Availability of National Pollutant Discharge Elimination System General Permit for Discharges from Aquatic Animal Production Facilities (PAG-11)

 Under The Clean Streams Law (35 P.S. §§  691.1—691.1001) and sections 1905-A, 1917-A and 1920-A of The Administrative Code of 1929 (71 P.S. §§  510-5, 510-17 and 510-20), the Department of Environmental Protection (Department), by this notice, informs the public of the availability of the National Pollution Discharge Elimination System (NPDES) PAG-11 General Permit for Discharges from Aquatic Animal Production Facilities.

 The PAG-11 General Permit is intended to provide NPDES permit coverage to persons who own or operate Concentrated Aquatic Animal Production as defined in 25 Pa. Code § 92a.2 (relating to definitions) and 40 CFR Part 122, Appendix C (relating to criteria for determining a concentrated aquatic animal production facility (§ 122.24)), and other aquatic animal production facilities that are required to obtain NPDES permit coverage under The Clean Streams Law.

 The PAG-11 General Permit will become effective on March 3, 2018, and will expire on March 2, 2023. All permittees with existing coverage under the PAG-11 General Permit will be automatically covered under the reissued General Permit on March 3, 2018, and will be subject to the terms and conditions of the reissued General Permit. The Notice of Intent fee for coverage under PAG-11 is $100.

 Notice of the availability of a draft PAG-11 General Permit was published at 47 Pa.B. 7649 (December 16, 2017). A 30-day comment period was provided, and interested parties were directed to submit comments to the Department's eComment system. The Department received one comment during the comment period, which can be found in the PAG-11 General Permit Comment and Response Document. No changes were made to the final PAG-11 General Permit (3800-PM-BCW0006d) and associated documents in comparison to the draft PAG-11 General Permit documents published at 47 Pa.B. 6884 (November 4, 2017).

 The General Permit package can be accessed through the Department's eLibrary web site at www.elibrary.dep.state.pa.us (select ''Permit and Authorization Packages,'' then ''Clean Water,'' then ''PAG-11 NPDES General Permit for Discharges from Aquatic Animal Production Facilities Draft'').

 In accordance with 25 Pa. Code § 92a.84(c)(3) (relating to public notice of general permits), the Department will publish notice in the Pennsylvania Bulletin for every approval of coverage under the PAG-11 General Permit.
