocation. The wells are located in the Jacoby Creek Watershed in Upper Mount Bethel Township, Northampton County, PA, within the drainage area of the section of the main stem Delaware River known as the Lower Delaware, which the Commission has classified as Special Protection Waters.

 15. Lower Milford Township, D-2009-010 CP-3. An application to renew the approval of the applicant's existing 0.035 mgd Village of Limeport WWTP and its discharge. The WWTP will continue to discharge treated effluent to Saucon Creek at River Mile 183.7—9.4—14.6 (Delaware River—Lehigh River—Saucon Creek) in Lower Milford Township, Lehigh County, PA, within the drainage area of the section of the main stem Delaware River known as the Lower Delaware, which the Commission has classified as Special Protection Waters.

 16. Lehigh Cement Company, LLC, D-2009-016-3. An application to renew the approval of the applicant's existing 0.35 mgd discharge of NCCW. The NCCW will continue to discharge to an unnamed tributary (UNT) of Shoeneck Creek at River Mile 184.0—5.9—4.1—0.2 (Delaware River—Bushkill Creek—Shoeneck Creek—UNT Shoeneck Creek) in Lower Nazareth Township, Northampton County, PA, within the drainage area of the section of the main stem Delaware River known as the Lower Delaware, which the Commission has classified as Special Protection Waters.

 17. Parkland School District, D-2013-007 CP-2. An application to renew the approval of the applicant's existing 0.0324 mgd Parkland High School WWTP and its discharge. The WWTP will continue to discharge treated effluent to Jordan Creek at River Mile 183.7—16.3—9.4 (Delaware River—Lehigh River—Jordan Creek) in South Whitehall Township, Lehigh County, PA, within the drainage area of the section of the main stem Delaware River known as the Lower Delaware, which the Commission has classified as Special Protection Waters.

 18. Pine Forest Camp, Inc., D-2013-010 CP-2. An application to renew the approval of the applicant's existing 0.025 mgd WWTP and its discharge. The WWTP will continue to discharge treated effluent to a UNT of Lake Greeley, which is located on Taylortown Creek, at River Mile 273.3—6.8—2.7—0.3 (Delaware River—Shohola Creek—Taylortown Creek—UNT Lake Greeley) in Lackawaxen Township, Pike County, PA, within the drainage area of the section of the main stem Delaware River known as the Upper Delaware, which the Commission has classified as Special Protection Waters.

 19. Nestlé Waters North America, Inc., D-2013-020-2. An application to renew the approval of a groundwater withdrawal of up to 11.696 mgm from Well No. IW-1 and the discharge of the withdrawn groundwater to Greenwalk Creek. The project will continue to intercept groundwater containing elevated concentrations of total dissolved solids, sulfate and calcium, apparently emanating from upgradient former slate mining areas, in order to manage the docket holder's downgradient existing sources. The project is located in the Greenwalk Creek Watershed in Washington Township, Northampton County, PA, within the drainage area of the section of the main stem Delaware River known as the Lower Delaware, which the Commission has classified as Special Protection Waters.

 20. Allied Utility Services, Inc., D-1996-025 CP-3. An application to approve the re-rate of the docket holder's existing Schnecksville North WWTP from 0.075 mgd to 0.120 mgd. Modifications of the existing facilities are not proposed. The WWTP will continue to discharge treated effluent to a UNT of Coplay Creek at River Mile 183.7—21.1—10.1—0.7 (Delaware River—Lehigh River—Coplay Creek—UNT Coplay Creek), by means of Outfall No. 001 in North Whitehall Township, Lehigh County, PA, within the drainage area of the section of the main stem Delaware River known as the Lower Delaware, which the Commission has classified as Special Protection Waters.

