Federal Consistency under the Coastal Zone Management Act; Maintenance Dredging at Hog Island Wharf

 This notice is published under section 306(d)(14) of the Federal Coastal Zone Management Act of 1972 (16 U.S.C.A. § 1455(d)(14)), regarding public participation during consistency determinations. The Department of Environmental Protection (Department), Coastal Resources Management Program has received notice that Sunoco Partners Marketing and Terminals (Sunoco) is seeking authorization from the United States Army Corp of Engineers (USACE) for a 10-year maintenance dredging permit at Hog Island Wharf in Tinicum Township, Delaware County.

 Sunoco is seeking USACE authorization to conduct periodic maintenance dredging at Dock # 3 and Dock # 4 at Hog Island Wharf to a maximum depth of 37 feet below mean low water (35 feet plus 2 feet of overdredge). The applicant estimates the removal of approximately 123,000 cubic yards of material per dredging event and up to 370,000 cubic yards of material over the duration of the 10-year maintenance permit. Dredging will be conducted using a closed-clamshell environmental bucket. Recovered materials will be transferred to either White's Basin or Biles Island disposal facilities. The applicant proposes to adhere to dredging restrictions during the spawning and migrating periods of anadromous fish.

 This project is subject to Department review for Federal consistency because it is a Federal license and permit activity and will have reasonably foreseeable effects on the Commonwealth's coastal resources or uses.

 In accordance with National Oceanic and Atmospheric Administration (NOAA) regulations at 15 CFR Part 930, Subpart D (relating to consistency for activities requiring a Federal license or permit), Sunoco has certified that the proposed activity will be conducted in a manner consistent with the applicable enforceable policies of the Commonwealth's NOAA-approved Coastal Resources Management Program. Interested parties may request a copy of the Federal Consistency Certification from the Department contact listed as follows.

 The Department will consider all comments received on or before February 4, 2019, before issuing a final Federal consistency concurrence or objection.