 21. Perkasie Regional Authority, D-1997-012 CP-4. An application to renew the approval of an existing groundwater withdrawal and to increase the allocation from 40.2 million gallons per 30 days to 44.83 mgm from existing Wells Nos. 5—7, 10 and 11. The project wells are completed in the mixed zone of the Brunswick and Lockatong formations. The wells are located in the Commission's Southeastern Pennsylvania Ground Water Protected Area in the East Branch Perkiomen Creek and Three Mile Run watersheds in Perkasie Borough and East Rockhill Township, Bucks County, PA. Wells Nos. 5—7 are in the Three Mile Run Watershed, within the drainage area of the section of the nontidal Delaware River known as the Lower Delaware, which the Commission has classified as Special Protection Waters.

 22. Lehigh Carbon Community College, D-2009-025 CP-3. An application to approve an upgrade of the applicant's existing 0.036 mgd WWTP. The proposed WWTP modifications consist of replacing the aeration tanks and clarifiers, repurposing an aeration tank, and the abandonment of sludge holding tanks. The WWTP will remain designed for 0.036 mgd and continue to discharge treated effluent to a UNT of Jordan Creek at River Mile 183.7—16.3—14—1.3 (Delaware River—Lehigh River—Jordan Creek—UNT Jordan Creek) by means of Outfall No. 001 in North Whitehall Township, Lehigh County, PA, within the drainage area of the section of the main stem Delaware River known as the Lower Delaware, which the Commission has classified as Special Protection Waters.

 23. Pike County Commissioners Office, D-2018-001 CP-1. An application to approve the applicant's existing 0.0484 mgd Pike County Correctional Facility WWTP and its discharges to land and surface water. The WWTP will continue to discharge treated effluent to land by spray irrigation, and to Billings Creek at River Mile 273.3—9.4—3.2—5.7—2.3 (Delaware River—Shohola Creek—Shohola Marsh Reservoir—Shohola Creek—Billings Creek) in Blooming Grove Township, Pike County, PA, within the drainage area of the section of the main stem Delaware River known as the Upper Delaware, which the Commission has classified as Special Protection Waters.

 24. Keystone Anthracite Company, Inc., D-2018-003-1. An application to approve a total withdrawal of up to 11.3643 mgm of surface water from Intake SWW No. 1 (Pond No. 3) and up to 608 mgm from Intake SSW No. 2 when needed to supplement Pond No. 3 for use in the docket holder's anthracite coal preparation plant. The project withdrawals were formerly operated by South Tamaqua Coal Pockets, Inc., under Commission Certificate of Entitlement No. 256, which was terminated upon the transfer of ownership of the facility to the applicant. The project is located in the Little Schuylkill River Watershed in West Penn Township, Schuylkill County, PA.

 25. Village Utility, LLC, D-2018-008-1. An application to approve the applicant's new North Village at Sparta 0.12 mgd WWTP and its discharge to groundwater by means of subsurface disposal beds. The discharge is located in the Paulins Kill Watershed in Sparta Township, Sussex County, NJ, within the drainage area of the section of the nontidal Delaware River known as the Lower Delaware, which the Commission has classified as Special Protection Waters.

Public meeting. The public business meeting on December 12, 2018, will begin at 10:30 a.m. and will include: adoption of the minutes of the Commission's September 13, 2018, business meeting; announcement of upcoming meetings and events; a report on hydrologic conditions; reports by the Executive Director and the Commission's General Counsel; and consideration of any items for which a hearing has been completed or is not required.

 After all scheduled business has been completed and as time allows, the business meeting will also include up to 1 hour of open public comment.

 There will be no opportunity for additional public comment for the record at the December 12, 2018, business meeting on items for which a hearing was completed on November 14, 2018, or a previous date. Commission consideration on December 12, 2018, of items for which the public hearing is closed may result in approval of the item (by docket or resolution) as proposed, approval with changes, denial or deferral. When the Commissioners defer an action, they may announce an additional period for written comment on the item, with or without an additional hearing date, or they may take additional time to consider the input they have already received without requesting further public input. Any deferred items will be considered for action at a public meeting of the Commission on a future date.
